1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.

3. Discussion
a. Regetta Fields Final Plat
This subdivision is located at the northwest intersection of county road 50 and Flagstaff
Avenue. It includes 24.08 acres. The preliminary plat was approved in August 2017.
The final plat includes 61 single-family lots. Initially the developer,Mr. Tim Giles,
requested the development be phased. Now he has decided to plat the entire 61 lots.
This is the only change in the plat. It is zoned R-2 (low/medium density residential)
PUD. The access from Flagstaff Avenue will be on the northern boundary of the
subdivision. A turn lane will be provided for the southbound lane of Flagstaff Avenue.
Contingencies include:
1. The satisfaction of all engineering comments related to the construction plans for
grading and utilities.
2. A Development Contract between the applicant and the city shall be executed and
security, fees, and costs shall be paid. Submission of all other documents required
under the Development Contract shall be required.
MOTION by Kuyper, second by Bjorge to recommend approval of the revised final plat
for Regetta Fields subject to the contingencies. APIF,MOTION CARRIED.
b. Discussion on City's Kennel Ordinance
A business would like to locate a dog boarding and daycare business within the
Farmington Mall at 923 8th Street. Services would include daycare, boarding,walking
services,transportation and training. The daycare would be open 14 hours, 6 a.m. to 8
p.m. The boarding component would consist of unattended overnight stay from 8 p.m. to
6 a.m. The use falls under the zoning classification of a kennel. Under the current
zoning regulations,kennels are only allowed in the agricultural district as a conditional
use. The Farmington Mall is in the B-1 zoning district and kennels are not allowed in this
zone. It would require an amendment to the city code for the business to locate in this
property.

Staff provided code information from Apple Valley and Burnsville that addresses this
type of use. Members were in favor of this type of business and agreed it should be a
conditional use. They agreed with noise barriers, ventilation and screening. This would
also be appropriate for an industrial area. Members wanted to be clear, they are not
talking about a proposal for Farmington Mall specifically. This would be a general
ordinance.
An Apple Valley resident who was previously in the kennel business spoke. The kennel
business has changed a lot and very fast. In any city in the metro there is a minimum of
30% dog ownership. Farmington has a great potential for this type of business. It can be
chaotic and loud. This would be used by people who don't want to leave their dog alone
during the day or need a place to take their dog while on vacation. It would take 7,000
sq. ft. to provide everything a dog would need.
Members did have a concern about the quality of care that the facility could provide and
the safety of the animals. It was suggested having a vet oversight would be appropriate.
Members also asked if there was any county or state licensing required. Items in the
ordinance should cover square footage, accommodations, sanitation, waste removal and
noise abatement.
Staff will bring a draft ordinance to the December meeting.
Member Rich asked when the commission will look at fencing as far as materials and whether
there should be a permit. Staff will bring this back in December. Member Rich stated in August
2016 the commission looked at a state law regarding temporary family health care dwelling
units. The commission and the city council agreed to opt out. His concern then and now is that
if we have washed our hands of this and never think about it again. He was curious if sometime
next year we could get an update on the situation. Maybe the organization of city planners
knows everyone has turned it down and no one wants to think about it again, but he would say
two years from that point, by fall of 2018 it would be nice to have an update of what has gone
on.

INTRODUCTION
Eric Ruud, 2088 270th Street W, Randolph, MN, has made application for a Conditional Use Permit to
allow a Recreational Vehicle Storage Facility within the B-4(Neighborhood Business)zoning district. The
subject property is addressed as 20522 Akin Road.
Planning Division Review

