Flagstaff Avenue Development Administrator McKnight reviewed potential development along Flagstaff Avenue and the settlement agreement between the city and school district related to the building of Farmington High School in 2006. The city council was in support of the administrator meeting with the superintendent to continue to work on the issues related to the settlement agreement. City Administrator Update Administrator McKnight updated the city council on discussion occurring about the Dakota Communications Center and its governance. The DCC Executive Committee and Board of Directors are looking at possible changes to the organizational structure of the entity. The city council was in support of these continued discussions. Petitions, Requests and Communications a) Donations for the Park Naming Contest Parks and Recreation Director Distad shared that the city is conducting a park naming contest to name the new park in Regetta Fields. The Park and Recreation Advisory Commission is leading the effort. Commission member Laurie Suchanek volunteered to solicit prizes from local businesses. The following businesses donated to this project: Nesbit Agency, Pizza Man, Premier Bank, Family Vision Clinic, Longbranch Saloon and Eatery, Farmington Tap House, Dakota Electric and the City of Farmington. The city council will approve the selected name at the March 19, 2018 meeting. Councilmember Bernhjelm thanked the businesses for donating to this project. Motion by Bernhjelm, second by Craig,to adopted resolution R10-2018 accepting the prizes donated by Farmington businesses for the park naming contest and authorized the use of a Schmitz-Maki Arena open skate ten punch card as one of the prices for the contest. Bernhjelm-Shared her excitement for the partnership opportunities that exist in the community for businesses and the city. Malecha-Shared that the bills that were approved tonight included the payoff of three bond series. Distad-Reminded residents that the outdoor ice season is scheduled to end on February 25, 2018. APIF, motion carried. Architectural Service Proposal for Build Out of City Hall USDA Space Parks and Recreation Director Distad presented a proposal from Wold Architects and Engineers to provide design services, prepare construction and bid documents and provide construction management of the build out of the space to be leased to the USDA. City staff solicited a bid from Wold for a number of reasons including the fact that they originally designed city hall. Councilmember Craig asked if this company has a history of competitive bidding. Distad responded they did. Distad reviewed the estimated cost of the contract. Wold is proposing their fee to be 7.5%of construction costs which is estimated to be$7,125. There will also be approximately$500 in reimbursable expenses as well. The city council was in support of working with Wold. This item will be brought to the March 5, 2018 city council meeting for consideration. Outdoor Pool Demolition Update Parks and Recreation Director Distad updated the city council on the progress of the city pool demolition. To date the following steps have been taken: February 26,2018 Work Session Minutes -1- ✓ Asbestos testing in the bathhouse building and filtration room has been completed and no asbestos has been found. ✓ Preparation of the outdoor pool demolition specifications were completed through a team effort of city staff members. ✓ Specifications identify that demolition is requested to be completed between April 1st and June 1st ✓ Demolition specifications were mailed directly to eight contractors experienced in demolition with some of the contractors having prior experience with pool demolition. ✓ Demolition specifications were placed on the city website. ✓ Notification was sent out via the city's website to the subscribers of the e-notification tool on the city's website. ✓ A pre-bid meeting was held at the outdoor pool on Friday, February 16, 2018 and three contractors attended this meeting. Quotes for the pool demolition are due on or before Friday, March 2, 2018. The awarding of the bid will be placed on the March 19, 2018 city council agenda. City staff is proposing to save the bathhouse portion of the building to be used as a restroom for the park and shelter. Councilmembers had questions on how the maintenance of the bathhouse will occur and other minor issues. The city council thanked Distad for his work on this project. Updates to Mission Statement,Tag Line and Logo Human Resources Director Wendlandt and Communications Specialist Siebenaler presented information on the city's current mission statement, tag line and logo. Siebenaler shared a history of the development of the current mission statement and reviewed recent trends of other cities on their mission statements. In addition a number of other city taglines and recently updated logos were reviewed. The city council discussed the pros and cons of mission statements, logos and tag lines. The city council directed staff to work on potential logo ideas to bring back to the city council for consideration. If a tag line fits into the new logo at this time that would also be considered. The city council was not interested in a mission statement at this time. Accessory