MOTION CARRIED. 3. Public Hearings—Chair Rotty opened the public hearings a. Conditional Use Permit Application to Allow an Auto Sales Use within the B-1 Zoning District-Continued This is a continuation from the June 13, 2017,meeting. The location is 923 $t Street. The applicant,Ms. Tara Fonseca, was present to answer questions. The unresolved questions dealt with where staging and parking of vehicles would occur on site as well as the location of vehicle inventory. There are three conditions for approval: 1. The applicant obtains all necessary building permits from the city's building official. 2. A sign permit is obtained for any external signage that may be placed on the premises. 3. Other conditions as may be recommended by the Planning Commission. Chair Rotty asked if there will be staging of vehicles and where that will be. Ms. Fonseca stated the mall owner will allow five slots for parking of vehicles in the area behind the gas station. They probably will not be parking vehicles there as they want to do more internet sales. They just need the permit to obtain their license in order to start the business. There would be no parking of vehicles in front of the mall or the gas station. The five slots behind the gas station would be roped off. Chair Rotty noted there is traffic flow through that area for vehicles coming behind the gas station, so the vehicles would have to be out of the way for that traffic flow. Ms. Fonseca stated right now that area is full with other vehicles. Chair Rotty clarified the owner of the property has guaranteed you a safe location that won't inhibit traffic flow or anything else. Ms. Fonseca stated yes; they were told they could have five spaces that would not inhibit traffic flow. They will not be doing any mechanical work. Member Franceschelli stated it sounds like you have the vehicles for people to do a test drive,finalize the sale and take it off the lot. Ms. Fonseca stated that is exactly what they want to work towards. It will not be a big thing where people are coming in to look at cars all day long. Member Franceschelli asked why she selected this site. Ms. Fonseca stated every other place in the entire south metro is over$1200 a month which she cannot afford. This space is significantly less and allows her to start a new business. Planning Commission Minutes July 12,2017 Page 2 Member Rich stated at the last meeting they were wondering about staging the car for washing and cleaning it and where that would occur. Ms. Fonseca stated that would probably be in her driveway. MOTION by Bjorge, second by Rich to close the public hearing. APIF,MOTION CARRIED. MOTION by Franceschelli, second by Rich to approve the conditional use permit allowing an auto sales use at 923 86 Street with three contingencies. APIF, MOTION CARRIED. b. Fairhill Estate at North Creek Preliminary Plat and PUD Amendment The applicant and developer have asked that this be continued to the August 8,2017, meeting. MOTION by Rich, second by Franceschelli to continue the public hearing to August 8, 2017. APIF,MOTION CARRIED. 4. Discussion a) Discussion on Revising the Home Occupation Ordinance This item was previously discussed in May 2017, and is a substantial change to the current home occupation ordinance. The first change is to have two categories for home, occupations;permitted home occupations and special home occupations. Permitted would be those uses allowed by the city without additional planning commission approval. All parking would be contained within the existing driveway. They generate little, if any traffic. Examples are art studios, consulting services and tailoring. The special home occupations would include barber and beauty services,massage therapy, photography studio, etc. The difference between the two is the special would allow for one additional employee who does not reside on the premises. They would also require an interim use permit approved by the planning commission. Currently home occupations are approved through a conditional use permit process and stay with the property. An interim use permit would allow for the use to not transfer with the property. It would be issued for an initial one-year period, after that the peirnit can be re-issued for up to three years. The initial permit would require a public hearing at the planning commission. Subsequent renewals would not require a public hearing; however,property owners within 350 feet would be notified of the renewal. The second change to the ordinance is the addition of a general provisions and performance standards section. The current code is not specific and puts staff in the position of interpreting the code. The revision would be more specific and provide some teeth to the ordinance. It would regulate noise,light and hours of operation. The revised ordinance lists uses that would be prohibited in a residential neighborhood. Examples are service repair or painting of vehicles, dispatch centers,medical or dental clinic,rental businesses, contracting, excavating, welding or machine