Existing Building and Lot Size: The property consists of a single lot totaling 4.79 acres. There is an
existing 3,520 square foot building that will be utilized on the property.
Surrounding Land Uses: Single-family residences are located to the north and west of the subject property.
Farmington Lutheran Church is located to the south and farmland is adjacent to the east.
Proposed Land Use: Recreational Vehicle Storage Facility.
DISCUSSION
The applicant, Eric Ruud, has submitted a Conditional Use Permit application in order to allow a
recreational vehicle storage facility on the property located at 20522 Akin Road. As shown on the attached
diagram, the facility would contain approximately 150 storage spaces and the existing building would be
utilized as a shop/storage space. Mr. Ruud is proposing the following improvements to the site with the
proposed use:
• Add asphalt in front and to the north and east side of the existing building.
• Remove 4 inches of topsoil where needed (east side of property).
• Overlay entire usable space with 1 1/2 inch lime rock.
• Trim trees as needed.
• Improve existing berm and add berm to south side of the driveway to match north side.
• Add 6' chain link fence around entire property
• Add fence screening to west side of chain link along Akin Road.
• Install automatic gate with key pad.
• Add surveillance & lighting as needed.
The applicant is proposing to overlay the portions of the site where the recreational vehicles will be stored
with 1 1/2" lime rock. Staff finds the storing or the recreational vehicles on the 1 1/2" lime rock acceptable
as the code allows for the storing of recreational vehicles on landscape rock in the side and rear of
properties. The applicant has mentioned that there is a plan to pave a bituminous drive aisle through the
site but the applicant is asking that they be given a year to complete this drive aisle. The installation of the
lime rock will need to be completed prior to the storing of any recreational vehicles on the site.
According to the city's Wetland Classification Map (dated February 2008)it appears the site is impacted by
wetlands, specifically on the north and east side of the site. All parking areas must be located outside of
these wetland areas. The applicant will have to provide the city with documentation that the wetlands will not
be impacted with the proposed use.
A Conditional Use Permit shall be approved if it is found to met the following criteria:
1. The proposed use conforms to the district permitted and conditional use provisions and all general
regulations of this title. The subject property is zoned B-4 (Neighborhood Business). The use of the
property as a recreational vehicle storage facility is a conditional use within that zone.
2. The proposed use shall not involve any element or cause any conditions that may be dangerous,
injurious or noxious to any other property or persons and shall comply with the performance
standards listed below. Staff believes the use will not involve any element or cause any conditions
that may be dangerous, injurious or noxious to any other person or property.
3. The proposed use shall be constructed, designed, sited, oriented and landscaped to produce
harmonious relationship of buildings and grounds to adjacent buildings and properties. The existing
building will be utilized as a storage/shop space for the recreational vehicles. Outside storage of
recreational vehicles is proposed to occur along the north, east and southern borders as well as the
interior back portion of the lot behind the existing building. Additional screening is proposed with
increased berming along western property line along with fencing that will completely enclose the
property. The fencing along the western side of the lot will include some screening aspects.
4. The proposed use shall produce a total visual impression and environment which is consistent with
the environment of the neighborhood. Staff believes the proposed use is the type of commercial use
that will have minimal impact on the adjacent residential uses from a transportation and noise
standpoint.
5. The proposed use shall organize vehicular access and parking to minimize traffic congestion in the
neighborhood. Access to the site will continue to be from the existing driveway that is located in
front of the building.
6. The proposed use shall preserve the objectives of this title and shall be consistent with the
comprehensive plan. The subject property is comprehensively guided as commercial. The proposed
use is consistent with the 2030 Comprehensive Plan.
ACTION REQUESTED
Approve the Conditional Use Permit allowing a Recreational Vehicle Storage Facility to take place on the
property addressed as 20522 Akin Road, subject to the following conditions:
1. The applicant obtains all necessary building permits from the City's Building Official.
2. A sign permit is applied for and approved for any external signage that may be placed on the premises.
3. The 1 1/2" lime rock parking pads must be installed prior to the storing of any recreational vehicles on
the site.
4. The bituminous drive aisle shall be installed no later than December 12, 2018.
5. The applicant must provide documentation to the city that the wetlands will not be impacted by the
proposed use.

