The estimated cost of these improvements is $128,000 for the traffic light and $6,000 for the emergency vehicle pre- emption system. It is anticipated that the turnback funds will pay these total costs. The City will be responsible for some engineering costs and street lighting costs (no estimates are available at this time.). The City had established an $87,000 budget for this project. Approximately, $60,000 has been assigned towards utility work and the bridge railing. It appears that there is sufficient funding available to cover the City costs. R -96 APPROVING AGREEMENT WITH DAKOTA COUNTY FOR TRAFFIC LIGHT SIGNAL AT CSAH 31 AND CSAH 50 Pursuant to due call and notice thereof,a regular meeting of the City Council and the City of Farmington, Minnesota,was held in the Civic Center of said City on the 20th day of February, 1996 at 7:00 p.m.. The following members were present: The following members were absent: Member introduced and Member seconded the following resolution: BE IT RESOLVED that the City of Farmington enter into an agreement with Dakota County for the following purposes,to wit: To install a permanent traffic control signal system with street lights and emergency vehicle pre-emption on County State Aid Highway 50 and County State Aid Highway 31 in accordance with the terms and conditions set forth and contained in Traffic Signal Agreement No. 96-04, a copy of which is before the Council. BE IT FURTHER RESOLVED that the proper City officers be and hereby are authorized to execute such agreement, and thereby assume for and on behalf of the City all of the contractual obligations contained therein. SEAL Interim Clerk/Administrator 87 DAKOTA COUNTY DEPARTMENT OF HIGHWAYS TRAFFIC SIGNAL AGREEMENT NO. 96-04 BETWEEN THE COUNTY OF DAKOTA AND THE CITY OF FARMINGTON FOR COUNTY PROJECT NO. 50-04 TO Install a permanent traffic control signal system with street lights and emergency vehicle pre-emption on County State Aid Highway 50 at County State Aid Highway 31 in accordance with the plans and specifications for the above referenced project in Farmington, Dakota County. Traffic Signal Agreement 96-04 THIS AGREEMENT, made and entered into by and between the County of Dakota, hereinafter referred to as the "County", and the City of Farmington, hereinafter referred to as the "City", WITNESSETH: WHEREAS, it is considered mutually desirable to install a permanent traffic control signal system with street lights and emergency vehicle pre-emption on CSAH 50 at CSAH 31 in accordance with the Plans and Specifications for County Project No. 50-04 in Farmington, Dakota County; and WHEREAS, the County and City will jointly participate in the cost, maintenance, and operation of said traffic control signal with street lights and emergency vehicle pre-emption as hereinafter set forth. NOW, THEREFORE, BE IT AGREED AS FOLLOWS: 1. Engineering. The County shall prepare the necessary signal plan sheets, specifications, and proposals and shall perform the engineering and inspection required to complete the items of work hereinafter set forth. Such work as described immediately above shall constitute "Engineering and Inspection" and shall be so referred to hereinafter. -2- Traffic Signal Agreement 96-04 2. Construction Costs. The contract cost of the work and, if portions of the work are not contracted, the cost of all labor, materials, and equipment rental required to complete the work shall constitute the actual "Construction Cost" and shall be so referred to hereinafter. 3 . Signal Installation. The County with its own forces and equipment, and/or by contract shall install a permanent traffic control signal system with street lights and emergency vehicle pre-emption on CSAH 50 at CSAH 31 in accordance with County Project No. 50-04 with the construction, engineering, and inspection costs shared as follows: Traffic Control Signal System Estimated Construction Cost = $128, 000. 00 Emergency Vehicle Pre-emption System Estimated Construction Cost = $6, 000.00 County Turnback Funds are anticipated to pay the total cost of the Traffic Control Signal System and the Emergency Vehicle Pre- emption System. The City agrees to share in the cost of any amount not paid for by County Turnback Funds up to 50% of the costs for the Traffic Control Signal System and up to 100% of the costs for the Emergency Vehicle Pre-emption System. -3- Traffic Signal Agreement 96-04 4. Payment. Upon execution of this agreement and a request in writing by the County, the City shall advance to the County an amount equal to the City's share of the cost based on actual bid price. Upon final payment to the Contractor and computation of the City's share for the work provided for herein, that amount of the funds advanced by the City in excess of the City's share shall be returned to the City without interest. The City shall pay to the County that amount of the City's share which is in excess of the amount of the funds advanced by the City. The City shall make payment to the County for the invoiced amounts within thirty days. 5. Engineering Costs. Upon completion of the work and computation of the County's engineering costs, the County shall invoice the City for the City's share of the engineering and inspection costs incurred by the County. The City shall make payment to the County for the invoice amount within thirty days. 6. County Furnished Materials. Upon completion of the work and computation of the cost of County furnished materials, the County shall invoice the City for the City's share of the cost of materials furnished by the County. The City shall make payment to the County for the invoice amount within thirty days. -4- Traffic Signal Agreement 96-04 7. Previous Signal Agreements. Upon execution of this Agreement by the County and City, the terms and conditions of this Agreement shall supersede and terminate the applicable provisions of Minnesota Department of Transportation Agreement No. 62574 dated March 11, 1985. 