I will be presenting a report to the Council at the March 18th meeting. This memo is intended to outline the 1991-1995 CIP. I have incorporated the Council's input, Dakota County 5 Year CIP and staff recommendation into this report. The City's current annual MSA allocation is $270,000 per year. For this report, it is estimated that the City will have $1,369,963.23 of MSA funds available in 1991 - 1995. A copy of the MSA 5 Year CIP will be distributed with this memo. In addition, the City has $84,000 available in Federal Aid Urban (FAU) allocation for 1991 con- struction. (See attached.) It appears that this is the last year the City of Farmington will be eligible for an FAU allocation unless Congress extends the program. In order to utilize the entire FAU allocation, a project must be initiated in 1991. Staff recommends that the City consider the designation of Spruce Street as an FAU route. This would allow the use of the funds in 1991, provided the route is approved by the Federal Highway Administration and MnDOT. The projects planned for 1991 are: 1) Paving of shoulders along CSAH 31 from 195th Street to 183rd Street by Dakota County. (No City funds.) 2) Construction of a 9 ton road at 208th Street to service the proposed middle school. Construction of 208th Street will not be on the Municipal State Aid designated system, however, the City can utilize MSA funds off the system. Attached is some information from MnDOT Office of State Aid which indicates that it does not financially harm the City, in fact, it helps the City continue receiving needs for 20 years on an MSA route that is not constructed in lieu of the off system construction. It should be noted that 208th Street cannot be designated as a State Aid route because it is not completely within the City limits. The project planned for 1992 is the construction of a 9 ton road on 195th Street (County Road 64) from the west edge of Fair Hills to the existing point by Akin Road Elementary School. This project will be funded 45% by the City, 55% by the County. It is recommended to designate 195th Street between Flagstaff Avenue and Essex Avenue as an MSA route. This would be done when the 1991 Certification of Mileage is done in January of 1992. The project planned for 1993 is the construction of a 9 ton road on 195th Street (County Road 64) from CSAH 31 (Akin Road) to TH 3. The City had considered designating this as a Municipal State Aid Road, however, it is not possible to designate MSA streets outside of the City. I contacted the Dakota County Highway Engineer to see if the County would consider designating CSAH 64 on the east portion of this segment. The County does not have any balance of CSAR mileage to utilize, therefore, this project will not be on the City's MSA system. The funding for this project will be 45% City/55% County within the City limits. The segment constructed in Empire Township will be through 100% County funding. The City will utilize MSA funds off system as previously outlined in this memo. The project planned for 1994 is the reconstruction of Ash Street (CSAH 74) as a 9 ton road from the railroad tracks (including rubberized crossings) to TH 3. This project will be funded 45% City/55% County. It is important that this project be coordinated with the southeast stormwater management project. This project will be an off system expenditure of MSA funds as previously outlined. The project planned for 1995 is the reconstruction of Walnut Street from 4th Street to TH 3/50. This project will be a 9 ton road design. This project will utilize City MSA funding. It should be noted that the City will utilize assessments to some degree in all of the projects outlined in the CIP. These assessments will help the City establish its Road and Bridge Fund to assist in reconstruction of non MSA streets. All assessments will be in accordance with the Council's policy. The City Council should be aware that the proposed MSA 5 Year CIP does not include any improvements on Essex Avenue in this 5 year time frame. This deviation was done by Council directive. It has been done because Dakota County has expressed an interest in its 5 Year CIP to assist the City in constructing Essex Avenue from 190th Street to TH 50 to CSAH 74 at some point in time in 1995 and beyond. The City is willing to delay the construction at this time in order to receive 55% County funding in the future. This reduces the City share from 100% funding to 45%. The Council can make adjustments in the MSA 5 Year CIP on an annual basis. The proposed improvements in the current CIP are not locked in until the Council has awarded a contract. It is expected that needs can change due to other influences such as the southeast stormwater management project affects the timing of Ash Street improvements, and the City has some flexibility in the Plan. Attached you will find a projection of the City's MSA account balance. This table outlines the current balance of the account, projected annual allocations and annual expenditures as outlined in this report. It should be noted that the account balance cannot exceed 2 times the annual allocation (estimated at $540,000) or the City will be penalized. The MSA system is designed to encourage cities to plan annual improve- ment projects. It is my recommendation that the City Council approve the 1991-1995 Municipal State Aid Capital Improvement Plan. It is also recommended that the City Council consider the authorization of a feasibility study for the proposed street improvements on 208th Street adjacent to the proposed middle school. It is my understanding that the school district is working towards the platting of the middle school in 1991. It will be necessary to prepare a feasibility study for utility improvements in the vicinity of the middle school in the near future. /%1 Tho s J. Accacnmenc A comparison of spending M.S.A. funds on a M.S .A.S . system