shops, commercial kennels and veterinary clinics,tow truck services, sale or use of hazardous materials in excess of consumer quantities which are packaged for consumption by individual households for personal care or household use, any another use of residential property deemed to be detrimental or inconsistent with the residential character of the neighborhood. Member Bjorge suggested clarifying the internet sales portion. Staff stated technically they are running a business from their home. If it is mainly computer work and phone Planning Commission Minutes July 12,2017 Page 3 calls,they have not been required to obtain a permit. Staff will make the internet sales portion more clear. Some are not only making calls all day,but are also holding events. In the revised ordinance, it would not need a permit. Member Bjorge stated some have social events or parties and that should be stated. Staff noted as an example,Tupperware parties are limited to four per year. Member Bjorge asked if the general provisions apply to permitted and special permits. Staff stated they do. Member Bjorge stated some things under general provisions and performance standards don't align with what are permitted uses. Such as not being able to have internal or external alterations or involve construction features not customarily found in residential dwellings and then allowing a salon. Staff stated salons are not changing walls,just adding plumbing. That is the purpose of a home occupation is for the home to be the primary use and the business is secondary. Member Bjorge asked for the reason for allowing one employee. Staff stated most cities allow no additional employees or one. More are leaning towards none. Member Bjorge liked the revisions to the home occupation ordinance. Member Rich stated what may be disappointing is the number of additional employees. He understood the point of complying with performance standards, although he could see two or three employees. He liked the clarity for permitted and special occupations. This is a substantial expansion that may not satisfy everyone. He asked for examples of interim use permits. Staff stated off premise directional signage is an interim use for signage for new housing or commercial development. Member Rich liked the fact it did not go with the property. Under the general provisions, he pointed out the home occupation is incidental and doesn't change the character of the house. This is extremely important and applicants need to be aware of this. He also agreed with not using more than 45% of the gross floor area of a dwelling unit. He asked about no retail sales and delivery of products and that this could interfere with occupations such as Tupperware sales. Staff stated retail sales means we don't want it open to the general public. If we - have a one-chair barber shop,they could sell their products to their customers because the products are incidental to their main use. Member Rich asked to clarify that it can't be an actual retail service. He felt the revisions cover the items discussed. Member Franceschelli stated as far as deliveries,we are thinking of a FedEx truck coming in. We don't want a semi coming to unload a year's worth of supplies at one time. He liked the structure of the ordinance and it allows the neighborhoods to remain neighborhoods and not centers for commerce in large scale. The suggestions are worth pursuing. Member Rich suggested one way of resolving the additional employees could be that is part of the special home occupation permit. We could have a normal cap and the ability to consider more. That may need to be part of a public hearing. Member Franceschelli asked where would you set the cap. Member Rich stated it could be based on the circumstances. A home with a long driveway, a lot of parking area would be a special circumstance. It would be reviewed by the planning commission. Member Bjorge recalled another comment was that you could have five employees,but only one is in the house at a given point in time. Staff was concerned with how do you ensure that. Member Bjorge asked how would we track the number of employees. Member Franceschelli stated you have a licensed person doing haircuts and we don't require them to register with the city,but those licenses are in the public domain. Member Rich stated Planning Commission Minutes July 12,2017 Page 4 you could say non-consecutive,but how do you regulate it. Member Franceschelli stated there are a lot of what-if's that we can't decide. Chair Rotty liked the interim use permit and that the use would not run with the property. Existing home CUP's would continue. Home occupation shouldn't become a nuisance in the neighborhood. It should be transparent to the neighbors. If they want to expand, that is why we have a commercial district. This is a step in the right direction. The commission would like to continue with the process to revise the code. Member Franceschelli asked at what point does a home business become something that the EDA would look at to assist into branching out to