8. Signal Energy. Upon completion of said traffic control signal installation, the County and City shall be responsible for providing the necessary electrical power for the operation of the traffic control signal (except street lights) , as follows: Signal System - CSAH 50 at CSAH 31 County's Share = 100% City's Share = 0% 9. Signal Maintenance. Upon completion of said traffic control signal installation, the County shall maintain and keep in repair the signal system, except street lights, at the cost and expense of the County. 10. Street Lights. Upon completion of said traffic control signal installation, the City shall provide necessary electrical power for the operation of the street lights and maintain the street lights, at the cost and expense of the City. -5- Traffic Signal Agreement 96-04 11. Mast Arm Signs. Upon completion of said traffic control signal installation, the County shall maintain and keep in repair the mast arm mounted street name signs at the cost and expense of the County. 12. Timing. Timing of the new traffic control signal system provided for herein shall be determined by the County Engineer through the County Traffic Engineer, and no changes shall be made thereon except with the approval of the County. 13. EVP Maintenance. All modifications, revisions, and maintenance of the emergency vehicle pre-emption system considered necessary or desirable by the parties shall be done by County forces, or upon concurrence in writing by the County's Traffic Engineer, may be done by others. Any and all costs and expenses of emergency vehicle pre-emption maintenance shall be the responsibility of the City. 14. EVP Emitter Units. Emergency vehicle pre-emption emitter units may be installed and used only on vehicles responding to an emergency as defined in Minnesota Statutes Chapter 169.03 . The -6- Traffic Signal Agreement 96-04 City shall provide the County Engineer or his duly appointed representative a list of all such vehicles with emitter units authorized by the City. 15. EVP Use. In the event said emergency vehicle pre-emption system or components are being misused or the conditions set forth in this agreement are violated, and such misuse or violation continues after receipt by the City of written notice thereof from the County, the County shall remove the emergency vehicle pre-emption system. Should the City elect at some future date to no longer operate the emergency vehicle pre-emption system, the City shall provide to the County written notice of such intent and the County shall remove the emergency vehicle pre-emption system. Pursuant to this paragraph, the field wiring, cabinet wiring, and other components shall become the property of the County. All detector heads and indicator lamps mounted external to the traffic controller cabinet will be returned to the City. The detector receivers and any other assemblies located on the traffic control signal cabinets, which if removed will not affect the traffic control signal operation, will be returned to the City. -7- Traffic Signal Agreement 96-04 16. Indemnification. The County agrees to defend, indemnify, and hold harmless the City against any and all claims, liability, loss, damage, or expense arising under the provisions of this Agreement and caused by or resulting from its negligent act or omissions and/or those of its employees or agents. Waiver. Any and all persons engaged in the aforesaid work to be performed by the County shall not be considered employees of the City and any and all claims that may or might arise under the Worker's Compensation Act of this State on behalf of said employees while so engaged, and any and all claims made by any third party as a consequence of any act or omission on the part of said employees while so engaged on any of the work contemplated herein shall not be the obligation or responsibility of the City. I will be fulfilling the duties of the County Agriculture Inspector (CM) for the SWCD. A major part of the duties performed by the CM is the implementation of the Minnesota Noxious Weed law. The Noxious Weed Law was established for the State of Minnesota and Counties to protect public health, the environment, crops, livestock and property. Other duties include agronomic seed and "screenings" inspections. A key component in the success of the noxious weed program is the "Local Weed Inspector." According to Minnesota Statutes, Chapter 18, section 18.80 Subdivision 2, City Mayors are named in the statute as the "Local