The people in attendance at the meeting understand that the City will be eliminating this service. An effective date of January 1, 1996 has been requested by several large customers. It is my recommendation that the City Council allow commercial recycling customers to begin the change-over to private haulers as of November 27, 1995 and eliminate commercial recycling effective January 1, 1996. The implementation with private vendor recycling can proceed after the receipt of this letter. It is necessary for the vendor and/or commercial customer to send a written request for an exemption to City code for these private commercial recycling services to the Director of Public Works. Upon review and approval, the Director of Public Works will issue a letter authorizing the exemption. B) Collection of cardboard for recycling at five select locations utilizing the cages and the multi-tech truck will be continued by the City. C) All customers will be required to utilize the City's services for collection of municipal solid waste as outlined in the City codes. D) Commercial businesses that put out small amounts of recyclables will be serviced by the City's recycling contractor on the same basis as the residential customers. Director of Public Works/City Engineer MEMO TO: MAYOR AND COUNCIL SUBJECT: UPDATE ON COMMERCIAL RECYCLING DATE: NOVEMBER 16, 1995 At it's March 20, 1995 meeting, the City Council directed staff to make revisions to the City's recycling operations. This directive was intended to do the following; 1) Secure bids for contracting with a private hauler to do residential recycling collections. 2) Eliminate commercial recycling done by the City. 3) Eliminate commercial accounts that can't be serviced by the automated trucks. To date, the City has contracted with Lakeville Sanitary, Inc. for residential recycling collections. This contract was implemented on October 1, 1995 and will be in effect for three years. This completed the first part of the Council's directive. There was an attempt to eliminate the City's commercial recycling services prior to October 1, 1995, however, the project did not get implemented. The City's commercial customers were notified that changes to the commercial recycling would be implemented soon. The City is now in the process of eliminating the commercial recycling services. The • attached meeting notice was sent to various commercial customers advising them of a meeting scheduled for November 16, 1995, at 10:00 a.m. at City Hall. Also attached is the mailing list of customers which may be affected by eliminating the City's commercial recycling services. It is my recommendation that the City Council approve discontinuing these commercial recycling services effective after December 1, 1995. Commercial customers can secure these services on the open market through private vendors. - The type of services that will be discontinued by the City are as follows; 1) Collection of hazardous wastes. 2) Collection of waste lumber in 8-10 cubic yard dumpsters. 3) Office paper collection. 4) Collection of large quantities (containers 30 gallons or larger) of glass, plastic and aluminum/tin containers from restaurants and food services. 5) Cardboard collections utilizing the rear load packer. (see attached list) It is my recommendation that the City Council approve the continued cardboard recycling by utilizing the cardboard cages and the multi-tech truck. This method of service is more cost-effective than the rear load packer and it should be continued as it currently exists. It also provides a method of recycling that helps keep the downtown and Benedict Plaza area clean. I am recommending that the Council approve the continuation of this method of cardboard recycling because it is cost effective. The City has made arrangements to receive revenue from the sale of cardboard. Currently, 6000 pounds of cardboard per week is being recycled with the cages. The price for cardboard has ranged from $30/ton to $100/ton in 1995. This has the potential of providing $90 to $300 per week in revenue to fund the service. The cost of providing this service with cardboard cages has been estimated at $77 per week by Wayne Henneke, Finance Director. This service is clean and cost effective and it is in the City's best interest to continue it. The current solid waste staff has been providing this service since October 1, 1995 without problems. It is my recommendation to allow the exemption to the City code for the collection of recyclable materials as allowed in Section 7-1-2 (E), which is attached. This recommendation only applies to commercial recycling collections in containers 30 gallons in size or larger. The City will continue to provide recycling services for all other customers through it's recycling contract with Lakeville Sanitary. This grant is being offered to us by the Minnesota Department of Trans- portation Office of Transit. The City of Farmington and South Suburban Terrace are looking into apply- ing for this grant jointly to strengthen the odds of receiving the grant. The goal of the Federal Transit Administration program is to provide capital assistance in meeting the special transportation needs of elderly persons and persons with disabilities residing in urban, small urban and rural areas. We are interested in applying for this grant to replace our current Senior Center Van, which is on its last legs. Eighty percent (80%) federal funding is available from the United States Department of Transportation, Federal Transit Administration for the purchase of accessible vehicles. The remaining twenty (20%) must be funded by the City and South Suburban Terrace and must be available at the time the vehicle is ordered. We would be applying for the Mid-Size Bus which will hold 9-18 passengers with 2 wheelchair positions (vehicle description attached). The cost of the bus is $45,360.00 less the 80% ($36,288) provided by grant money. This leaves $9,072.00 left to be shared equally by the City and South Suburban Terrace. The final City cost would be$4,536.00 at the time of order. We are hopeful that we will receive this amount through the local charitable gambling organizations. The City code establishes a 30 day waiting period for a violation to occur. It has been brought to my attention that this is not acceptable to most residents when they are complaining about unauthorized refuse accumulations. In fact, the City practice has been to send the attached notice which gives the property owner ten days to remove the refuse. Following the ten day notice, the City will take action to remove the refuse and bill the property owner. It is my recommendation that the City Council revise the ordinance to fit the current practice of City action after ten days. Witnesseth: WHEREAS, the City desires to employ the services of said Gerald