It was agreed previously that the City would assess water fees, but had not considered sewer. I feel that assessing sewer fees would not place a burden on City finances. Request for Water and Sewer Service The owner has requested that water and sewer service be extended to the property described as follows: The South 200 feet of the West 80 feet of the East 940 feet of the South 1/2 of the Southeast 1/4 of Section 30, Township 114, Range 19 West, all in Dakota County, Minnesota. ..uuulu1Oua w. -rr_____ The Farmington Water Board and City have agreed to install water ,and sewer service to said property, upon the Owner paying a fee of $ 3,094.00 and complying with the terms and conditions of this agreement. The fee shall be assessed against the property over a 10 year period with 8% interest on the unpaid balance. The assessment shall be deemed adopted on the date this agreement is signed by the City. The assessment may be prepaid at any time. The Owner waives any and all procedural and substantive objections to the assessments including any claim that the assessments exceed the benefit to the property. The Owner waives any appeal rights otherwise available pursuant to MSA 429.081. The Owner agrees to pay in full any remaining outstanding balance of such assess- ment before sale or transfer of the property. 3. Easements The Owner ensures that there is adequate public utility easement available to install the water and sewer service from City mains to the property line. The Owner agrees to secure any such required easements for the City before installation of the sewer and water services. 4. Ownership of Improvements Upon completion of the work and construction required by the agreement, the improvement lying within public easements shall become City property without further action or notice. The City agrees to restore lawn to the condition existing prior to the improvement. 5. Miscellaneous A. This agreement shall be binding upon the parties, their heirs, successors or assigns, as the case may be. B. If any portion, section, subsection, sentence, clause, paragraph or phrase of this agreement is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this agreement. C. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this agreement. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. Conditions of Approval The Farmington Water Board has agreed to install water service to said property upon the Owner paying a fee of $ 2,610.00 and complying with the terms and conditions of this agreement. The fee shall be assessed against the property over a 10 year period with 8% interest on the unpaid balance. The assessment shall be deemed adopted on the date this agreement is signed by the City.