Weed Inspector" for their City. The duties of the Local Weed Inspector are outlined on the enclosed Minnesota Department of Agriculture Fact Sheet. According to MN Statue 18.80 subdivision 3, the municipality may appoint one or more assistants to act on behalf of the appointing authority (Mayor) as a weed inspector for the municipality. It is my intent to create a cooperative effort for the implementation of the Noxious Weed Law. Each level of government has a unique role to fulfill. When each level communicates and works in cooperation, the implementation is efficient, uniform, and is relatively low in cost. AN EQUAL OPPORTUNITY EMPLOYER In order to accomplish the intent of the Statute, I am asking for the following cooperation from your city: 1. Appointment of the Local Weed Inspector - Please discuss this mater at your next regular City Council Meeting. Under MN Statute 18.80 subdivision 2, the Local Weed Inspector is the Mayor of the Municipality when they take office. The Mayor, under 18.80 subdivision 3, has the option of appointing assistant weed inspector(s) to perform the duties as outlined. Regardless, the meeting minutes or resolution will need to reflect the action taken. 2. Informational and Training Meeting - A meeting for the "Local Weed Inspectors and Assistants" will be held March 25, 1996 at the Minnesota Extension Service in Farmington from 1:00 p.m. to 3:30 p.m. At this meeting, training will be provided to the Local Weed Inspectors and/or assistants regarding the Minnesota Noxious Weed Law, Rules and Responsibilities of Local Weed Inspectors and assistants, Process and Procedures for noxious weed law implementation, and noxious weed identification. Please plan to have your City Weed Inspector(s) attend this meeting. The information supplied will be valuable to a successful program in your city and throughout Dakota County. Please have the Local Weed Inspector or appointed assistant contact me as soon as possible so that I am aware of who your local contact will be and RSVP for the March 25th meeting. I will also need a copy of the City Council meeting minutes or resolution regarding this matter. Please send this information to me as soon as it becomes available. Dakota County did not have a County Ag. Inspector in 1995, however, your city may have had activity regarding noxious weed control. At first the State thought the City had a shortage of staff time available for this project. On February 1, 1996,Don Anderson came down and we went through a worksheet for 1995's work load,this indicated we are close to having enough staff. They thought we only had 1.5 in inspections instead of two. • On February 14, 1996,I am meeting with the Building Codes and Standards Division and the architect at 1:30 in St. Paul. It my understanding that after the meeting,we are to take over the project. The project is estimated at$2,800,000. This would be about$9962.25 • for the building permit fee and$6475.46 for plan check fee. This project is scheduled to start in June 1996. With the increased number of contractors working in the City,I believe we should start doing foundation and sheetrock inspections.These are above the minimum requirements of the State Building Code, but are very important. Attached is a sample of what is covered with these inspections. Sue checked with Lakeville,Apple Valley, Eagan and Rosemount, they are performing these inspections. Check core fill spacing and reinforcement are at sole plate ankor locations. Check • ankor spacing as approved. Check for curb blocks and ankors on center bearing footings. Foundations (Prior to backfilling soil). Verify that foundation is properly braced for backfill. Inspect exterior damproofing/water proofing application. Inspect any exterior foundation drainage system required as part of the approved engineering or site approval. Check all exterior insulation is approved for contact with soil and is continous to frost depth per code. Visually note the type of soil piled on site for backfilling . A claim form was given to the resident, however, the official claim has not been turned in. The landscaping that was damaged consisted of an old wagon wheel, parallel to the driveway. Attached is a sketch of the site showing the wheel very close to the back of the curb. In addition, the operator has noted that the wheel was completely covered by a large bank of snow. The City was performing routine maintenance of winging the snow banks away from the street with the grader. This is typically done following heavy snows. Winging provides more storage space for future snow plowing operations. Attached you will fmd a copy of the City code 8-1-5, that relates to this issue. The City code indicates that several types of landscaping are allowed on boulevards, however, Section "D" clearly states..."The City shall not be responsible for damages relating to the removal of such structures." The City has the authority to remove these wagon wheels and it is not responsible for the damage. The wheels were close to the curb, and an eight foot set back is the minimum needed for snow plowing operations. These wheels should be relocated. The homeowner has noted that they have been in this location for a number of years.
