3. CONTINUED HEARING - Proposed Amendment to the Zoning Ordinance Adding Resource
Recovery as a Conditional Use in the I-1 Light Industrial
District
The original impetus for discussing resource recovery has been removed by the City
Council. A decision was made on October 19, 1991 not to proceed with an application
to the State of Minnesota for grant money to help build a co-composting plant in
Farmington. The only thing that has not changed is the continuing emphasis on the
objective for a general reduction in waste throughout contemporary society. As
indicated in the original public hearing, resource recovery is one of the primary
growth industries of the 1990's. Currently the Farmington Zoning Ordinance does
not address the issue directly since resource recovery was not in anyone's vocabulary
in 1971 when the zoning ordinance was originally adopted. Section 10-2-7 addresses
this by saying, in part, that "A use not specifically designated as a permitted
or conditional use anywhere in the City is considered prohibited. In such a case,
the Council, Commission or property owner may request a study by the City to determine
if the use is acceptable and if so, what zoning district would be most appropriate
for the use." The City staff has reviewed the ordinance and recommends that resource
recovery has a place in every community, since every community contributes to the
"waste stream". Locating such uses is always a problem since everyone has a fear
of the unknown.
The staff has reviewed the districts available in the Zoning Ordinance and decided
that the most appropriate location for any possible resource recovery operation
is within an industrial area. However, because there can be so much variety in
the types of recovery facilities, the most protection available to residents of
the City is through the conditional use process, whereby the Planning Commission
has the authority to hire consultants to testify and change the cost of such services
to the applicant. In earlier discussions of resource recovery, a definition was
prepared which failed to capture an endorsement from the Commission. Member Thelen
has provided one that she turned up while researching a paper for current class
work. The definition is as follows:
Resource Recovery - Reclamation for sale, use or reuse of materials, sub-
stances, energy or other products contained within or
derived from waste.
Recommendation
Forward a recommendation to the City Council endorsing the proposal to add resource
recovery to the I-1 Light Industrial District as a Conditional Use as well as adding
the definition of resource recovery immediately preceding to the list of definitions
in the ordinance.

4. DISCUSSION - *Proposed Resolution for Name Change for Essex Avenue South of 190th
Street to Trunk Highway 50
The attached draft resolution speaks for itself. Currently, the road changes its
name at the existing "S" curve near 190th Street. Once County Road 31 is realigned
to eliminate the "S" curve, a continuation of the Pilot Knob name, which is familiar
to many people who live south of the Twin Cities appears to make sense. The con-
tinuation of this road south of Highway 50 will gradually curve to the east into
Ash Street and eventually could adopt that name with Essex Avenue meeting at a "T"
intersection midway through the curve. This, however, will not need a decision
until after 1993 when the County plans to upgrade existing Ash Street.
Recommendation
Forward the draft resolution to the City Council with the recommendation that it
should be adopted.
5. DISCUSSION - Zoning Ordinance Amendment - Urban Land Outside of MUSA
The October 1, 1991 memo to the Commission on the subject of development densities
on land outside of MUSA limits described several ways to foreclose the possibility
that landowners outside of MUSA limits would demand development densities indicated
on Table I of all the options outlined, the last appears to be the simplest and
most effective. In essence, Section 10-4-1(0) is recommended to be expanded to
include all residential districts as a way to eliminate any question about development
densities in two areas zoned R-3 which are not now included within the urban service
area. The wording change would substitute all residential districts for (the R-1
Low Density District) . If this meets with approval of the Commission, it should
be forwarded to the City Council reasonably soon. The existing loophole will be
difficult to defend if a developer decides to build without using public services.

