INTRODUCTION & DISCUSSION
The United States has celebrated Earth Day on April 22 since 1970 and it became a global event in
1990. Promoting Earth Day reminds people to rededicate themselves to another year of continuing
care of the Earth.
In commemoration of Earth Day, the City has several events planned. The 7th Annual Community
Pond & Park Cleanup will be held on May 3rd and the City is partnering again this year with
Farmington Area Community Education to bring the 4th Annual Earth & Arbor Day Celebration to
the community.
Earth & Arbor Day will be held at Rambling River Park from 11 :30am to 1 :OOpm and will give
people an opportunity to learn about how their actions impact the environment. Kids Rock will be
entertaining the Pond and Park Cleanup volunteers and Earth & Arbor Day attendees from 11 :30am
to 12:30pm and there are several new attractions added to the event this year.
Curbside Cleanup Days start on Saturday April 19, and run through May 17. The Curbside Cleanup
Day program gives Farmington residents the opportunity to recycle and dispose of a number of
problem materials. There will also be an opportunity for residents to drop off up to four old tires at
the Central Maintenance Facility on Saturday, May 31 from 8am to noon.

Proclaim April 22, 2008 to be Earth Day in Farmington.

The annual Arbor Day activities are scheduled for Friday, April 25, 2008.
DISCUSSION
The City is a Tree City USA designated community. To continue with this designation, the
Council must proclaim Arbor Day in the City of Farmington. The City's Arbor Day Celebration
is planned for April 25, 2008 at 9:30 am in Hill Dee Park.
The City Council is invited to participate through its collective support of the attached
proclamation.

In 1872, J Sterling Morton proposed to the Nebraska Board of
Agriculture that a special day be set aside for the Oplanting of trees,

the holiday, called Arbor Day, was first observed with the planting
of more than a million trees in Nebraska, and
Arbor Day is now observed throughout the nation and the world, and
trees can reduce the erosion of our precious topsoil by wind and
water, lower our heating and cooling costs, moderate the
temperature, clean the air, produce oxygen and provide habitat for .

Councilmember Fogarty asked if the Councilmembers not in attendance had any
comments regarding the resolution opposing the transit taxing district. City
Administrator Herlofsky explained it is the same resolution approved in 2007. The
purpose of this item is to re-affirm that resolution.
Councilmember Pritzlaff stated it was nice to see vehicles come in under the budgeted
amount, but noted the savings would be used to equip the pickup with tool boxes and
other necessities. He asked ifthese items are not included in the original order. Staff
explained those costs are included. This indicates there is more money to pay for those
items. There is $9,173 left in the budget.
Councilmember Pritzlaff noted the current card access system is six years old and is not
capable of handling an additional 19 doors. He felt six years was not very old. Finance
Director Roland stated six years ago when the police station and maintenance facility
were built, they cut to the bone to keep things under budget. They covered what they
needed to at the time and did not think about the future. Now the City has two additional
buildings to include in the card access system and the technology has changed
tremendously.

Councilmember Pritzlaff also had questions regarding the 195th Street Agreements. He
clarified that these agreements have nothing to do with Newland. Staff confirmed that
these would be required for the project no matter what developer was in that area. Bids
will be awarded by Council on June 2, 2008.
Mayor Soderberg asked some questions on the 2007 Municipal Services Annual Report.
Councilmember Pritzlaffhad some questions on the Orderly Annexation Agreement with
Empire Township. He asked ifthe agreement could include building regulations that
match the City. Councilmember Fogarty noted the township follows State standards
much like the City does. Councilmember Pritzlaff asked ifthey were to build something
across the street from this line that is not up to standards and that portion wants to come
into the City, should the agreement state anything around a certain line should be built to
standards. Councilmember Fogarty stated they did not include this because Empire
envisions incorporating and they will be putting in their own standards which are
comparable.
5. STAFF COMMENTS
City Administrator Herlofsky noted the supplemental items include an ad for bids for
towing and impounding of vehicles, a resolution opposing Farmington being placed in
the Transit Taxing District, and an informational item regarding State Patrol
responsibilities.

5. ANNOUNCEMENTS
a) New City Hall Presentation - Wold Architects
Mr. Chris Zeimer, Wold Architects, stated a tour was held last Friday for Council
and employees. They are currently putting brick on the outside of the building
and should be completed in four weeks. Windows will be installed at that point.
Inside there is framing and sheet rock work being done, and electrical and
mechanical work will be connected. The Council Chambers and conference
rooms are taking shape on the first floor. On the upper level, mechanical and
electrical work is being roughed-in. The project is on schedule.
Regarding the First Street Garage, the roofing was recently finished and work will
begin inside. This will be completed before the City Hall.
Councilmember Pritzlaff wanted to make sure there was enough height on the
flooring under the doors in case of heavy rain. Mr. Zeimer explained the stoop is
sloped away from the building and the sidewalk will be reconstructed to match
City standards. Councilmember Pritzlaff asked about the size and design of the
first floor windows. Mr. Zeimer stated it was a goal in working with City staffto

get as much light into the building as possible. The windows are larger on the
first floor and smaller on the top to match the downtown. Councilmember
Pritzlaff noted there are areas on the first floor where the wall stops in the center
of the window and was concerned with how that would look from the outside.
Mr. Zeimer explained the finishing on the wall and the window will make a
smooth transition.
Mr. Zeimer stated the stairs should be installed in the next one-two months and
then another tour can be scheduled to see the second floor.

a) 2007 Annual Report - Municipal Services
Municipal Services was formed in 2008 when Public Works was re-organized
into two separate departments. Municipal Services covers six divisions. The
Streets Division maintains 80 miles of streets and 92 cul-de-sacs. The Snow
Plowing Division has divided the City into 12 zones. The Sewer Division is
responsible for 83 miles of sewer lines and 6 lift stations. The Water Division
maintains 2 towers and 8 wells. Two mechanics in the Fleet Division provide
maintenance for 89 vehicles, 35 pieces of equipment and 10 trailers. The Solid
Waste Division provides garbage collection for 5,613 residents and 164
commercial accounts. The City contracts with Lakeville Sanitation for recycling.
Almost 1100 tons of recycling was collected in 2007. The first year of the
revenue sharing program brought in $9,958 used to purchase amenities for the
parks. Residents brought in 266 tons of cardboard. Global demand for cardboard
was high and the City received $12,340 in revenue to cover the cost of collecting
it.
b) Accept Feasibility Report/Order Public Hearing! Authorize Plans and
Specifications - Spruce Street/2nd Street Project - Engineering
This project covers Spruce Street from 4th Street to the railroad tracks and 2nd
Street from Spruce Street to Oak Street. The recommendation is to reconstruct
the road, reconstruct the sanitary sewer and the water main as well as storm sewer
improvements. The total estimated project cost is $1.18 million. $171,000 will
be items removed from the City Hall project and done as part ofthis project
because of the timing of the two projects. This includes streetscape, landscaping,
lighting, etc. The trunk improvements will be funded from the trunk utility funds.
The remainder of the project will be funded through a combination of bonding
and special assessments. Due to the location of the project, the City owns
approximately 25% of the benefiting properties. Therefore, the funding
contribution from special assessments outside of the City's own will be smaller
than normal. The public hearing will be held May 19, 2008, and the amount of
the assessment will be identified at that time.
Councilmember Pritzlaff suggested, depending on the assessment amount,
holding back half ofthe money this year and do the project next year. He asked if
they would have to tear up $171,000 worth of streetscape if it was done now with
the City Hall. Staff explained it would be that if not more, due to inflation. The
Spruce Street project goes back to the north side ofthe sidewalk, so it is close to
the building because of the location of the storm sewer and water main. Staff did
not recommend doing some of the streetscape with the City Hall project.
Councilmember Fogarty was concerned that the residents being assessed were
also assessed for Elm Street. Staff explained they have not been assessed yet for
Elm Street. Councilmember Fogarty did not want to do back to back assessments.
The properties being assessed for this project are apartment buildings. This is a