a commercial business. Member Rich suggested when they exceed the performance standards. Member Franceschelli stated that may be something to alert the EDA to at the time; that a resident needs assistance identifying where to move or the next logical step. Chair Rotty directed staff to incorporate the commission's comments into the ordinance and discuss it again next month. Regarding the current CUP's the property owner could amend the CUP. If they want to obtain an interim use permit and expand on it, that could have a sunset provision. A resident in attendance stated she could not start a day spa with one employee. Her initial goal would be to have one hair, one nail, one massage, one skin care; so it would be four to five people to have the business she wants. That is her only concern. Staff will bring this back as a public hearing on August 8,2017. b. 1St Street Complaint There is an issue with a resident dealing with a business on First Street. The business owner was unable to attend this meeting, so the discussion will be held at the August 8, 2017, meeting. Member Rich stated at the last meeting a public hearing was held and the commission made a recommendation and in the process,the City Council chose a different recommendation. The minutes for the planning commission meeting were approved tonight. He asked without the minutes, does the City Council have access to the comments. We do a thorough recording of the comments and the citizens who speak to the commission. He asked if the City Council is at a disadvantage in not having the minutes before they take action on something. Staff stated a couple of the residents were also at the City Council meeting and expressed the same concerns they had at the planning commission meeting. Staff does not provide the City Council with draft minutes,because they are not official until the planning commission approves them. Staff did outline to the City Council the concerns expressed at the commission meeting. Member Rich stated his concern is that the planning commission has the obligation of holding the public hearing and getting the feedback. If he were a Councilrnember,he would want to be privy to the body of information the planning commission considered. He wondered about the process with only a one week turnaround when there isn't an opportunity to present the good material compiled. Councilmembers have to take a position with some of the residents coming back. The City Council doesn't hold a public hearing. He was interested in having a procedure where the items the commission has to take a position on and forward with a recommendation of yes or no to the City Council that it would seem to be more appropriate that they get the official record. Planning Commission Minutes July 12,2017 Page 5 That introduces a delay, but everything goes to a certain timeline and people have to meet those timelines. Staff stated that would be a substantial delay in the process and with the way state statute is for the approval of applications,that could create some issues. Member Rich stated with the fine job staff does with presenting the character of the discussion,he doesn't know how much flavor of that comes through in the City Council's consideration. He is not questioning the City Council can see something differently than the commission,he would want them to have sufficient information. Member Franceschelli stated they can view the video the next day, so they can get the flavor of the meetings. That public record is just as valid as our official record. They are getting it; it is up to them to devote the time to it. Chair Rotty stated the City Council and the commission hold a workshop periodically. This sounds like a good discussion for that workshop. Our goal is, are they getting the information they need to make the best decision possible. S. The subject property is generally located at the southwest intersection of 190th Street and Highway 3. The original Planned Unit Development encompasses almost 1,000 acres and was master planned by Newland Communities. The Planned Unit Development was approved just prior to the real estate recession. It has been almost 10 years since the original Planned Unit Development was approved and being that housing markets have shifted this development attempts to deal with new environmental challenges and evolving consumer preferences. It should also be noted that the Alternative Urban Areawide Review(AUAR)for the entire 1,000 acres of Fairhill was recently updated in early 2017. Planning Division Review Applicant: True Gravity Ventures 12800 Whitewater Drive Suite 100 Minnetonka, MN 55343 Attachments: • Preliminary Plat(dated August 4, 2017) • Overall Site Plan(dated August 4, 2017) • PUD Amendment and Preliminary Plat Supplemental& Supporting Details booklet(dated July 11, 2017) • Pre plat and construction booklet(dated May 22, 2017) • Trail and sidewalk plan from Park and Recreation Director Distad Location of Property: Southwest intersection of 190th Street W and Highway 3. Area Bounded By: 190th/195th