2008 PRESERVATION MONTH PROCLAMATION
WHEREAS, historic preservation is an effective tool for managing growth, revitalizing
neighborhoods, fostering local pride and maintaining community character while enhancing
livability; and
WHEREAS, historic preservation is relevant for communities across the nation, both urban and
rural, and for Americans of all ages, all walks of life and all ethnic backgrounds; and
WHEREAS, it is important to celebrate the role of history in our lives and the contributions
made by dedicated individuals in helping to preserve the tangible aspects of the heritage that has
shaped us as a people; and
WHEREAS, "This Place Matters" is the theme for National Preservation Month 2008,
cosponsored by the Heritage Preservation Commission and the National Trust for Historic
Preservation.
NOW, THEREFORE, I, Kevan Soderberg, Mayor of the City of Farmington, do proclaim May
2008, as National Historic Preservation Month, and call upon the people of Farmington to join
their fellow citizens across the United States in recognizing and participating in this special
observance.

Councilmember Fogarty asked about the Historic Property Tax credit. Administrative
Services Director Shadick explained that last year it made it to the Omnibus bill, but the
Governor vetoed it. Currently, properties can get a federal tax credit if it is used for
commercial purposes. A homeowner cannot use this credit for residential purposes.
Councilmember McKnight noted in the investments the City went from $22.9 million to
$16.4 million and asked if money was spent on something out of the ordinary during the
first three months. Finance Director Roland replied nothing was out ofthe ordinary,
bond payments amounting to $3 million were made on February 1,2008.
Councilmember Wilson asked about selling a refuse truck. Municipal Services Director
Reiten stated there is an extra truck due to slow growth. A minimum resale value would
be $50,000. Councilmember Wilson asked about the school and conference for the
Police Department due to the budget and was assured the conference is necessary.
Councilmember Wilson noted on the audio visual bid award, he stated normally there
would be a projected budget amount to know whether bids came in over or under budget.
Finance Director Roland replied currently technology is rolled into one number and that
is $180,000. There are a variety of other technology items included in this budget.
Councilmember Wilson had requested to add a National Day of Prayer Proclamation for
an event on May 1, 2008, at Rambling River Park. Council decided to not add this to the
agenda due to separation of Church and State.

Acting Mayor Pritzlaff asked if the fuel surcharge is more for a tri-plex than a single-
family for recycling. Finance Director Roland stated it is not listed as a separate item on
the bill and is included in the garbage charge. The charge for a tri-plex is three times the
amount for a single unit. Acting Mayor Pritzlaff asked about the payment to MT A
Sandblasting. Finance Director Roland stated the garbage trucks have to be sandblasted
and then painted. Municipal Services Director Reiten stated this was for a rolloff
container. Acting Mayor Pritzlaff asked about the payment to the City of Rosemount for
patrol services. Staff will check on the purpose of the payment. Acting Mayor Pritzlaff
stated regarding the Fairhill Development, he was uncomfortable to still see the Newland
name on the documents. City Attorney Jamnik stated there has not been an official
change at this point; the applicant is still Newland and the owner has consented.
5. STAFF COMMENTS
City Administrator Herlofsky distributed some articles from various newspapers on
Farmington. He noted on the Consent Agenda, there is an outline of the budget.
Licenses and permits are not at the number staff would like. At the first meeting in May,
staff will be making a recommendation to Council regarding 2008, and some
recommendations will affect 2009. At the May workshop, 15 minutes will be set aside
for Council to give their recommendations for the 2009 budget.
Assistant Planner Wippler stated on April 16, 2008 the Administrative Law Judge
approved the Orderly annexation Agreement with Empire Township.

8. PUBLIC HEARINGS
a) Amend Ordinance - 2008 Fee Schedule - Engineering
The amendment is to replace the charge for the Pre-Plat Surety with a Pre-
Development Contract Surety based on the number of lots, units, or square
footage for different types of proposed developments. MOTION by Fogarty,
second by McKnight to close the public hearing. APIF, MOTION CARRIED.
MOTION by McKnight, second by Wilson to approve the amendment to the
Charges and Fees ordinance. APIF, MOTION CARRIED.
9. AWARD OF CONTRACT
a) Audio Visual Equipment New City Hall- Administration
Bids were received for the audio visual equipment for the Council Chambers for
the new City Hall. The low bidder was Alpha Video & Audio, Inc. in the amount
of$103,309.53. MOTION by Wilson, second by McKnight to adopt
RESOLUTION R27-08 accepting the bid and awarding the contract for audio
visual equipment, installation and services to Alpha Video and Audio, Inc. APIF,
MOTION CARRIED.
10. PETITIONS, REQUESTS AND COMMUNICATIONS
a) Adopt Resolution - Preliminary Plat, Comprehensive Plan Amendment,
Schematic PUD Fairhill Development - Planning
The comprehensive plan amendment is due to the housing market conditions.
The largest change is in the low density residential which covers 500 acres of the
960 acres in the site. The schematic PUD shows a 42-acre community park, the