part of doing business and assessments are deductible on their taxes. Staff noted
there are no single family residences benefiting from this project.
MOTION by Fogarty, second by Pritzlaffto adopt RESOLUTION R18-08
accepting the feasibility report, authorizing preparation of plans and
specifications, and scheduling a public hearing for May 19, 2008 for the Spruce
Street/2nd Street Reconstruction Project. APIF, MOTION CARRIED.
c) Transit Taxing District - Administration
This is to re-affirm a resolution approved by the City Council in 2007 opposing
the City of Farmington being placed in the Transit Taxing District.
Councilmember Fogarty attended a meeting in St. Paul to urge the legislators not
to vote to add taxing the residents of Farmington. Councilmember Fogarty feels
Farmington has been caught in the crossfire between other entities. Nothing was
said about why Farmington was to be included in the taxing district. Farmington
will see no benefit from this tax. The Met Council said Farmington may see some
benefit in 10 years, but that will be $3-5 million later. Lakeville is also being
placed in the district. Mayor Soderberg noted this is the type of behavior that
gives politics a bad name. Adding Farmington to the Transit Taxing District after
we have engaged in discussions about this, does a lot to sour that.
Councilmember Pritzlaff was unhappy about the process. He had to attend
another event to represent the City, but felt more Councilmembers should have
met with the legislators. MOTION by Pritzlaff, second by Fogarty to re-affirm

a) Development Fee Structure - Administration/Engineering
In an effort to improve the City's private development process, staffhas been
looking at ways to give the private developers a better understanding of the
engineering costs associated with private development. Staffhas developed a pre-
development surety that will secure the City's interest in engineering costs on
private development prior to a development contract. Sureties proposed are:
Single Family
Multi-Family
Mixed Use
Commercial
$350 per lot
$65 per unit
$300 per unit
$0.25 per building square foot
Developers could provide the City with the surety through a cash escrow, a bond
or a letter of credit. If cash escrow, they could draw it down as bills are occurred,
or keep it aside and pay them on a monthly basis. The developers would also be
provided with an average of engineering costs per lot or per unit as follows:

This will replace the pre-plat surety currently in place. This will not change how
the developers are billed. They are currently billed per month for the hours
actually spent doing their reviews and inspections.
Councilmember Pritzlaff asked if the developer has a construction trailer on site,
if the inspector could check in with the developer and check out. Staff stated
inspectors could attempt to do that, but depending on when the developer is there,
it may not work. Staff has no problem with letting the developer know when they
are coming. If the developer is not there, the inspection would still need to be
done.
MOTION by Fogarty, second by Pritzlaffto approve the creation of a pre-
development contract surety that will be collected from potential developers prior
to engineering review of potential developments. APIF, MOTION CARRIED.
b ) Veteran Re- Integration Seminar - Administration
City Administrator Herlofsky has received requests to hold an event to assist
veterans who return to Farmington from an overseas assignment. MOTION by
Pritzlaff, second by Fogarty to support the Beyond the Yellow Ribbon Campaign.

13. COUNCIL ROUNDTABLE
a) Property Tax Update - Finance
Finance Director Roland explained the new format of the property tax statements.
She urged residents to check the Dakota County website for information.
b) State Patrol - Administration
Council received a copy of an e-mail from Rep. Pat Garofalo regarding the State
Patrol shifting more responsibility to the Cities, even after receiving extra funding
for State Patrol officers.
Councilmember Fogarty: Thanked City Administrator Herlofsky and City Engineer
Schorzman for dealing with the water issues on 190th Street.
Councilmember Pritzlaff: On Thursday he attended the Partners in Progress event.
City Engineer Schorzman: There is a new mentor student in Engineering for the
semester from Farmington High School.

INTRODUCTION
The City's approved 2008 Capital Outlay Budget identified funding for the purchase of a new van in the
Recreation Division.
DISCUSSION
The van is being acquired through the State bid process, which eliminates the requirement for the City to
go through the competitive bidding process. A 2008 Dodge Grand Caravan SE, 7 passenger will be
purchased. The cost of the new van, including tax and license will be $22,491.52. In addition to the cost
of the van there will be additional costs of approximately $250 for the purchase and installation of a trailer
hitch and City logos (2) for the van.
BUDGET IMPACT
The Adopted 2008 Capital Outlay Budget included funding in the amount of $24,313, for a new van for
Recreation. The total cost to purchase the vehicle, trailer hitch and vehicle logos is $22,741.52, which
results in the price of the vehicle being $1,571.48 under the budgeted amount.

Approve Boulevard and Right of Way Maintenance Policy and Mowing Map

INTRODUCTION
The City's Parks Maintenance Division and Public Works staff currently maintains (i.e. mow, trim and remove
weeds) boulevards and right of ways but no clear policy currently exists identifying which boulevards and right
of ways City staff should be maintaining. With the mowing season almost upon us, City staff would like to have
the City Council approve a policy on the maintenance of boulevards and right of ways and a mowing map that
will provide clear direction.
DISCUSSION
City staff met several times in 2007 to discuss the development of a policy that identifies boulevard and right-of-
way areas that should be maintained by staff. As a result of these meetings an attached policy and map were
created that identified the areas to be maintained by City staff.
Perhaps the most beneficial outcome of the meetings was the realization that there was not a clear understanding
of what areas of storm water detention ponds should be mowed that abuts a boulevard or right of way. Under
the policy and map created, the maintenance of these areas are clearly delineated and these areas will be added
to the City's mowing route so that they are routinely mowed at a width of six feet from the back of curb.
In regards to situations where maintained areas are located within Dakota County or Minnesota Department of
Transportation (MN DOT) right of way areas, the proposed attached policy clearly states the areas the City shall
maintain and the areas to be maintained by either Dakota County or MN DOT.
Finally, in situations where there is a City boulevard, the policy identifies the areas to be maintained by City
residents and the boulevard areas that the City staff will maintain.
ACTION REQUESTED
Approve by motion the Boulevard and Right of Way Maintenance Policy and the mowing map.

Boulevard and Right of Way Maintenance Policy
Purpose
The purpose of developing this policy is to clarify who should maintain the areas within City
boulevards, Dakota County right of ways and Minnesota Department of Transportation (MN-DOT)
right of ways.
Definitions
For the purposes of clarifying key words in this policy, the following definitions are being used:
Boulevard - The area between the sidewalk and the curb.
Right of Way - The area from where private property line ends to the curb of a street or the area
from where the private property line ends to the shoulders of a rural section of a road.
Rural Road Section - A street or road that contains no curb.
Concrete Curb - A concrete border forming part of a gutter along the edge of a street.
Maintain - The practice of eliminating weeds by spraying or reducing grass and weeds to an
acceptable height by mowing or trimming.
Policy
In a situation where a City boulevard or right of way exists the following policy shall be followed:
. The property owner whose property abuts a boulevard or right of way whether on the side(s),
back or rear of the property shall be responsible for maintaining the boulevard or right of way
regardless if there is or isn't a trail and/or sidewalk located in the boulevard or right of way.
. If the City owns property (i.e. park, open space, storm water detention pond, well site, or
wetland) abutting a right of way or boulevard, then the City shall be responsible for maintaining
the right of way or boulevard
In a situation where Dakota County right of way exists in the City the following policy shall be
followed:
. If a trail and curb exists, then the City shall maintain the area from the trail to the curb.
. If a sidewalk and curb exists then the resident shall maintain the area from the sidewalk to the
curb.
. If no trail or sidewalk exists but a curb exists, then it shall be Dakota County's responsibility to
maintain.
. If a rural road section exists, then it shall be Dakota County's responsibility to maintain.
. If a City entrance sign exists along a rural road section, then the Parks and Recreation Director
or designee shall determine an area around the signs to be maintained.
In a situation where MN-DOT right of way exists in the City the following policy shall be followed:
. If a City entrance signs exist along a rural road section, then the Parks and Recreation Director
or designee shall determine an area around the signs to be maintained.
. If a rural road section exists, then the Minnesota Department of Transportation shall be
responsible for maintaining the right of way.
. If a trail exists, then the City shall mow 18 inches on each side of the trail and the remaining
portion of the right of way shall be maintained by the Minnesota Department of Transportation.