Dwelling Unit/Tiny Homes Discussion Community Development Director Kienberger and Planning Manager Wippler presented information on accessory dwelling units and tiny homes. There is currently a growing trend for tiny home living. February 26, 2018 Work Session Minutes -2- Wippler updated the city council on a number of issues including current rules and examples of accessory dwelling units,the advantages and disadvantages of accessory dwelling units, information on tiny homes, how the Minnesota building code plays into these issues and a number of additional issues to consider. The city council held a lengthy discussion on this issue, how it is/could impact Farmington and potential ways to approach the issue. The city council had questions on how this issue is being handled both regionally and nationally. The consensus of the city council was to have city staff perform additional research, including specific city examples, on accessory dwelling units, tiny homes and the Air BNB issues. City staff will bring this issue back for additional discussions when the research is complete. City Administrator Update Administrator McKnight updated the city council on the following items: ✓ Current status of the cleaning of city facilities and potentially moving away from contracted help to a city staff position performing these duties. ✓ Updated the city council on a residents concerns with snow plowing. Lindquist, Police Chief SUBJECT: Adopt a Resolution Declaring Surplus Property and Authorize the Sale of Surplus Property-Police DATE: March 12, 2018 INTRODUCTION In accordance with Minnesota State Statute 16A.695, a public officer or agency shall not sell any state bond financed property unless the public officer or agency determines by official action that the property is no longer usable or needed by the public officer or agency to carry out the governmental program for which it was acquired or constructed, the sale is made as authorized by law, the sale is made for fair market value, and the sale is approved. DISCUSSION The police department has a piece of equipment that has reached or passed the expected life expectancy or is no longer in working condition: • Matrix Rowing Machine, circa 2001 and purchased used in 2016 This item will be replaced by new Elliptical stair climber. BUDGET IMPACT All items will be offered up for sale on the public auction site, www.govdeals.com All proceeds will be returned to the general fund. ACTION REQUESTED Adopt the resolution declaring surplus property in the police department and authorizing the sale of this equipment. R 1 1 -18 DECLARING SURPLUS PROPERTY IN POLICE DEPARTMENT Pursuant to due call and notice thereof, a regular meeting of the City Council of Farmington, Minnesota, was held in the Council Chambers of said city on the 12th day of March, 2018 at 7:00 p.m. Members Present: Larson, Bernhjelm, Craig, Donnelly Members Absent: Bartholomay Member Craig and Member Donnelly introduced and seconded the following resolution: WHEREAS, the Police Department has recommended that the matrix rowing machine be declared surplus; and WHEREAS,the city has an opportunity to offer surplus items for sale through an online public auction at GovDeals.com. NOW, THEREFORE, BE IT RESOLVED, that the city of Farmington hereby declares the matrix rowing machine as surplus equipment and authorizes the City Administrator and/or his designee to sell and/or dispose of said equipment. DISCUSSION In December 2017, the city council approved a joint powers agreement with the cities of Lakeville and Elko New Market that established a regional safety group (RS G)in order to provide a cost effective yet enhanced safety program for our employees. The RSG sent out request for proposals for a safety consultant to provide safety training and safety program support for each city's safety objectives. Those objectives include developing and maintaining safety programs oriented to municipal and employee needs;providing a safe and healthy workplace for employees;providing training that is tailored to our needs,meets the requirement of OSHA and MN OSHA and is delivered in close proximity to our work sites; and increases safety awareness among employees. After receiving the proposals and meeting with potential consultants,the RS G agreed to recommend that the contract be awarded to Midwest Safety Counselors, Inc. Per the joint powers agreement,the city needs to provide approval to the city of Lakeville, as lead agency, to award the contract to Midwest Safety Counselors, Inc. Attached is a copy of the professional services agreement and a copy of the proposal tabulation. BUDGET IMPACT The city's share of the cost is per year is $6080.00. Under this agreement, the city could, if necessary, purchase additional services at a per hour rate of$95.00. The costs for the safety program are provided for in the 2018 budget. ACTION REQUESTED By motion, give approval to the city of Lakeville, as lead agency for the RSG, to award the contract for safety consultation services to Midwest Safety Counselors, Inc. ATTACHMENTS: Type Description Professional Services Agreement-Safety ❑ Backup Material Consultant ❑ Backup Material Proposal Tabulation- Safety Consultants PROFESSIONAL SERVICES AGREEMENT AGREEMENT made this 5th day of March 2018,by and between the City of Lakeville,a Minnesota municipal corporation ("City") and Midwest Safety Counselors,Inc., a Minnesota corporation ("Consultant"). IN CONSIDERATION OF THEIR MUTUAL COVENANTS THE PARTIES AGREE AS FOLLOWS: 1. SCOPE OF SERVICES. The City retains Consultant to furnish the services set forth in the Contract Documents, to provide safety training and program support for a Regional Safety Group. The Consultant agrees to perform the services. 