looped road has been changed to a north-south spine road, a more traditional
subdivision with cul-de-sacs and many local roads. The housing in the southwest
comer has been changed as requested by the Planning Commission. The first
preliminary plat will contain 241 lots as well as numerous outlots. The 42-acre
park and the area for Diamond Path Road will be shown as separate outlots. The
width ofthe lots vary from 45 ft. to 75 ft. wide. The contingencies are as follows:
1. Provide an outlot for the community park area located in the southwest
comer ofthe Fairhill development.
2. Provide an outlot for the portion of the Diamond Path Road that extends
north from 195th Street through the community park to the southerly intersection
of I 89th Street.
Councilmember McKnight was uncomfortable with the change due to the market,
but can live with it. He asked what the ramifications are if this is approved
tonight and the PUD Agreement does not get approved as is in a month. City
Attorney Jamnik explained it will not be approved as is. He anticipates
amendments. The project would still need to go to final plat and at that time, if
there is not an approved PUD Agreement, there would still be a standard
Development Contract where certain infrastructure improvements will be required
and sureties will be provided. If the PUD was dropped, the development would
proceed under normal development procedures. The PUD Agreement will be
brought to the May 5, 2008, Council meeting.
Councilmember Fogarty was also concerned with the change in housing type, but
understood the market changed. She appreciated everyone's hard work on this.
Acting Mayor Pritzlaff agreed the market has changed, but had the same
concerns. MOTION by Fogarty, second by Wilson to adopt RESOLUTION
R28-08 amending the 2020 Comprehensive Plan for the Fairhill property located
on the west side ofTH3 in northeast Farmington, and adopt RESOLUTION
R29-08 approving the preliminary plat Fairhill phase 1. APIF, MOTION
CARRIED.
b) Adopt Resolution - Development Contract Twin Ponds - Engineering
The final plat for Twin Ponds 2nd Addition was approved by the Planning
Commission on November 14,2006, and by the City Council on January 16,
2007. The main condition for approval of the Development Contract is that the
developer provide a temporary ingress and egress easement across the Tollefson
development. This is to provide temporary access to TH3 until a formal backage
road can be constructed that would line up with Centennial.
Councilmember McKnight noted part of the temporary access to TH3 goes right
by the convenience store and the gas pumps. The convenience store is open
again, so he asked if there was any concern with increased traffic so close to the
gas pumps. City Engineer Schorzman replied based on the layout of the

temporary access road, he would expect traffic in that area would be going to the
convenience store. There is another break at TH3, so traffic could go left or right
rather than past the convenience store. MOTION by Fogarty, second by
McKnight to adopt RESOLUTION R30-08 approving the execution of the Twin
Ponds 2nd Addition Development Contract and authorize its signing contingent
upon the above conditions and final approval by the Engineering division. APIF,
MOTION CARRIED.
c) Ice Arena Report - Parks and Recreation
Parks and Recreation Director Distad presented a report for the 2006-2007 and
2007-2008 ice season. There was an increase of 48 hours in the hours rented this
season. As a result of the increase in hours and the increased fee, the revenues
increased by $32,000. The rate increased from $150 to $170/hour. The personnel
costs went down due to reallocating staff time. Electrical usage decreased, but
gas usage increased. The ice arena is close to breaking even this season.
d) 2007 Annual Report - Parks and Recreation
Parks and Recreation Director Distad presented the 2007 Parks and Recreation
Annual Report. He highlighted park improvements, recreation programs,
facilities, personnel, awards received for the Green Team and Depot Way Arts
Park. He noted he is very proud of the Parks and Recreation staff for their
dedication and hard work.
11. UNFINISHED BUSINESS
a) Approve Tobacco Free Parks Policy - Parks and Recreation
At the January 7, 2008, Council Meeting, students from the Tiger Leadership
Club proposed a tobacco free parks policy. The Parks and Recreation
Commission has discussed this policy and the policy would prohibit the use of
tobacco products in parks with the exception of an area within 150 ft. of the adult
softball fields at Feely Fields. It would also allow tobacco to be used in parking
lots.
Councilmember Wilson noted there would be some budget impact for installing
signs and maintaining them.
Councilmember McKnight asked how much debate was held at the Parks and
Recreation Commission meeting. Parks and Recreation Director Distad said there
was some disagreement about wanting the entire park to be tobacco free and some
were more flexible with allowing use around adult softball fields and the parking
lot. Councilmember McKnight noted this came to Council from the Tiger
Leadership Club who are the current and future users of our park facilities. We
asked the commission to come up with something and bring a recommendation.
As tobacco use is allowed around the adult softball fields, this will not drive
teams to other cities, so he liked the compromise and respected the differing
opmlOns.

Councilmember Fogarty stated she was not a big supporter ofthis policy. She
agrees people should not smoke in parks, but whether that should be public policy
is a different conversation. She does not think that something that is legal in the
state should be banned in the outdoors.
Councilmember Wilson stated sometimes government can delve into realms
which do not have a government role. In the ordinance, it recognizes tobacco is
illegal for those under 18 years of age. On school property, tobacco use is
banned. One comment in the policy he disagrees with is that adult role models
who use tobacco products project to children that the use of tobacco is an
acceptable life style. This is a true comment, but is that the role of government as
opposed to the role of the parent. He feels adults are not running to the parks to
smoke as they can freely smoke on their own property.
Acting Mayor Pritzlaff thanked the Tiger Leadership Club for bringing this to
Council, but felt the policy goes too far and is beyond smoking. If parents smoke
at home, kids will see that. It is up to the parents to teach them.
The policy failed for lack of a motion.
12. NEW BUSINESS
a) Farmington Wellhead Protection Plan - Engineering
The Wellhead Protection Plan has two parts. The first is the delineation of the
wellhead protection area. This was approved by the Department of Health in
2004. The second part looks at vulnerable areas and what is in them that could
contaminate the water source. The main point is to identify where our water
comes from, how easily the water could be contaminated, and by what means that
contamination could occur. The water in the City flows to our wells from the
southwest towards the northeast.
b) Accept Feasibility Report and Approve Joint Powers Agreement TH3
Roundabout-Engineering
The feasibility report addresses the construction of a roundabout at TH3 and 19Sth
Street. MnDOT has approved a single-lane roundabout to optimize both safety
and mobility. The proposed improvements include the construction of a
roundabout as well as approaches from all four directions, lighting, landscaping
and storm drainage. The cost of the project is $2.2 million. Funding will be
provided by several project partners including Empire Township, Dakota County,
MnDOT, and developers. A more detailed description of project funding will be
provided at the May 19, 2008, Council meeting.
Councilmember McKnight asked what if 190th Street does not happen to the west,
is this still an effective traffic control device. City Engineer Schorzman stated it
depends on what happens in Empire Township. Whether there is aT-intersection
or a four-way intersection, this would be beneficial. Councilmember McKnight

