New Business a) Proposed 2019 General Fund Budget and Preliminary Tax Levy Administrator McKnight presented the proposed 2019 General Fund Budget and Preliminary Tax Levy for city council consideration. The city council and city staff have developed the draft budget and tax levy at work sessions held on May 14th, June 11th,July 9th and August 13th. These were open meetings and involved discussions on all budgets, capital improvement plans and more. The city must set the preliminary 2019 tax levy by September 30, 2018 and submit this information to Dakota County for inclusion in the Truth in Taxation statements that are sent to residents in November. The city may lower the preliminary levy that is set at the meeting tonight by the time the final levy is approved in December, but it cannot be raised. Some of the most important factors that impacted the 2019 budget and tax levy include: ✓ The use of$240,000 in General Fund balance dollars to reduce the change in the 2019 tax levy. The fund balance has increased from 24.6% in 2010 to 44.9% in 2018. ✓ Debt repayment has reached its peak in 2019. ✓ There are estimated wage and benefit increases included in the 2019 budget. ✓ New positions are included in the budget in the Administration, Fire, Community Development and Building Inspections departments. ✓ The collection of the first debt payment on the 2019 Westview Acres reconstruction project is included in the budget. ✓ Mill and overlay projects are being restarted in 2019. September 4,2018 Minutes -3 - ✓ Overall revenue is stable but building permit revenue is down slightly and fiscal disparities revenue is up from anticipated numbers. Existing debt repayment peaks in 2019 with large amounts of debt being paid in full between 2019-2022. The projected tax rate for the city will be 52.37% in 2019, down from 58.76% in 2017 and 57.161% in 2018. Councilmember Bartholomay echoed the same thoughts and stated we are going in the right direction. Councilmember Bernhjelm was happy to see the preliminary levy under three percent and stated good things are happening financially. Motion by Bartholomay, second by Donnelly,to adopt Resolution R37-2018 establishing the 2019 preliminary tax levy and setting the public input meeting prior to the adoption of the final 2019 budget and tax levy for Monday, December 3, 2018 at 7:00 p.m. APIF, motion carried. 13. City Council Roundtable Donnelly-School is back in session and encouraged everyone to drive safely. Gehler-Reminded residents of the Household Hazardous Waste Collection Event scheduled for Saturday. Bernhjelm-School is back in session, congratulated the new fire lieutenants and encouraged residents to shop local. The agreement identifies the hourly rental rate and the responsibilities of each entity during games. DISCUSSION The attached 2018-2019 ice season agreement has been revised to reflect increased cost of wages and benefits associated with full-time and seasonal city staff members who work during the games. As you can see there is a difference in cost when the Park and Facilities Supervisor attends and works at games. Typically this is limited to games that draw a larger crowd, so attendance does not occur at every game. As a result the hourly game ice rental will increase from$345.00 an hour to $350.00 an hour when the Park and Facilities Supervisor works at a game and will increase from $275.00 an hour to $280.00 an hour when the Park and Facilities Supervisor does not work at a high school game. The attached agreement continues to identify the city and school's responsibilities during games. School staff members have reviewed the agreement and Superintendent Jay Haugen has signed the attached agreement showing the school is accepting the terms and conditions in the agreement, including the increase to the hourly rental rate. Approving the attached agreement is in alignment with a partnership priority the City Council has identified. BUDGET IMPACT The School's rental for high school games provides revenue to the arena. The total revenue received by the city will depend on the number of home games played during the 2017-2018 regular high school season and during high school post season play. ACTION REQUESTED Approve by motion the attached agreement with the School for the rental of the Arena for the Farmington High School boys and girls hockey games during the 2018-2019 season. The School District hereby agrees to pay to the City$345.00 an hour for Farmington High School varsity and junior varsity games when the Park and Facilities Supervisor works during games and$280.00 an hour when the Parks and Facilities Supervisor does not work during games. Since the School District is tax exempt no taxes will be charged. The City agrees to allow the School District to keep 100%of the gross ticket proceeds from Farmington High School hockey games. In consideration of being allowed to use the Schmitz-Maki Arena(Arena), the School District, for itself and each of its members, hereby voluntarily assumes all risks of accident or damage to its property and to any person and property of said members and hereby releases and agrees to defend and indemnify the City, its officers and employees from every claim, liability or demand of any kind for or on account of any personal injury or damage of any kind sustained by it and each one of its members or guests, whether caused by negligence by the City, its officers or employees. The parties agree that the release, defense, and indemnification obligations of