St W to the north, Highway 3 to the east, residential development within Empire Township to the south, and railroad and floodplain to the west. Existing Zoning: The property is largely zoned Low Medium Density with the north east portion of the property being zoned Medium Density Residential. The property is part of an existing Planned Unit Development that was approved in 2008. DISCUSSION Preliminary Plat and PUD Amendment True Gravity Ventures is requesting approval of a Preliminary Plat and Planned Unit Development Agreement for the Fairhill Estate at North Creek development. The applicant is proposing a preliminary plat consisting of 217 single-family residential lots spread over 86.6 net developable acres for a net density of 2.51 units per acre. In addition the preliminary plat contains 39 outlots. The outlots largely contain park and open space or storm water facilities in addition to ag-purposed open space. The developer has stated that many of the core principals and objectives of this development revolve around the concept of a rural aesthetic. A concept that can be tied to Farmington's heritage and small town character. This rural aesthetic is specifically prevalent in many of the engineering designs for this development(i.e., street sections and stormwater systems). Additionally, the developer is proposing an agriculturally-purposed open space in the west central portion of the development(Outlot L of the preliminary plat)where a third party can utilize the area for agricultural purposes,whether vegetable farm or some other farming component. To compliment the agriculturally-purposed open space the developer is proposing a water reuse component where storm water is collected in a storm water facility(pond located in Outlot P of the preliminary plat)and the water that is collected is re-applied to the ag-purposed open space within the development. Lot Sizes and Setbacks The lot sizes generally range from 40 feet(typ)in width from the southwestern most module up to more standard 62 foot(typ)wide lots along the main north/south roadway(Road A). It should be noted that the lot widths identified above are the typical widths, there are lots identified within the preliminary plat that are less than 40 feet in width, specifically within the modules on the west side of the development. The average lot area within the preliminary plat varies from 4,720 square feet to 9,300 square feet. Some of these lot widths and areas are a deviation from the city's standard for minimum lot width and area requirements but will have to be addressed within the Planned Unit Development Agreement. The developer is proposing to allow setbacks that would be less than what the city's typical zoning requires. A typical side yard setback in a single-family residential neighborhood is 6 feet. The developer would like to reduce this setback to 5 feet within portions of the development, specifically, within focus area labeled la, 3 and 4 on the map on page 12 of the supplemental and supporting details booklet that is attached. All other areas would meet the 6 foot setback. The reduced setback will need to be addressed within the Planned Unit Development Agreement. Transportation The main access to the development will come from 190th Street W(Road A). Right-of-way has been provided at the southern boundary of the preliminary plat for a future access to this development from the south when that property(which is in Empire Township)develops. Additionally,right-of-way has been provided for a possible connection to 194th Street. 194th Street is also located within Empire Township and some concerns have been expressed with this possible connection. The developer and city staff held a neighborhood meeting and met with the Empire Planning Commission on August 1, 2017. It was generally agreed upon at the Empire Plannng Commission meeting that platting the right-of-way makes sense however, the township and city staff will be meeting in the near term to discuss all options for the potential of interconnecting our respective systems whether utilities or roadways. The Dakota County Plat Commission reviewed the preliminary plat at their July 24th regular meeting. The Commission's recommendations are attached. Parks, Trails and Sidewalks As shown on page 24 of the supplemental and supporting details booklet, the development contemplates a community park in the central portions of the plat. Additionally, sidewalks and trails can be found throughout the development. Trails consist of a mixture of bituminous trails and mowed trails. All trails within the public community park to be deeded over to the city must be constructed of bituminous. Utilities A water service currently exists near the northwest corner of the plat and will be extended into this development. Sanitary sewer is located on the west side of the railroad, south of 195th Street. The saintary sewer line will have to be extended under the railroad in order to service this development. The developer will have to obtain an easement from the railroad in