asked what if there were no intersections to the east or west and a roundabout was
put in on the current TH3. Staff replied it would not be beneficial.
Councilmember Fogarty asked if this was an average cost for a roundabout. City
Engineer SchorZlllan stated this is a typical price for a roundabout constructed on
a state highway.
Acting Mayor Pritzlaff asked if the roundabout can be expanded if TH3 were
made into four lanes. Staff replied it could be expanded. If the project was
delayed a year, Acting Mayor Pritzlaff asked if the funding sources would still be
available. City Engineer SchorZlllan stated the funding from MnDOT, $550,000,
is required to be spent in this fiscal year. If Council does not approve the project
at the first meeting in July, the funding would disappear. Originally this project
was not funded under the cooperative agreement funding. Another community
dropped out, so Farmington stepped up and we were able to get the funding. He
was unsure if Dakota County would be willing to participate next year. City
Administrator Herlofsky noted Empire is having some commercial development
taking place this year. If the highway were shut down next year, they may be less
willing to contribute next year.
The Joint Powers Agreement gives the details of the maintenance responsibilities
the City and Empire Township will have for the east and west legs of the
roundabout. Empire will take care of the east leg, and Farmington will take care
of the west leg until Dakota County makes this a county road at which time it
would be their responsibility. Empire Township will contribute $380,000 to the
project cost and the maintenance responsibilities show the City and the township
sharing equally in the cost of lighting, landscaping maintenance and watering for
the landscape material. MOTION by Wilson, second by Fogarty to adopt
RESOLUTION R31-08 accepting the feasibility report, approving the agreement
with Empire Township and authorizing the execution of the Joint Powers
Agreement for the TH3 and future CR64 project. APIF, MOTION CARRIED.
c) YMCA Appointment - Administration
The YMCA has requested a community leader be appointed to the YMCA Board
of Directors. MOTION by Pritzlaff, second by McKnight to appoint
Councilmember Wilson as the City's designee to the YMCA Board of Directors.
APIF, MOTION CARRIED.
13. COUNCIL ROUNDTABLE
Councilmember Fogarty: On April 27, 2008, from 8:30 - 12:30 there is a benefit
breakfast for funding for organizations supported by the American Legion.
Councilmember Wilson: On May 1,2008 there will be a National Day of Prayer
event at 7:00 p.m. at Rambling River Park. May 3, 2008 will be Park and Pond Clean-up
day which he will be attending with the Cub Scouts.

On April 25, 2008 there will be an Arbor Day celebration at
Acting Mayor Pritzlaff: Last Friday, he and City Administrator Herlofsky attended
the Mayor/Managers meeting where a discussion was held regarding the watershed
program. Last Wednesday, he and Councilmember McKnight attended the
groundbreaking for Allina Medical Center. The new center should be completed in
October 2008. Earth Day is April 22, 2008. He will be attending the Arbor Day event on
April 25, 2008.

INTRODUCTION
City staff, Parks and Recreation Advisory Commission (the Commission) and the City Attorney have
reviewed Ordinance 6-9-6 Park Regulations Prohibited Activities in Parks.
DISCUSSION
Complaints and concerns have been received about the practicing of golf in City parks. These
complaints stem from golfballs being hit errantly and causing damage to abutting property owner's
cars and homes. A concern was also reported about a situation in one park where golf balls that were
being hit came close to hitting parents and their children while they were playing in the park.
Staff brought this issue to the Commission at its April 9, 2008 meeting. The Commission voted
unanimously to recommend to the City Council that a text amendment be made to Ordinance 6-9-6
concerning park regulations that would add a provision prohibiting golf in City parks. The attached
Ordinance contains the recommended text amendment language in Ordinance 6-9-6.

DISCUSSION
Currently, the City has a card reader system for the Police Department, Fire Station 2 and the
Central Maintenance Facility. This system is being expanded to incorporate the new City Hall.
The project will include the purchase and installation of twenty (20) card readers that will control
access at specified doors in the City Hall as well as the controllers and power supplies necessary
to effectively manage the system.
BUDGET IMPACT
The funding for this project is included within the technology portion ofthe City Hall budget and
the total cost for this project is $20,935.73.

Mr. Klotz joined the City on April 6, 1981 and was promoted to Solid Waste Supervisor on February
1, 1993. He has been an excellent and valued member of the City Organization. The City has
appreciated his commitment to the organization and wishes him well in his future endeavors.

The purpose of this memorandum is to provide information to the Council regarding the proposed
summer hours for City facilities.
DISCUSSION
Again this year, the City is asking to implement a new summer hour schedule for City hall. These
hours are intended to provide better service to our customers by giving them extra time on Monday
through Thursday to take care of business with the City. Additionally, these hours allow us to
maximize efficiency as well as provide some flexibility to City staff regarding their summer work
schedules. The hours for the City facilities are listed below and would begin June 2, 2008 and end
Friday, August 29, 2008.

A proposed settlement has been reached between the parties in the litigation between Doris & Gary
Schmitz, Barbarossa, Northern Dewatering and the City of Farmington.
DISCUSSION
As was outlined in the Special City Council meeting on April 28, 2008, the Schmitz's and all
defendants have agreed to a proposed settlement. The City's portion of the settlement is $72,500,
waiving the balance of the plaintiff s Main Street assessment and refunding the amount of assessment
principal and interest which has been paid to this point.
BUDGET IMPACT
Funding has been reserved to cover this expense.
ACTION REQUESTED
Approve payment of the City's portion of the settlement in the amount of $72,500, waive the balance
of the Main Street assessment outstanding and refund principal and interest which plaintiffs have
already paid on the assessment.

IN CONSIDERATION OF THE MUTUAL UNDERTAKINGS HEREIN
CONTAINED, THE PARTIES AGREE AS FOLLOWS:
1. CONTRACT DOCUMENTS. The following documents shall be referred to
as the "Contract Documents", all of which shall be, taken together as a whole as the
contract between the parties as if they were set verbatim and in full herein:

C. Bid documents dated~, 2008.
In the event of conflict among the provisions of the Contract Documents, the order in which
they are listed above shall control in resolving any such conflicts with Contract Document
"A" having the first priority and Contract Document "C" having the last priority.
2. OBLIGATIONS OF THE CONTRACTOR. The Contractor shall provide the
goods, services, and perform the work in accordance with the Contract Documents.
3. OBLIGATIONS OF THE CITY. The City shall pay the Contractor in
accordance with the bid.
4. SOFTWARE LICENSE. If the equipment provided by the Contractor
pursuant to this Contract contains software, including that which the manufacturer may
have embedded into the hardware as an integral part of the equipment, the Contractor
shall pay all software licensing fees. The Contractor shall also pay for all software updating
fees for a period of one year following cutover. The Contractor shall have no obligation to
pay for such fees thereafter. Nothing in the software license or licensing agreement shall
obligate the City to pay any additional fees as a condition for continuing to use the
software.
5. ASSIGNMENT. Neither party may assign, sublet, or transfer any interest or
obligation in this Contract without the prior written consent of the other party, and then only
upon such terms and conditions as both parties may agree to and set forth in writing.

