that the item be taken off the consent agenda for discussion. While
I do not dispute that Mr. Kaldunski used his own vehicle for City
business, the matter should have been addressed up front. City policy
does allow employees to be reimbursed at $.18/mile, but as pointed
out by Mr. Henneke, there must be proper documentation. Therefore,
I would recommend that the request be denied.

NOTICE OF PUBLIC HEARING
Notice is hereby given that a Public Hearing will'be held by the City Council
of the City of Farmington, Dakota County, Minnesota
on the 1Sth day of August , 19 86 , at 7:15 (P.M.)(4 )
in the Council Chambers of the Civic Center, 325 Oak Street, Farmington,
Minnesota for the purpose of: Considering the partial vacation of a utility
easement along the south line of Block 1, Dakota County Estates, Farmington,
Minnesota.
All persons desiring to be heard, in person or in writing, will be heard at this
time.

MEMO TO: MAYOR AND COUNCIL
SUBJECT: UTILITY EASEMENT VACATION - LOT 1, DAKOTA COUNTY ESTATES
DATE: AUGUST 14, 1986
Per developer's request, the Council is considering the partial vacation
of the utility/drainage easement along the south line of Block 1, Dakota
County Estates. The present easement is 15' which would be reduced to
6' .
Staff has reviewed the proposal and does not feel that the City needs the
entire 15' easement. The City originally requested 15' because it did
not know how the property south of the addition was going to develop and
the City needed an adequate easement for storm sewer.
Tom Kaldunski has indicated that there are no utilities presently located
within the easement. The only concern I have is that if the southern
easement is reduced to six feet, the side yard easement be extended through
the vacation portion of the easement.
It is, therefore, recommended that the vacation be approved subject to the
side yard extension.

MEMO TO: MAYOR AND COUNCIL
SUBJECT: UTILITY EASEMENT VACATION - BLOCK 1, DAKOTA COUNTY ESTATES
DATE: JULY 17, 1986
Dakota County Estates developer, Jack Benedict, has requested that the
utility easements along the south line of Block 1, Dakota County Estates
be reduced from 15' to 6' . I have attached a map showing the location
of the easement. You may note that it appears the only City service
affected by the easement is a short length of storm sewer pipe between
lots 12 and 13, which can be retained.
It is recommended that a public hearing be set for August 18, 1986 at
7:15 P.M. to consider the partial vacation of the utility easement on the
south line of Block 1, Dakota County Estates.

Re : Vacation of Utility Easement , Block 1 , Dakota County Estates
Dear Larry:
The following is recommended language to be used in the
resolution which the Council adopted vacating a portion of the
utility easement in Block 1 , Dakota County Estates :
NOW, THEREFORE , BE IT RESOLVED , That the City Council
of the City of Farmington hereby vacates that portion of
the drainage and utility easements located in Block 1 , Dakota
County Estates , Dakota County, Minnesota, described as follows :
The North 9 feet of the 15 foot easement for drainage
and utility purposes located adjacent to the south line
of Block 1 , Dakota County Estates .
( It is not the intent to vacate any portion of the drainage
and utility easements being five feet in width adjoining
lot lines and 10 feet in width adjoining streets . )
If the above language is incorporated in the resolution and
recorded, it will assure that the side yard easements are extended
through the vacated portion of the easement along the south line
of Block 1 . Should you have any questions , please call .

Dear Larry:
Dakota County is currently completing the recertification process for the Entitlement
Community Development Block Grant (CDBG) program. Dakota County first qualified as an
Urban County in 1983 and the recertification process occurs every three years.
The County's current Cooperation Agreement with the City of Farmington will continue to
remain in effect through the next three year program (Fiscal Years 1987 - 1989) , unless
you elect not to participate in the Dakota County Entitlement CDBG program by excluding
the population of the City of Farmington from the total county population count for deter-
mining eligibility of future Entitlement CDBG funding. If you do elect to exclude your
population from the total county population count, this exclusion would be in effect for
the entire upcoming three fiscal years. If the City of Farmington does exclude their
population from the county total, they will not be eligible to participate in the CDBG
Entitlement program during this three year period.
Your unit of local government must notify both Dakota County and the HUD Area Office no
later than September 1, 1986, if you wish to exclude your community's population from the
county's total . If you do not contact them by September 1, the Cooperation Agreement will
continue to be in effect for another three year period. Therefore, if you would like to
continue in the Dakota County CDBG program, please disregard this notice; you do not need
to take any action to continue participating in the program.
During 1984, 1985 and 1986, Dakota County received approximately 3.6 million CDBG dollars
to perform Community Development activites. Many worth while projects have been funded
that benefit Dakota County communities and their residents. We looking forward to working
with all of the communities on future projects.