this Agreement are intended to be as broad and inclusive as is permitted by the laws of Minnesota. If any portion thereof is held invalid, it is further agreed that the balance shall, notwithstanding, continue in full legal force and effect. Further, the School District agrees that it and its members and guests using the Arena shall abide by all rules and regulations from time to time in effect governing the use thereof. It is understood that the City and the School District each reserves the right (1) to cancel this Agreement for any default by either party in terms of this Agreement and (2)to reschedule the dates or times of permitted use of said facilities on 20 days written notice. In the event of mechanical failure of the Arena's equipment, the School District shall be notified by the Arena staff as soon as possible. The condition of the ice sheet becomes the responsibility of the Arena staff. Prepaid fees for hours canceled due to mechanical failure shall be reimbursed to the School District. The School District shall receive a refund of the amount owed for ice rental when the following conditions apply: 1. When the School District has declared school closed due to inclement weather or other emergency condition, Act of God/Force Majeure. 2. When the Minnesota State High School League curtails all practice times for any reason. All invoices or refunds due to the School District under this Agreement shall be sent directly to the School District's Business Office. The City shall provide and pay for the following: • One (1) scoreboard operator • One(1) announcer • One (1)penalty box gate operator The School District shall provide and pay for the following: • First-aid personnel • Game referees • Goal judges when deemed necessary by the Athletic Director • Admission personnel Concessions are provided by the Farmington Youth Hockey Association (FYHA). Scheduling and concession's staffing will be facilitated by FYHA. The School District agrees to inform both FYHA and the City about any concerns and/or issues it has with concessions. The School District shall be responsible for notifying their opponents of the game schedule and fees set forth by the City for the Arena. DISCUSSION Pursuant to state statute and pertinent city code, an organization must first obtain a resolution from the city, granting permission for gambling to occur at a specific location. The Farmington Firefighters Auxiliary Association is requesting approval to conduct turkey bingo and a raffle at Farmington Fire Station 1, 21625 Denmark Avenue, on November 10, 2018. BUDGET IMPACT They are requesting the $50 investigation fee be waived. ACTION REQUESTED Consider the attached resolution approving a gambling event permit for the Farmington Firefighters Auxiliary Association at 21625 Denmark Avenue on November 10, 2018. DISCUSSION The FAA is in the process of expanding the existing dewatering system at the Air Route Traffic Control Center located at 512 Division Street in order to mitigate high ground water levels impacting the facility. The project will include the installation of a 10" forcemain that is proposed to run from a below ground sump pit on the FAA facility north across Spruce Street and through the east side of property owned by the city(see attached aerial map and survey). The forcemain will then discharge from an existing concrete headwall into the Vermillion River. The proposed forcemain will run parallel to an existing 18" gravity storm pipe. The existing gravity pipe is within a 20' wide easement that was obtained in 1960. The proposed easement that is being requested adds an additional 10 feet of easement along the west side of the existing easement area. The additional easement area provides the necessary coverage for the construction of the forcemain and future maintenance of the storm sewer utilities. The attached easement agreement specifies the terms of the easement including the rights of the city and the FAA to the proposed easement area and a restoration clause. The attached easement agreement has been reviewed by the City Attorney and has been found acceptable. BUDGET IMPACT NA ACTION REQUESTED Authorize the execution of the attached easement agreement between the Federal Aviation Administration and the City of Farmington. PERPETUAL EASEMENT Between UNITED STATES OF AMERICA DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION And CITY OF FARMINGTON,A MINNESOTA MUNICIPAL CORPORATION Easement No.697DCM-18-K-00005 Exclusive Storm Sewer Easement Farmington,Minnesota SECTION 1—OPENING 6.1.1-5 Preamble(JAN 2017) This Deed of Easement("Easement")is entered into by and between CITY OF FARMINGTON,A MINNESOTA MUNICIPAL CORPORATION(hereinafter referred to as the"Grantor(s)"),and the Federal Aviation Administration,an agency of the United States of America(hereinafter referred to as "the Government").The Grantor and the Government are jointly referred to as the "parties." For purposes of this Easement,the term contractor and grantor are interchangeable with each other. 