order to cross the railroad property with the sewer line. A portion of the development's storm water system uses a series of riser pipes and storm inlets to collect storm water. The inlets are in the swales within the right-of-way and at other various collection points. Storm water runs-off of the rooftops, gutters, and driveways. It is collected into individual grassy swales, yard inlets, and conveyed through a network of small diameter pipes. The storm water that runs-off the street is collected in the same inlets via ribbon curb and grassy swales. The inlets are connected to riser pipes which connect to the pipe network. Higher flows, during 25 and 100 year storm events, are further conveyed over driveways and swales that parallel the street. Various key inlets are spaced within the project to collect these higher flows. Staff will be working with the developer on addressing potential long term maintenance concerns with the storm water system as proposed through the development contract and Planned Unit Development Agreement,both of which will be approved with the final plat. ACTION REQUESTED Recommend approval of the Preliminary Plat and PUD Amendment for Fairhill Estate at North Creek, subject to the following conditions: 1. The approval of a Planned Unit Development Agreement and ordinance at time of final plat. 2. The submission of constructions plans for grading and utilities that are acceptable to the City Engineer. The subject property is generally located at the northwest intersection of CSAH 50 and F lagstaff Avenue. Planning Division Review Applicant: Tim Giles Giles Properties, Inc. 5745 Meadow Lane Elko, MN 55020 Property Owner: Richard Sayers 21020 Cambodia Avenue Farmington, MN 55024 Attachments: • Preliminary Plat • Final Plat • Planned Unit Development Agreement • Letter from Randy Distad, Parks and Recreation Director Location of Property: Generally located at the northwest intersection of CSAH 50 and Flagstaff Avenue. Area Bounded By: The property is primarily surrounded by agricultural uses. There are a cluster of single- family residences on larger lots located to the northeast of the subject property. Existing Zoning: The property was rezoned by the City Council on June 19, 2017 to R-2 PUD. Surrounding Zoning: Agriculture to the north, west and south and IP (Industrial Park)to the east. Topography: The property is relatively flat, but does slope slightly from the Northeast corner of the property to the southwest corner. DISCUSSION Preliminary Plat The applicant proposes to plat 61 single-family lots on 24.08 acres within the preliminary plat. Additionally, there are three outlots that make up the remainder of the plat. The outlots are as follows: Outlot A-stormwater facility(3.08 acres) Outlot B -parkland (1.34 acres) Outlot C -trail(0.18 acres) Lot Width and Area Requirements The zoning code requires lots in an R-2 district to have at least 60 feet of street frontage as measured from the front yard setback line. Additionally the R-2 code requires that lots have a minimum area of 6,000 square feet. All lots proposed within the preliminary plat meet and or exceed these requirements. Transportation There are two accesses proposed for this development. Street A connects into Flagstaff Avenue towards the northern boundary of the site and loops through the development. Streets C and D provide the secondary access to Flagstaff Avenue at the southern boundary of the site. Street B is a stub street that will eventually be extended northerly when development takes place to the north. A turn lane will be provided for the southbound lane of Flagstaff avenue at Street A. Parks, Trails and Sidewalks Attached are referral comments by Randy Distad, Parks and Recreation Director as well as a marked up Park, Trail and Sidewalk Plan. Eight(8')foot wide bituminous trails are shown located along the outer boundaries of the lots. Five(5')foot wide sidewalks are shown on the inner loop of Street A with five(5') foot wide sidewalks along one side of Street C and Street B. Parkland to be dedicated to the city with this plat is located in the northwest corner of the proposed subdivision. The Parks and Recreation staff and Commission have reviewed the development plans as they relate to parks, trails and sidewalks and find them acceptable. Utilities Both sanitary sewer and water are located in Flagstaff Avenue and will be extended west into the subdivision in the right-of-way of Street A. A sanitary sewer line will be installed the length of Street D that will eventually serve the property to the south upon development. Water service is currently in Flagstaff Avenue. The water for this development will be extended from Flagstaff Avenue into both site accesses (Streets A and D)and will be looped through the development. Stormwater will be handled on site as a pond will be installed in the southwest portion of the development. Final Plat The subdivision is planned to be phased. The first phase, consists of 32 single-family residential lots and four outlots. The outlots are as