At the February 4,2008, meeting, Council designated 19Sth Street from Akin Road to TH-3 as a
Municipal State Aid Street. The Minnesota Department of Transportation (MnDOT) has
reviewed the construction plans for the 195th Street Extension Project. MnDOT has indicated
that a condition of approval of the plans is that the Farmington City Council declare a ban for
parking on 19Sth Street because the improvements will not provide adequate width for parking.
Due to the fact that this project ties into 195th Street on the west end, and 190th Street at TH-3,
the roadway being constructed as part of this project will carry two designations. From Akin
Road to Deerbrooke Path, the roadway will be 19Sth Street. From Deerbrooke Path to TH-3 the
roadway will be I 90th Street.
BUDGET IMPACT
None.

WHEREAS, Dakota County and the City of Farmington have planned the extension of 19Sth
Street from its current eastern terminus east of Diamond Path to T.H. 3 in the City of
Farmington, Minnesota; and
WHEREAS, the new roadway will be designated as 19Sth Street west of Deerbrooke Path, and
will be designated as 190th Street east of Deerbrooke Path to T.H. 3; and
WHEREAS, MnDOT, Dakota County and the City of Farmington will be expending State,
County and Municipal State Aid Funds on the improvement of this Street; and
WHEREAS, this improvement does not provide adequate width for parking on the street; and
approval of the proposed construction as a Municipal State Aid Street project must therefore be
conditioned upon certain parking restrictions.
NOW THEREFORE, BE IT RESOLVED THAT: The City of Farmington hereby restricts
and prohibits the parking of motor vehicles on 19Sth Street from Akin Road to Deerbrooke Path,
and on 190th Street from Deerbrooke Path to T.R. 3 at all times, and directs the City staff to erect
appropriate signage notifying the public of the parking restriction, and enforce the parking
restriction.

INTRODUCTION & DISCUSSION
As part of the TH-3 roundabout project, pedestrian and bike trails are being constructed in the
right-of-way of TH-3 as shown on the attached diagram. The ability to construct, operate and
maintain the trails as part of the roundabout project is conditioned on the City obtaining a
Limited Use Permit (LUP) from the Minnesota Department of Transportation (MnDOT). Before
MnDOT will issue an LUP, they require the local governing body to pass a resolution
acknowledging their responsibility for the construction, operation and maintenance of the trail.
The resolution and the permit will cover only the trails on the west side of TH-3. Empire
Township is adopting a similar resolution and will receive a separate LUP for the trails located
on the east side ofTH-3 in the Township.

WHEREAS, the City of Farmington is a political subdivision, organized and existing under the laws of
the State of Minnesota; and,
WHEREAS, the City Council ofthe City of Farmington has approved a plan to construct a pedestrian trail in
the right-of-way of Trunk Highway 3 to promote the orderly and safe crossing of the highway; and,
WHEREAS, the State of Minnesota Department of Transportation requires a Limited Use Permit for the
construction and utilization of said pedestrian trail.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Farmington hereby
consents to enter into a Limited Use Permit with the State of Minnesota, Department of Transportation
for the following purposes:
I. To construct, operate and maintain a pedestrian trail within the right-of-way of Trunk Highway 3
(TH 3=00 I) of the State of Minnesota which lies within the Corporate Limits of the City of
Farmington along 190th Street. The City of Farmington shall construct, operate and maintain said
trail in accordance with the Limited Use Permit granted by the Minnesota Department of
Transportation.
BE IT FURTHER RESOLVED, that the City Council and the Mayor are authorized to execute the
Limited Use Permit and any amendments to the Permit.

INTRODUCTION
The Farmington Police Department was approached by ISD 192 with concerns of security for
building materials at the new high school construction site. We were given a tour of the buildings and
the grounds and asked to assist in protecting the site.
DISCUSSION
After careful review, the Farmington Police Department recommended placing the StopTech
Centurion Scout wireless alarm system at the site. This system will be connected to several sensors
that will notify officers of an intrusion over the 800 MHZ radio system. A copy of the proposal given
to the school as well as an equipment list accompanies this memo.
BUDGET IMPACT
A budget of $4000 was approved to purchase a new StopTech Alarm System for 2008. An additional
$4900 worth of equipment is necessary to secure the site. ISD 192 as agreed to enter into a contract
with the City of Farmington at $400 a month for approximately the next 12 months to rent the alarm
system. The rental fees are designed to cover the costs of the additional sensors. Upon completion of
the contract, the City of Farmington retains ownership of the system and all additional equipment.

ALARM MONITORING AGREEMENT
TillS AGREEMENT, entered into on the date last executed below, is by and between the
CITY OF FARMINGTON, a Minnesota municipal corporation ("City") and INDEPENDENT
SCHOOL DISTRICT NUMBER 192, a Minnesota public school corporation ("ISD"),
(collectively referred to as the "Parties").
WHEREAS, ISD is owns property ("Premises") on which a high school is currently being
constructed; and
WHEREAS, ISD has security concerns with storing construction materials outdoors; and
WHEREAS, the City agrees to assist ISD with providing security for the Premises during
the construction of the high school.
NOW, THEREFORE, in consideration of the mutual promises, and for good and valuable
consideration, the parties hereto mutually agree as follows:

SECURITY EQUIPMENT. The City agrees to provide and have installed a
wireless alarm system on the Premises.
2.
MONITORING SERVICE. The City agrees to monitor signals received from the
security system located on the Premises. Upon receipt of notification that an alarm
condition exists, the City shall make every reasonable effort to respond to the
Premises.
3.
PAYMENTS. ISD agrees to pay the City $400 per month for monitoring and
responding to alarm conditions at the Premises.
4.
NO WARRANTY. The City makes no express or implied warranties as to any
matter whatsoever, including, without limitation, the condition of the equipment,
its merchantability or its fitness for any particular use.
5.
LIABILITY. ISD agrees that the City is not an insurer and that no insurance
coverage is offered herein. Payments by ISD are for alarm system monitoring
that is designed to reduce certain risks of loss, though there are no guarantees that
the monitoring will reduce such risks of that no loss will occur. The City is not
assuming responsibility and therefore shall not be liable to ISD for any loss or
damage suffered by ISD as a result of burglary, hold-up, fire, smoke, equipment
failure, or any other cause whatsoever, regardless of whether such loss or damage
or personal injury was caused by or contributed by the City's negligent
performance or failure to perform any obligations.
6.
INDEMNIFICATION. ISD agrees to defend, indemnify, and hold harmless the
City against any and all claims, liability, loss, damage, or expense arising under
the provisions of this Agreement and caused by or resulting from negligent acts or
lof2
omissions of ISD and/or those of ISD employees or agents. All parties to this
agreement recognize that liability for any claims arising under this Agreement are
subject to the provisions of the Minnesota Municipal Tort Claims Law, Minnesota
Statutes, Chapter 466. In the event of any claims or actions filed against either
party, nothing in this Agreement shall be construed to allow a claimant to obtain
separate judgments or separate liability caps from the individual Parties.
7. OWNERSmp. Upon completion of the construction ofthe high school, the City
shall retain ownership of the security system equipment installed on the Premises.
8. TERM AND MODIFICATON. This Agreement shall be effective twelve (12)
months from the date of execution by both Parties. The parties may modify any
provision of this Agreement by subsequent agreement.
9. ENTIRE AGREEMENT. This Agreement contains the full understanding of
the parties and may not be amended, modified, or canceled except in writing
signed by the parties.
IN WITNESS WHEREOF, the Parties hereto have caused this Agreement to be duly
executed as of the dates shown.