6.1.3-5 Witnesseth(JAN 2017) Purpose(s): The purpose(s)of this Easement is as follows: a permanent easement to construct,reconstruct, and perpetually maintain a private storm sewer system for purposes of expanding the Government owned storm sewer system,to be constructed on and across the Easement Area. Now therefore,for such other goods and valuable considerations,the receipt of which is hereby acknowledged and accepted by the Grantor(s),the Grantor(s)hereby grants and conveys,a permanent easement for storm sewer purposes over,across,on,under,and through lands comprising the Easement Area described in the legal description and appurtenant rights of access to the Easement Area. This Easement shall constitute a servitude upon the land so encumbered; it shall run with the land for the duration of the easement; and it shall bind the Grantor(s),their heirs, successors,assigns,lessees, and any other person claiming under them. Subject,however,to all valid rights of record,if any. 6.1.4-6 Description and Depiction of the Easement Area(JUL 2012) The lands encumbered by this Easement,hereinafter referred to as the"Easement Area", are described in the legal description and depicted in the survey,which are attached hereto and incorporated herein. Together with a right of access for ingress and egress to the Easement Area across adjacent or other properties of the Grantor. Such a right-of-way for access purposes is described in the legal description,which is attached hereto and incorporated herein. Page 1 Easement No. 697DCM-18-K-00005 Exclusive Storm Sewer Easement Farmington,Minnesota SECTION 2—TERMS 6.2.3 Legal Authority(JUL 2012) This Easement is entered into under the authority of 49 U.S.C. 106(1)and(n),which authorize the Administrator of the FAA to enter into contracts, acquisitions of interests in real property,agreements,and other transactions on such terms and conditions as the Administrator determines necessary. 6.2.6-2 Consideration-Perpetual Easement The Government shall pay the Grantor no monetary consideration in the form of rental. It is mutually agreed that the rights extended to the Government herein are in consideration of the obligations assumed by the Government in its establishment,operation and maintenance of facilities upon the premises hereby granted. 6.2.15 Abandonment by Grantee/Right Reversion in Grantor The parties intend the duration of this Easement to be perpetual.However, if the Government abandons the use of the Easement Area for the purposes set forth herein,this Easement shall cease and all rights granted herein shall terminate and revert to the Grantor,or to the Grantor's successors,heirs, or assigns. SECTION 3—GENERAL CLAUSES 3.2.5-1 Officials Not to Benefit(APR 1996) No member of or delegate to Congress,or resident commissioner,shall be admitted to any share or part of this contract, or to any benefit arising from it.However,this clause does not apply to this contract to the extent that this contract is made with a corporation for the corporation's general benefit. 6.3.1 Rights Reserved in the Grantor(JUL 2012) The Grantor reserves the following rights in the Easement Area, subject to the rights,title,and interest of the Government conveyed by this easement: A. Title: Record title,in addition to the Grantor's right to convey,transfer,and otherwise alienate title to these rights reserved. B. Control of Access: The right to prevent trespass and control access by the general public subject to the operation of State and Federal law. C. Subsurface Resources: The right to oil,gas,minerals,and geothermal resources underlying the Easement Area,provided that any drilling or mining activities are to be located outside the boundaries of the Easement Area, and,provided further,that such drilling or mining activities do not endanger or interfere with Government's use of the easement area.In the event that Government determines that Grantor's drilling or mining operations interfere with Government's rights as holder of this Easement, all mining or drilling activities will be expressly prohibited and shall cease immediately. D. Use of the Easement Area for current operations: The Grantor retains the right to continue to use the Easement Area for its current operations. E. Use of the Easement Area for future improvements including,but not limited to: bituminous parking lot, stormwater best management practices,fencing,signage,landscaping and other aesthetic surface improvements Page 2 Easement No. 697DCM-18-K-00005 Exclusive Storm Sewer Easement Farmington,Minnesota 6.3.2 Duties and Obligations of the Grantor Without otherwise limiting the rights of the Government acquired herein,the Grantor shall comply with all terms and conditions of this Easement, including the following: A. Fences:Except for any establishment/construction cost(s)incurred by the Government and replacement cost(s)not due to the Grantor's negligence or malfeasance, all other costs involved in maintenance of fences and similar facilities,excluding livestock, shall be the responsibility of the Grantor. B. Protection of Water Uses and Water Rights: To the extent applicable,or to the extent required by law,the Grantor shall undertake any and all actions necessary to protect any water rights and water uses for easement purposes. C. Taxes:The Grantor shall pay any and all real property and other taxes and assessments which may be levied against the Easement Area,if any. D. Reporting of Adverse Events/Conditions: The Grantor shall report to the Government any conditions or events which may adversely affect the easement area or the Government's use thereof E. Interference with Government Operations on Easement Area: The Grantor agrees not to erect or allow to be erected any building structure of whatsoever kind or nature within the boundaries of the Easement Area that may interfere with the Government's exercise of its rights under this Easement. F. Successors In Interest: The provisions of this easement shall run with the land,and be binding upon,and for the benefit of,the Parties and their heirs,successors and assigns.In the event of any sale or transfer of ownership of the easement area or any portion thereof,the Government will be deemed to have attorned to any purchaser, successor,assign, or transferee. The succeeding owner will be deemed to have assumed all rights and obligations of the Grantor under this easement establishing direct privity of estate and contract between the Government and said succeeding owner,with the same force,effect, and relative priority in time and right as if the easement had initially been entered into between such succeeding owner and the Government. 