Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty,Bjorge,Franceschelli, Kuyper, Tesky Members Absent: None Also Present: Tony Wippler,Planning Manager a. Election of Officers MOTION by Franceschelli, second by Kuyper to nominate Dirk Rotty as Chair. APIF, MOTION CARRIED. MOTION by Kuyper,second by Bjorge to nominate John Franceschelli as Vice-Chair. APIF,MOTION CARRIED. b. Appointment to Committees Member Bjorge will serve on the Empire/Farmington Planning Advisory Committee. Member Franceschelli will serve on the Castle Rock Discussion Group. Member Kuyper will serve on the Eureka/Farmington Planning Group. Members Kuyper and Tesky will serve on the MUSA Review Committee. MOTION by Franceschelli, second by Bjorge to approve the above appointments. APIF,MOTION CARRIED. 2. Approval of Minutes a. Approve Planning Commission Minutes MOTON by Franceschelli, second by Kuyper to approve the minutes of January 9, 2018. Voting for: Rotty,Franceschelli,Kuyper. Abstain: Bjorge,Tesky. MOTION CARRIED. 3. Discussion a. Draft Ordinances Regarding Kennels The commission discussed the current kennel ordinance in November 2017. A dog daycare business would like to move into the Farmington Mall. Currently,more than three dogs require a kennel license and are only allowed in the agricultural district. Staff has revised the current ordinance, amending Title 6,Chapters 2 and 3. The change in Chapter 2 includes specifying that a conditional use permit along with a license is required in order to operate a commercial kennel and residential hobby kennel. Changes to Chapter 3 include several changes and staff reviewed them in detail. The second ordinance amends the zoning districts listing residential hobby kennels and commercial kennels as conditional uses. This affects the A-1 (Agricultural), B-1 (Highway Business),B-3 (Heavy Business),IP (Industrial Park)and I-1 (Industrial)districts. Planning Commission Minutes February 13,2018 Page 2 The business owner asked about the 4 foot fencing and the 3 foot buffer around the outside. He asked if the fence were higher,would that eliminate the vegetation buffer. Staff replied yes,if the fence is higher and fully screened. The owner was considering a 6 foot vinyl,fully enclosed fence. Members felt this is an opportunity to bring in a new business and to meet a need in the community. A member asked about the residential hobby kennel and the steps for enforcement. Staff stated a conditional use permit and license is required. Both would be revoked and,if necessary,remove the dogs. Staff noted this is still only allowed in the agricultural district. A member asked if the entire ordinance is complaint based. Staff agreed it would be mainly complaint based. The license is for one year so upon renewal would be a good time to do an inspection. Members had no problem with the ordinances. They will be brought back to the Planning Commission in March for a public hearing. The business owner asked about the sound proofing and how that will be defined. Staff will research this item. 4.