6. TIME-OF PERFORMANCE. The Contractor shall complete its obligations
on or before :cl..Q~ ~ \~I~ ?.1X5B.
7. PERFORMANCE AND PAYMENT BOND. Within fifteen (15) calendar
days after the execution of this Agreement and before any work or services are rendered,
the Contractor shall furnish a performance bond insuring the faithful performance of the
contract and payment of all obligations arising thereunder pursuant to section 574.26 of-
the Minnesota Statutes, and in accordance with the bid specifications. If the bonds are not
submitted within the time frame, then the contract shall be considered void and the City
may elect to collect the proposal bond or security as liquidated damages.
8. PAYMENT.
a. When the obligations of the Contractor have been fulfilled, inspected, and
accepted, the City will pay the Contractor. Such payment shall be made not later than
thirty (30) days after completion, certification thereof, and invoicing by the Contractor.
b. No final payment shall be made under this Contract until Contractor has
satisfactorily established compliance with the provisions of Minn. Stat. Section 290.92. A
certificate of the commissioner shall satisfy this requirement with respect to the Contractor
or any subcontractor.
9. PROMPT PAYMENT TO SUBCONTRACTORS. Pursuant to Minnesota
Statute 471.25, Subdivision 4a, the Contractor must pay any subcontractor within ten (10)
days of the Contractor's receipt of payment from the City for undisputed services provided
by the subcontractor. The Contractor must pay interest of one and one~half percent (1%
%) per month or any part of a month to subcontractor on any undisputed amount not paid
on time to the subcontractor. The minimum monthly interest penalty payment for an
unpaid balance of $100.00 or more is $10.00. For an unpaid balance of less than
$100.00, the Contractor shall pay the actual penalty due to .the subcontractor. A
subcontractor who prevails in a civil action to collect interest penalties from the Contractor
shall be awarded its costs and disbursements, including attorney's fees, incurred in
bringing the action.
10. WORKER'S COMPENSATION. If Contractor does public work, the
Contractor shall obtain and maintain for the duration of this Contract, statutory Worker's
Compensation Insurance and Employer's Liability Insurance as required under the laws of
the State of Minnesota.
11. COMPREHENSIVE GENERAL LIABILITY. Contractor shall obtain the
following minimum insurance coverage and maintain it at all times throughout the life of the
Contract, with the City included as an additional name insured:

A. All data created, collected, received, ~ned, or disseminated tor
any purpose in the course of this Contract is governed by the Minnesota Government Data
Practices Act, Minn. Stat. Ch. 13, any other applicable state statute, or any state rules
adopted to implement the act, as well as federal regulations on data privacy.

B. All books, records, documents, and accounting procedures and
practices of the Contractor and its subcontractors, if any, relative to this Contract are
subject to examination by the City.
13. WARRANTY. The Contractor guarantees that all new equipment warranties
as specified within the bid shall be in full force and transferred to the City upon payment by

the City. The Contractor shall be held responsible for any and all defects in workmanship,
materials, and equipment which may develop in any part of the contracted service, and
upon proper notification by the City shall immediately replace, without cost to the City, any
such faulty part or parts and damage done by reason of the same in accordance with the
bid specifications. The Contractor further warrants to the City that all goods and services
furnished under the Contract will be in conformance with Contract Documents and that the
goods are of merchantable quality and are fit for the use for which they are sold. This
warranty is in addition to any manufacturer's standard warranty y, and any warranty
provided by law.
14. NONDISCRIMINATION. All Contractors and subcontractors employed shall
comply with all applicable provisions of all federal, state and municipal laws which prohibit
discrimination in employment to members of a protected class and all rules and
regulations, promulgated and adopted pursuant thereto. The Contractor will include a
similar provision in all subcontracts entered into for the performance of this contract.
15. INDEMNITY. The Contractor agrees to indemnify and hold the City
harmless from any claim made by third parties as a result of the services performed by it.
In addition, the Contractor shall reimburse the City for any cost of reasonable attorney's
fees it may incur as a result of any such claims.
16. WAIVER. In the particular event that either party shall at any time or times
waive any breach of this Contract by the other, such waiver shall not constitute a waiver of
any other or any succeeding breach of this Contract by either party, whether of the same
or any other covenant, condition, or obligation.
17. GOVERNING LAW. The laws of the State of Minnesota govern the
interpretation of this Contract.
18. SEVERABILITY. If any provision, term, or condition of this Contract is found
to be or become unenforceable or invalid, it shall not effect the remaining provisions,
terms, and conditions of this Contract, unless such invalid or unenforceable provision,
term, or condition renders this Contract impossible to perform. Such remaining terms and
conditions of the Contract shall continue in full force and effect and shall continue to
operate as the parties' entire contract.
19. ENTIRE AGREEMENT. This Contract represents the entire agreement of
the parties and is a final, complete, and all-inclusive statement of the terms
thereof, and supersedes and terminates any prior agreement(s),
understandings, or written or verbal representations made between the
parties with respect thereto.

