Explanation: Reference Material/Responsibilty Hearing Notice/Recommendations Fire Marshal Referred To: (Name) Department Larry Thompson Administration Ken Kuchera Fire Byron Reed Fire Marshal Signature Am MEMO TO: KEN KUCHERA SUBJECT: ADOPTION OF 1988 MINNESOTA UNIFORM FIRE CODE DATE: SEPTEMBER 16, 1992 I have reviewed the City's municipal code book and found that Title 5 - Fire Regulations, contains several chapters that are inconsistent with State statutes and Minnesota rules. It is my recommendation that the Council review the existing fire regulations and amend and/or delete several chapters that are covered by State statutes and rules. The following are my recommended changes: Title 5, Chapter 3 - Fireworks - be eliminated from the municipal code because it is covered in Minnesota Statutes. Title 5, Chapter 4 - Fire Prevention Code, Section 1 be amended to adopt the Minnesota Uniform Fire Code as the municipal fire code. Title 5, Chapter 4 - Fire Prevention Code, Section 2 - Fires or Barbecues=_on:Bai- conies or Patios be eliminated because it is covered under Uniform Fire Code. Title 5, Chapter 4 - Fire Prevention Code, Section 2 be added - Enforcement - responsibility for enforcement of these provisions shall be given to the Fire Marshal. Title 5, Chapter 4 - Fire Prevention Code, Section 3 - Violation and Penalties be added to apply penalties under Title 1, Chapter 4 to violations of this Chapter. Title 5, Chapter 5 - Explosives; Blasting Agents be eliminated from the code because it is covered under Minnesota Statutes. Title 5, Chapter 6 - Open Burning be eliminated from the Municipal Code because the City needs to obtain authority to issue open burning permits by adopting Minnesota Rules 7005.075 to 7005.0805 as a local ordinance. After adopting the ordinance, the City must submit the following materials to the MPCA: a. A written statement requesting the authorization. b. The name of the person or persons authorized to issue permits on behalf of the City. c. A certified copy of the motion as passed by the City designating such person. d. A copy of the ordinance adopting the Minnesota Rules. Title 5, Chapter 7 - Fire Lanes be eliminated from the municipal code because the establishment of Fire Lanes is covered in the Uniform Fire Code. Title 5, Chapter 8 - Fire, Burglary and Safety Regulations and Requirements should remain as is now stated in the Municipal Code. My understanding at this time is that your recommendation will be presented to the Council on September 21st, at which time a public hearing will be set, possibly for October 5th. SECTION II: Title 5 shall be amended by adding the following language: CHAPTER 1 FIRE DEPARTMENT 5-1-1: Department Officers: The officers of the Fire Department of the City shall consist of a fire chief, two (2) assistant chiefs and a secretary treasurer. The election of these officers shall be in accordance with the by laws and constitution of the Fire Department. Elected officers are subject to the approval of the City Council. Non-elected officers of the Department shall consist of three (3) captains and two (2 ) lieutenants . The non elected officers shall be appointed in accordance with the bylaws and constitution of the Fire Department. 5-1-2: Fire Chief: The Fire Chief or designee shall have the following powers and duties : (A) Full power, control and command over all persons whatever at any fire, except members of the Council. (B) Provide direction at all fires such measures as he may deem advisable for the extinguishment of the fire. (C) Planning, directing and coordinating all activities of the Fire Department including, but not limited to, fire protection, fire prevention, training and safety. (D) Upon notification of a fire, the Fire Chief shall immediately proceed to the place of the fire and take charge of all apparatus connected therewith. (E) Be responsible for all apparatus, equipment and structures of the Department. (F) Preparation and administration o he Fire e artment budget. In the case of absence of the Fire C ief 014WAr t any fire, the next highest ranking officer shall assumes duties Fire Chief. 5-1-3: Fire Marshal: The Fire Marshal shall be appointed by the City Council upon the recommendation of the Fire Chief and the City Administrator. The Fire Marshal's immediate supervisor shall be the Fire Chief. The Fire Marshal shall carry out duties and responsibilities as assigned by the Fire Chief. The bylaws and constitution of the Department shall provide the overall rules and regulations of the operation of the Fire Department. CHAPTER 2 FIRE PREVENTION CODE 5-2-1: Fire Prevention Code Adopted: The Minnesota Uniform Fire Code and all amendments thereto, is hereby adopted by the City of Farmington as the governing regulations of the City' s fire prevention code. 5-2-2: Enforcement: Responsibility for enforcement of the provisions of this Chapter shall be given to the Fire Marshal. 5-2-3: Violation and Penalties: Violation of any provision of this Chapter shall be subject to the penalties provided under Title 1, Chapter 4 of the City Code. CHAPTER 3 OPEN BURNING 5-3-1: Establishing Authority to Issue Permits: The City of Farmington hereby adopts Minnesota Rules 7005 . 075 to 7005 . 0805 as the local ordinance governing the issuance of open burning permits . 5-3-2 : Authority to Issue Permits: The Fire Marshal and Fire Chief are hereby authorized to issue open burning permits on behalf of the City. CHAPTER 4 FIRE, BURGLARY AND SAFETY REGULATIONS AND REQUIREMENTS 5-4-1: Purpose: This Chapter regulates the use of fire, burglary and safety alarms from misuse of alarm systems through frequency of false alarms . 