to an off- system expenditure. (T.H. or C.S.A.H. ) This comparison is made by assuming that a needs loss per year is equally the same as constructing the street. In this example, a street width of 44 feet with a needs and construction cost of $600, 000 per mile is used for a period of 20- years. This is the amount of time it takes before complete needs can be reinstated. OFF-SYSTEM EXPENDITURE A. Spending M.S.A. funds on a C.S.A.H. or T.H. lowers the unencumbered construction fund balance so that a benefit is received from a smaller negative needs adjustment. The result is a $12 , 000, 000 gain in needs. $600, 000 Expenditure X 20 years = a $12 , 000 , 000 gain in needs. B. A 10 year negative needs adjustment is made for an off-system expenditure which results a $6, 000 , 000 loss of needs. $600 , 000 Expenditure X 10 years = a $6, 000 , 000 negative needs adjustment. T) CONSTRUCTION FUND BALANCES If a municipality continually has a construction fund balance resulting in a needs adjustment as required by screening committee resolution, that adjustment can be tempered if a city elects to use their Municipal State Aid construction funds to pay the city's share of local costs on a Trunk Highway or County State Aid construction project. The amount of money expended will reduce the Municipal State Aid construction account balance. However, if a city so elects to use their Municipal State Aid construction funds in such a manner, then an off-system expenditures adjustment is made per screening committee resolution to compensate for not reducing the needs which would have been done if construction funds were used to improve their Municipal State Aid Street system. An off-system expenditure can be beneficial when it reduces a city's construction fund balance but in the same instance it requires an adjustment to the needs because it was used for other than improvement to the Municipal State Aid Street system and therefore does not reduce the city's needs in comparison to those cities that are improving their Municipal State Aid Street system. As Administrator Thompson stated in his memo to Council dated February 22, 1991, "Due to projected LGA cuts and financial adjustments required in solid waste, it is felt that the City Council should address these issues first, and then work toward funding facility expansion within the context of LGA cuts and solid waste adjustments." The City Council has been given a financial analysis for 1990-1994, a copy of the 1991 Budget and a basic tutorial written by the Administrator on how to read the 1991 Budget document. Meetings will be held at the staff level and Council level to address the financial issues before the City. The funding for space needs must be included in these discussions in order for a workable solution to be recognized. This system is a computer based mapping and information system. The City has the capability of utilizing this mapping system on our AutoCADD/MSA computer. This system will allow the City to generate updated maps of 2' contours, land parcels, utility plans and up to 100 layers of information for the entire community. I had requested an $18,000 budget for 1991 to take advantage of this program. The Council has done this joint venture with Burnsville, Apple Valley, Rosemount, Eagan, So. St. Paul and others in 1990. The 1991 project includes Lakeville, Farmington, Hastings, and Nininger Township. This will give the County GIS system mapping capabilities over most of the developing areas. In addition, Dakota Electric is also participating in the program. Attached is a memo dated March 1, 1991 which outlines the anticipated costs of the project based on Requests for Proposals (RFP's) for the aerial photography and digitized maps. The Council has not awarded the contract to date. The Coucnil has requested that the City set up a budget as indicated below for the aerial photography and digitized maps: Dakota County $10,601 (39%) Dakota Electric 6,334 (23%) City of Farmington 10,600 (39%) Total $27,535 The 1991 cost of $10,600 for a computer mapping system with 2 foot contours compares quite favorably with the 1986 cost of $28,000.00 for mylar 2' contours of approximately half of the City. In addition to the contracted services, Dakota County is coordinating the control for the aerial photography. This control is a series of surveys identifying section corners for global positioning (horizontal) and benchmark surveys (vertical) . All land sur- veying is being done by the County at no cost to the City. The City of Farmington has provided benchmark surveys to the County at no cost to the County. The cost of these benchmarks surveys is outlined as follows: City Engineer at 20 hours @ $45.00/hour = $900.00 Asst. Engineer at 120 hours @ $25.00/hour = $3,000.00 Eng. Tech at 120 hours @ $20.00/hour = $2,400.00 Total = $6,300.00 The City is almost completed with the benchmark loops as requested by the County. The County will make sure Farmington and Lakeville are on the same elevation control. The aerial flights are scheduled for early May, 1991. Following the flights, the digitized maps will be prepared. The City will receive a series of computer disks which will allow the digitized maps to be loaded into the City system, probably in late Summer or early Fall. My original budget request of $18,000 also included $1,100 for computer software to improve the AutoCADD system for such items as coordinate geometry to handle County land surveying data and the bi-annual update of AutoCADD to Version II. In order to fund the $18,000 expenditure in 1991, the City has applied for a Metro Council Planning Assistance Loan. See attached application. This loan is an interest free 3 year loan. The County has requested that the City approve the agreement as soon as possible. PROPOSED ( ,� d• / ' RESOLUTIO i" a� i' APPROVING AN APPLICATION FOR A 1991-1993 LOCAL PLANNING ASSISTANCE LOAN Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Farmington, Minnesota, was held in the Civic Center of said City on the 18th day of March, 1991 at 7:00 P.M. The following members were present: \'(0,3,__ i .