INTRODUCTION I DISCUSSION
The Minnesota Building Code offers several optional chapters that may be adopted by individual
municipalities, including Chapter 1306, which relates to on-premises fire suppression systems.
The Building Code is updated periodically due to advances in materials, techniques, research and
knowledge. The updated Minnesota State Building Code (International Building Code with
State amendments) became effective on July 10,2007. Due to the updates made to the building
code, the City must re-adopt the optional code mentioned above to reflect changes made to
Chapter 1306 of the State Building Code.
The City Council initially adopted Chapter 1306 of the Minnesota Building Code on July 7,
2003. Chapter 1306 is attached to this memorandum as Exhibit "A".
The revisions proposed in this amendment are largely for clarification purposes. In addition, the
amendment being proposed removes specific language regarding the sprinkler requirements for
attached R-3 occupancies and attached townhouses built to the International Residential Code
with more than 16 dwelling units or more than three stories in height. The optional code for this
is now part of the model and state code with a 9250 square foot maximum before sprinkler
requirements need to be met.
ACTION REQUESTED
Adopt the attached Ordinance amending Sections 4-1-1 and 4-1-2 of the Farmington City Code
to adopt recent revisions and future amendments to the Minnesota State Building Code.

AMENDMENTS TO THE MINNESOTA STATE BUILDING CODE
THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Section 4-1-1 of the Farmington City Code is amended as follows added

4-1-1: ADOPTION OF BUILDING CODE:
The Minnesota state building code, as adopted by the commissioner of administration
pursuant to MSA chapters 16B.59 to 16B.75, including all amendments, rules and
regulations established, adopted and published from time to time by the State of
Minnesota commissioner of administration, through the b\:lilding codes and standards
division is hereby adopted by reference with the exception of the optional chapters that
are not specifically adopted by Section 4-1-2 of this Code. The Minnesota state building
code is hereby incorporated in this chapter as if fully set out herein.
SECTION 2. Section 4-1-2 of the Farmingtop City Code is amended as follows:
4-1-2: ADOPTION OF OPTIONAL PROVISIONS:
The Minnesota state building code, established pursuant to Minnesota statutes 16B.59 to
16B.75 allows the municipality to adopt by reference and enforce certain optional
chapters of the most current edition of the Minnesota state building code. The following
optional provision identified in the most current edition of the state building code is
hereby adopted and incorporated as part of the building code for the city of Farmington.
(A) Chapter 1306, Special Fire Protection Systems. New Buildings (Minn. Rule
1306.0020. Subp. 3).

1306.0020 MUNICIPAL OPTION.
Subpart 1. Requirement. The sprinkler system requirements of this chapter, if
adopted, must be adopted with the selection of either subpart 2 or 3, without amendment.
Subp. 2. Existing and new buildings. Automatic sprinkler systems for new
buildings, buildings increased in total floor area (including the existing building), or
buildings in which the occupancy classification has changed, must be installed and
maintained in operational condition within the structure. The requirements of this subpart
apply to structures that fall within the occupancy classifications established in part
1306.0030, items A to D.
Exception: The floor area of minor additions that do not increase the occupant load
does not have to be figured into the square footage for occupancy classifications
established in part 1306.0030, items A to D.
Subp. 3. New buildings. Automatic sprinkler systems for new buildings, additions
to existing buildings, or buildings in which the occupancy classification has changed must
be installed and maintained in operational condition within the structure. The requirements

1306.0030 REQUIREMENTS.
For purposes of this chapter, area separation, fire barriers, or fire walls do not establish
separate buildings. Gross square footage (gsf) means the floor area as defined in the
International Building Code. The floor area requirements established in items A to D are
based on the gross square footage of the entire building and establish thresholds for these
requirements. The following occupancy groups must comply with sprinkler requirements
of this chapter, unless specified otherwise:
A. Group A-I, A-2, A-3, and A-4 occupancies;
Exception: air inflated structures, and open picnic shelters.
B. Group B, F, M, and S occupancies with 2,000 or more gross square feet of
floor area or with three or more stories in height;
Exception: S-2 open parking garages, aircraft hangars, salt storage sheds, and group
"M" detached canopies.
C. Group E occupancies with 2,000 or more gross square feet of floor area or
with two or more stories in height;
D. Group E day care occupancies with an occupant load of 30 or more.

Automatic sprinkler systems must comply with the applicable standard referenced in
the State Building Code. If a public water supply is not available, the building official
and fire chief shall approve the use of an alternate on-site source of water if the alternate
source provides protection that is comparable to that provided by a public water supply. If
an adequate alternate water supply sufficient for hose stream requirements is provided or
available, the building official and fire chief may permit the water supply requirements for
the hose stream demands to be modified.

The building official, with the concurrence of the fire official, may waive the
requirements of this chapter if the application of water has been demonstrated to constitute
a serious life, fire, or environmental hazard, or if the building does not have an adequate

Department of Labor and Industry, Construction Codes and Licensing Division. The
ordinance does not go into effect until:
A. a signed electronic, faxed, or paper copy of the ordinance has been received

B. the ordinance has been approved by the division.
An ordinance is deemed automatically approved by the division if the municipality
has not been informed that the ordinance has not been approved within ten working days
of the division's receipt of the ordinance.

INTRODUCTION
The City's approved 2008 Capital Outlay Budget identified funding in the amount of$50,000 for the
purchase of a new condenser in the Schmitz-Maki Arena (Arena).
DISCUSSION
The existing condenser at the Arena is the original condenser that was installed when the Arena was built
in 1976. It has deteriorated to the point where it now has become corroded and there have been leaks
found. It is at the end of its useful life. The condenser is a vital piece of the ice making equipment at the
Arena as it removes the heat from the compressors and the heat from the floor allowing the water to
freeze on the floor. Without it, we cannot make ice. In talking with vendors who submitted quotes, they
indicated to staff that other arenas that were built at the same time as our Arena was built, have already
replaced their condenser at least once and in some arenas it has been replaced twice. It is important to note
that when quotes were solicited staff had indicated to the vendors that one condition to be met was that
the condenser purchased had to be capable of being used in a new arena if one was built. Quotes
submitted reflect the condition of the condenser being able to be used in a new facility.
Quotes were requested from four vendors. Only two vendors submitted quotes. New Mech Companies
from St. Paul, Minnesota submitted a quote to install a new condenser for $41,442. IceRink Supply from
Albert Lea, Minnesota submitted a quote for $47,788 to install a new condenser.
BUDGET IMPACT
The Adopted 2008 Capital Outlay Budget for the Arena included funding in the amount of $50,000 for
purchasing a new condenser. The low quote submitted by New Mech Companies was in the amount of
$41,442, which is $8,558 less than what was budgeted.
ACTION REQUESTED
Approve the purchase of the condenser for the Arena from New Mech Companies.