5-4-2: Definitions: For the purpose of this Chapter: Alarm System: Means and includes any alarm installation designed to be used for the prevention or detection of burglary, robbery, fire or safety devices on the premises which contain an alarm installation. Automobile alarm devices shall not be considered an alarm system. Alarm User: The person or business using an alarm system to protect the premises, regardless of whether the system is owned or leased. Audible Alarm: A device designed for the detection of smoke or fire or of an unauthorized entry on the premises, which alarm activates or generates an audible sound on or near the premises . Automatic Dialing Device: An automatic alarm system which automatically sends, over telephone lines, a prerecorded voice message or signal indicating the existence of an emergency situation. Calendar Year: The period January 1 through December 31 of each year. False Alarm: The occurrence of an alarm in an alarm system for any reason other than an authorized intrusion or attempted robbery, or call to an existing fire. Financial Institution: A commercial bank, savings and loan association, credit union or establishment leasing safety deposit boxes . Nonresidential: Commercial, industrial, business, State agencies, special purpose units of government, apartment complexes, schools and hospitals . Residential Alarm User: Occupied housing units, residential homes and condominiums . 5-4-3 : Regulations and Requirements: (A) Alarm User Registration: Any alarm user shall fill out and return to the Police Department the "alarm user registration" form as provided within thirty (30 ) days . (B) False Alarm Statement of Correction: Following the third false alarm within the calendar year, the alarm user shall fill out and return to the Police Department, within five (5) days, the "false alarm statement of corrections" . This form shall contain a detailed statement of the corrective actions the alarm user has taken to prevent additional false alarms, and to notify the alarm user of impending forfeitures should additional false alarms occur. (C) Audible Alarms : All audible alarms shall meet the following requirements : 1 . Every person maintaining an alarm system with an audible alarm signal shall post a notice containing the name and telephone number of a person to be notified to render repairs or service to such alarm system during any hour of the day or night upon activation of such alarm system. Such notice shall be posted at the main entrance to such premises or near the alarm in such a position as to legible from the ground level adjacent to the building. 2 . Alarm systems with audible alarm signals, except for fire alarms, shall have an automatic shut off which will silence the audible alarm within a period not to exceed twenty (20) minutes . (D) In-house Annunciation Panel: Financial institutions having an alarm system with multiple sensors shall have an in-house annunciation panel providing specific annunciation of the sensors at a private monitoring location on the premises . When, in the judgment of the Police Department, no such private monitoring location is possible on the premises, the requirements of this subparagraph (D) may be waived. (E) Installation of Alarm System: No person shall install an alarm system or use, monitor and possess an operative alarm system which utilizes taped or prerecorded messages which deliver a telephone alarm message to the Police or Fire Departments . No automatic dialing services or systems are permitted in any form, including automatic dialing of the emergency number 911 . 5-4-4: Schedule of Payments Rated: (A) Residential and nonresidential users of alarm systems shall be permitted three ( 3 ) false alarms per calendar year. (B) Any alarm user who has more than three (3) false alarms in any calendar year shall pay a fee set from time to time by resolution of the City Council . (C) There is hereby established a thirty (30) day grace period for all newly installed alarm systems . All false alarms occurring during this period shall not be considered part of the three ( 3) allowable false alarms per year. The installation date must be verified by a dated sales receipt for the alarm system, or a dated invoice from the installer of the alarm system. (D) A false alarm is excused if prior written notification stating the exact time and date is given to the Police Department, and the alarm is activated for the purposes of testing or upgrading the alarm system. (E) All payments provided for in this subsection shall be made to the City of Farmington within thirty ( 30) days after mailing a statement to the alarm user. Payments not made within thirty ( 30) days are delinquent and a penalty of ten percent ( 10%) of amount due will be added. All delinquent charges and penalties shall be certified by the City Clerk to the County Auditor each year providing for assessment of the delinquent amounts against the property of the delinquent alarm user. (F) All information submitted in compliance with this Section shall be held in confidence and shall be deemed a confidential record exempt from discovery to the extent permitted by law. Subject to requirement of confidentiality, the Chief of Police may develop and maintain statistics for the purpose of ongoing alarm system evaluation. 