The Council may consider defining the ordinance further by stating for example: "2 excused and/or one unexcused absence" and define ex- cused absences such as illness, vacation, death in the family and so on. Attendance - Absence by a member of more than twenty percent (20%) of the regularly scheduled meetings during any calendar year shall constitute inefficiency or neglect of duty, and the Council may initiate the procedure for removal from the Authority as set forth under M.S. 462.435. 4. It is agreed by the City Attorney, Fire Chief and I that the agreement is vague and should be updated. A sprinkler system is installed in the garage and basement of the ARTCC Building. 2. Stringer, Telephone Number Farmington 453-7804. v � FIRE FIGHTING SERVICE AGREEMENT THIS AGREEMENT, made and entered into this day of , 19 , by and between the City of Farmington, a Municipal Corporation of Dakota County, Minnesota, party of the first part, and the Federal Aviation Administra- tion (FAA) an agency of the United States Government, party of the second part. WHEREAS, the party of the second part deems it advisable to have available for its benefit, services of the Fire Department operated under the direction of the party of the first part; and WHEREAS, pursuant to M.S. Ch. 1.042, jurisdiction of the property owned by the FAA has been ceded to the United States Government, WHEREAS, each of the parties have, by appropriate action, authorized its officers to enter into this contract for the furnishing of such fire fighting service, NOW THEREFORE, it is mutually agreed by and between the parties hereto, that the party of the first part will, through its Fire Department, furnish and man suitable fire fighting apparatus and will make all reasonable efforts to respond to all fire calls and fight fires at the FAA facility provided however, that roads and weather conditions must be such that, in the judgement of the Fire Chief or other Fire Department officer in charge, whose judgement shall be final, the fire run can be made with reasonable safety to men and equipment. IT IS FURTHER AGREED, that all charges made by the party of the first part for fire fighting service shall be calculated according to the formula for Fire Section Charges which is attached hereto and made a part hereof and listed as Exhibit 'A' . A statement for services shall be provided to the party of the second part as services are rendered but such statements shall not in itself constitute a bill. December 31st of each year a statement for fire section charges shall be computed and calculated according to the formula a aforesaid and payments on said charges shall be due within thirty (30) days after billing. IT IS FURTHER AGREED, that while every reasonable effort will be made to 4 respond to fire calls and fight fires as provided above, the party of the first part, through its Fire Department, shall be under no obligation to respond to fire calls received while then engaged in responding to a fire call or fighting in any way to the party of the second part, its employees, or any other person, firm or corporation for failure of its Fire Department to attend a fire, or to put out a fire, or for damage to property caused by a fire or fire fighting. The packet of information you sent me was beneficial in my decision to accept this position. In addition to the information already sent could you please send an insurance booklet which explains the policy and also the dental coverage. It would also be appreciate if you could tell me what cost will be to have dependent coverage. I will be available to begin work on Monday, December 2, 1985. I am confi dent that I will be able to fulfill the city's expectations, and I am looking forward to the many challenges and responsibilities I will face. There is, however, one other subject I would like to mention at this time. It is a common practice to reimburse a professional, such as myself, for travel expenses to the job interview. My travel expenses were as follows: 22Umiles @ $0.22 per mile = $48.40 1 meal @ $3.50 = $ 3.50 Total Travel expenses = $52.90 I would appreciate your prompt reply on this matter. I thank you for me the opportunity to serve the Cityof Farmington. I will contact allowing pp y you prior to my next trip up to Farmington. I would also ask that the City Council withdraw my name from consideration for the position of City Engineer, because I feel that my engineering skills and expertise are not those that would best satisfy their needs and desires as indicated in the interview. I appreciate their taking time for this interview and would like to compliment them and the citizens of Farmington for being a clean and well kept community. I was very impressed.