INTRODUCTIONIDISCUSSION
Farmington Municipal Liquors is requesting a Temporary on-sale Liquor License for a wine tasting
event, to be held during Rambling River Days on June 17,2008.
This event will be held at the Schmitz-Maki Arena. Per State Statute, a Temporary Liquor license must
first be approved by the City and then forwarded to the State for approval.
BUDGET IMPACT
The State of Minnesota waives all fees for a Temporary On-Sale Liquor Licenses for non-profit
organizations. Therefore, a City fee has not been established at this time.
ACTION REQUESTED
Approve the attached application for a Temporary Liquor License for Farmington Municipal Liquors,
for June 17,2008.

INTRODUCTION
Staff has reviewed and discussed the current year's projected revenues and expenditures and believes
that adjustments need to be made to both.
DISCUSSION & BUDGET IMPACT
The current real estate environment shows no sign of easing and staff believes that building permit
revenues should be revised downward to reflect the market trend. Given the anticipated development
activity in the City at this time, staff would revise the building permit revenue estimate down from
$500,000 to $250,000.
Revisions to expenses by $250,000 in the general fund would be achieved by the following:
· Not filling the 2008 budgeted position shared by Human Resources and Fire. Salary
and benefits total $53,456
· Not filling the vacant Assistant City Engineer Position. Salary and benefits total
$90,828.
· Reducing the Building inspections staff by one person. Salary and benefits total
$67,300.

INTRODUCTION
Council awarded the Flagstaff Avenue Utility and Street Project at the August 6, 2007, City
Council meeting.
DISCUSSION
This change order includes eight changes on the Flagstaff Avenue Utility and Street Project.
Item one is included to pay for an additional shut-off valve that was added so that the watermain
could be tested. It will also be used for future flushing of the line. Item two was added to
address a spring that was encountered in the roadway toward the north end of the project. Items
three and four were added to provide guidance for traffic traveling through the project.
Items five and six were incorporated into the contract to compensate the contractor for additional
work and overtime necessary to get the utilities installed up to the south entrance of the high
school by a target date of May 26th. This also includes completing the roadway to a point that
traffic can access the high school from Highway 50.
Item seven is included to compensate the contractor for additional work necessary to support the
gas line that runs parallel to Flagstaff A venue that provides gas service to the high school.
Supporting the gas line will be necessary when installing sanitary sewer stubs north of the high
school site.
The final item is a price reduction for Class 5 material that was placed on the project. While the
material placed on the project did fall within an acceptable size range for road base construction,
it did not meet the requirements for 100% pay. The contractor will receive 89% pay for this
material in accordance with MnDOT specifications.
This change order has been reviewed with the school district, and they have given their
concurrence with the changes.

SUBJECT: Amend Ordinance - City Boulevard Trees
DATE: May 5, 2008
INTRODUCTION
At the February 4, 2008 City Council meeting, the Council recommended that City staff review
the Boulevard Tree Ordinance (Exhibit A) with utility companies that serve Farmington in order
to determine if the proposed ordinance would be compatible with the utility companies' needs.
The Planning Commission recommended approval of the ordinance revisions on September 11,
2007 with a 5-0 vote.
DISCUSSION
City staff met with utility companies (Dakota Electric, Xcel Energy, MERC, and Frontier
Communications) on March 26,2008 to discuss the width of drainage and utility easements and
determine where Lot Frontage Trees should be located in the front yards of new subdivisions.
The staff and utility companies determined the following:
1. The front yard drainage and utility easement will remain as a 10- foot wide easement.
2. Lot Frontage Trees need to be installed in the front yard within the 10-foot wide
drainage and utility easement at 8 feet from the property line.
3. Lot Frontage Trees may be installed within the lO-foot drainage and utility easement
in the front yard of new subdivisions, but not within the side yard 5-foot wide
drainage and utility easements.
4. The owner of any lot of record existing on the effective date may replace a dead
boulevard tree with a new tree planted on the boulevard, but the tree should not be
located within 10 feet of any water or sewer line and 2 feet from any other
underground utility.

5. The owner of any lot that is not a part of the lot of record existing on the effective
date may replace a boulevard tree with a lot frontage tree at 8 feet from the property
line in the front yard drainage and utility easement, and outside of the side yard
drainage and utility easements.
The utility companies reviewed the Boulevard Tree and Drainage and Utility Easement
Ordinances and approved them as shown on the attached emails (Exhibit B).
The following list identifies revisions to the Boulevard Tree Ordinance that was presented to the
City Council on February 4, 2008. The revisions are detailed in bold below (as well as on
Exhibit A).
LOT FRONTAGE TREES
The Lot Frontage Trees language will now identify the trees developers in new developments
must propose' on the required landscape plan and install within the front yard of lots rather than
on the boulevard as was typical practice in the past. The lot frontage trees shall be installed on
private property in the front yard at a minimum spacing of one tree for every forty feet (40') of
lot frontage or one tree per lot if 40 feet is not feasible and eight feet (8') from the front property
line and shall be installed in a parallel line to the front lot line.
UTILITIES
(d) Utilities: No lot frontage tree, boulevard tree, or replacement tree may be planted within ten
(10') lateral feet of any underground water line or sewer line (sanitary or storm) and two feet
(2') from any other underground utility. Gopher State One shall be called to request locations
of utilities.
BOULEVARD TREES
Boulevard trees will continue to include the existing trees in boulevards throughout the City as
well as trees proposed by developers on the required landscape plan and installed by them in new
developments along City approved Boulevard Tree Routes as identified on Exhibit C.
REPLACEMENT OF TREES
The replacement of trees is proposed as follows:
(1) The City shall be responsible for removing existing boulevard trees that have died or
sustained severe damage. The City shall replace trees on designated Boulevard Tree Routes.
(2) The owner of any lot of record existing: on the effective date (original adoption date) mav. at
his or her own risk. replace a dead boulevard tree with a new tree to be planted on the boulevard.