follows: Outlot A-stormwater facility Outlot B -parkland Outlot C -trail Outlot D-future phase(s)for residential lots The applicant wishes to install all utilities (sanitary sewer, water and storm sewer)for the development with the first phase due to the need for dewatering in order to install those utilities. Therefore, an easement is shown on the final plat where the road right-of-way would be located with a future development phase. That easement will need to be vacated as part of the final plat application for that future phase. The Engineering Department has reviewed the Regetta Fields preliminary and final plats and recommends approval of those applications contingent upon the satisfaction of all engineering comments related to the construction plans for grading and utilities. Planned Unit Development The applicant is requesting to enter into a Planned Unit Development Agreement with the final plat. The agreement is attached and is necessary to provide flexibility in regards to density for this development. The net density for the entire development based on the attached preliminary plat is 3.13 unit per acre. The R-2 zone requires a minimum net density of 3.5 units per acre. Concerns Expressed at Previous Planning Commission Meeting During the June 13, 2017 public hearing for the Comprehensive Plan Amendment and Rezoning applications for this property there were some concerns expressed about the possible development of this site. Those concerns are outlined below: 1. There were comments from the public that groundwater flow paths have changed since the Flagstaff Avenue project. Flow paths generally follow an east west direction across the Regetta site and are not likely to influence areas north and east of this site which lie at or above elevations within the proposed development. 2. There were comments from the public concerned with traffic, specifically school traffic, on Flagstaff Avenue and safety of turning traffic into this development. As previously mentioned in this memorandum, a right turn lane will be incorporated at the northern access. 3. There were concerns raised regarding the impact of the traffic generated by this development on the level of service of the Flagstaff Avenue and CSAH 50 intersection. The county contemplated a warrant analysis of this intersection in 2014. At that time the intersection did not meet the warrants for intersection control and little has changed along this corridor since then. Signal warrants look at the volume of traffic at both the major and minor approaches amongst other criteria. Although the traffic volumes met the warrants on the major approaches (CSAH 50)they were low on the minor approaches (Flagstaff Avenue). Backups of school traffic were noted but for very limited times. The county has indicated they will complete an updated warrant analysis as development continues to occur in areas that impact this intersection. Once it is determined the intersection meets warrants, the county will work with the city to evaluate traffic control options and program improvements. ACTION REQUESTED Recommend approval of the Preliminary, Final Plats and Planned Unit Development Agreement for Regetta Fields, subject to the following contingencies: 1. The satisfaction of all engineering comments related to the construction plans for grading and utilities. 2. A Development Contract between the Applicant and the City of Farmington shall be executed and security, fees, and costs shall be paid. Submission of all other documents required under the Development Contract shall be required. 3. The signing and recording of the Planned Unit Development Agreement. (referred to herein as"Developer"). RECITALS A. Developer owns property situated in the County of Dakota, State of Minnesota and legally described in Exhibit A(referred to herein as "Subject Property"). (referred to herein as"Subject Property). B. Developer has asked the City to approve a planned unit development for the Subject Property(also referred to in this Agreement as the"PUD"). C. Developer has requested and been approved to have the Subject Property rezoned from A-1 (Agriculture)to R-2 Planned Unit Development. NOW,THEREFORE,the parties agree as follows: 1 1. Conditions of Approval. The City hereby approves a rezoning of the Subject Property to R-2 PUD subject to the conditions set forth in this Agreement, on condition that the Developer enters into this Agreement. 2. Effect of Planned Unit Development Approval. For two (2) years from the date of this Agreement, no amendments to the City's Comprehensive Plan or official controls shall apply to or affect the use, development density, lot size, lot layout or dedications of the development unless required by state or federal law or agreed to in writing by the City and Developer. Thereafter, notwithstanding anything in this document to the contrary, subject to nonconforming use rights the City may require compliance with any amendments to the City's Comprehensive Plan, Zoning Ordinance, official controls, platting or dedication requirements enacted after the date of this document. 