-9,-A---4=---A- 1The following members were absent: Member int oduced and Member V fes- seconded the following resolution: WHEREAS, the City of Farmington is entering into a joint venture.with Dakota County to conduct aerial photography and computerized mapping of all physical features in the City of Farmington as part of the County's Government Information System (GIS) ; and WHEREAS, the GIS will be utilized by the City for the purpose of updating mapping, planning new physical developments, updating the City's comprehensive Plan, and up to 100 levels of differing maps of geophysical features; and WHEREAS, the Metropolitan Council presently provides funding assistance for local government planning. Description of Proposed Project The City of Farmington is entering a joint venture with Dakota County to conduct aerial photography and computerized mapping of all physical features as part of the County's Government Information System (GIS). This GIS will be utilized by County, City and Dakota Electric staff for the purpose of up- dating mapping, planning of new physical developments, updating the City Comprehensive Plan which includes maps of zoning, land use, sanitary sewer, storm water utility, water supply and distribution, solid waste collection and up to 100 levels of differing maps of geophysical features. 4. Relationship of Proposed Project to Funding Criteria (refer to Funding Criteria, page 3 in the guidelines) The City is currently in the process of updating its Comprehensive Plan (1). The City is also affected by the proposed airport siting and this is being studied through the Comprehensive Plan update (1). The system will also provide the proper management tools for the existing sewer and water systems and for planning future expansions(3). The City is reviewing zoning densities as part of the Comprehensive Plan update (2). We have a large base of agricultural land, 5. Work Program preserve and green acres to protect by zoning (4). We are also in the process of updating the Comprehensive Storm Water ** Outline on a separate sheet the major tasks that must be undertaken to complete the proposed project and the costs for each task. 6. Completion Date Estimated completed date of the work program December 31, 1991 -8- ** Management Plan (3) with an emphasis on wetland preservation for ponding areas. 7. Attached is a tabulation of the RFP's received. It appears that the City will have to fund approximately $10,000 of this project. It is very important to fund this project. Wayne and I discussed funding through the sanitary sewer, solid waste, roads and bridges as an excellent source. I will also be submitting an application for the 0% Planning Loan as we've discussed. In addition, it is very important that the City Council approve the agreement with Dakota County at the March 18, 1991 meeting as the County will be approving the RFP at their March 26th meeting. The parties agree to, in good faith, undertake resolution of any disputes in an equitable and timely manner. 1-4. - Term. DEFINITIONS. Unless the Language or context clearly indicates that a different -Tata ing is intended, the following words, terms and phrases, when capitalized, shall have the following meaning: Data Base: A geographical Data Base in digital form which incorporates planimetric and contour features of the County and which was designed and developed to be used with tF1tiNap" software. Horizontal hound Control: A point onthe ground that is identified on the photograph and is used to fix the position of the photograph in latitude and longitude (S and Y) . vertical Ground control: A point on the ground that is identifed on the photograph and is used to fix the elevation of the photograph in altitude (Z) . 3. PURC2ASE OF StaviCES. 3.1. County Agreement. The stereo digitizing and aerial photography to be obtained shall be governed by the terms of a separate contract between the County and in which the City and Ma be named as third party beneficiaries. 3.2. Non-exclusive. Nothing in this Agreement or in the contract between the County and contractor referenced above shall be interpreted to prohibit any of the parties from purchasing services, products or data directly from the contractor at 4-b a i r own expense. A. COST SHARING. 4_1. Costs. Ground Control. Ownership of the Data Haase shall be jointly held by the parties. Dakota County shall exercise all rights of ownership, title and control to the Data Base under federal copyright law or other law relating to confidential and/or trade secret information. The parties agree that the development of the Data Base required the skilled efforts of professionals in its design and compilation and that the end product is the result of the original work of the County, its employees and agents. Parties to this Agreement may copy and use data so long as such use is consistent with the terms of this Agreement and for internal purposes only. 5.4. Modification/Addition`.. Any additions or modifications of the Data Base completed by a party shall be made available to the other parties. Additions or modifications to the Data Base shall be compatible to the preexisting Data Base, including but not limited to, the program, documentation., nap project reference- numbers and -symbol dictionary. - To_inmmre .simndardLization and compatibility with the pre-existing Data Base, any additions or modifications into the Data Base shall be .approved by the County Surveyor, before - incorporation. . . 5.5. *Distribution of Data- Data or products obtained under the terms of this Agreement may be sold to persons or entities not party to this Agreement, at prices to be set by agreement agreemof the parties.