Henricks in the position of Economic Development Director as said position is stated in the Job Description; and • WHEREAS, it is the desire of the City to provide certain benefits, establish certain conditions and terms of employment of Employee; and WHEREAS, it is the desire of the City to: 1. retain the services of Employee and to provide inducement for him to begin employment; 2. make possible full work productivity by assuring Employee's morale and peace of mind with respect to future security; 3. act as deterrent against malfeasance or dishonesty for personal gain on the part of the Employee; and 4. provide a just means for terminating Employee's services at such time as he may be unable to fully discharge his duties or when the City may desire to otherwise terminate his employ; and WHEREAS, Employee desires to continue his employment as Economic Development Director of said City. NOW, THEREFORE, in consideration of the mutual covenants herein contained, the City and Employee agree as follows: Section I: Duties The City hereby agrees to employ said Gerald Henricks as Economic Development Director to perform the functions and duties specified in the Job Description and to perform such other legally permissible and proper duties as the City may from time to time assign. 1 Section II: Term Except as stated in this Agreement: A. Nothing shall prevent, limit or otherwise interfere with the right of the City to terminate the services of Employee at any time. B. Nothing shall prevent, limit or otherwise interfere with the right of the Employee to resign at any time. Section III: Termination and Severance Pay A. In the event the Employee is terminated by the City, the City agrees to pay Employee a lump sum cash payment equal to sixty (60) working days' salary based on the salary of the Employee in effect when notice of termination is given by the City. Said amount shall be payable in addition to any other salary due Employee pursuant to Section X (B) of this Agreement and, at the option of Employee, shall be paid on the effective date of termination. B. In the event Employee voluntarily resigns his position with the City, Employee shall provide the City thirty (30) days written notice in advance. C. In the event that the Employee is terminated from his position with the City for an act or actions for which he is convicted of a crime under the ordinances of the City of Farmington or the laws of the State of Minnesota, he shall not be eligible for severance pay as called for in this Agreement. Section IV: Salary City agrees to pay Employee, for services rendered pursuant to this Agreement, an annual base salary based on the midpoint of a Grade 11, effective November 20, 1995 in installments at the same time as other employees of the City are paid. The amount of annual base salary shall be subject to the annual Compensation Study update. Section V: Hours of Work It is recognized that Employee must devote a great deal of time outside of normal office hours (40 hours weekly) to the business of the City and, to that end, Employee shall be allowed to take reasonable compensatory time off as Employee shall deem appropriate during said normal office hours. The amount of accumulated comp time shall not exceed 80 hours. 2 Section VI: Automobile It is recognized that Employee's duties require the use of an automobile at all times during his employment by the City. Said automobile shall be furnished by the Employee subject to an agreement between Employee and the City as to a monthly car allowance amount of $180.00 per month, with the Employee then providing for all costs of its operation, including proper insurance coverage. In this event, the monthly allowance shall be the sole reimbursement to Employee for automobile travel within the State of Minnesota. Section VII: Dues and Subscriptions The City agrees to budget and to pay the professional dues and subscriptions of Employee necessary for the continuation and full time participation in national, regional, state and local associations and organizations necessary and desirable for his continued professional participation, growth and advancement and for the good of the City. Such amount shall be determined by the City. Section VIII: Professional Development A. The City hereby agrees to budget and to pay the registration, travel and subsistence expenses of Employee for professional and official travel, meetings and occasions to perform necessary official and other functions for the City. Such amount shall be determined by the City. B. The City agrees to budget and pay the registration, travel and subsistence expenses of Employee for short courses, institutes and seminars that are necessary for the continued professional development of the Employee and for the benefit of the City; provided, however, that attendance at said events shall require the express prior approval of the City. This benefit shall not extend to college courses taken for an advanced degree. Section IX: Fringe Benefits - A. In addition to the specific provisions covered in this Agreement, Employee shall be entitled to all other employment benefits provided to full time City of Farmington employees by law, ordinance or resolution except for the provisions of Section 13 of the Personnel Policy relating to disciplinary action and suspension. This section refers to, but is not limited to, such things as holidays, vacation leave, sick leave, compensatory time, group hospitalization and participation in any general employee's retirement system. B. Accrued vacation leave and holidays shall be paid to Employee whether employment terminates either pursuant to Section II, Paragraph A; or Section II, Paragraph B of this Agreement. Accrued sick leave shall be paid to the Employee at the same rate as other non-union City employees whether employment terminates either pursuant to Section II, Paragraph A; or Section II, Paragraph B of this Agreement. 3 Section XI: General Provisions A. The City shall fix any such other terms and conditions of employment as it may determine from time to time relating to the performance of Employee, provided such terms and conditions are not inconsistent with or in conflict with the provisions of this Agreement, resolutions or ordinances of the City, or any other law. B. The text herein shall constitute the entire agreement between the parties. C. This Agreement shall be binding upon and inure to the benefit of the heirs at law and executors of Employee. D. This Agreement shall become effective commencing the 20th day of November, 1995. E. In any provision, or any portion thereof, contained in this Agreement is held to be unconstitutional, invalid or unenforceable, the remainder of this Agreement, or portion thereof, shall be deemed severable, shall not be affected and shall remain in full force and effect.