Construction Site Security
Problem:
The Farmington High School construction project has reached a point where on-site
security of construction materials is a concern. There are several geographical situations,
(remote location, lack of occupied neighboring residences and the vast size of the
construction area), that compound the problem. Though there are several remedies for
those problems, none of them are inexpensive.
After careful review of the site and conditions within the building, the Farmington Police
Department makes the follow suggestions to enhance on-site security.
I. The South entrance is not currently used by construction personnel and is
blocked by jersey barriers. Although the barriers block the main driveway, an
additional two or three barrier's is recommended to lengthen the barrier to
natural obstacles.

2. The North entrance is secure and would require no modification.
3. The West side of the construction project abuts the City of Lakeville and the
Spyglass Addition. There is a possibility from the west, but it is unlikely that
any vehicle capable of carrier larger construction would be able to enter or exit
the property from this location.
4. Building interior: The interior of the building is vast and open. Providing a
secure zone for the entire building would be extremely expensive and difficult.
It is our recommendation to decrease the area of coverage and concern. This
area will be confined to the ground floor directly adjacent to storage rooms of
concern and the north side access points.
5. Controlled Gate Access: In order for the system to function at optimal
efficiency, a strict daily construction schedule must be maintained. It is
suggested that gate access be controlled by on-site personnel allowing entrance
to the site only during designated hours of operation.
Interior Solutions:
The Farmington Police Department suggests deploying the StopTech Centurion Scout
wireless alarm system to assist in securing the new high school construction site. The
Scout consists of several components:
. The base unit will be placed in the construction office trailer. This is a small
briefcase-sized unit that will need to be plugged in to AC power (there is a built-
in battery backup in case of a power failure). Within this case are the main unit
and the 800 MHz radio. This radio will be used to transmit the alarms directly to
the Farmington Police Department officers on duty, as well as the DCC.
. The repeater will need to be installed within the high school. This increases the
range of the sensors, enabling greater coverage. This unit will need AC power as
well (battery backup included)
. The sensors will be placed at various locations at the construction site. They are:
o North and South Drives: An outdoor motion sensor will be placed along
each of these drives to signal an approaching vehicle. Initial discussions
placed the sensor near the Flagstaff Avenue gates. However, we feel that
placing the sensors closer to the school would be more beneficial if
someone decided to drive around the gate.
o Interior: After discussion we determined that it would be too difficult to
use door sensors to secure the exterior ofthe building. We contemplated
using outdoor motion sensors, but weather factors such as wind could
potentially create problems with the sensitivity settings we would need.
We recommend placing 8 motion sensors inside the building. These are
stand alone battery operated units. Possible locations are:
· (3) along the south hallway, first floor
· (I) near the loading dock area
· (1) near the locker room area
· (I) near the east access, second floor
· (I) near the building access, first floor
· (1) in the room where the majority ofthe copper will be stored.
This unit is designed to take digital photographs of the subject that
tripped the alarm
. No sensors (except for the north and south drives) will be installed on the
exterior of the building.

this project is:

DISCUSSION
City staff is requesting authorization to go out for bid for the audio/visual equipment for the new
City Hall. The attached bid document includes all necessary new equipment needed, as well as
the requirements for uninstalling of existing equipment and installation of existing and new
equipment.
At the time this memorandum was written, the bid document was still under review by the City
Attorney.
BUDGET IMPACT
The funding for audio/visual equipment is included in the City Hall budget.
ACTION REQUESTED
Approve the audio/visual bid specifications with any revisions made by the City Attorney and
authorize staff to advertise for bids for this project.

SECTION 27 41 00 - Integrated Audio Visual General
PART 1 - GENERAL
1.01 GENERAL
A. Refer to Bidding Information; conditions of the contract and Division I, General Requirements,
which all apply to work under this section.
1.02 DESCRIPTION OF WORK
A. This section applies to all work under the audio video contract. This shall include, but not be
limited to, the following:
1. Remove existing AN cablecast system from existing city hall.
2. Transport existing equipment to new city hall.
3. Install existing and any new equipment in new city hall.
4. Furnish and install flat panel monitors in chambers for presentation.
5. Furnish and install a projector for presentation.
6. Furnish and install any cabinets, racks, mounts etc. as required.
7. Program a complete audio DSP program with intuitive software based user interface.
Creating a virtual mixer interface.
8. Furnish any other materials required to complete all systems listed above that mayor
may not be listed.
9. Perform complete system testing and verify full system operation.
10. Furnish test results and provide to Owner in paper and electronic disc format.
11. Provide Owner two sets of "As-built" drawings on paper and electronic format (.dwg &
PDF formats).
12. Provide Owner with training and training documentation.
B. The work shall include all materials, equipment and labor required for complete and properly
functioning audio video systems.
C. Work persons skilled in the particular craft involved and regularly employed in that particular
craft shall perform all elements of the construction.
D. All work shall be performed in a neat, work person like manner in keeping with the highest
standards of the craft.

due to failure to comply with the applicable codes and standards. Where two or more codes or
standards are in conflict, that which requires the highest order of workmanship will take
precedence, but such questions shall be referred to City for final decision.
1.04 AUDIONlSUAL DRAWINGS
A. Drawings for the audiolvisual systems work are in part diagrammatic and are intended to
convey the scope of work and to indicate in general the location of the equipment.
B. Contractor shall layout their own work and shall be responsible for determining the exact
quantities and locations of the equipment.
C. Contractor shall take own field measurements for verifying locations and dimensions; scaling of
the drawings will not be sufficient for laying out the work.
D. Because of the scale of the drawings, certain basic items for an installation are not shown, but
where such items are required by code or where they are required for proper installation and
operation of the work, such items shall be furnished and installed.
1.05 SITE INSPECTION
A. Contractor shall inspect the site prior to submitting bid for work to become familiar with the
conditions of the site which will affect the work and shall verify points of connection with existing
system wiring.
B. Extra payment will not be allowed for changes in the work required because of the contractor's
failure to make this inspection.
1.06 COORDINATION AND COOPERATION
A. It shall be the contractor's responsibility to schedule and coordinate work with the schedule of
the City and the General Contractor so as to progress the work expeditiously, and avoid
unnecessary delays.
B. Contractor shall fully examine the drawings and specifications for other trades and shall
coordinate the installation of their work with the work of the other contractors. Contractor shall
consult and cooperate with the other contractors for determining space requirements and for
determining that adequate space is allowed with respect to their equipment, other equipment,
and the building. The City reserves the right to determine space priority of the contractors in the
event of interference between piping conduit, ducts, and equipment of the various contractors.
C. Conflicts between the drawings and specifications or between the requirements set forth for the
various divisions shall be called to the attention of the City. If clarification is not asked for prior
to the taking of bids it will be assumed that none is required and that contractor is in agreement
with the drawings and specifications as issued. If clarification is required after the contract is
awarded, such clarification will be made by the City and the decision will be final.
D. Special care shall be taken for all equipment. All equipment and material shall be completely
protected from weather elements, painting, plaster, dust, dirt, debris, theft, etc., until the project
is substantially completed. Damage from rust, paint, scratches, etc., shall be repaired as
required to restore equipment to original condition.