5-4-5: Unlawful Act: It is unlawful for any person to fail or refuse to comply with the regulations set forth in this Chapter. SECTION II: After adoption, signing and attestation this ordinance shall be published one time in the official newspaper of the City and shall be in effect on and after the day following such publication. Reference Material/Responsibilty Proposed Ordinance - Larry Thompson Referred To: (Name) Department Development Committee aff7 69174#1 Signature PROPOSED CITY OF FARMINGTON DAKOTA COUNTY, MINNESOTA ORDINANCE An Ordinance Establishing a City of Farmington Heritage Preservation Commission and Defining Its Powers and Duties THE CITY COUNCIL OF THE CITY OF FARMINGTON HEREBY ORDAINS AS FOLLOWS: SECTION I: Title 2 of the Farmington City Code shall be amended by adding Chapter 11 as follows : CHAPTER 11 HERITAGE PRESERVATION COMMISSION 2-11-1: Declaration of Public Policy and Purpose. The Farmington City Council hereby declares as a matter of public policy that the preservation, protection, perpetuation and use of areas, places, buildings, structures, and other objects having special historical interest or value is a public necessity, and is required in the interest of the health, safety, welfare and prosperity of the people. The purpose of this ordinance is to: A. Safeguard the heritage of the City of Farmington by preserving sites and structures which reflect elements of the City's cultural, social, economic, political, visual or architectural history. B. Protect and enhance the City of Farmington' s appeal to residents, visitors and tourists, and serve as a support and stimulus to business and industry. C. Foster civic pride in the beauty and notable accomplishments of the past; and D. Promote the preservation and continued use of historic sites and structures for the education and general welfare of the people of the City of Farmington. 2-11-2: Definitions. HERITAGE PRESERVATION SITE shall mean any area, place, building, structures, lands, landscaping, building interior, districts, adjacent property or other objects which have been so designated pursuant to the provisions established by this Ordinance. J CERTIFICATE OF APPROVAL shall mean that documentation provided by the Commission which evidences approval of activities proposed for a Heritage Preservation Site. 2-11-3: Heritage Pr servation Commission Established. A. Members. There ' s hereby created and established a City of Farmington Heritage Presery tion Commission (hereinafter the "Commission" ) which shall consist of nine (9 ) voting members appointed by the City Council. Any member appointed to serve on the Commission shall have a demonstrated interest and/or expertise in historic preservation. At least two (2 ) members must be professionals in a field related to preservation (architecture, h' story, planning, design, c n uction, law, so B. Terms of Office. All appointi'hents shall be made for a term of three years . Members shall serve without compensation and continue to hold office until their successors have been appointed. C. Organization. The Commission when formed shall elect from its members such officers as it may deem necessary. The Commission shall have the power to designate and appoint from its members various committees . The Commission shall make such by-laws as it may deem advisable and necessary for the conduct of its affairs, for the purpose of carrying out the intent of this ordinance, which are not inconsistent with the laws of the City of Farmington and the State of Minnesota. The Commission shall make an annual report on or before February 1 containing a statement of its activities and plans to the City Council. D. Program Assistance. To accomplish the intent and purpose of this ordinance, the City of Farmington shall provide the Commission with staff support. The Farmington Housing and Redevelopment Authority (HRA) Director and Administrative Assistant, or their designees, will act as this staff support. 2-11-4: Designation of Heritage Preservation Sites A. Reports. The City Council, upon request of the Commission, may direct City staff to prepare studies which catalog buildings, land, areas, districts, or other objects to be considered for designation as a Heritage Preservation site. B. Criteria. The Commission shall recommend to the City Council areas, buildings, districts or objects to be designated Heritage Preservation sites . In considering the designation of Heritage Preservation Sites, the Commission shall apply the following stated criteria and other applicable criteria that may be established by the Secretary of Interior from time to time. 1 . Its character, interest or value as part of the development, heritage or cultural characteristics of the City of Farmington, State of Minnesota, or the United States. 2 . Its location as a site, or contributing element in proximity to a site of significant historic event or process. 3 . Its embodiment of distinguishing characteristics of an architectural style, period, form or treatment. 4 . Its identification with a person or persons who significantly contributed to the culture and development of the City of Farmington. 5 . Its embodiment of elements of architectural design, detail, materials or craftsmanship which represent distinctive architectural innovation. 6 . Its unique location or singular physical characteristics representing established and familiar aspects of a view, vista, site, area or district in the City of Farmington. C. Intra-City Communication. The Commission shall establish and maintain communications with the City Planning Commission, Housing and Redevelopment Authority and others interested in or affected by a heritage preservation site designation. D. Findings and Recommendations. The Commission shall determine if a proposed Heritage Preservation Site is eligible for preservation as determined by the criteria established by this Ordinance and applicable Secretary of Interior standards, and current procedure as recommended by the State Historical Preservation Office. E. Council Designation, Hearings. The City Council, upon recommendation of the Commission, may by resolution designate a Heritage Preservation Site. Prior to such designation the City Council shall hold a public hearing, notice of which shall have been published in the official newspaper at least ten ( 10) days prior to the date of the hearing and mailed notice sent to the owner(s) of the property which is proposed to be designated a Heritage Preservation Site and to all owners of property lying immediately adjacent to the proposed Site. F. Communication with State Historical Society. Prior to designating a proposed Heritage Preservation Site, the Commission shall forward information concerning the proposed designation to the State Historical Society for comment within sixty (60) days . The decision of the Heritage Preservation Commission and City Council shall be sent to the State Historical Society in accordance with Minnesota Statues, Section 471 . 