ADJOURN City of Farmington 325 Oak Street, Farmington, MN 55024 (651) 463-7111 Fax (651) 463-2591 www.ci.farmington.mn.us TO: Mayor, Council Members, City Administrator FROM: Lee Smick, AICP City Planner SUBJECT: Certify Certain Properties as Eligible for Preserve Lands DATE: February 26,2007 INTRODUCTION / DISCUSSION Mr, John Devney has applied to the City of Farmington to enroll and re-enroll his properties into the Agricultural Preserve program for the length of at least 8 years. Before the parcels may be enrolled, Minn, Stat. ch, 473H requires that the City, acting as the "local authority," must certify, by resolution, the eligibility of the relevant parcels for designation as agricultural preserve land, The certification requires that the City review the signed applications, determine eligibility and provide a resolution certifying the property as Agricultural Preserve and providing a map to the county recorder, county assessor, the Metropolitan Council, and the county soil and water conservation district showing the certification of properties eligible for preserve lands. Tax implications for the Devney property necessitate action on this item prior to March 1, 2007, This special meeting is necessary in order to meet this time constraint. Devney Devney Family Limited Partnership Devney Family Limited Partnership ACREAGE 79.68 33.93 153.11 79,82 0.75 75.22 50,12 Mr. Devney also applied for ag preserve status on properties 6, 7, & 8, however, the City Council denied Mr, Devney's request to redesignate these properties from Industrial to Agricultural on February 20, 2007, Therefore, these properties are not eligible for preserve lands, Mr, Devney also applied for ag preserve status on property 11, however this is already planned as low density residential and zoned as R- 1. The final property that Mr, Devney applied for ag preserve status is property 12, which also does not meet the eligibility criteria since the property is currently planned for highway business and industrial and is zoned B-1 and IP respectively, City staff is recommending that properties owned by Mr, Devney numbered 1-5 and 9-10 be certified as preserve lands. CERTIFYING CERTAIN PROPERTIES AS ELIGIBLE FOR PRESERVE LANDS Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Farmington, Minnesota, was held in the Council Chambers of said City on the 26th day of February, 2007 at 7:00 P.M. Stat. 473H,04, the City is required to certify land eligible for designation as agricultural preserves; and WHEREAS, the City may initiate expiration of agricultural preserve eligibility for the parcels pursuant to the procedure set forth under Minn. Stat. S 373H.08 when the comprehensive plan and zoning for the land have been amended so that the land is no longer planned for long term agricultural use and is no longer zoned for long term agricultural use, evidenced by a maximum residential density permitting more than one unit per 40 acres; NOW, THEREFORE, BE IT RESOLVED that the City Council of Farmington hereby certifies the following parcels as eligible for agricultural preserve lands under Minn.
