PUBLIC HEARING - 7:00 P.M. - REQUEST TO REZONE LOTS 1 AND 2, BLOCK 16 FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-2 GENERAL BUSINESS The 1971 Comprehensive Plan indicated that this entire block was destined to become industrial or, at the very least, heavy commercial. But after 10 years of no commercial or industrial expansion and some displeasure on the part of residents owning property that would someday become industrial, the 1982 Comprehensive Plan indicated medium density residential use with two blocks between Elm and Spruce Streets. This produced some interest in apartment construction in the late 1980's for the half block adjoining Hardee's Restaurant which in turn lead to a downtown plan prepared by the HRA showing that the Weierke property also would be developed as a high density residential block. The request from Lamperts brings the various proposals full circle since Lamperts has indicated an interest in acquiring the entire block for the expansion of its lumber business. Lamperts has also been negotiating with the HRA for some of the former railroad right of way in this block. In addition, representatives from Lamperts have met with City staff Development Committee to discuss the amenities that should accompany the proposed expansion to assure that the new investment will be compatible with the residential and business uses anticipated in the new downtown. The requirements for greenspace in the expansion will be fulfilled by the extension of the biking and hiking path between Oak and Spruce Streets plus tree planting in the Spruce Street right of way, plus some smaller landscaping on the lumber yard property adjoining Spruce Street. The Development Committee will be reviewing the final site plan before • it is implemented. Recommendation Forward a recommendation to the City Council which endorses the expansion of Lamperts and the rezoning of Lots 1 and 2, Block 16, Original Town of Farmington from R-2 Medium Density Residential to B-2 General Business. 4. DISCUSSION - DEVELOPMENT POLICY REGARDING LOOPED STREETS AND SURETY Memorandum to the Development Committee outlining similar requirements in nearby cities, plus an analysis for the Commission of how the policy relates to both Silver Springs and Nelsen Hills Farm are attached. 5. DISCUSSION - NELSEN HILLS FARM PRELIMINARY PLAT Nelsen Hills Farm is the same plat with minor variations that was approved as Pilot Pointe in 1989. Comments have been returned from both the Soil and Water Conservation District and the City Engineer. The Conservation District has made four specific recommendations with regard to erosion control during construction of the plat and one suggestion that a permanent ponding area be created on Outlot B for purposes of water quality improvement downstream from the plat. The City Engineer has outlined 283 MINUTES PLANNING COMMISSION REGULAR JANUARY 14, 1992 1. The Chairman called the meeting to order at 7:00 P.M. . Members Present: Gramentz, Hanson, Rotty, Schlawin, Thelen. Members Absent: None. Also Present: City Planner Tooker. 2. The Chairman asked for comments on the minutes of December 10, 1991. MOTION by Schlawin, second by Thelen to approve the minutes of December 10, 1992 as prepared. APIF, MOTION CARRIED. 3. Chairman Hanson opened a public hearing requested by Lamperts and Lawrence and Verna Weierke to rezone Lots 1 and 2, Block 16, Original Town of Farmington from R-2 Medium Density Residential to B-2 General Business. The City Planner outlined the planning and zoning history of this property which at one time included B-3 Heavy Business zoning. He indicated that Lamperts eventually would like to control Block 16 entirely, but until that happens, the block will continue to show mixed use. As background information, City Planner Tooker explained the need for landscaping on and around the property and a plan that the staff Development Committee prepared showing City expectations regarding the expansion. Tooker also identified the Lampert response which did not include any planting on Spruce Street and diagonal parking which would extend into the traveled portion of the street. The Chairman recognized Alan Wutschke of 101 Spruce Street, the neighbor living within 20 feet of one existing pole type storage building on the site. I I He suggested that the outer boundary fence should be adjusted on the east side of the property to allow over the road trucks with deliveries for Lamperts to pull off of Spruce Street while they wait for the yard to open. He said that he has experienced a considerable amount of trucking noise very early in the morning as trucks stand with motors idling in the street until the staff arrives and lets them onto the property. He also requested that existing and new buildings on site should be designed with interior sound boarding in place to cut down on the noise associated with stacking and removing lumber from the sheds. As they exist today, contact between building materials and the metal siding reverberates throughout the neighborhood and is a nuisance. Pete Chown, Vice President for Sales and Operations at Lamperts, said that sound boarding can be installed on the inside of the sheds. General discussion followed regarding parking options and landscaping. Mr. Wutschke asked if the request would come before the Commission again. The response was that it would not unless the staff and Lamperts could not agree on the content of the. landscaping. on the site plan. Tooker said that the City Council will act upon the request next and possibly another