193, Subdivision 5 . G. Acquisition. The Commission may recommend to the City Council that certain property eligible for designation as a Heritage Preservation Site be acquired by gift, by negotiation, or other legal means as provided in Chapter 117 of Minnesota Statutes. r 2-11-5: Additional Powers and Duties of the Commission. The Commission shall have the following powers and duties in addition to those otherwise specified in this chapter: A. The Commission shall conduct a continuing survey of all areas, places, buildings, structures or objects in the City which the Commission, on the basis of information available or presented to it, has reason to believe are significant to the cultural, social, economic, political or architectural history of Farmington. B. Following designation of a Heritage Preservation Site, the Commission shall act as a resource and in an advisory capacity to owners of said properties regarding preservation, restoration and rehabilitation activities . Commission activity in this regard shall include participation in the planning and implementation of activities within the downtown and designated adjacent properties and other local Heritage Preservation Sites . C. The Commission shall work for the continuing education of the citizens of the City with respect to the civic and architectural heritage of the City. It shall keep current and public a register of designated and proposed Heritage Preservation Sites and area along with the plans and programs that pertain to them. D. The Commission may recommend to the City the acceptance of gifts and contributions to be made to the City and to assist the City staff in the preparation of applications for grant funds to be made through the City for the purpose of Heritage Preservation. Any contributions or gifts will be expended in the manner provided through the fiscal policy of the City of Farmington. E. At the discretion of the Commission, public hearings may be initiated to solicit public input regarding proposed activities to a Heritage Preservation Site. 2-11-6: Review of Permits. A. The Commission shall review all activities which are proposed for a Heritage Preservation Site within Farmington. The Commission shall review activities in accordance with this Ordinance and by-laws as adopted by the Commission. 1 . To initiate review by the Commission, the owner or designated representative of a Heritage Preservation Site shall prepare and submit plans to the City detailing all proposed activities . Upon receipt of said plans and rcfunda194,kfee in accordance with the by- laws established by the Commission, the proposed activities shall be considered by the Commission. 2 . Following review of the proposed activities and detailed plans, the Commission shall forward its recommendation and Certificate of Approval to the City Building Official, as necessary, and other A persons interested in or affected by the proposal at the discretion of the Commission. The Building Official shall deny any building permit application for work proposed on a Heritage Preservation Site which has not been considered by the Commission or which is inconsistent with recommendations made by the Commission. 3 . If the owner or designated representative of a Heritage Preservation Site objects to the recommendations made by the Commission, an appeal may be made to the Farmington City Council. In considering an appeal, the City Council will review all information generated relative to the proposed project and, thereafter, issue a decision by resolution of the City Council. B. Types of Activity to be Reviewed 1 . Remodel, repair or change in any manner that will alter the exterior appearance of an existing building or site, including painting, signage, awnings, landscaping and permanent interior remodeling which affects the exterior appearance; or 2 . new construction, including the expansion or enlargement of an existing building or site; or 3 . moving of buildings; or 4 . demolition in whole or part; or 5 . interior remodeling, repair or change of a Heritage Preservation Site; or 6 . public improvement projects which directly or indirectly affect a Heritage Preservation Site. C. All meetings of the Commission shall be scheduled and conducted in compliance with the Minnesota Open Meeting Law and by-laws as established by the Commission. D. Enforcement No activity as defined by Ordinance shall occur on a Heritage Preservation Site without having first received a Certificate of Approval issued by the Commission. No application fee shall be returned to an applicant until the Certificate of Approval is provided. Activity initiated or completed without the consent of the Commission and City of Farmington as required shall be considered to be in violation of this Ordinance. Upon citing any violation of this Ordinance, the Commission shall initiate actions necessary to resolve the violation. If a violation cannot be resolved with the cooperation of the affected parties, the Commission shall initiate the following procedures : 1 . A written notice of violation will be provided to the owner or designated representative of the Heritage Preservation Site. Said notice shall specify the nature of the violation and possible means for rectifying said violation. 2 . Said notice shall be issued by registered mail or hand delivered receipt requested to the owner or designated representative of the Heritage Preservation Site. Upon receipt of the notice of violation, ten ( 10) days will be allowed to rectify the violation to the satisfaction of the Commission. 