from the property line in front yard drainage and utility easements.
RESPONSIBILITY OF TREES
The responsibility of trees is proposed as follows:
(1) The natural resources division will inspect and trim Boulevard Trees.
(2) The homeowner shall be responsible for trimming Lot Frontage Trees or any other tree on
private property.
At the February 4, 2008 City Council meeting, staff discussed the need to continue the
Reforestation Advisory Commission since the City employs a Natural Resource Specialist to
care for and manage the community's trees; and therefore, could replace the tree board. The
Planning Commission recommended that as long as a tree specialist is on staff at the City, they
would be in favor of recommending repealing the Reforestation Advisory Commission.
ACTION REQUESTED
Amend the ordinance in Sections 10-2-1, 10-6-10 (F), 10-6-10 (G), and 8-1-5 (A) of the City
Code concerning Replacement Trees, Lot Frontage Trees and Boulevard Trees and direct staff
concerning the continuation or deletion of the Reforestation Advisory Commission.

THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. The City of Farmington City Code, Section 10-2-1, Definitions is
amended by adding the underlined language and deleting the striketlKough language as
follows:
BOULEVARD TREE ROUTE: City designated route that includes maiar collector
streets on the City's Thoroughfare Plan that are allowed to be planted with boulevard
trees within the right-of-way.
STREET BOULEV ARD TREES: Trees on land lying between the edge of curb and the
property line within the city or located in new developments on City approved Boulevard
Tree Routes.
CITY BOULEV ARD: Area between property lines on either side of all streets, avenues,
or ways within the city.
LOT FRONTAGE TREES: Trees installed on private property in the front yards of new
developments by the developer per the Development Contract.
SECTION 2. Section 10-6-10, Landscaping is amended by adding the underlined
language and deleting the striketlKough language as follows:
10-6-10: LANDSCAPING:
(F) Street Tree Lot Frontage Tree and Boulevard Tree Species To Be Planted:
1. Official Street Lot Frontage Trees and Boulevard Trees: The following list
constitutes the official 5tfeet lot frontage tree and boulevard tree species for
Farmington, Minnesota. No species other than those included in this list may be

planted as street lot frontage trees and boulevard trees without written permission of
the natural resources division. (Ord. 002-469,2-19-2002; amd. Ord. 006-563, 9-18-
2006)
(a). Landscape Plan: Developers of new developments must submit a landscape
plan to the planning division. The planning division will be responsible for
approving appropriate lot frontage and boulevard tree plantings. The lot frontage
trees are required in the front vards of lots in new developments. Boulevard trees
in new developments shall onlv be installed on City approved Boulevard Tree
Routes. The only exception would be if an agreement is made with a homeowners
association or other such organization where the responsibility to maintain the
trees is that of the named organization in perpetuity.

trails. or pavement shall be no closer than four feet (4').
(c) Distance From Street Corners And Fire~ Hydrants: No 5treet lot frontage
tree. boulevard tree. replacement tree. landscape material or fences shall be located
within the triangle of visibility, which is the area within a triangle created by
measuring from a point on the curb or edge of the street closest to the center of the
intersection, down the front curb lines or edge or intersecting streets thirty feet
(30'), and connecting their end points with a straight line. No 5treet lot frontage
tree. boulevard tree. or replacement tree shall be planted closer than ten feet (10')
from any fireplug.
(d) Utilities: No 5treet lot frontage tree. boulevard tree. or replacement tree may be
planted within ten (10') lateral feet of any underground water line or sewer line
overhead or undergronnd transmission line or other utility (sanitarv or storm)
and two feet (2') from any other undere:round utility. Gopher State One shall

SECTION 3. The City of Farmington City Code, Section 10-6-10 (G), Tree
Maintenance on City Boulevards, is amended by adding the underlined language and
deleting the strikethrough language as follows:
10-6-10 (G) Tree Maintenance OR City Bou.levards:
1. The natural resources program is designed to prescribe various levels of
maintenance to city boulevard trees located within city ovmed boulevards.

(a) Planting Requirements: The natural resources division will review all planting
of trees and shrubs within "city boulevards", defined as the area between property
lines on either side of all streets, avenues, or ways within the city.
b) Landscape Plan: Developers of subdivisions must submit a landscape plan to the
planning diyision. The planning division \-yill be responsible for appro'.'ing
appropriate tree plantings vii thin city boulevards.

addition to the tree plan must receive prior appro'/al from the natural resources

responsible for all trimming of boulevard trees. As these trees are on city
property, and are essentially and legally city property, they must be maintained
by the city to ensure that they are properly trimmed for structural integrity and
disease control measures.
w @ Contact Responsibility of Trees: Residents '..vill need to contact the natural
resources diyision when a boulevard tree needs trimming or inspection.
(1 ) The City will inspect and trim boulevard trees.
(2) The homeowner shall be responsible for trimming lot frontage trees or any
other tree on private property.
fB W Height Standards: Trimming height standards must maintain a ten foot (10')
clearance above any walkway and fourteen feet (14') above the roadway. These

requirements provide clearance for walkers, snow removal equipment and solid
waste vehicles.
fgj ill Brush From Pruning: The ci,ty will not collect any brush resulting from
pruning or removal oftrees or brush from private property.
W {g} Emergency Collection Of Brush: An emergency brush situation would
occur when the public safety officer declares one to exist. Then and only then will
the city collect brush generated by residents on private property, as a onetime
emergency servIce.
SECTION 4. The City of Farmington City Code, Section 8-1-5, Boulevards; Allowable
Uses, is amended by adding the underlined language and deleting the strikethrough
language as follows:
8-1-5: BOULEVARDS; ALLOWABLE USES:
(A) No person shall install any structure or improvement or plant any materials in the city
boulevard except at the person's own risk as follows:
1. Street Boulevard trees as allowed on any lot of record existing on the effective date
(original adoption date) under section 2 9 11 and subsections 10-6-1 O(F) and (G) of
this code;
SECTION 5. Effective Date. This ordinance shall be effective upon its passage and
publication according to law.