public hearing will be held. MOTION by Rotty, second by Thelen to close the public hearing. APIF, MOTION CARRIED. MOTION by Gramentz, second by Schlawin to recommend Council approval of the request by Lamperts and Lawrence and Verna Weierke to rezone Lots 1 and 2, Block 16, Original Town. of Farmington from R-2 Mediun Density to B-2 General Business. The City Planner briefly outlined the conclusions of staff after polling ten nearby communities regarding their policies on the acceptance of temporary cul-de-sacs when a subdivision is platted in phases. The existing policy provides for the completion of improved loop streets or surety pledged by a financial institution to pay for completing loops in subsequent development phases. This policy came into being following less than satisfactory performances by developers at a time when letters of credit were relatively easy to secure. I met with HRA Executive Director Mark Ulfers and identified the following potential sources for financing the program: MHFA Grant $125,000 1983 CDBG Revolving Loan Program 91,000 Dakota County HRA Matching Funds 30,000 1983 TIF Housing District 100,000 Future TIF ? $346,000+ It should be noted that this program came about fairly rapidly, therefore, all of the details have not been work out. Most of the general background information is stated in Jerry Henrick's memo dated January 21, 1992. The application with the defined target area should be available for the Council meeting. It should be noted the City has the opportunity to drop from the program at any time prior to accepting the grant. I feel this is a very worthwhile program and should be aggressively pursued. /aAsrze7-d"fr---' L ry Thomps City Administrator cc: Mark Ulfers Jerry Henricks Development Committee file • MEMO TO: LARRY THOMPSON SUBJECT: RESIDENTIAL PROPERTY ACQUISITION AND REHABILITATION PROGRAM DATE: JANUARY 21, 1992 The Residential Property Acquisition and Rehabilitation program offers an opportunity for the City of Farmington to rehabilitate residential areas that may be blighted or are in need of substantial repairs. Demolition of these structures is an alternative in this program. Dakota County HRA will administrate to program obtaining administrative funding by hiring their part-time consultant to perform the construction management phase. Secondly, the Dakota County HRA will match up the City's Small City funds reserves prior to 1983 with MHFA funds for assisting in acquiring/rehabilitating the property. The rehabilitated property must be sold to moderate income individuals. The costs associated with acquisition/rehabilitation may exceed what the sale price for the rehabilitated property would generate. This "gap" difference would be absorbed by the matched funds. -- The details associated with the "formal agreement" between Dakota County HRA and the City of Farmington are not in place. Therefore, I can not comment on the terms of the agreement. Secondly, this plan could be modified to the Richfield housing plan. It must be recognized the funds derived from the use of Tax Increment Financing in association with this program, would be limited. Example, house purchased for $50,000 would generate taxes between $350/$500. If this house was demolished with a new house built worth $100,000 (including land) in its place, taxes generated would be between $1,000 and $1,320. The TIF funds for 10 years would be approximately $4,000-$4,500 recognizing the LGA penalty. Over a 10 year period the TIF funds for 5 homes would equal approximately $20,000 to $22,500. If the City was to use TIF on rehabilitation projects, the tax return would be substantially less. Please recognize the City and MHFA are contributing the funds for this program with Dakota County HRA administering the program. I believe this is a positive program for the City for rehabilitating or constructing new homes. The City should be encouraged to utilize all 4 activities under this program. _ 1. Acquisition of blighted properties. 2. Demolition of blighted properties. 3. Gap financing for rehabilitation of blighted properties. 4. Gap financing for new construction. By utilizing the four activities or a combination there of, the City could maximize their efforts at reducing the some blighted conditions in Farmington. Finally, when the program has been completed in December 1993, there could be no funds remaining of the Small City Block Grants or the Community Development Block Grant. These funds more than likely will be totally absorbed in gap financing and other activities. If the City prefers to use the pre 1983 SCBG funds for other purposes at this time or in association with the CDBG for 1993 there could be other similar MHFA programs available in the future. Also, the City could have more time available to review the details and complete the agreements prior to making the application. I believe this is a favorable program for the City while recognizing the limited time to review the proposal as presented. If the City decides to approve the application for this program the following items must be done: 1. Page 1, Section I, General Information -the City should detemine the contact person: City Administrator, myself or designated person. 2. Page 2, Section II (A) , Designated Neighborhood Information - The City could establish the area from Ash Street to the river from Highway 3 to Denmark Avenue as the boundaries. 