3 . If the violation is not rectified to the satisfaction of the Commission as required, the City shall proceed to prosecute the matter as a misdemeanor punishable by fine, imprisonment or both in accordance with the laws of the State of Minnesota. The following outlines the bids received: Arcon Construction $ 88,636.50 Rice Lake Contracting 95,255.00 Ryan Contracting 107,527.60 Engineer's Estimate 65,270.00 You will note that the project has come in significantly higher than the original estimate. I have reviewed the project estimate and plans and specifications to determine what caused this difference. In summary, the following items were the main reasons: Earth Work (+ $6,000) This was due to information obtained by the soil borings. The borings indicated up to 5' of topsoil material rather than the normal 2 to 3 feet. It is my recommendation that this material be removed, however, the typical 2-3 foot subcut/granular fill could provide a 7 ton design strength. The Council could choose to reduce the earthwork. Bituminous Surfacing/Placement/Sawcutting (+ $8,100) The major increase is due to a unit price of $33-36/ton when compared to the typical $12-16/ton unit price the City has received on most projects. This increase is due to the relatively small size of the project and to the fact that equipment mobilization is comparable on large and small projects alike. ,Any size project utilizes the same bituminous placement equipment. There is not an option to reduce this cost unless the Council was to consider rebidding in 1993 as part of a larger project. Most likely that would not reduce costs significantly. The Council could also opt to eliminate the overly on 2nd Street by change order. The potential savings would be $4,360. I recommend that the overly be included in the project. 4" Walk (+ $1,700) Due to decorative walks (using paver brick) and an increase in the total quantity of walks. The original estimate includes 4' wide walk along the lot compared to 8' wide walk as bid. Boulevard Sod/Seeding/Trees (+ $5,790) This was included in the bid at a cost of $5,790. Storm Sewer (+ $5,350) Storm sewer costs were higher than anticipated due to two factors. One is the jacking beneath the railroad tracks necessary for licensing requirements ($3,250). Second, the unit prices bid were higher due to it being a small project ($2,100). NOTE: Change Order No. 1 is attached. The railroad license will not allow the use of the jacked casing for the carrier pipe as was allowed in Project 89-1 (Storm Trunk West of RR Tracks). In reviewing these items, the + $20,000 difference is readily explained. The Council will have to review these items and give staff direction on any change orders that may be desired. I will have a plan available for review at the Council meeting. The Council has a number of options from which to choose: 1. Reject all bids and rebid in 1993. 2. Award the contract with change orders per Council direction, contingent upon receipt of a license from the railroad. Delays are possible. 3. Award the contract as bid contingent upon receipt of the license from the railroad. Delays are possible. I am seeking Council direction on this project. Another source of funds is that state law allows the City to impose reasonaoie rates, rents, fees, and charges for the use of any on-street or off-street parking privilege. The increase would increase the ad valorem levy for fire pension from $14, 326 to $28,483 for 1992/1993 . A $100 increase would increase the levy from $14,326 to $21, 712. The 1993 Proposed Budget and levy certified to the County on September 15, 1992 included the $21, 712 needed to increase the pension by $100 . The Fire Department surveyed certain metropolitan area cities and their results are tabulated on Attachment I. The annual benefit ranges from $1, 150 to $3, 600 . The City of Hermantown, Minnesota in September, 1992 conducted a survey of certain cities ranging in population from 5, 020 to 9, 421 the annual benefit in this survey ranged from $750 in Waite Park to $2, 000 in Thief River Falls . The Hermantown survey is included as Attachment II to this memorandum. Also attached as Attachment III is a survey conducted by the State Auditor' s Office using 1990 data. This survey can be used for comparing the relationship of what one city pays as opposed to another without using current numbers . I agree with the Fire Department in their statement that it is hard to measure community to community because of so many variables. I believe after looking at the data that the amount paid as an annual benefit is paid more on the community' s ability to pay than any other factor. The City of Farmington has included the funds needed for an increase from $1,200 to $1, 300 in the 1993 Proposed Budget. With this in mind we feel a 3 year plan to take us to $1500 . 00 annually is a start to get us parity, if that term can apply here, with other communities that are similar to us in the Metro area. Our first step in achieving this goal is to ask for an amendment to $1100 . 