Raun, Ambulance Director Date: April 27, 1994 Subject: Proclamation for Emergency Medical Services Week The Ambulance Joint Powers Board at their meeting of April 26, 1994, passed the attached proclamation recognizing the week of May 15 - 21, 1994, as Emergency Medical Services Week. The Board asked if I would circulate this proclamation to the member cities and ask if you would have your city councils also pass this proclamation. The proclamation is complete with the exception of including your city name as the proclaming city and your councils signature page. On behalf of the Board thank you for your consideration on this matter. KJR ALF AMBULANCE PROCLAMATION - To Designate the Week of May 15-21, 1994 as Emergency Medical. Services Week WHEREAS, emergency medical services is a vital public service; and WHEREAS, access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and WHEREAS, only a third of Americans rate their households as being "very well prepared" for a medical emergency; and WHEREAS, emergency medical services providers have traditionally served as the safety net of America's health care system; and WHEREAS, the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day, seven days a week; and WHEREAS, emergency medical services teams consist of emergency physicians, emergency nurses, emergency medical technicians, paramedics, firefighters, educators, administrators, and others; and WHEREAS, approximately two-thirds of all emergency medical services providers are volunteers; and WHEREAS, the members of emergency medical services teams, whether career or volunteer, engage in thousands of hours of specialized training and continuing education to enhance their lifesaving skills; and WHEREAS, Americans benefit daily from the knowledge and skills of these highly trained individuals; and WHEREAS, it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical Services Week; and WHEREAS, the designation of Emergency Medical Services Week will serve to educate the people of the ALF Ambulance service area about injury prevention and how to respond to a medical emergency; and NOW, THEREFORE, the City Council of the City of Farmington in recognition of this event do hereby proclaim the week of May 15-21, 1994 as EMERGENCY MEDICAL SERVICES WEEK t 1 ' A , 4g1 e• .rr, - ouncilmemberIIW..r MIL Chris' :11- ouncilmember ii itt- /2I✓. . I CONTRACTUAL AGREEMENT BETWEEN 1 and STATE OF MINNESOTA, DEPARTMENT OF ADMINISTRATION BUILDING CODES AND STANDARDS DIVISION Recitals WHEREAS, the State of Minnesota, Commissioner of Administration, by and through the Department of Administration, Building Codes and Standards Division, (hereinafter "State") is authorized pursuant to Minn. Stat. § 16B.61, subd. la to Contract with a municipality for plan review, code administration, and code enforcement service, as stated in subdivision 1(a) for public buildings in the contractual jurisdiction, WHEREAS, (hereinafter "Municipality"), as defined in Minn. Stat. § 16B.60, subd.3, constitutes an entity with which the state shall contract for plan review, code administration, and code enforcement service for public buildings in the contractual jurisdiction, WHEREAS, the Municipality wishes to provide these services, WHEREAS, the Municipality's building official meets the requirements of Minn. State § 16B.65, WHEREAS, the State has determined that the Municipality has enough adequately trained and qualified building inspectors to provide those services for public building projects defined in Minn. State § 16B.60, subd. 6: NOW THEREFORE,in consideration of the mutual covenants contained herein,the State and the Municipality enter into this Contract for the purpose of conferring upon the Municipality responsibility for administration of the State Building Code, Minn. Stat. § 16B.59 to 16.73 and Minn. Rules Chapters 1300 - 1370 (hereinafter "Code") for public buildings within the Municipality's jurisdiction, as follows: 1. Recitals. The above recitals are true and are incorporated herein by this reference. 2. Municipality's Duties: a. To attend to all aspects of code administration and code enforcement, including: 1. Preliminary plan review with the State when required by the State, • 2. Plan review of building and grounds with municipal plan review comments,designer's responses,and state plan review application form signed by designer and forwarded to the State, when requested, 3. Application, enforcement and interpretations of all Code provisions, 4. Documentation on file of all equivalencies and modifications to Code as required by UBC 105 and 106, 5. Issuance of all permits, 6. Maintenance of all records (inspection records, special inspection reports, tests); 7. Issuance of certificate of occupancy with a copy informing the State Building Inspector when services are completed, 8. Completion of the Building Codes and Standards Division public building project report form,which form is to be provided by the State. 3. Term of Contract. This Contract shall be effective upon execution by the State Building Inspector and will terminate on July 1, 1996,unless cancelled by either party under paragraph 4, "Cancellation." 4. Cancellation. This Contract may be cancelled by the State or Municipality at any time, with or without cause, upon thirty (30) days written notice to the other party. 5. Liability. Municipality assumes all liability for its actions and actions of its employees and agents performing under this Contract and is governed by the provisions of the Municipal Tort Claims Act, Minn. Stat. Ch. 466. 6. Assignment. Municipality shall neither assign nor transfer any rights or obligations under this Contract. 7. State Audits. The books, records, documents and accounting procedures and practices of the Municipality relevant to this Contract shall be subject to examination by the contracting department and the legislative auditor. 8. Fees and Surcharges. All costs of administering the building code under this Contract shall be charged by the Municipality as prescribed by Minn. Stat. § 16B.61, subd. la. No fees, charges or surcharges shall be paid by the Building Codes and Standards Division of the Department of Administration, State of Minnesota,under the provisions of this contract. 9. Ownership of Documents. Any reports, studies, photographs, negatives or other documents prepared by the Municipality in the performance of its obligations under 7 this Contract shall be the exclusive property of the State and all such materials shall be remitted to the State upon request. Municipality shall not use, willingly allow or cause to have such materials used for any purpose other than performance of State's obligations under this Contract without the prior written consent of the State. 