It is recommended that the Council pass the attached resolutions adopting the assessment roll after the public hearing is completed. The Council can direct staff to modify the rolls based upon testimony, if necessary. It is also recommended that the Council pass the resolution awarding the contract to Arcon Construction after the assessment roll is adopted. The contract award should include the following: 1 . Total Base Bid $624 , 224 . 36 2. Alt #1 - Street Lighting 12, 128 .00 3 . Alt #3 - 6th St. Utilities 16 , 693 . 05 Total $653,045.41 The bid for Alternate #2 - Seal Coating for $12, 280 . 00 should be rejected at this time. The City will conduct the seal coat project in 3 years after construction is completed. Note that the assessment roll includes assessments for seal coating. Benefitted properties will be assessed for the first seal coat at this time. Please note that City staff has contacted NSP regarding a proposal for NSP to install the street lighting. The proposal will be submitted at a later date. A change order to delete street lighting from Arcon' s contract will be presented with that proposal. Thomas J. R -94 ADOPTING ASSESSMENT ROLL FOR PROJECT 94-1 Pursuant to due call and notice thereof, a special meeting of the City Council and the City of Farmington, Minnesota, was held in the Civic Center of said City on the 22nd day of August, 1994 at 7:00 P.M.. The following members were present: The following members were absent: Member introduced and Member seconded the following resolution: WHEREAS, pursuant to proper notice duly given by the Council, the Council has met and heard and passed upon all objections to the proposed assessments for the following improvement: Project No. Description Location 94-1 Remove/replace base, bituminous, Oak Street - 4th St. to 8th St. curb/gutter, sidewalk; remove/replace 5th St. - 1 blk north & 1/2 blk south of Oak St. sanitary sewer, watermain, storm sewer; 6th St. - 1 blk north & 1/2 blk south of Oak St. sanitary sewer services; install bituminous 7th St. - 1 blk north & 1/2 blk south of Oak St. and storm sewer and all appropriate appurtenances. ;and WHEREAS,the Council has amended such proposed assessment as it deems just. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FARMINGTON, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is on file in the office of the City Clerk, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the pro- posed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 1995 and shall bear interest at the rate of 7.1918%per annum from the date of the adoption of this assessment resolution until December 31, 1994. To each subsequent installation when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assess- ment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment,to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is • made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 9 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as the other municipal taxes. A public hearing has been scheduled for 7:00 PM on Monday, 8/ 22/94 in the City Council Chambers.