3. Plans. The City grants approval to the development of the PUD in accordance with the following plans which are on file at Farmington City Hall. The plans are not attached hereto. If the plans vary from the written terms of this Agreement, the written terms shall control. The plans are: Plan A—Preliminary Plat—Regetta Fields 4. Zoning. Except as otherwise modified by this Agreement,the landuse, design and other requirements and standards of the R-2 zoning district shall apply to the Subject Property with the following exceptions: • The net dwelling units per acre for a single-family development will be less than the minimum of 3.5 units per acre. The net density as depicted in Plan A (Preliminary Plat—Regetta Fields) is 3.13 units per acre. 2 5. Compliance with Permit and Licenses. It is the responsibility of the Developer to obtain and comply with all necessary approvals, permits, and licenses from the City of Farmington, Dakota County, Minnesota Pollution Control Agency, Minnesota Department of Health, and any other regulatory agency affected by or having jurisdiction over the Subject Property. All costs incurred to obtain said approvals, permits, and licenses shall be the responsibility of the Developer. 6. Compliance with Laws and Regulations. Developer represents to the City that the proposed development complies with all applicable City, County, Metropolitan, State, and Federal laws and regulations, including but not limited to the Farmington City Code, planned unit development ordinance, subdivision ordinances, zoning ordinances, and environmental regulations in effect during the course of this development or Agreement, and agrees to comply with such laws and regulations. 7. Enforcement. Developer shall reimburse the City costs incurred in the enforcement of this Agreement, including reasonable engineering and attorney's fees. Developer shall pay in full all bills submitted to it by the City within sixty(60)days after receipt. Bills not paid within sixty(60) days shall be subject to an eight percent(8%) per annum interest charge. 8. Miscellaneous. A. Breach of any material term of this Agreement by Developer shall be grounds for denial of building permits. B. If any material portion, section, subsection, sentence, clause, paragraph, or phrase of this Planned Unit Development Agreement is for any reason held invalid as a result of a challenge brought by Developer, their agents or assigns, the City 3 may, at its option, declare the entire Agreement null and void and approval of the final planned unit development shall thereby be revoked. C. The action or inaction of any party shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties, and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement after expiration of time in which work is to be completed shall not be a waiver or release. D. This Agreement shall run with the land and shall be recorded in the Dakota County Recorder's office. E. This Agreement shall be binding upon the parties, their heirs, successors, or assigns, as the case may be. F. Third parties shall have no recourse against the City under this Agreement. G. Except as otherwise specified herein, Developer shall pay all costs incurred by them or the City in conjunction with the development of the PUD, including but not limited to legal, planning, engineering and inspection expenses incurred in connection with the preparation of this Agreement. H. DISCUSSION The Planning Commission reviewed a draft version of this ordinance amendment at the regular meeting in July and recommended to staff to move forward with a public hearing on the proposed amendment. The city's existing home occupations ordinance is very generic and lends itself to staff making interpretations on what types of home occupations truly need city oversight. The attached ordinance amendment not only provides staff with clarification on what uses are allowable and prohibited as home occupations but also changes how the city approves these home based businesses. The first"major" change that staff is proposing is to have two distinct classifications for home occupations. The classifications are"Permitted Home Occupations" and "Special Home Occupations". Permitted home occupations would be those uses that can be allowed by the city without additional approval or a permit and can contain all parking within the existing driveway. These types of home occupations are the types that generate little if any traffic and would include such uses as art studios, consulting services, and tailoring. Special home occupations would include such uses as barber and beauty services,massage therapy, and photography studio. Another difference between the special and permitted home occupations is that the special would allow for one(1)additional employee who does not reside on the premises to be employed. The proposed ordinance also provides some flexibility to allow additional non-resident employees (up to 4) on a case by case basis if found by the Planning Commission