00 for this year. This application was submitted by Wangerin/S.M. Hentges/Kraus-Anderson following Council direction and staff correspondence relating to these pits. The Council noted concerns with exposed ground water in the pits and safety. This permit would be issued "after the fact" since most of the operations have been completed. The School architect and contractors have indicated that the site is to be finished graded and seeded in October, 1992. This permit may affect Dakota County gravel taxes. A site plan is attached to the application. The application indicates that 2500 cy of granular material will be extracted for road subbase. The pit is to be closed by filling with black dirt. The Engineering staff have calculated the quantity of fill at 15,500 cy (based upon an average of 2 feet of sand subgrade treatment beneath all paved areas on the Middle School site) . It is my recommendation that the permit be based upon the City's estimate and that it cover the 3 borrow pits on site used by the contractors. City code requires a public hearing for mineral extraction permits. Surety must be posted. The Middle School surety would be sufficient if allowed by the Council. No abstract of landowners within 350 feet of the borrow pits has been submitted, however, the School District and/or City owns the land within this distance. The Council has indicated that special conditions concerning ground water may be required, therefore, I would further recommend that no ground water be left exposed without protection of safety fencing around the perimeter. This exposed water would be con- sidered an attractive nuisance. The 1992 fee for mineral extractions of 15,500 cubic yards is $100.00. The recommended surety is $20,000. Hours of operation are shown on the application and the expiration date will be December 31, 1992. The applicant will be required to rehabilitate the borrow pit sites by spreading topsoil and revegetating. A certificate of insurance will be required and all requirements of the permit must be met prior to the public hearing, tentatively scheduled for October 19, 1992. It is the intent of these specifications to cover the furnishing and delivering to the purchaser, complete apparatus equipped as specified. Minor details of the construction and materials where not otherwise specified are left to the discretion of the Contractor who shall be solely responsible for the design and the construction of all features. The apparatus being furnished under these specifications shall conform to minimum requirements to Chapters 1,2,4, 6, 10 and 11 of NPPA 1901 or as Customer so specifies. Any test equipment required or expense incurred for the Certification Tests shall be borne by the Contractor supplying this equipment. RELIABILITY OF CONTRACTOR: Contractor shall furnish satisfactory evidence that he has the ability to design, engineer, and construct the apparatus specified and shall state -3- • the location of the factory where the apparatus is to be manufactured and tested. WARRANTY: As a condition of the acceptance of the apparatus, the Contractor shall furnish the following Warranty: The Contractor shall warrant each new piece of .Fire and Rescue apparatus to be free from defects in material and workmanship under normal use and service. The Contractor's obligation under this Warranty is limited to repair or replacing, as the Contractor may elect, any part or parts thereof which shall be returned to them with transportation charges prepaid and as to which examination shall disclose to the Contractor's satisfaction to have been defective, provided that such part or parts thereof shall be returned to them not later than one (1) year after delivery of such vehicle. Such defective part or parts will be returned or replaced free of charge and WITHOUT CHARGE FOR RE- INSTALLATION, to the original purchaser. This Warranty will not apply: 1. To normal maintenance services or adjustments. 2. To any vehicle which shall have been repaired or altered outside of the Contractor's factory in any way so as in Contractor's judgment, to affect its stability, nor which has been the subject to misuse, negligence, or accident, nor to any vehicle made by us which shall have been operated at a speed exceeding the factory rated speed, or loaded beyond the factory rated load capacity. 3 . To commercial chassis and associated equipment furnished with chassis, signaling devices, generators, batteries, or other trade accessories in as much as they are usually warranted separately by their respective manufacturers. This Warranty is in lieu of all other warranties, expressed or implied all other representations to the original purchaser and all other obligations or liabilities, including liabilities for incidental or consequential damage on the part of the Contractor. We neither assume any other warranty or liability on the Contractor's behalf unless made or assumed in writing by the Contractor. The water tank (Booster Tank) is to carry an extended Warranty of at least twenty (20) years from date of manufacture, against any leaks or destruction due to cracks or corrosion caused by normal use of the same. This Warranty extension requires the yearly -4- 11111 examination of the tank interior, with irregularities being reported to the factory immediately. The factory will repair or replace, as the Contractor may elect, the tank and/or its components. CARRYING CAPACITY: The fully laden weight of the completed vehicle, including the filled tank, shall not exceed. the published rating for the axle components nor exceed the axle loads permitted under applicable laws. ALTITUDE REQUIREMENTS: The apparatus shall be designed to meet the specified rating of 2000 feet altitude above sea level. ACCEPTANCE TESTS AND REQUIREMENTS: Acceptance tests on behalf of the purchaser shall be prescribed and conducted prior to delivery or within ten (10) days after delivery, by the manufacturer's representative in the presence of such person or persons as the purchaser may designate in the requirements for delivery. The manufacturer must supply at the time of deliver, at least two (2) copies of: 1. Manufacturer's record of pumper construction details, per NFPA 1901. 2 . Pump Manufacturer's Certification of Hydrostatic Tests. 3 . Pump Manufacturer's Certification of Pump Test Results. 