AND COUNCIL SUBJECT: HAM RADIO ANTENNA DATE: NOVEMBER 2, 1990 The City received a verbal request to install a ham radio antenna and base on property just east of Dakota County Estates (see map) . The request was made on behalf of a ham operator group with backing of the U.S. Army, MCI and other organizations. The purpose of the operation would be to set up a communications link with U.S. Forces in Saudia Arabia. The operations as described would consist of a series of 90' poles in two groups with each group covering an area of approximately 200' x 500' . Cable would be strung between the poles. The base would be a temporary structure similar to a construction trailer. It was indicated that the antenna and trailer would be in place on a temporary basis from November until April, and would be staffed 7 days per week, 24 hours per day. Review of the pity code indicates several problems as outlined in Attorney Grannis' memo dated Octbber 31, 1990 (see attached) . While I support the concept, I do not feel it would be permitted without modification to the City Code and a variance to the maximum height', requirements. It was indicated that the group would like to begin oper- ations by November 20, 1990. Review of the City Code indicates that due to publication requirements, the earliest the modifications could be made and variances could be granted would be November 22, 1990. This assumes the appropriate ordinance could be drafted and the Planning Commission would call a special meeting. The following 'should be noted: 1. It was indicated that depending on its location, the antenna would cause some minor interference to television reception in Dakota County Estates. 2. While it was anticipated that the operation would cease by the beginning of April, 1991, it was indicated demand could extend that date. The April deadline is pre- sently tied to when the farmers begin their fieldwork. 3. Attorney Grannis' memo incorrectly states that all the land is zoned F-3. Some por- tions are 'zoned R-1. Mr. Grannis indicated that this would have little bearing on the action required by the Council. I have discussed all of the problems associated with the request, but the representative indicated he w'ould- like the matter discussed by the City Council. This matter has been added to the November 5, 1990 agenda. 7 Larry Thompson! In addition, even if the radio antennae were an allowed use, the height restriction in section 10-5-1 would require a variance approval for anything above 45 feet. The separate Antenna Ordinance, 4- 4-2, would require a permit before any private antenna over 20 feet could be erected but this assumes that the zoning law allows the use in the first place. Under the current zoning law the City cannot allow this use. However, the Council could consider amending the Code to allow this use in the F-3 district, as either a permitted use, a conditional use or they could consider creating an "interim use which would allow the city to limit the use to a specific time period or until a certain condition happens or until the zoning law is(changed. Attached is a copy of Minnesota Statutes § 462.3597 which authorizes Cites to create interim uses, if you have any questions please give us a call.
