1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.
Members Present: Rotty, Bjorge, Franceschelli, Tesky

2. Approval of Minutes
a. MOTON by Bjorge, second by Tesky to approve the minutes of April 10, 2018. Voting
for: Rotty, Bjorge, Tesky. Abstain: Franceschelli. MOTION CARRIED.

a. Conditional Use Permit to Operate a Commercial Kennel in the B-1 Zoning District
—N2 Investments Inc— Continued
This hearing was continuedfrom the April 10, 2018, meeting. The request for a
conditional use permit is to operate a commercial kennel at the Farmington Mall, 915 8111
Street. The business owner was present to answer questions raised at the April meeting.
The owner explained the two main concerns were odor and noise. An average dog bark
is between 80 and 90 decibels at 4 feet away from a dog. This is much lower than other
noises in the area. From the business's backdoor to the resident's back door is 462 feet.
If that space was wide open and the dogs were barking at full volume, by the time the
sound reaches her door it will be at 60 decibels. There is a row of townhomes, garages
and trees between the two properties. By the time any sound would reach the residential
property, it should not be a problem. There are mechanical tools used in the resident's
garage that are 100 decibels. The traffic on Ash Street is 4,000 vehicles a day that are
constantly going by the house. Regarding the odor concern, coffee is placed in the grass
to neutralize the odor. They will be getting free coffee grounds from the coffee shop.
The entire area will be grass and there will be no runoff. Regarding the number of dogs,
the business will have to have as many as possible to be successful;perhaps 32 to 40
dogs on average. Within three years, he hopes to be out of the mall and in his own
building in Farmington.
Members appreciated having an incubator type business in Farmington that planned to
grow and stay within the community.
Approval of the conditional use permit would include four conditions:
1. A kennel license shall be applied for and approved by the city every year that the
proposed use is established at the premises. Said license shall expire on December 31
of each year. Reapplying for a kennel license shall trigger the need for a property
inspection by staff.
2. All standards as outlined in Section 6-3-2(B) of the city code must be met.
3. The applicant shall obtain all necessary building permits that may be required for the
establishment of the proposed use.
4. A sign permit application shall be required for any signage to be placed on site.
MOTION by Franceschelli, second by Bjorge to close the public hearing. APIF,
MOTION CARRIED. MOTION by Franceschelli, second by Tesky to approve the
conditional use permit allowing the operation of a commercial kennel within the B-1
zoning district and on the property located at 915 8th Street with the above conditions.
APIF, MOTION CARRIED.

MOTION by Franceschelli, second by Bj orge to continue this public hearing to the
June 12, 2018, Planning Commission meeting. APIF, MOTION CARRIED.

MOTION by Franceschelli, second by Bjorge to adjourn at 7:15 p.m. APIF, MOTION
CARRIED.

This item was continued from the May 8th regular meeting.
DISCUSSION
Due to revisions for the preliminary plat not yet being complete, the applicant has requested that the public
hearing be continued to the July 10th regular Planning Commission meeting.
ACTION REQUESTED
Continue the public hearing to the regularly scheduled Planning Commission meeting on July 10, 2018.