2. CONTRACT DOCUMENTS. The following documents shall be referred to as the "Contract Documents,"all of which shall be taken together as a whole as the contract between the parties as if they were set verbatim and in full herein: A. This Professional Services Agreement. B. The Request for Proposals for Safety Training and Program Support C. Consultant's proposal. In the event of conflict among the provisions of the Contract Documents, the order in which they are listed above shall control in resolving any such conflicts with Contract Document"A" has the first priority and Contract Document"C"having the last priority. 3. COMPENSATION. Consultant shall be paid by the members of the Regional Safety Group for the services described in Contract Documents based on amounts provided in the Consultant's proposal,inclusive of reimbursables,taxes and other charges. Fees shall not be adjusted if the estimated hours to perform a task, the number of estimated required meetings or any other estimate or assumption is exceeded. Consultant will invoice each member City for their share of the costs for services rendered on a monthly basis. The monthly invoices from Consultant shall identify work completed. 4. CHANGE ORDERS. All change orders,regardless of amount,must be approved in advance and in writing by the City. No payment will be due or made for work done in advance of such approval. 5. DOCUMENTS. The City shall be the owner of all documents, reports, studies, analysis and the like prepared by the Consultant in conjunction with this contract. 6. STANDARD OF CARE. Consultant shall exercise the same degree of care, skill, and diligence in the performance of the services as is ordinarily possessed and exercised by members of the profession under similar circumstances in Dakota County, Minnesota. Consultant shall be liable to the fullest extent permitted under applicable law, without limitation, for any injuries, loss or damages proximately caused by Consultant's breach of this standard of care.City shall not be responsible for discovering deficiencies in the accuracy of Consultant's services. Consultant shall be responsible for the accuracy of the work and shall promptly make necessary revisions or corrections resulting from errors and omissions on the part of Consultant without additional compensation. 7. COMPLIANCE WITH LAWS AND REGULATIONS. In providing services hereunder, Consultant shall abide by all statutes, ordinances,rules and regulations pertaining to the provisions of services to be provided. 8. INDEMNIFICATION. The Consultant shall indemnify and hold harmless the City, its officers,agents,and employees, of and from any and all claims, demands,actions,causes of action, including costs and attorney's fees, arising out of or by reason of the execution or performance of the work or services provided for herein to the comparative extent they are caused by Consultant's negligent acts or omissions or those negligent acts or omissions of persons for whom Consultant is legally responsible. 9. COPYRIGHT. Consultant shall defend actions or claims charging infringement of any copyright or patent by reason of the use or adoption of any designs, drawings or specifications supplied by them, and they shall hold harmless the City from loss or damage resulting therefrom. 10. INSURANCE. Consultant shall secure and maintain such insurance as will protect Consultant from claims under the Worker's Compensation Acts,automobile liability,and from claims for bodily injury, death, or property damage which may arise from the performance of services under this Agreement. Such insurance shall be written for amounts not less than: Commercial General Liability(or in combination with an umbrella policy) $1,000,000 Each Occurrence $2,000,000 Products/Completed Operations Aggregate $2,000,000 Annual Aggregate The following coverages shall be included: Premises and Operations Bodily Injury and Property Damage Personal and Advertising Injury Blanket Contractual Liability Products and Completed Operations Liability Automobile Liability $1,000,000 Combined Single Limit-Bodily Injury&Property Damage Including Owned, Hired&Non-Owned Automobiles Workers Compensation Workers' Compensation insurance in accordance with the statutory requirements of the State of Minnesota, including Employer's Liability with minimum limits are as follows: • $500,000- Bodily Injury by Disease per employee • $500,000- Bodily Injury by Disease aggregate • $500,000 - Bodily Injury by Accident The Cities shall be named as an additional insured on the general liability and umbrella policies on a primary and non-contributory basis. The Consultant shall secure and maintain a professional liability insurance policy. Said policy shall insure