E. Protection of all equipment during the painting of the building shall be the responsibility of the
Painting Contractor, but this shall not relieve the AV Contractor of the responsibility for checking
to assure that adequate protection is being provided.
F. Where the final installation or connection of equipment in the building requires Contractor to
work in areas previously finished by Owner, the Contractor shall be responsible that such areas
are protected and are not marred, soiled or otherwise damaged during the course of such work.
Contractor shall be responsible for patching and refinishing of such areas, which may be
damaged in this respect.
1.07 MATERIALS AND EQUIPMENT
A. All materials and equipment shall be the standard product of a reputable manufacturer regularly
engaged in the manufacture of the specified item unless authorized in writing by the City
Administrative Services Director or City Administrator. Where more than one unit is required of
the same item they shall be furnished by the same manufacture except where specified
otherwise.
B. All equipment shall be installed in strict accordance with the manufactures specifications.
C. The equipment specifications cannot deal individually within ancillary items such as rack kits,
mounts, power strips, rack accessories, wire ties, etc., which may be required to produce the
equipment performance and function as specified, or as required to meet the equipment
guarantees. Such items, when required, shall be furnished by contractor, as part of the
equipment whether or not specifically called for.
1.10 SUBMITTALS
A. Contractor shall furnish, to the City, 3 complete sets of "D" size shop drawings and other
submittal data. Contractor shall review and sign shop drawings before submittal.
B. Contractor shall supply submittals to the City for review prior to commencing work.
C. Shop drawings shall be bound into sets that cover related items for a complete system for as
much as practical and shall be identified with symbols or "plan marks" used on drawings.
Incomplete, piecemeal, or unbound submittals will be rejected.
D. City will review shop drawings solely to assist Contractors in correctly interpreting the plans and
specifications.
D. Contract requirements cannot be changed by shop drawings, which differ, from contract
drawings and specifications.
E. Submittals required by the various sections of the Project Manual may include, but are not
necessarily limited to those identified in the included submittals schedule.
F. After award of contract, the Contractor shall provide a complete submittal schedule including
dates that the submittals will be to the City for review.
G. Contractor shall include cut sheets for any equipment the contractor is substituting for
equipment listed within this document.
H. Contractor shall have all submittals to the City within 10 days of award of contract.

1.11 OPERATION AND MAINTENANCE MANUALS
A. Operation and maintenance manuals shall be submitted to the City in duplicate upon
completion of the job. Manuals shall be bound in a 3 ring hard-backed binder. Front cover and
spine of each binder shall have the following lettering done: "Operation and Preventative
Maintenance Manual for Council Chambers AudioNisual Systems Farmington City Hall", along
with date (month and year).
1.12 TEST AND DEMONSTRATION
A. All systems shall be tested by Contractor and placed in proper working order prior to
demonstrating systems to owner.
1.13 TRAINING AND DEMONSTRATIONS
A. Prior to acceptance of the AudioNisual installation, the Contractor shall provide to Owner, or
their designated representative, all comprehensive training on essential features and functions
of all systems installed, and shall instruct the owner in proper operation and maintenance of
such systems.
1. Provide adequate notice to Owner as to when instruction will be conducted so
appropriate personnel can be present.
2. Prepare instruction format for a minimum of 4 Owner Representatives.
B. Equipment and system training:
1. Training sessions shall use the printed installation, operation, and maintenance
instruction materials included in the O&M manuals and emphasize preventative
maintenance and safe operating procedures.
2. Training shall be performed by qualified factory-trained technicians.
4. Equipment training shall occur as soon as possible after the start up and testing of the
equipment and shall include hands on operation.
5. Contractor shall provide no less than 8 but no more than 16 hours of on site training.
C. Contractor shall submit a certificate, signed by the Owner stating the date, time and persons
instructed and that the instruction has been completed to Owner's satisfaction.
D. System shall be substantially complete by June 2ih, 2008. Training and final acceptance shall
be completed by July ih, 2008.
1.14 PERMITS, FEES, AND ETC.
A. Secure all required permits and pay for all inspections required in connection with the
AudioNisual systems work. Contractor shall post all bonds and obtains license required by the
State, City, County, and Federal agencies.
1.15 SUBSTITUTIONS

A. To obtain approval to use unspecified equipment, bidding contractors shall submit written
requests to the City at least 4 days prior to bid due date. Requests shall clearly describe the
equipment in which approval is being requested. Include all data necessary to demonstrate that
equipments capabilities, features, and performance are equivalent. Also include a cost
comparison between specified equipment and equipment in which approval is being requested.
If equipment is acceptable, City will approve it via addenda. The City will not, under any
circumstances, be required to prove that an item proposed for substitution is or is not of equal
quality to the specified item.
B. Where substitution is approved, Contractors assume all responsibility for physical dimensions,
operation and all other resulted changes. This responsibility extends to cover all extra work
necessitated by other trades as a result of the substitution.
1.16 APPROVED CONTRACTORS
A. AN Contractor shall have been in business for at least 5 years with proven track record of A V
system integrations and television broadcast systems.
B. AN Contractor's company must be a Certified AudioVisual Solutions Provider (CAVSP) as set
forth by InfoComm International standards.
C. AN Contractor shall have employees on staff and assigned to the project who are Certified
Technology Specialists (CTS) as set forth by InfoComm International standards.
D. AN Contractor shall have a manufacturer-trained and master certified Crestron or AMX
programmer on staff.
E. AN Contractor pulling the audiolvisual cabling (if different from the prime audio video
contractor) shall meet the same CTS requirements.
F. Bidding contractors must be authorized resellers of all equipment included within the video and
audio systems of this contract.
G. AN Contractor shall have a minimum of five successful integrations of similar Audio, Visual,
Production systems, and submit referral contact information and project summary of said
projects.
H. Bidder shall provide all necessary documentation with bid submission that Bidder/Contractor
meets minimum qualifications.
1.17 ACCEPTABLE MANUFACTURERS
A. In most cases, equipment specifications are based on a specific manufacturer's type, style,
dimensional data, catalog number, etc. Listed with the base specification, either in the manual
or on the plan schedules, are acceptable manufacturers approved to bid products of equal
quality. These manufacturers are encouraged to submit to the City at least 4 days prior to the
bid due date drawings and catalog numbers of products to be bid as equals.
B. Contractors, who do not submit prior to bidding, run the risk of having the product rejected at
time of shop drawing submittal. Extra costs associated with replacing the rejected product shall
be the responsibility of Contractor and/or the manufacturer.
C. If Contractor chooses to use a manufacturer listed as an equal, it shall be his responsibility to
assure that the manufacturer has complied with the requirements in 'A' above. Contractor shall

assume all responsibility for physical dimensions, operating characteristics, and all other
resulting changes. This responsibility extends to cover all extra work necessitated by other