The City is continuing to propose revisions to its Boulevard Tree Policy on all new subdivisions constructed in the
community as of April 2008. As you recall, we had correspondence with you in August-October in 2007 about our
proposed revisions. The City is continuing to propose that trees will no longer be allowed to be installed within the
boulevard between the curb and sidewalk/trails. At that time, we proposed that these trees be installed at 11 feet
from the property line, outside of the 10 foot wide front yard drainage and utility easement.
However, the City would like to revise this portion of the proposal to state that "trees may be planted in new
subdivisions at 8 feet from the property line", which would mean that the drainage and utility easement in the front
yard would be reduced to 5 feet in width. (Please see attached drawing), Proposed language:

City staff is proposing to revise Section 10-2-1 concerning Definitions and Sections 11-4-4 (A) &

DISCUSSION

amendment on October 16, 2006. The approved amendment proposed to include additional
language that would not allow the rerouting of drainage onto adjacent property, eliminate grade
changes within the easement by meeting the as-built certificate for the lot, and that any
improvements that encroach into the easements are at the owner's own risk.
During the summer and fall of 2007, staff proposed revisions to the drainage and utility
easements along side and rear yards concerning the elimination of all structures, landscape
material, and impervious surfaces within these easements because the Building Inspections and
Engineering Divisions continue to witness a rise in drainage problems within drainage and utility
easements. There have been a number of problems in the field with the enforcement of this 2006
code due to the vagueness of the requirements. The text stating "No plant material/impervious
surface is allowed to encroach within the easement that will negatively affect the drainage
within the easement" and "inhibit the access to the easement" continues to be an interpretation
problem for the building and engineering inspectors in the field. The "negatively affect" and
"inhibit" language is an interpretation problem because at times landscaped rock with edging
within an easement will meet the code requirements, while this type of landscaping within an
easement elsewhere in the same subdivision will affect the drainage negatively. This becomes
an issue in the field since one homeowner is allowed the landscaping and one is not, thereby,

raising concerns from homeowners of either claiming bias by the inspector or by the homeowner
refusing to abide by the code because another homeowner has been allowed landscaping that
they are not.
Additionally, residents often confront staff regarding plant material located in their easements,
and they typically refer to the "negatively affect" or "inhibit" language when disagreeing with
staff concerning the drainage problems witnessed by staff. Most residents don't see problems
with removing plant material if it inhibits access to the drainage and utility easements because
they feel that the City won't need to access the easements, if ever. Others question how a tree
with one-trunk would negatively affect drainage. Exhibit B and C are photos of a recent
situation in Mystic Meadows. The homeowner has been notified that the pavers and steps need
to be removed from the easement on Exhibit B, however, they don't agree with the need to
remove the rock and mulch within the easement. On Exhibit C, once again the homeowner
doesn't see the drainage problems with the location of the rock, mulch, and easy removal of the
pavers if the City needs to access the easement. On both Exhibits B and C, the engineering
division is concerned about drainage issues because the homeowner installed the mulch, rock,
and pavers above the as-built grade, thereby, rerouting water onto the adjacent property owner's
lot. When the lots on either side of homeowner's property develop, those new homeowners will
need to cut a swale 5-10 feet from their property lines in order to provide a swale that will drain.
This is unfair to the new homeowners moving in next to an established homeowner's lot because
the new owners need to take all of the runoff, including the established homeowner's runoff into
a swale located on the new homeowner's lots.
Since staff wants to treat all residents on an equal level the Planning Division is requesting that
the City Council review the proposed easement revisions (Exhibit A) and discuss the merits of
excluding all types of structures, landscape material, and impervious surface with the exception
of sod and fences within the front, side or rear yard drainage and utility easements. Definitions of
the proposed excluded material are shown below.
10-2-1: DEFINITIONS:
STRUCTURE: Anything constructed or erected, the use of which requires a fixed
location on the ground or an attachment to something having a fixed location on the
ground, including but not limited to buildings, billboards, carports, porches, signs,
retaining walls, and other building features, but not including sidewalks, drives,
fences and patios.
LANDSCAPE MATERIAL: Such living material as trees, shrubs, ground cover/vines, turf
grasses (sod), and nonliving material such as: rocks, pebbles, sand, bark, mulch, brick
pavers and earthen mounds (excluding pavement); and/or other items of a decorative
or embellishment nature such as: fountains, pools, walls, fencing, sculpture, etc.
IMPERVIOUS SURFACE: A surface that has been compacted or covered with a layer of
material so that it is highly resistant to infiltration by water. It includes surfaces such
as compacted sand, limerock, or clay, as well as most conventionally surfaced streets,
roofs, sidewalks, parking lots, and other similar structures.

THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. The City of Farmington City Code, 10-2-1 Definitions is amended by
adding the underlined language and deleting the strikethrough language as follows:
LANDSCAPE MATERIAL: Such living material as trees, shrubs, ground cover/vines,
turf grasses (sod), and nonliving material such as: rocks, pebbles, sand, bark, mulch,
brick pavers and earthen mounds (exeluding pavement); and/or other items of a

etc.
SECTION 2. The City of Farmington City Code, 11-4-4 (A) Width And Location, is
amended by adding the underlined language and deleting the strikethrough language as
follows:
An easement for draina2e and utilities at least ten feet (10') wide shall be
provided in the front and rear yard. An easement for draina2e and utilities at
least five feet (5') wide on either side of an abuttin2 property line shall be
provided in the side yards. If necessary for the extension of water main or sewer
lines or similar utilities, easements of greater width may be required along lot lines or
across lots.
SECTION 3. The City of Farmington City Code, 11-4-4 (D) Drainage and Utility
Easements, is amended by adding the underlined language and deleting the strikethrough
language as follows:
No structures, elc'lated landsca~ material, or impervious surfaces, with the
exception of turf grasses, are allowed within a property line front, side or rear vard
drainage and utility easement with the exception of fences installed on the property
line and lot fronta2e trees placed ei2ht feet (8') behind the property line in front
yard draina2e and utility easements. No plant material/impervious surface is
allowed to encroach ',vithin the easement that will negatiyely affect the drainage
within the easement, reroute the drainage onto adjaeent properties, or inhibit the