that circumstances exist that won't compromise the residential integrity of the surrounding neighborhood and provided all employee parking is provided off-street. Special home occupations would require an interim use permit be approved by the Planning Commission. The existing code provision requires that a conditional use permit be approved for any home occupation. As previously mentioned, with the proposed amendment, special home occupations would be approved through an interim use permit. By approving the use through the interim use permit process the use does not run with the land in perpetuity, there is a timeframe associated with the interim use permit. The proposed ordinance requires that a special home occupation permit be issued for an initial one year period after which the permit may be reissued for periods up to three(3)years. The initial permit application would require a public hearing. Subsequent permit renewals for special home occupations would not require a public hearing;however,property owners within 350 feet of the subject property would be notified of the renewal. The other major change that is being proposed with this amendment is the addition of a"General Provisions and Performance Standards" section. This provides more "teeth" than what is currently available in the existing ordinance. This section provides regulations on such things as noise, light, and hours of operation. Lastly,the proposed ordinance identifies home occupations that would be prohibited or undesirable in a residential neighborhood. ACTION REQUESTED Recommend approval of the attached ordinance amendment regarding home occupations and forward that recommendation on to the City Council. No home occupation shall require internal or external alterations or involve construction features not customarily found in residential dwellings except where required to comply with the local and state fire and police recommendations. 5. All vehicle parking required for conduct of the home occupation shall be off-street. We love to have a glass of lemonade or ice cream/ice tea but it is so unbearable we hate to think of the noise penetrating,hurting our ear nerves and giving us headaches as it sometimes does. We cannot enjoy our property one day without this repetitious pounding on our heads,ears,foreheads and mind, Where is our God given tranquility of PEACE? The quality of life,calmness,freedom from disturbances or agitation and quietness. God gives It to us,but the Base Specialty Company takes them from us. We sometimes want to sit in our outdoor swing,but we cannot because of these sharp noises. A Tort of Nuisance states a person can be charged with creating a public nuisance by causing LOUD NOISES, FOUL ODORS,BRIGHT LIGHTS,OR DIVERTING A STREAM. 3, NEGLIGENCE We feel the Base Specialty Company Is using carelessness and recklessness by throwing their metal strips and wood boards from pallets and just let them fall to cement floors, plus many other supplies they work with. We have been closely observing and watching them do this,making this noise. If OSHA were to know this unsafe hazard and habit, it would get stopped. If you worked in the factories,and we all have,you would not be able to throw parts to the floors,whereas it could splinter off and fly Into someone, Someone would report this. Another noise maker is the electric forklifts,which still drives back and forth In the street all day. The forklifts don't fit as they were homemade forks and rattle going over 2 driveways,there's NO reason for these DOORS TO BE WIDE OPEN. 5. i WE ARE ASKING YOU? 1 . We all feel that because of the many different kinds of LOUD noises that the Base Company consists of, that the Base Specialty Company was designed and the type of business for the Farmington Industrial Park, because of the many LOUD noise. factors.. The noise is a Nuisance--SHUT THE BIG DOOR. We are asking that you eliminate these noises for the residents? 2. Because the Base Company has a LARGE doorway open on the inside of the buildings connecting the two buildings together, they should NOT be OUT in the traffic of cars, bikes, strollers doing production in the. driveway. If the Base Company would use the East big door facing the rail- road tracks it- would- help a great deal when breaking the boards of the skids apart. Most small companies where buildings are smaller and a fewer than 15 people work, can afford to put in an air conditioner, ONLY in the area where those people are working. Workers should NOT struggle through the heat in the summer for safety issues. An air conditioner would help the workers in the summer with • Ventilation and eliminate the noise problem for the residents. A city loan to the Base Company for this would help at this time the workers and residents that could really solve the problem. .ALL the neighbors being totally affected by this. For the Base Company to go from one bad forklift to another bad • forklift with the forks not properly fitted making rattling noise -all day long driving in the street is NEGLIGENT.