E. Where a model or catalog number is provided, it may not be inclusive of all product
requirements. Refer to additional requirements provided on the plans in the specifications as
required. Similarly, there may be additional requirements included in the model or catalog
number that are not specifically stated. These requirements shall also be met.
1.18 QUALITY ASSURANCE
A. Contractor shall be a company specializing in AudioNisual systems with a minimum of five
years documented experience in installation of AudioNisual systems or similar to those
specified below.
1.19 WARRANTY AND SERVICES
A. The entire AudioNisual system including all sub-systems shall be guaranteed against defect in
materials and installation for a minimum of one year. Any malfunctions that may occur within
the guarantee period shall be promptly corrected without cost to Owner. This guarantee shall
not limit or void any manufacture's express or implied warranties.
1. Warranty period will begin upon issue of final acceptance certificate.
C. Continuing Maintenance: The contractor shall furnish an hourly rate with the proposal submittal,
which shall be valid for a period of one year from the date of acceptance. The rate will be used
when cabling support is required to affect moves, adds, and changes to the system performed
by an approved Contractor shall be added to the warranty.
D. Final Acceptance & System Certification: Completion of the installation, in-progress and final
inspections, receipt of the test and as-built documentation, and successful performance of the
cabling system for a two week period will constitute acceptance of the system.
1.20 CHANGES IN THE WORK
A. A Contract Change Order is a written order to Contractor signed by Owner and Contractor,
issued after the execution of the Contract, authorizing a change in the Work or an adjustment in
the Contract Sum or Contract Time. Only Contract Change Order may change the Contract
Sum and/or the Contract Time.
B. Owner, without invalidating the Contract, may order changes in the Work within the general
scope of the Contract consisting of additions, deletions or other revisions, with the Contract
Sum and the Contract Time being adjusted accordingly. All such changes in the Work shall be
authorized by Contract Change Order and shall be performed under the applicable conditions of
the Contract Documents.
C. The cost or credit to Owner resulting from a change in the Work shall be determined by mutual
acceptance of a lump sum properly itemized and supported by sufficient substantial data to
permit evaluation. A Change Order in excess of $300.00 shall be submitted with each item
listed individually with a material cost and labor unit extension. Overhead and profit, as mutually
agreed upon between Owner and Contractor shall be added to material and labor cost figures.
F. It shall be the responsibility of Contractor before proceeding with any change to satisfy them
self that the change has been properly authorized on behalf of Owner.

1.21 COMPLETION
A. Systems, at time of completion, shall be complete, efficiently operating, and non-hazardous and
ready for normal use by Owner.
B. When all the work is complete Contractor shall thoroughly clean all material and equipment
installed as a part of this contract and leave all equipment and material in new condition.
C. Contractor shall clean up and remove from the site all debris, excess material and equipment
left during the progress of this contract.
PART TWO - PRODUCT
2.01 PRODUCT REQUIREMENTS
A. Substitutions: Contractor may propose substitutions during the bidding process.
B. Substitution Approval: Owner reserves the right to govern over and determine whether
proposed substitutions are equal to the specifications.
2.02 PRODUCT SPECIFICATIONS
A. Provisions: Product specifications are provided in subsequent sections to Contractor for the
appropriate configuration and/or provision of accessories as well as for a guide to indicate key
features for possible substitutions.
B. Substitutions for Non-specified Products: Where no product specification is provided,
Contractor may use manufacturer's specification for the identified product as a guide for
suggesting appropriate substitutions. Substitutions are subject to prior approval by City.
C. Deviation: Products provided or installed that deviate from the products named herein in
make, model, color, or other significant characteristic (i.e., non-approved substitutions)
shall be removed and replaced with specified products at no additional expense to Owner.
2.03 MISCELLANEOUS MATERIAL
A. Required Equipment: Contractor shall provide additional system components typically
and reasonably required to make system operational even though not specifically
indicated in Drawings, Appendices, or Specifications including, but not limited to, cable,
connectors, connecting accessories, adaptors, power supplies, power strips, rack
mounting adapters and shelves, cover plates and closure panels, relays and switches,
remote antenna mounts, terminal blocks, and related connector and terminations
hardware required by but not supplied with the equipment.
B. Blank Fill Panels: Contractor shall provide blank fill panels to cover any openings in
equipment racks. Fill panels shall match finish of specified rack hardware.
C. Power Distribution Strips: Contractor shall provide power distribution strips as necessary
for distributing power within equipment racks. Strips shall be UL listed and appropriate for
professional installation.

2.04 CABLE
A. Cable shall be provided and installed as detailed herein. Cable installed that does not
conform to these standards or that has not been given prior approval by City shall be
removed by Contractor and replaced at Contractor's sole expense.
B. Installed Video: Video signal coaxial cables shall have #18 solid copper center conductor,
gas-injected high density Polyethylene or Fluorinated Ethylene Propylene insulation,

C. RCA (Video): Video signal RCA Connectors shall be 3-piece crimp-on type with gold
flashed center pin, ADC CRCA series or equal.
D. BNC (RGBHV Graphics): Graphics signal BNC connector shall be crimp-on type with
insertion barrel and ferrule, and gold flashed crimp-on center pin. Barrel shall provide full
circumferential contact with the braid. Fittings shall be sized to fit the cable. BNC

B. Floor Boxes: Floor box plates shall be provided wherever connectivity through a floor

D. Connector Placement: Verify connector layout detail for custom panels in

E. Box Mounts: Wall and floor interface plates shall mount to appropriate electrical conduit
boxes unless indicated otherwise.
F. Cut-ins: Where no box is provided, Contractor shall cut in appropriate opening for plate,

PART THREE-EXECUTION
3.01 EQUIPMENT
1. Safety: Contractor shall use proper structural installation techniques and
maintain a minimum 5:1 safety margin.
2. Custom Mounting Finish: Custom mounting hardware shall be painted by
Contractor to match either color of wall, ceiling or equipment, at City's
discretion.
3.02 INTERCONNECTION
1. Interpretation: Contractor shall make system interconnections as indicated on
Drawings and specified herein. Contractor shall interpret Drawings using an
understanding of the equipment and general system topology (both existing and
future/specified). Contractor shall provide power and control lines to and from
power supplies, remotely controlled equipment and other devices even though
not explicitly indicated on Drawings or listed in equipment tables.
2. Additional: Contractor shall be responsible for associated equipment signals
not specifically documented in provided drawings. These include synchronizing
signals, transmitting and receiving antennas, and LAN connections to
equipment provided and/or installed by Contractor.
3. Exceptions: Contractor shall not be responsible for unrelated low voltage wiring
such as data and voice connections except as they pertain to interface boxes,
interface plates, and integrated control systems.
3.03 CABLE MANAGEMENT
1. Above Ceiling: Cabling located above ceilings shall be tied off to and supported by
ceiling supports or other structures at a minimum of eighteen (18) inches above the
ceiling. Not on Ceiling: Cabling shall not lie on the ceiling.

2. Wall Cabling: Cables installed in a horizontal fashion along wall surfaces shall be
installed in surface raceway approved by Owner.
3. Floor Cabling: Cabling placed at floor level such as microphones shall be installed
on the floor in the shortest possible route to the nearest wall considering traffic
patterns and in an enclosure designed for that use and offering protection from foot
traffic.
4. Desk Cabling: Where a cable is installed using desk furniture, a means of
protecting the cables and holding cabling to a fixed surface shall be installed.
5. Grommets: Holes in horizontal furniture surfaces for cable pass-through shall be
provided with appropriate sized grommet. Grommet shall be black unless
otherwise specified or required.
3.04 CONNECTOR TERMINATION
1. Video Connectors: Video connectors (BNC, RCA, F) shall be terminated using a
crimp tool or dies designed specifically for the connectors being applied.
2. XLR Connectors: Terminate XLR type connectors wired pin 2 high, pin 3 low, and
pin 1 shield.
3. UTP: UTP cable shall be terminated with crimps tools or tools specified by
manufacturer.
3.05 TRAINING
A. Coordination and Personnel: Training shall be coordinated with Owner's schedule, and
Contractor personnel who provide training are subject to Owner's approval.
3.06 PROJECT CLOSEOUT
A. Completion: System shall be considered complete when all of the following has occurred:
1. Testing has been completed to the satisfaction of Owner and City.
2. Punch-listed items have been addressed to the satisfaction of Owner.
3. As-built drawings and system documentation has been turned over to Owner and
City.
a. Included in as-built will be complete system drawings, programming software
used in programming, all files associated with the programming and network
addressing of all viewstations.
4. Complete operational training has been conducted with Owner's staff.
B. Acceptance: Contractor shall secure written Acceptance of systems in the form of authorized
Owner signature on Acceptance Document. This shall constitute the date of Acceptance.