1. Chairman Hanson called the meeting to order at 7:00 P.M.
Members Present: Gramentz, Hanson, Rotty, Schlawin, Thelen.
Members Absent: None.
Also Present: City Planner Tooker, City Administrator Thompson, Bill Fitch,
Jim Oslund and Steve Empey from Castle Rock Township.
2. The Chairman asked for comments on the minutes of October 8th and October 17th,
1991. MOTION by Rotty, second by Gramentz to approve the minutes as distributed.
APIF, MOTION CARRIED.
3. The Chairman reopened the public hearing continued...€xom tie October meeting
to discuss the addition of resource recovery as a conditional use in the I-1
Light Industrial District. He introduced members of the Castle Rock Township
Planning Commission who he had invited while attending a Township meeting
on a request for a recycling operation to be initiated on the south side of
Highway 50 immediately south of the Henderson Addition. There was a general
discussion of the recycling request which would include "everything from recycling
cans, plastic and tin to batteries and tires". The Township Planning Commissioners
were interested in the way such a request would be handled in Farmington.
They also indicated that the Rural Residential Zoning District in Castle Rock
Township could accommodate industrial uses through the conditional use process.
Member Thelen shared information she had regarding State and/or Federal requirements
which prevent communities from placing barriers against certain resource recovery
facilities. She would like more specific information about these requirements.
Member Rotty was interested in hearing from other Commission members before
a vote was taken. Chairman Hanson said that he was leery of making a change
like this because of the unknown. Member Schlawin responded that there are
profitable industries that are expanding and others that are developing which
are not likely to wait for Farmington to bring its ordinance up to date. Further-
more, if the City continues to not recognize resource recovery as a legitimate
industrial use, it is more likely to attract only those recyclers at the bottom
of the scale. MOTION by Schlawin, second by Gramentz to recommend that the
City Council amend the zoning ordinance by adding Resource Recovery as a conditional
use in the I-1 Light Industrial District and to include the following definition
of Resource Recovery in the definition section of the ordinance:
Reclamation for sale, use or reuse of materials, substances, energy
or other products contained within or derived from waste.
VOTING FOR: Schlawin, Gramentz, Thelen. VOTING AGAINST: Hanson, Rotty.
MOTION CARRIED.
' 4. The Chairman next discussed the proposal to recommend a change in the
name of Essex Avenue between 190th Street and Trunk Highway 50. It was generally
agreed by the Members that the extension of the name Pilot Knob made sense,
particularly when County Road 31 is realigned. Pilot Knob has a great deal
of name recognition in the Twin Cities Area. MOTION by Thelen, second by
Hanson to forward a draft resolution requesting a name change for County Road 31
between 190th Street and Trunk Highway 50 to the City Council with the recommendation
that it be approved. APIF, MOTION CARRIED.

Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Farmington, Minnesota, was held in the Civic Center of said City on
2nd day of December, 1991, at 7:00 P.M.

changing from Pilot Knob Road to Akin Road south of 190th Street; and
WHEREAS, both the City of Farmington and the County of Dakota plan to realign County
Road 31 from 190th Street south to Trunk Highway 50.
NOW THEREFORE, BE IT RESOLVED that a request be forwarded to the Dakota County Planning
Department for a change in the name of the future right of way, known as Essex Avenue,
between 190th Street and Trunk Highway 50 to Pilot Knob Road.
This resolution adopted by recorded vote of the Farmington City Council in open
session on the 18th day of November, 1991.

SUBJECT: Winter Parking Ordinance
DATE : November 25 , 1991
At the November 4th , regular City Council meeting , the topic
of the new Winter Parking Ordinance was discussed during
round table. At that time, the City Council was advised there
would be a joint meeting between Public Works and Police to
determine recommended enforcement and implementation policies
for the new ordinance.
Two meetings were held between Public Works , Police , Administration
and Park and Recreation . The issues revolving around winter park-
ing were discussed at length . Some of the problems identified
with the existing ordinance were : cul de sacs ; midnight change
in allowable parking ; daily enforcement for a limited need .
After extensive discussion , the group reached the conclusion
that we were creating more problems than we were resolving with
the new ordinance. We next focused on the original goals desired.
Prompt response to a snow emergency. Equitable service to all
areas of town . Responding to the concerns of citizens . Based on
these goals, the attention was turned to working within our past
system to meet those goals.
Working on the premise that the new ordinance is flawed and that •
the old system could work with modifications , the following
recommendations are made.
Council : -Repeal the Winter Parking Ordinance 9-1-12 .
Public Works :
-Establish a priority plan to allow for emergency
services and downtown plowing .
-Establish district plowing to ensure prompt
service to all areas of the City.
-Provide direct radio contact between drivers and
Administration to answer citizens concerns .
-Establish callout policy for emergency plowing
and sanding to increase public safety .
Police : -Establish police priorities for removal of vehicles.
-Enhanced enforcement of snowbird ordinance.
-Provide print out of snowbirds to Public Works for
follow up work.
-Increased parking enforcement in construction areas.

The Dakota County EMS Council has determined that the EMS Financial
Assistance Program should continue as last year. Your department will
be eligible for $487.00 for EMS equipment this year. The departments
that participated last year appreciated the flexibility. Equipment
purchased should be pertinent to EMS.
This is the procedure to follow:
1. Identify the EMS equipment you want to purchase.
2. Purchase the equipment with your own funds or get a written quote
from the vendor.
3. Send a copy of your invoice or quote to Dave Gisch, Dakota County
Emergency Preparedness Coordinator.
4 . The Financial Assistance Subcommittee will review the invoice or
the quote and either approve or deny the item.
5. Reimbursement to your department will not exceed $487.00.
6. Dakota County E.M.S. Advisory Council has developed a disclaimer

Dear Larry:
Our general engineering revised hourly rates for next year are enclosed
herewith. Though our costs have risen higher during 1991, we have held the
increase in our rates to approximately 3.8 per cent. These rates are to
become effective on January 1, 1992. This information is provided at this
time so that it is available for review prior to the beginning of the new year.
We have all appreciated our long and pleasant relationship with the City and
Staff and are looking forward to continuing to serve you in 1992. If you have
any questions on these rates or on our service to the City, please call.