10. Amendments or Changes. a. Any additions or changes to this Contract must be in writing and must be agreed to by each party by having the proper authorized designees sign each amendment, exhibit, and addendum. b. Any additions and changes executed and agreed to as required by subdivision (a) of this paragraph must be approved as to form and execution by the Deputy Attorney General for the Division of Public Finance. A total of six candidates were interviewed. The Fire Marshal portion of this position requires the completion of our specified courses or equivalents. In addition, our requirements include 2 years of municipal fire code inspection and enforcement. After contacting the applicants ' references and giving considerable thought to the various aspects of this position, it is my recommendation to offer the position to Michael Palm. I have shared my recommendation with Karen Finstuen and John Manke, and both concur with my selection. I am requesting the Council consider approving the hiring of Michael Palm at the May 2, 1994 Council meeting. Signature I MEMO TO: Mayor and Council SUBJECT: Hiring - Police Officers DATE: April 22, 1994 Pursuant to budget provision and Council approval, the Farmington Police Department has completed an extensive employee selection process . We initially mailed 429 applications and on March 12, 1994, a written test was conducted for 188 of those applicants . Through a series of tests, interviews and investigations, over a two and one-half month period we have determined the top five candidates . At this time, I am recommending the top two candidates for appointment as permanent full time employees for the City of Farmington. I recommend Mr. Thomas Stafford be hired effective May 31, 1994 with a start date of June 1, 1994 . I recommend Mr. Leslie TenEyck be hired effective June 1, 1994 with a start date of June 15, 1994 . The hire dates and start dates indicated coincide with insurance coverage and training. Each candidate will be required to successfully complete a 14 week Field Training Program and a one year probationary period. I have been actively involved in the selection process and am convinced that they will be valuable additions to our police force. UPDATES DATE: APRIL 26, 1994 Attached you will find a copy of correspondence I received from MnDOT regarding the City's recent request for new M.S.A. designations. The Commissioner of Transportation has approved the designation of 208th Street from Pilot Knob to Akin Road(CSAH 31). The request for a portion of 190th Street from Pilot Knob to Akin Road was not approved. Mn- DOT representatives have indicated that the 190th Street segment was not approved because4t-was viewed as a realignment of CSAH 31. As such, it is eligible for funding already. Improvements to this segment should be done in conjunction with the tentative 1995 project the City and Dakota County are planning. In addition, a copy of a revised Certificate of Mileage for 1993 is attached. Minor revisions were needed to this document to confirm with MnDOT records. No Council action is required at this time. This agreement will result in the completion of paved shoulders on Denmark Avenue from Ash Street to T.H. 50. This agreement was prompted by discussions regarding a bypass lane at Denmark Avenue and Spruce Street. Several accidents and near misses have occurred while south bound traffic waits to turn on Spruce. The County has proposed to complete this bypass lane along with paved shoulders on the rest of Denmark. This will also benefit the turning movements at T.H. 50 and C.S.A.H. 31 highway stop. This proposal is similar to the agreement that was used to place bypass lane's and right turn lane at high school entrances and Hickory Street. The City and County shared costs in that project. It is proposed that the City pay $5,000.00 for its share. The County's cost will be in excess of $13,000.00 on the project. The City and County are sharing the costs on a 45/55 split for the items specifically listed in Section 1, page 2 of the Agreement. The County is funding all other minor improvements at 100%. Funding for this project is available from the City's road and bridge fund. I have reviewed this fund with Wayne and he concurs. County Project No. 31-40 April 8, 1994 THIS AGREEMENT, made and entered into by and between the County of Dakota, hereinafter referred to as the "County" ; and the City of Farmington, hereinafter referred to as the "City" , WITNESSETH: WHEREAS, it is considered mutually desirable to construct CSAH 31 between CSAH 50 and CSAH 74 in accordance with the plans and specifications for County Project No. 31-40 in Farmington, Dakota County; and WHEREAS, the County and City will jointly participate in the costs of said roadway construction as hereinafter set forth. If the City should employ their own contractor for the above described water, sewer or other utility repair or installation, they shall hold the County harmless from any and all liability incurred due to the repair or installation of said water, sewer or other utility. Rules and Regulations. The County and City shall abide by Minnesota Department of Transportation and Federal Highway Administration rules and regulations where appropriate. 6. Indemnification. The County agrees to defend, indemnify, and hold harmless the City against any and all claims, liability, loss, damage, or expense arising under the provisions of this Agreement and caused by or resulting from its negligent act or omissions and/or those of its employees or agents. Contracted with the Minnesota DNR to provide an additional $9,000 in supplementary funding for additional boating safety patrol hours during the summer of 1994. The attached map indicates the sewer meter locations. Attached you will fmd a table which analyzes and compares the MWCC flow monitoring with the City's metering. The net result is that an estimated 130 million gallons of I/I that went through the MWCC meter M647 did not pass through any of the City's sewer meters. This represents a significant amount of I/I entering the sewer from non-City sources (MWCC interceptor and/or Empire Township-Edmar lift station). It represents 24.6% of the sewer flows that the City of Farmington will be billed for in 1993. The estimated cost of I/I from non-Farmington sources in 1993 is $161, 723.64. The attached graph indicates the annual sewer flows from Farmington from 1991 to 1993. Based upon the results of the 1993 sewer flow analysis, I have estimated inflow and infiltration from non-Farm- ington sources through this time period. The City cost of MWCC treatment is estimated to be $908,900.00. It is my recommendation that the City Council direct staff to initiate negotiations with MWCC seeking a refund for costs associated with non-Farmington I/I. Thomas J. Kaldunski, P.E.