4 . Manual covering the completed apparatus as delivered including the pump, emergency lighting and sirens, or other furnished accessories. It is the intent of the Fire Department to receive proposals on equipment/apparatus meeting the attached detailed specifications in their entirety. Any proposals being submitted, without "Full Compliance" with the advertised specifications shall so state on the Bid Proposal Page, followed by a detailed "Letter of Exceptions" listing the areas of non-compliance and equipment being submitted. Copies of the Specifications shall be attached to the Bidder's Proposal. Specifications and exceptions shall be noted on the same copy. The bidder shall include, with his Bid Proposal, all expenses for the travel of the Truck Committee members to the factory of the Manufacturer for two (2) inspection trips during the construction and pre-delivery of the new apparatus. If supplier and purchaser agree that the truck will be picked up by purchaser, all expenses will be covered by supplier (food, lodging, mileage) . -5- • Bidder shall arrange for and pay expenses for a "Pre- Construction" conference, to be held at the manufacturer's factory, at which time all final designs and equipment mounting locations will be approved. Bidders shall specify number of working days for completed delivery of apparatus from the date of bid acceptance. The City of Farmington reserves the right to reject any or all bids. Bid must be accompanied by a certified check, bidders bond, or cash in the amount of at least ten percent (10%) of the amount bid and made payable in favor of the City of Farmington, as liquidated damages in the event the bidder fails to enter into a contract for the equipment bid as accepted. All bids shall reflect the trade-in value for the existing 1974 American La France Pioneer Pumper, towards the purchase price of the new truck. However, the City reserves the right to sell the above-mentioned "trade-in pumper", therefore, bidder shall indicate an "add on" price for no trade. Information on the 1974 American La France Pioneer Pumper is included with the specifications. The Contractor shall provide a guaranteed delivery date on the proposal in the space provided. The delivery date shall be a factor in determining the bid that is the City's best interest. All crosslay preconnects shall have automatic drains. there shall be Lao (2) , 1-1 /2" crosslays ahead of the top mount control. panel . The crosslays shall have 2" valves and piping with a capacity for 200' of 1-3/4" hose. There shall be two (2) , 2-1/2" liquid filled pressure gauges mounted directly in line with crosslay control valves on operator' s panel . 1000 GPM electric remote monitor- removeable All valves shall be activated electrically, with a manual over ride in case of electrical failure. There shall be one electronic flow meter installed to monitor the flow of water out of the discharge side of the pump. Booster TANK The water tank shall have a capacity of 1 , 000 U. S. gallons ^ . ^ . . ' (883 Imperial gallons) . The water tank shall be constructed of 10 gauge cold rolled steel with a bolt-on removable top for inspection and clean out. The removable lid shall be fastened with bolts on the outside of the tank so they are never in contact with the tank water . The opening in the top of the Lank 'shall be large enough to allow access to all tank compartments for inspections and maintenance. The tank bottom shall be reinforced by welding square steel � 'tubing onto it where the tank rests on the chassis frame rails. This tubing shall run the entire length of the tank and shall be the only part or the tank to come into direct contact with the chassis frame rails. . The tank shall be designed in a tee shape to allow for maximum storage in the lower side compartments. The end and ' side panels shall have a 1-1/2" groove broken into plates for additional strength. The tank shall be built with proper splash baffles that run lengthwise and crosswise throughout the tank to comply with NFPA Pamphlet 1901 . The baffles shall be constructed and installed in a manner that prevents rapid shifting of the water while the truck is moving but still allow maximum flows through all connections. ` The tank shall be built entirely separate from the body and shall be removable without requiring any body disassembly. The minimum dimensions of the overflow discharge shall be 3" by 5" . The overflow shall be built in the fill tower and shall discharge under the tank, behind the rear wheels. A secondary vent shall be located at the opposite corner of the tank from the tower to prevent air from becoming entraped when the tank is filled while sitting at an angle. This vent shall be routed to vent into the overrlow discharge and be directed to behind the rear wheels. The tank sump shall be 10" x 10" x 6" deep. A 3" clean-out plug shall be provided at the bottom of the sump. ' The fill opening shall be at least 8" x 8" with a hinged lid and pop open release latch so the lid will self open if the tank is Filled at an excess rate. A removable screen shall be located in the fill tower to prevent foreign objects, from falling into the tank. � After the tank is completely fabricated it shall undergo a five step dip vat degrease and etching process and then be fully submerged while being hot •dip galvanized. The body assembly shall be securely bolted to the chassis frame rails with a minimum of six 3/4" bolts in the rear and four 1/r" bolts in the front of the apparatus. All attachment points shall be heavily reinforced. There shall be two (2) , rear 8" backup lights with chrome bezels. • -Clearance lights and reflectors to comply with I . C. C. regulations shall be supplied. All electrical equipment shall have circuit breakers mounted on a single panel at a convenient location with each circuit labeled. All wiring shall be protected in an automotive type loom with rubber grommets provided where wiring passes through body components. All wires shall be function coded along their entire length. A complete electrical schematic for the apparatus shall be provided. There shall be lights supplied on the side discharge panels, and in the pump compartment. These