3. Page 2, Section II (B) - Staff determines the number of "blighted residential properties" in the area. 4. Page 2, Section II (C) - Staff should determine the percentage of blighted properties in the area. 5. Page 3, Section III, Program Information - The City Council should select all or a combination of the activities for the program application. 6. Page 3, Section III - Complete all of A and B paragraphs. 7. Page 4 - City Council authorize and direct the City Administrator to sign this application. 8. Dakota County HRA will develop the necessary resolution for the City Council to act upon stating their agreement with the application for MHFA "Blighted Residential Properties" funding. The contractor charged Mr. Benedict $5,250 for 55 buildable lots and outlots or $95.45 per lot. 2. The contractor charged Terra Addition $2,255 for 23 lots or $98.04 per lot. 3. Lakeville Community Development Director, Jim Robinette, indicated that the City of Lakeville charges more for individual lots, but it is to discourage citizens from using City services. Mr. Robinette indicated that Lakeville uses a private contractor to mow undeveloped subdivisions and added that the cost per lot seemed high. Mr. Robinette added that he was reluctant to comment on the costs because the charges were highly dependent on how much debris, rubble and uneven grading the contractor had to deal with. Mr. Robinette indicated that he would review Lakeville's records relating to mowing and get back to me. As a taxpayer 1991 saw me and my companies paying a total of $32,465.00 in real estate taxes on property in Farmington. As a longstanding business resident of this community I have never shirked my responsibilites to the community nor my customers; my record and reputation speaks for itself. So it was with a sense of outrage and disbelief when a bill from the City of Farmington to Dakota County Estates in the amount of $5395.00 was received by me in early January 1992. The bill was supposedly for mowing weeds in the 6th, 2nd, and 3rd additions. Since 1983 we have been mowing the weeds in Dakota County Estates ouselves. We used to rent a mower, but 2 years ago we bought one and we hire a local boy to cut them. Perhaps it is not the most professional way to deal with the problem, but one should remember we are talking about weeds not nuclear waste, and for 8 years it worked just fine. Which brings us to the spring and summer of 1991, one of the wettest in many years. The city sends a notice. We as usual respond by saying we will cut the weeds as weather permits. We started cutting the first week in July. During the next week we cut all the vacant lots in the 2nd and 3rd additions, and were ready to start on the 6th when Skippers Clippers showed up unannounced and proceeds to start cutting the 6th addition. Point of Fact: Not one house is inhabited in the 6th addition at that time. I immediately proceed to tell Skippers Clippers to stop mowing. He does not. I called city hall and asked for Tom Kaldunsky. He is on vacation. Jerry Bauer is approached by myself and asked to intervene. He said he could do nothing. Larry Thompson is called and I asked him to at least come out and look at what is being done. It is approximately 1 week after Skippers Clippers has been here. During which time he has mowed the 6th addition and is now remowing lots in the 3rd and 2nd we have already mowed. It can also be attested by my sales manager, production co-ordinator and myself that many times Skippers Clippers was no where to be found during the approximate 2 plus weeks he was supposed to be here, and we all told him at one point or Page 2 another during that time his services were not needed. Tom finally comes out and observes what I have been saying for the past week and Skippers Clippers finally leaves. At this point I would ask all of us to recall our own lawn mowing experiences and see if we can make ourselves believe that mowing 9 acres of weeds would take 87 hours; over 2 weeks of 8 hours per day! ! This type of abuse is one of the reasons our great country is in such poor shape. As a business person I have to be responsible for my actions, and financially responsible to continue my business. Government has not had to be responsible for their actions therefore the attitude is lets take advantage of the government and charge them $2.50 for a 5C screw, for example. Clearly this happens at the federal level much more than at the local level because of the sheer size of the bureaucratic system. The apathy the common man feels is because of frustration in knowing we can't do something. As you probably ascertain I feel this bill is more than wrong; it is outrageous, and further it is a symptom of what is wrong with our whole society. Thank-you, John A. Two last notes: 1) Of all the weeds supposedly mowed by Skippers Clippers I find it ironic that the only ones not mowed were on the city owned bike path that fronts on Pilot Knob Road and Dakota County Estates for -',, mile between 130th and 182nd St. W. Why weren't the cities weeds cut? 2) Previous outside bids for weed removal received by me were a per lot cost of $35 to $45. The 6th addition has 50 lots. 50 x $40 = $2,000.00. As noted, Mr. Benedict asked why the weeds in Dakota County Estates 6th were mowed when there are no homes nearby (there is a model under construction). I realize the Code refers to any "platted property" but is the intent to mow weeds in all platted property or those that may be a nuisance or eyesore to homeowners. I would like to discuss this issue with you and Karen before the bill is sent to Mr. Benedict. Therefore, I am setting a meeting for Tuesday, July 30, 1991 at 9:00 A.M. to discuss this matter.