payment of damages for legal liability arising out of the performance of professional services for the City,in the insured's capacity as Consultant,if such legal liability is caused by a negligent act, error or omission of the insured or any person or organization for which the insured is legally liable. The policy shall provide minimum limits of$2,000,000 with a deductible maximum of$125,000 unless the City agrees to a higher deductible. Before commencing work,the Consultant shall provide the City a certificate of insurance evidencing the required insurance coverage in a form acceptable to City. 11. INDEPENDENT CONTRACTOR. The City hereby retains the Consultant as an independent contractor upon the terms and conditions set forth in this Agreement. The Consultant is not an employee of the City and is free to contract with other entities as provided herein. Consultant shall be responsible for selecting the means and methods of performing the work. Consultant shall furnish any and all supplies, equipment, and incidentals necessary for Consultant's performance under this Agreement. City and Consultant agree that Consultant shall not at any time or in any manner represent that Consultant or any of Consultant's agents or employees are in any manner agents or employees of the City. Consultant shall be exclusively responsible under this Agreement for Consultant's own FICA payments,workers compensation payments, unemployment compensation payments, withholding amounts, and/or self- employment taxes if any such payments, amounts, or taxes are required to be paid by law or regulation. 12. SUBCONTRACTORS. Consultant shall not enter into subcontracts for services provided under this Agreement without the express written consent of the City. Consultant shall comply with Minnesota Statute § 471.425. Consultant must pay subcontractor for all undisputed services provided by Subcontractor within ten days of Consultant's receipt of payment from City. Consultant must pay interest of 1.5 percent per month or any part of a month to subcontractor on any undisputed amount not paid on time to subcontractor. The minimum monthly interest penalty payment for an unpaid balance of$100 or more is $10. 13. ASSIGNMENT. Neither party shall assign this Agreement,or any interest arising herein,without the written consent of the other party. 14. WAIVER. Any waiver by either party of a breach of any provisions of this Agreement shall not affect,in any respect,the validity of the remainder of this Agreement. 15. ENTIRE AGREEMENT. The entire agreement of the parties is contained herein. This Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof as well as any previous agreements presently in effect between the parties relating to the subject matter hereof. Any alterations, amendments, deletions, or waivers of the provisions of this Agreement shall be valid only when expressed in writing and duly signed by the parties,unless otherwise provided herein. 16. TERM. This contract shall remain in effect for 24 months from date of award and may be renewed for two additional 12-month terms upon agreement of the Cities and the consultant. 17. CONTROLLING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of Minnesota. 18. RECORDS. The Consultant shall maintain complete and accurate records of time and expense involved in the performance of services. 19. AUDIT DISCLOSURE AND DATA PRACTICES. Any reports,information,data,etc. given to, or prepared or assembled by the Consultant under this Agreement which the City requests to be kept confidential, shall not be made available to any individual or organization without the City's prior written approval. The books, records, documents and accounting procedures and practices of the Consultant or other parties relevant to this Agreement are subject to examination by the City and either the Legislative Auditor or the State Auditor for a period of six (6) years after the effective date of this Agreement. This Agreement is subject to the Minnesota Government Data Practice Act, Minnesota Statutes Chapter 13 (Data Practices Act). All government data,as defined in the Data Practices Act Section 13.02,Subd. 7,which is created, collected, received, stored, used, maintained, or disseminated by Consultant in performing any of the functions of the City during performance of this Agreement is subject to the requirements of the Data Practice Act and Consultant shall comply with those requirements as if it were a government entity. All subcontracts entered into by Consultant in relation to this Agreement shall contain similar Data Practices Act compliance language. CITY OF LAKEVILLE CONSULTANT Midwest Safety Counselors, Inc. DISCUSSION Per State Statute 349.166 and pertinent City Code, a Gambling Event Permit must be issued by the city for this type of event. An application has been received, along with the appropriate fees. The City Attorney has reviewed the application and the attached resolution approving the request. BUDGET IMPACT Gambling fees are included in the revenue portion of the 2018 budget. ACTION REQUESTED Consider the attached resolution granting a Gambling Event Permit to Farmington Travel Baseball, to be held at Celt's Pub & Grill, 200 Third Street, on March 16, 2018.