lights shall be activated by a switch on the operator' s panel . Lights shall be mounted in a manner that illuminates all • walkways and steps fur safe operation of the apparatus. These lights shall^ be activated by a switch 00 the operator' s panel . A switch to act ivate the backup lights when the transmission is in neutral and in pump gear, shall be provided at the rear of the vehicle. A 12 volt work light with switch shall be installed in the chassis engine compartment. Lights in the compartments shall be activated by an automatic door switch. There shall be a master electrical moduale on the dash for all -emergency light switches, master switches and gauges. The electrical modual shall be vinyl covered. A master emergency light switch shall be installed on the electrical modual. This switch shall allow the preselection of emergency lights and siren so they may energized with the flip of a single switch. Andshall be centered in the dash - . , . . for operation from both seats. • A flashing indicator light and auible alarm buzzer shall be supplied within the driving compartment to warn of an open compartment duor . The buzzer shall be wired in such a manner that it will only be energized upon release of the parking brake, while the light will be operable at any 'tiMe a Compartment door has been opened. LIGHTING EGUIPMENT . . Two Unity AG deck lights shall be mounted high at the rear of the apparatus to illuminate the hose bed loading area. These . lights shall be energized by a switch located directly on the lamp heads. PAINTING, LETTERING AND STRIPING After body and components have been fabricated and assemled they shall then be disassembled prior to painting so when the apparatus is completed there will be finish paint beneath the removable components. The apparatus body and components shall be metal finished as follows to provide substrate for painting. All galvannel steel sections of the body shall undergo a five ' step degreasing cleaning process starting with an alkaline cleaner to degrease the metal surface and then rinsed. Next a phosphoric acid rinse shall be performed to begin the etching process. A phosphatizer shall be applied to continue the etching process and deposit a protective film on the metal , surface. The last step shall consist of a non chromatic rinse to seal the protective film and rinse off solution. All aluminum surfaces shall undergo the last four steps in the • cleaning process since degreasing of the metalis not needed. . After the cleaning process the body and it' s components shall ' . ' . ^ . . . ` be primed with an epoxy primer and the seams shall be caulked. . The painting process shall consist of applying three coats of a high quality polyurethane coating to maintain proper film thickness and then applying two coats of a clear coat to promote extra gloss and additional corrosive protection. The interior of the compartments shall be finished with splatter type painting to provide a scratch and scuff resistant surface. The splatter paint process shall consist ' 'Of applying three coats of white polyurethane base then splatter painting the compartments with three differnt colors. The paint shall then be sealed with two, coats of clear sealer . . All bright metal fittings, if unavailable in stainless steel • shall be heavily chrome plated. Iron fittings shall be copper ' underplated Prior to chrome plating. Two quarts of touch up paint shall be supplied. The apparatus shall undergo a two step under coating process. It shall be undercoated after it is painted and again when it is completely assembled. The apparatus shall be painted with the following colors and to match the dept . fleet and will be decided at preconstruction meeting: ` WHITE: PPG-DITZLER-POLYURETHANE 9E-FORD BLUE: SHERWIN WILLIAMS J5-4889 Lettcring shall be 23K gold leaf with black shadowing and edging. . The insurance carrier for the City has declared the car to be a total loss. While the car may be made functional their experience has suggested that repairs would be continuous and more expensive than its current value. According to the insurance carrier, the book value of the totalled 1991 LTD would be $10, 875, less $2, 125. for high mileage, this leaves $8, 750. Savage value of the car• is $2, 250. leaving $6, 500. An additional reduction of $250. covers the City 's insurance deductible. The final insurance payment would be $6, 250. Payment for salvage, $2, 250. Total payments $8, 500. I have received information from Farmington Ford indicating there are no 1992 replacement vehicles available. Any that were available were dedicated to Florida and Louisiana Law Enforcement. I have been further informed that production of 1993 LTD squad package begins this week. A preliminaryprice quote from Farmington Ford is $13, 311. This represents a $300 increase over 1992 and is still less than we paid in 1991.• Unfortunately this leaves a shortage of $4, 811. for the squad purchase. In addition to the basic squad cost, there will be the cost of replacing damaged electronics including radios, lights, siren, radar and controls. Since the radio was a brand new unit, the insurance cbrrier has indicated it will be covered 100%. Other items will be depreciated at 10% per year• based on original purchase price. Due to the age of most of the equipment, insurance ' payments will be relatively small. A list of prices will be finalized and forwarded to the insurance company this week for review. One final cost will be the charge for squad building/conversion. For 1992, that cost was approximately $600. and should be similar for this unit. At this time, I am requesting authorization to order a replacement squad for a price not to exceed $13, 500. This will allow for time to obtain prices and new equipment as well as insurance payment. These requests would be made at a future City Council meeting.