4.01 TESTING & INSPECTION
A. Notification: Prior to start of testing, provide a list to City of test equipment, make, model
numbers, and calibration dates that will be used.
B. Testing: Contractor shall perform complete testing on system before inspection. Selected
systems may be retested during inspection at Owner's discretion.
C. Display/Output checks: Contractor shall verify that visual and audio outputs from the system
are high-quality and without noticeable distortion or feedback at normal operating levels.
D. Wiring and Labeling: Contractor shall check all inputs and outputs for correct wiring and
labeling.
E. Computer Graphics: Computer graphics shall be crisp and focused with respect to color
alignment. If color alignment is not registered properly, Contractor shall identify source of
problem and correct.
F. Time Domain Reflectometer (TDR): Contractor shall use a TDR to test UTP cable for pair
length differences. Contractor shall adjust for skew as necessary for proper signal alignment.

PART 3 - EXECUTION
3.01 EQUIPMENT
A. Install AudioNisual Systems cables and auxiliary materials as indicated in accordance with
manufacturer's written instructions, and recognized practices.
B. Contractor shall use proper structural installation techniques and maintain a minimum 5:1 safety
margin.
C. Custom parts and mounts shall be painted or otherwise finished to match the color of the wall,
ceiling, or equipment at the Architects discretion.
3.02 INTERCONNECTION
A. Interpretation: Contractor shall make system interconnection as indicated on Drawings and
specified herein. Contractor shall interpret Drawings using an understanding of the equipment and
general system topology (both existing and future). Contractor shall provide power and control
lines to and from power supplies, remotely controlled equipment, and other devices even though
not explicitly indicated on Drawings or listed in equipment sections.
B. Additional: Contractor shall be responsible for associated equipment signal not specifically
documented in provided drawings. These include synchronizing signals, transmitting and receiving
antennas, and LAN connection to equipment provided and/or installed by Contractor.
3.03 EQUIPMENT LOCATION
A. Coordination: Where device locations are not shown on rack/console elevations or project
drawings, Contractor shall coordinate with Architect.
B. Equipment not specifically shown, shall be mounted securely to/within equipment racks, walls,
tables Etc.
3.04 TESTING AND INSPECTION
A. General information as required by 27 41 00.
B. General: Contractor shall check the functionality and programming of system prior to final
inspection. Any programming bugs shall be fixed prior to final inspection.
C. Demonstration: Contractor shall demonstrate all system control functions during final inspection
for each phase.
D. Date of Acceptance: Upon final inspection by Owner and Architect, and sign-off of any/all punch
lists by Owner, the date of sign-off shall be considered the Date of Acceptance.
3.05 TRAINING
A. General information as required by 27 41 00.
B. Prior to acceptance of the AudioNisual installation, the Contractor shall provide to Owner, or their
designated representative, all comprehensive training on essential features and functions of all
systems installed, and shall instruct the owner in proper operation and maintenance of such
systems.

1. Provide adequate notice to Owner as to when instruction will be conducted so appropriate
personnel can be present.

C. Equipment and system training:
1. AN Contractor shall provide instruction on major pieces of equipment.
2. Training sessions shall use the printed installation, operation, and maintenance instruction
materials included in the O&M manuals and emphasize preventative maintenance and
safe operating procedures.
3. Training shall be performed by qualified factory trained technicians.
4. Contractor shall attend all sessions performed by the manufacturer's representative and
shall add to each session any special information relating to the details of installation of
the equipment as it might impact the operation and maintenance.
5. Equipment training shall occur as soon as possible after the start up of the equipment and
shall include hands on operation.
6. Contractor shall provide no less than 8 but no more than 16 hours of on site training.
D. Contractor shall submit a certificate, signed by the Owner stating the date, time and persons
instructed and that the instruction has been completed to Owners satisfaction.

A. All Control system programming work shall be performed by an on-staff programmer, certified

1.06 AESTHETIC REQUIREMENTS
A. Logo and Colors: Contractor shall coordinate with Owner for use of logo and colors in touch
panel design.
B. Button Status: Buttons shall indicate the status of corresponding equipment by their color.
Colors shall be chosen that provide good contrast for viewing in all lighting conditions while
retaining a theme that is consistent with the basic colors requested by the Owner.
C. Graphics: Icons and graphic representations of equipment and functions shall be crisp, sharp,
and easy to identify. Icons shall be used wherever possible.
D. Text: shall not use uncommon abbreviations.
E. Hard buttons shall be engraved denoting there intended function.
1.07 IT COORDINATION
A. General: Where connection between components or control features are accomplished over the
Owner's LAN, Contractor shall coordinate with Owner's IT department for IP addresses, firewall
access, and other issues pertaining to successful integration.
B. Permission: It is Contractor's responsibility to obtain necessary information and permissions to
implement their system. Any delays or problems with gathering information or coordinating
access to the LAN or WAN shall be brought to City immediately for resolution.
1.08 OWNERSHIP
A. General: Upon completion of the project, all programming and configuration of control
hardware, touch panels, and other devices shall be property of Owner.
B. Property Rights: Contractor assigns to Owner any and all intellectual property rights and
applications made by Contractor, or its agents or employees in connection with the
performance of this contract. Contractor also acknowledges and agrees that services rendered
in connection with the performance of this contract shall be a "work made for hire" within the
meaning of Section 201 inventions of the Copyright Law of 1976.
C. No Passwords: Contractor shall not use any passwords to prevent access to code files except
as specified herein.
1.09 DELlVERABLES
A. Pre-Installation Submittals: Contractor shall supply the following to City for review prior to
commencing work.
1. Button layouts for each panel/keypad.

.tiff.
2. Printout showing layout of each control page. Pages shall be organized in binder with
product manuals from integrated control system manufacturer.
3. A one to two page laminated quick reference operation guide for each touch panel.
1.10 UPGRADES
A. Firmware upgrades shall be dated the same as Date of Acceptance. Contractor shall upgrade
firmware and software as necessary during project so that latest versions are installed as of
Date of Acceptance.

AGREEMENT
CITY OF FARMINGTON
DAKOTA COUNTY, MINNESOTA
AGREEMENT made this day of , 2008,
between the CITY OF FARMINGTON, a Minnesota municipal corporation ("City"), and
, a ("Contractor").
IN CONSIDERATION OF THE MUTUAL UNDERTAKINGS HEREIN
CONTAINED, THE PARTIES AGREE AS FOLLOWS:
1. CONTRACT DOCUMENTS. The following documents shall be referred to
as the "Contract Documents", all of which shall be taken together as a whole as the
contract between the parties as if they were set verbatim and in full herein:

In the event of conflict among the provisions of the Contract Documents, the order in which
they are listed above shall control in resolving any such conflicts with Contract Document
"A" having the first priority and Contract Document "c" having the last priority.
2. OBLIGATIONS OF THE CONTRACTOR. The Contractor shall provide the
goods, services, and perform the work in accordance with the Contract Documents.
3. OBLIGATIONS OF THE CITY. The City shall pay the Contractor in
accordance with the bid.
4. SOFTWARE LICENSE. If the equipment provided by the Contractor
pursuant to this Contract contains software, including that which the manufacturer may
have embedded into the hardware as an integral part of the equipment, the Contractor
shall pay all software licensing fees. The Contractor shall also pay for all software updating
fees for a period of one year following cutover. The Contractor shall have no obligation to
pay for such fees thereafter. Nothing in the software license or licensing agreement shall
obligate the City to pay any additional fees as a condition for continuing to use the
software.
5. ASSIGNMENT. Neither party may assign, sublet, or transfer any interest or
obligation in this Contract without the prior written consent of the other party, and then only
upon such terms and conditions as both parties may agree to and set forth in writing.
6. TIME OF PERFORMANCE. The Contractor shall complete its obligations
on or before
7. PERFORMANCE AND PAYMENT BOND. Within fifteen (15) calendar
days after the execution of this Agreement and before any work or services are rendered,
the Contractor shall furnish a performance bond insuring the faithful performance of the
contract and payment of all obligations arising thereunder pursuant to section 574.26 of
the Minnesota Statutes, and in accordance with the bid specifications. If the bonds are not
submitted within the time frame, then the contract shall be considered void and the City
may elect to collect the proposal bond or security as liquidated damages.
8. PAYMENT.
a. When the obligations of the Contractor have been fulfilled, inspected, and
accepted, the City will pay the Contractor. Such payment shall be made not later than
thirty (30) days after completion, certification thereof, and invoicing by the Contractor.
b. No final payment shall be made under this Contract until Contractor has
satisfactorily established compliance with the provisions of Minn. Stat. Section 290.92. A
certificate of the commissioner shall satisfy this requirement with respect to the Contractor
or any subcontractor.
9. PROMPT PAYMENT TO SUBCONTRACTORS. Pursuant to Minnesota
Statute 471.25, Subdivision 4a, the Contractor must pay any subcontractor within ten (10)
days of the Contractor's receipt of payment from the City for undisputed services provided
by the subcontractor. The Contractor must pay interest of one and one-half percent (1 %
%) per month or any part of a month to subcontractor on any undisputed amount not paid
on time to the subcontractor. The minimum monthly interest penalty payment for an
unpaid balance of $100.00 or more is $10.00. For an unpaid balance of less than
$100.00, the Contractor shall pay the actual penalty due to the subcontractor. A
subcontractor who prevails in a civil action to collect interest penalties from the Contractor
shall be awarded its costs and disbursements, including attorney's fees, incurred in
bringing the action.
10. WORKER'S COMPENSATION. If Contractor does public work, the
Contractor shall obtain and maintain for the duration of this Contract, statutory Worker's
Compensation Insurance and Employer's Liability Insurance as required under the laws of
the State of Minnesota.
11. COMPREHENSIVE GENERAL LIABILITY. Contractor shall obtain the
following minimum insurance coverage and maintain it at all times throughout the life of the
Contract, with the City included as an additional name insured:

Products and Completed Operations Insurance shall be maintained for a minimum period
of three (3) years after final payment and Contractor shall continue to provide evidence of
such coverage to City on an annual basis during the aforementioned period; or if any
reason Contractor's work ceases before final payment, for a minimum period of three (3)
years from the date Contractor ceases work.

12. DATA PRACTICES/RECORDS.
A. All data created, collected, received, maintained, or disseminated for
any purpose in the course of this Contract is governed by the Minnesota Government Data
Practices Act, Minn. Stat. Ch. 13, any other applicable state statute, or any state rules
adopted to implement the act, as well as federal regulations on data privacy.
B. All books, records, documents, and accounting procedures and
practices of the Contractor and its subcontractors, if any, relative to this Contract are
subject to examination by the City.

13. WARRANTY. The Contractor guarantees that all new equipment warranties
as specified within the bid shall be in full force and transferred to the City upon payment by
the City. The Contractor shall be held responsible for any and all defects in workmanship,
materials, and equipment which may develop in any part of the contracted service, and
upon proper notification by the City shall immediately replace, without cost to the City, any
such faulty part or parts and damage done by reason of the same in accordance with the
bid specifications. The Contractor further warrants to the City that all goods and services
furnished under the Contract will be in conformance with Contract Documents and that the
goods are of merchantable quality and are fit for the use for which they are sold. This
warranty is in addition to any manufacturer's standard warranty y, and any warranty
provided by law.
14. NONDISCRIMINATION. All Contractors and subcontractors employed shall
comply with all applicable provisions of all federal, state and municipal laws which prohibit
discrimination in employment to members of a protected class and all rules and
regulations, promulgated and adopted pursuant thereto. The Contractor will include a
similar provision in all subcontracts entered into for the performance of this contract.
15. INDEMNITY. The Contractor agrees to indemnify and hold the City
harmless from any claim made by third parties as a result of the services performed by it.
In addition, the Contractor shall reimburse the City for any cost of reasonable attorney's
fees it may incur as a result of any such claims.
16. WAIVER. In the particular event that either party shall at any time or times
waive any breach of this Contract by the other, such waiver shall not constitute a waiver of
any other or any succeeding breach of this Contract by either party, whether of the same
or any other covenant, condition, or obligation.
17. GOVERNING LAW. The laws of the State of Minnesota govern the
interpretation of this Contract.
18. SEVERABILITY. If any provision, term, or condition of this Contract is found
to be or become unenforceable or invalid, it shall not effect the remaining provisions,
terms, and conditions of this Contract, unless such invalid or unenforceable provision,
term, or condition renders this Contract impossible to perform. Such remaining terms and
conditions of the Contract shall continue in full force and effect and shall continue to
operate as the parties' entire contract.
19. ENTIRE AGREEMENT. This Contract represents the entire agreement of
the parties and is a final, complete, and all inclusive statement of the terms thereof, and
supersedes and terminates any prior agreement(s), understandings, or written or verbal
representations made between the parties with respect thereto.

INTRODUCTIONIDISCUSSION
St. Michael's Church has submitted applications for a Temporary On-Sale Liquor License for their
Spring Fundraiser, to be held May 7, 2008 and a Gambling Event Permit for their Spring Fundraiser on
May 7, 2008 and their Fall Festival September 20-21,2008.
The events will be held on St. Michael's property located at 22120 Denmark Ave. Per State Statute
and City Code, a Gambling Event Permit and Temporary Liquor license must first be approved by the
City Council.
BUDGET IMPACT
The State of Minnesota waives all fees for Temporary Liquor Licenses for non-profit organizations.
Therefore, the City has not established a fee for a Temporary On-Sale Liquor License.
Gambling permit fees have been received and are included in the revenue estimates of the 2008
budget.
ACTION REQUESTED
Approve the attached application for a Temporary On-Sale Liquor License for St. Michael's Church
for their Spring Fundraiser on May 7, 2008.
Approve the attached resolution granting a Gambling Event Permit to St. Michael's Church for their

hearing, and the clerk shall state in the notice the total cost of the improvement. The clerk
shall also cause mailed notice to be given to the owner of each parcel described in the

New City Hall Change Orders

INTRODUCTION I DISCUSSION
Listed below are the recent change orders for the new City Hall project:
Change Order 7 Eliminating the transom lights above the conference rooms to match the
office frames. This will be a credit in the amount of $564.
Change Order 8 Change in fabric for the acoustic wall panels in the Council Chambers.
This will be a credit in the amount of$325.
Change Order 9 Relocating the vehicle outlets from the east side of the parking lot to the
west side to provide visitor parking near the west entry. This will be a charge in the amount
of$4,915.
Change Order 10 Installation of additional conduit associated with microphone wiring in the
Council Chambers. This will be a charge in the amount of$3,873.
Change Order II Revisions to the power, data, and microphone boxes and wire management
system. This will be a charge of $2,620.
BUDGET IMPACT
Credits amount to $889. Charges amount to $11,408. These amounts are covered in the City
Hall construction budget.
ACTION REQUESTED
Approve Change Orders 7 - II for the new City Hall project.
