October 24, 2006
1. CALL TO ORDER-Chairperson Preece called the meeting to order at 7:00 p.m.

6. UNFINISHED BUSINESS
a.) Heritage Landmark Designation Project -The reports for the six landmark
nominations are complete and have been forwarded to the State for review. The next
step is to take them to the City Council for a public hearing and designation. Written
comments were presented to the HPC from the property owners to be added to the
reports. Comments were received from The Flynn's at 320 Walnut and Loren Schulz
at 500 Spruce Street. Renae Auge will also be forwarding comments on her property
at 409 Spruce Street. Consultant Vogel suggested taking the designations to Council
two at a time.
Mr. Schulz asked for clarification as to what the designation means. Mr. Vogel
explained that it is a type of overlay zoning. The designated properties are indicated
on the official zoning map. Mr. Vogel explained the intent of the designation is a
regulatory function to make sure the properties do not disappear. By identifying the
properties on the zoning map it serves as a type of reminder and forces the City
Council to take the property into consideration. To date there is no financial benefit in
Minnesota other than a potential increase in resale value. The possibility of a 20%
State income tax credit has been discussed at the State, but it has yet to pass in the
legislature.
Member Burke asked if the designations would result in implications for adjacent
properties. Consultant Vogel stated that "no" there are not implications for adjacent
property owners. However, the designation does not relieve the property owner from
other zoning restrictions but rather gives the building official more flexibility. For
example: window size may be within a few inches of the code and the Building
Official may approve it so as not to disrupt the integrity of the building.
Mr. Bolduc asked if the line of sight from a designated property was affected. He was
concerned about the building across from them getting tom down and what may be
put in its place. Mr. Vogel stated that establishing a conservancy district would be a
good tool in managing this, especially new construction. Mr. Vogel gave the example
of how the City of Edina regulates the replacement of buildings with in their
conservancy district. However, lot coverage and setbacks are no different for
designated properties.
Mr. Bolduc asked what the benefit would be to him for designating his property and if
the designation was documented at the State level. Mr. Vogel explained that the
designation itself and the prestige and distinction it brings are the primary benefits.
Mr. Vogel explained that the designations are documented at the State level as part of
the City's Certified Local Government (CLG) status. As a CLG, the City works under
the guidelines of the National Parks Service on preservation. Mr. Schulz asked if the
local designation automatically puts a property on the National Register. Mr. Vogel
stated that the National registration is another application process that could be done
in the future.
Mr. Bolduc asked ifthere is a way to pinpoint the exact date his property was built.
Consultant Vogel replied that before 1930 there were no legal instruments such as an
abstract to pinpoint exact dates. So based on what is know the Bolduc House for
example, was built sometime in the 1870's.
Mr. Schulz stated even though he appreciated the house being designated "The
Schulz House" he felt it would be more appropriate if it were designated the "Duff-
Betzold House" based on its history.
It was determined that the HPC would recommend the designation go to the City
Council for a public hearing. As part ofthe public hearing process, written
notification will be sent to surrounding property owners in advance of the public
hearing per ordinance. It was determined that the HPC would bring the designations
to the City Council two at a time. The schedule is as follows:
December 4 City Council Meeting
500 Spruce Street and 520 Oak Street
January 16 City Council Meeting
409 Spruce Street and 509 Oak Street
*May 21 City Council Meeting 320 Walnut and 421 Spruce Street
*The HPC decided to designate two in May because May is Preservation Month and
one of the homeowners resides in out of state in the winter.
MOTION by Burke, second by Stewart to bring the designations to the City Council
two at a time at three public hearings. APIF, MOTION CARRIED.
7. NEW BUSINESS
a.) Historic Conservation Overlay district - City Planners Lee Smick and Tony
Wippler presented two options to the HPC on how to create a Historic Conservation
District.
1) To define a 250 ft radius viewshed of the designated property.
2) The overlay district would be defined by streets to encompass all the designated
properties.
Both options would require "buy in" from all the properties within the area defined.
This would mean that any of the properties making changes would require HPC
review. Mr. Vogel suggested that the HPC should start with the properties that have
been designated that the HPC keep it simple and not make it harder than regular
zoning. This could be done by limiting HPC review to demolition of surrounding
properties and the building of any new buildings vs. regulating all changes to existing
buildings. The presumption being, that people buy into a neighborhood because they
like the style of the neighborhood. Planner Smick stated that the zoning for the
proposed area is RT and RD, which allows for a 4-plex such as a Centex town home
to be built as well as single family homes. Mr. Vogel added that with the
Conservation Overlay District if a property owner wanted to build they would be
required to follow the architectural guidelines set for the district.
City Planner Smick indicated that it would be better to start smaller with the overlay
district, noting that the district could eventually become larger. Education will be an
issue and there would need to be neighborhood meetings. The district would become
part ofthe Comprehensive Plan. The HPC directed staffto pursue a combination of
the viewshed and overlay options: a smaller version of the overlay option surrounding
the designated properties. Mr. Bolduc asked what they could do as residents. Ms.
Smick explained that they could help by showing their support. Member Samualson
suggested making the street signs identifiable to the district.
b.) Feely Elevator Discussion - The HPC directed staffto write a letter to the Feely
family to see if they are interested in designation of the elevator and possibly a reuse
study done on it. Mr. Vogel suggested that the HPC tour the elevator.
c.) State Preservation Conference Review - The State Preservation Conference was
held in Red Wing from September 27-29,2006. Member Preece, Administrative
Services Director Shadick and Mr. Vogel gave the commission a review of the
Conference.
8. MISCELLANEOUS
Mr. Vogel reported that the monitoring of the grading done near the Historic Middle
Creek Cemetery was completed without any concerns
The HPC decided to look at long range planning and how Mr. Vogel's time can be used
efficiently at the next HPC meeting on January 23,2007.
Mr. Vogel suggested the HPC look at the possibilities of a student member to the HPc. If
a student member is added the ordinance will have to be amended. Member Samuelson
suggested a son or daughter of a Rotary member.

(F) Guidelines for New Detached Garages
A. In reviewing applications for Certificates of Appropriateness for new detached
garages in the HPOD, the Heritage Preservation Commission will apply the
following design guidelines:
(1) No new detached garage should be taller, longer, or wider than the
house on the same lot.
(2) No new detached garage should have a roofline taller than that of
adjacent homes.
(3) Undecorated side walls longer than 16 feet should be avoided
whenever possible. ....