SUBJECT: Draft Ordinance Regarding Fencing

INTRODUCTION
Attached, for discussion purposes only, is a draft ordinance amending Section 10-6-12 of the City Code as
it relates to fencing.
DISCUSSION
Amending the fencing requirements was previously discussed with the Commission at its September regular
meeting. The proposed amendment removes the materials section of the existing code provision and
enhances the construction and maintenance portion of the code.
The existing code provided a list of prohibited fencing materials, with the proposed amendment this would
go away. After reviewing codes from adjacent jurisdictions, Farmington's was the only one that listed
prohibited materials for fencing.
The second change the proposed amendment makes is in regards to construction and maintenance for
fencing. Staff has added language that strengthens this provision while also requiring that all exterior
surfaces of any fence be protected from the elements by paint or other protective surface coating or
treatment.
During the previous discussion in September, the idea of requiring a building permit for all fencing was
discussed. Currently, the City only requires a building permit for fences that exceed 6 feet in height(this
would also require a variance to be approved). Staff is not proposing to change this requirement with this
proposed amendment. The current provision seems to be consistent with most of the other surrounding
communities.
ACTION REQUESTED
Discuss and provide direction to staff regarding the proposed ordinance amendment.

AN ORDINANCE AMENDING TITLE 10,CHAPTER 6,SECTION 12
OF THE ZONING ORDINANCE AS IT RELATES TO FENCES
THE CITY COUNICL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Title 10, Chapter 6, Section 12 of the Farmington City Code is amended as follows
(deleted text is struck and added texted is underlined):
10-6-12: FENCES:
Fences shall be permitted in all yards subject to the following:
(A)Residential Fence Heights: In residential districts four foot(4')fences may be located on any lot line
except that fences on interior lots may be six feet(6') in height on the side and rear lot lines beginning
at the nearest front corner of the principal building.
(B)Corner Lots: Fences up to six feet(6') in height may be constructed on the side and rear lot lines
behind the nearest front corner of the principal building subject to the following:
1. The front corner of the principal building is defined as beginning at the widest point of the
structure's front street facing foundation as determined by its street address.
2.No fence over four feet(4') in height shall be located within the triangle of visibility which is that
area within a triangle created by measuring from a point on the curb or edge of the street closest to
the center of the intersection, down the front curb lines or edge of the intersecting streets thirty feet
(30'), and then connecting these end points with a straight line.
3. When a fence is adjacent to a driveway of a neighboring lot,a five foot(5')triangle of visibility or
a five foot(5')setback along the streetside shall be provided at the intersecting lot lines.
(C)Varying Setbacks: Should the fence be located between principal buildings with varying setbacks on
adjacent lots,a fence up to six feet(6') in height may not extend beyond the average setback of the
two(2)buildings.
(D)Variance: A variance is required for fences over six feet(6')and up to eight feet(8') in height when
constructed within the buildable areas of lots in residential districts.
(E)Commercial And Industrial Districts: Fences located within commercial and industrial districts may
be located on any lot line up to a height of eight feet(8')except in the required front yard.
(F) Site Plan; Building Permit: A site plan or legal survey with the location of the proposed fence shall be
submitted to the building inspection division for approval for all fences over four feet(4') in height.
An application for a building permit is required for all fences exceeding six feet(6')in height.

used. Every fence shall be maintained in a condition of reasonable repair free from deterioration,
loose or rottingpieces, holes, breaks or gaps not otherwise intended in the original design of the fence
and shall not be allowed to become and remain in a condition of disrepair or danger,or constitute a
nuisance, public or private. Any such fence which is, or has become dangerous to the public safety,
health or welfare, is a public nuisance,and abatement would be required.
All exterior surfaces of any fence shall be protected from the elements by paint or other protective
surface coating or treatment,which shall be maintained in good repair to provide the intended
protection from the elements.
SECTION 2. Effective Date. This ordinance shall be effective upon its passage and publication
according to law.
