1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.
Members Present: Bjorge, Franceschelli, Kuyper,Rich
Members Absent: Rotty
Also Present: Tony Wippler,Planning Manager
2. Approval of Minutes
a. MOTON by Rich second by Kuyper to approve the minutes of October 17, 2017.
Voting for: Bjorge, Kuyper, Rich. Abstain: Franceschelli. MOTION CARRIED.
3. Discussion
a. Regetta Fields Final Plat
This subdivision is located at the northwest intersection of county road 50 and Flagstaff
Avenue. It includes 24.08 acres. The preliminary plat was approved in August 2017.
The final plat includes 61 single-family lots. Initially the developer,Mr. Tim Giles,
requested the development be phased. Now he has decided to plat the entire 61 lots.
This is the only change in the plat. It is zoned R-2 (low/medium density residential)
PUD. The access from Flagstaff Avenue will be on the northern boundary of the
subdivision. A turn lane will be provided for the southbound lane of Flagstaff Avenue.
Contingencies include:
1. The satisfaction of all engineering comments related to the construction plans for
grading and utilities.
2. A Development Contract between the applicant and the city shall be executed and
security, fees, and costs shall be paid. Submission of all other documents required
under the Development Contract shall be required.
MOTION by Kuyper, second by Bjorge to recommend approval of the revised final plat
for Regetta Fields subject to the contingencies. APIF,MOTION CARRIED.
b. Discussion on City's Kennel Ordinance
A business would like to locate a dog boarding and daycare business within the
Farmington Mall at 923 8th Street. Services would include daycare, boarding,walking
services,transportation and training. The daycare would be open 14 hours, 6 a.m. to 8
p.m. The boarding component would consist of unattended overnight stay from 8 p.m. to
6 a.m. The use falls under the zoning classification of a kennel. Under the current
zoning regulations,kennels are only allowed in the agricultural district as a conditional
use. The Farmington Mall is in the B-1 zoning district and kennels are not allowed in this
zone. It would require an amendment to the city code for the business to locate in this
property.

Staff provided code information from Apple Valley and Burnsville that addresses this
type of use. Members were in favor of this type of business and agreed it should be a
conditional use. They agreed with noise barriers, ventilation and screening. This would
also be appropriate for an industrial area. Members wanted to be clear, they are not
talking about a proposal for Farmington Mall specifically. This would be a general
ordinance.
An Apple Valley resident who was previously in the kennel business spoke. The kennel
business has changed a lot and very fast. In any city in the metro there is a minimum of
30% dog ownership. Farmington has a great potential for this type of business. It can be
chaotic and loud. This would be used by people who don't want to leave their dog alone
during the day or need a place to take their dog while on vacation. It would take 7,000
sq. ft. to provide everything a dog would need.
Members did have a concern about the quality of care that the facility could provide and
the safety of the animals. It was suggested having a vet oversight would be appropriate.
Members also asked if there was any county or state licensing required. Items in the
ordinance should cover square footage, accommodations, sanitation, waste removal and
noise abatement.
Staff will bring a draft ordinance to the December meeting.
Member Rich asked when the commission will look at fencing as far as materials and whether
there should be a permit. Staff will bring this back in December. Member Rich stated in August
2016 the commission looked at a state law regarding temporary family health care dwelling
units. The commission and the city council agreed to opt out. His concern then and now is that
if we have washed our hands of this and never think about it again. He was curious if sometime
next year we could get an update on the situation. Maybe the organization of city planners
knows everyone has turned it down and no one wants to think about it again, but he would say
two years from that point, by fall of 2018 it would be nice to have an update of what has gone
on.