6.3.4 Rights of the Government(JUL 2012)The rights of the Government include: A. Management of the Easement: The Government may delegate all or part of the management,monitoring,or enforcement responsibilities set forth in this easement to any entity that the Government determines appropriate. B. Termination: This easement may be terminated by the Government in its sole and absolute discretion.In the event of termination of the easement by Government,the Government shall restore and/or rehabilitate the property which is the subject matter of this agreement. The Government shall terminate by delivering to the Grantor a written notice specifying the effective date of the termination. The termination notice will be delivered by registered mail,return receipt requested,and mailed at least thirty(30)days before the effective termination date. C. Title to Improvements: Title to the improvements constructed for use by the Government during the life of this easement,if any, shall be in the name of the Government. D. Such expenses/payments will not exceed appropriations available at the time of the restoration in violation of the Anti-Deficiency Act. 6.3.18-3 Restoration The Government shall surrender possession of the premises upon the date of termination of this Easement Agreement. Nothing in this Easement Agreement may be considered as implying that Congress will, at a later date, appropriate funds sufficient to meet the deficiencies. 6.3.25 Quiet Enjoyment The Grantor warrants that they have good and valid title to the premises,and rights of ingress and egress,and warrants and covenants to defend the Government's use and enjoyment of said premises against third party claims. 6.3.33 Covenant Against Contingent Fees The Grantor warrants that no person or agency has been employed or retained to solicit or obtain this contract upon an agreement or understanding for a contingent fee, except a bona fide employee or agency.For breach or violation of this warranty,the Government shall have the right to annul this contract without liability or,in its discretion,to deduct from the contract price or consideration,or otherwise recover the full amount of the contingent fee. 6.3.34 Anti-Kickback-Real Property by Reference(JAN 2017) The Anti-Kickback Act of 1986(41 U.S.C. 51-58)(the Act),prohibits any person from(1)Providing or attempting to provide or offering to provide any kickback;(2)Soliciting,accepting,or attempting to accept any kickback;or(3) Including,directly or indirectly,the amount of any kickback in the contract price charged by a prime Contractor to the United States or in the contract price charged by a subcontractor to a prime Contractor or higher tier subcontractor. 6.3.35 Examination of Records The Comptroller General of the United States,the Administrator of FAA or a duly authorized representative from either shall,until three(3)years after fmal payment under this contract have access to and the right to examine any of the Grantor's directly pertinent books, documents,paper,or other records involving transactions related to this contract. 6.3.37 Notification of Change in Ownership or Control of Land If the Grantor sells,dies or becomes incapacitated,or otherwise conveys to another party or parties any interest in the aforesaid land,rights of way thereto,and any areas affecting the premises,the Government shall be notified in writing,of any such transfer or conveyance within 30 calendar days after completion of the change in property rights. Concurrent with the written notification,the Grantor or Grantor's heirs,representatives,assignees,or trustees shall provide the Government copies of the associated legal document(s)(acceptable to local authorities)for transferring and/or conveying the property rights. 6.3.45 Contract Disputes-Real Property By Reference All contract disputes arising under or related to this Easement will be resolved through the FAA dispute resolution system at the Office of Dispute Resolution for Acquisition(ODRA)and will be governed by the procedures set forth in 14 C.F.R.Parts 14 and 17,which are hereby incorporated by reference. Judicial review,where available,will be in accordance with 49 U.S.C.46110 and will apply only to fmal agency decisions. The city has four collective bargaining agreements and all will expire on December 31, 2018. Staff has begun negotiations with three of those bargaining units -AF SCME-Clerical, Technical and Professional, AFSCME-Maintenance, and LELS Police Sergeants; and have requested dates from the LELS Patrol Officer to begin those negotiations. Staff will update the council on the status of negotiations and discuss council priorities for labor negotiations. BUDGET IMPACT NA ACTION REQUESTED A motion should be made to go into closed session for the purpose of discussing labor negotiations as allowed by state statute.
