They are asking Farmington to participate in the cost of replacing the dispatching equipment in a manner consistent with the July 2, 1984 Joint Powers Agreement . The cost of the equipment is $98, 266 . 33 and Farmington' s share would be 18 . 3% of the cost or $17, 982 . 74 . The cost allocation between Lakeville and Farmington is based on population. To fund the upgrade of dispatching equipment, Lakeville sold certificates of indebtedness at 3 . 6571% interest . Farmington can either pay the $17, 982 .74 in one payment or pay Lakeville $4, 000 . 58 per year from 1995 - 1999 . The annual payments are based on the same interest rate Lakeville pays on the certificates, 3 . 6571% . It is recommended to approve the attached amendment to the Joint Powers Agreement . The amendment allows for the payment of the $17, 982 . 74 over a 5- year term commencing 1995 and ending 1999 at 3 . 6571% interest . The annual payment being $4, 000 . 58 . Waw Wayne E. Lakeville sold Certificates of Indebtedness for this equipment in November 1993 which yielded 3 .6571%. Hindsight is 20-20 vision but it appears that this was the all time low for interest rates. Recitals A. The parties have previously entered into a Joint Dispatching Agreement dated July 2, 1984 ("Agreement") . B. The parties desire to amend the Agreement. NOW, THEREFORE , in consideration of their mutual covenants the parties agree as follows: 1. The Agreement shall remain in full force and effect except as specifically amended by this First Amendment. 2 . Paragraph 9 of the Agreement is amended to read: "This Agreement shall be in effect from the 1st day of January, 1985, through the 31st day of December, 1999. " 3 . Paragraph 10 of the Agreement is amended to read: "Either party may terminate this Agreement prior to December 31, 1999, by notifying the other party in writing of its intention to terminate the Agreement at least six (6) months in advance of the termination date. If Lakeville terminates the Agreement, the balance of the equipment cost due to Lakeville not then due and owing under paragraph 12 of the Agreement shall be cancelled. If Farmington terminates the Agreement, the balance due to Lakeville under paragraph 12 shall not be cancelled and payment shall be made in accordance with the Agreement. 4. The Agreement is amended by adding paragraph 12 to read: "Lakeville has incurred costs of $98,266. 33 to upgrade and replace certain dispatching equipment. Farmington shall reimburse Lakeville for 18. 3% of the cost or $17,982.74. Also attached is a position description. A total of 23 applications were received. This position was vacated by Russ Matthys in May, 1994. The applications were reviewed and seven (7) candidates were selected for interviews during the week of June 13th, 1994. The following factors were utilized for rating purposes: 1. Requirements The applicant that was selected is James (Jay) Kennedy. He has demonstrated that he has the necessary skills desired for the position. It is my recommendation that the city Council appoint Jay Kennedy to the position of Assistant City Engineer. This position has been rated as a grade 9 in the City's compensation and compa- rable work study. The 1994 salary range is $33,312 to $39,903. It is recommended that the wages be set at the entry level for the position ($33,312/year). This position will be a Class II position, providing compensatory time for overtime, per City policy. DATE: JUNE 30, 1994 The City Council has had recent discussion regarding the establishment of a policy to address sanitary sewer service repairs and maintenance. These discussions were prompted by problems that arose at two (2)locations: 1) Dakota Lumber at Pine & 7th Streets 2) Lamberty residence at 905 Westwood*Ct. Memos outlining the problems encountered were sent to the Council previously. The Lamberty's and Steve Finden have been invited to the 7/5/94 to discuss the Council's policy. Attached is a draft policy for sanitary sewer services, improvements, repair and maintenance for your review and comment. This will be discussed at the 7/5/94 Council meeting. Please provide your input. The Council plans to establish a policy, this new policy will be an amendment to the City's Assessment/Improvement Policy. J � � Thomas J. Kaldunski, P.E. Director of Public Works/City Engineer cc: file Larry Thompson Development Committee Street and Utility Crew FIRST DRAFT SANITARY SEWER SERVICE POLICY CITY OF FARMINGTON • 1. The intent of this document is to describe the City Council's policies as they relate to sanitary sewer services. All sections of the Farmington City Code Section 8-2-1 through 13 shall apply in the interpretation of this policy. 2. The Director of Public Works is the City Council appointee for enforcement of all regulations and policies pertaining to sanitary sewer systems. 3. Attached are copies of the City's standard plates for the construction of sanitary sewer services. The City Council has approve these standards and they shall be followed in all work associated with sanitary sewer services. 4. All sanitary sewer mains and services with less than six(6) feet of cover from the sewer flow line to the finish grade above the pipe shall be insulated with 2" high density polyethylene, laid eight (8) feet wide and centered on the pipe. 5. All installation work, repairs or maintenance of the publicly owned sanitary sewer service line shall be performed under the direction of the Public Works Director per Section 8-2-9 of the City code. 6. The City is responsible for the sanitary sewer service line as folio ,.,0 ,0 The City would be responsible for the sanitary sewer maintenance) e, risers and service line from the main to the property line. The City is responsible for ensuring that these publicly / owned improvements are constructed to meet all applicable regulations, codes and policies. The City may also be responsible for any damages that may occur to the property owner due to failure, plugging and/or deficient installations of the publicly owned portion of service line as determined by the City's insurance carrier from time to time. The property owners responsibility shall be as follows; For the proper construction of the sanitary sewer service from the property line to the structures including the pipe, wyes, bends, clean outs, etc. as required by all applicable regulations, codes and policies. For the routine maintenance of the service line from the structure all the way to the sewer main; for example, blockages in the service, rust removal, etc. 7. A sanitary sewer permit as required by code is necessary for all service line connections. The Publics Work Department shall keep a record of all service line locations and note them on the City's utility maps. The Public Works Department will be responsible for all inspections of the service lines. Typically, the publicly owned service line is installed as part of a large utility improvement project, and the service line is installed as part of the home building. The Public Works Department shall sketch the private service line installation onto the sewer permit to provide a permanent record. 8. Permit applications can be approved by staff upon determination that the application is complete and all applicable fees have been collected and/or billed. 9. In the event that a public sanitary sewer service has not been installed for a buildable lot,the property owner can request the installation of a service line stubout. This work is done by the Public Works crews. The property owner will be required to pay various fees (i.e. S.A.C., benefit charges, S.S. trunk area charges, etc.) as established by the City Council from time to time. 10. Section IV of the City of Farmington's Assessment/Improvement Policy addresses the useful service life of sanitary sewer services. All public improvements are judged to have a normal useful life expectancy. For the purposes of this policy, the life expectancy of a sanitary service line is 50 years. When an existing public improvement is ordered to be renewed or replaced or repaired,the L__Fopeadwil be responsible for costs (to be assessed) on a prorated basis. This schedule defines the depreciation of the public improvement. 11. The City's definition of availability of sanitary sewer service is a service line stubbed to the property. City code requires that all properties must connect to municipal service within 1 year of availability, unless the City Council provides for an exception in a written agreement. 12. Property owners are responsible for notifying the City when their water service status is changed. City staff will utilize existing forms/procedures for documenting and implementing changes to -ligeter service. In the event of errors or discrepancies in billings and/or fees,the Council will review them on a case by case basis upon receipt of a written request. The maximum allowed will be for one (1) year prior to the written request. 13. City Council will designate its agents for water rate studies to determine fees and rates to be levied on behalf of the Council from time to time. The rates shall be established on an annual basis by Resolution adopted by the City Council. 14. Utility bills are the responsibility of the property owners. All accounts will be put in the property owners names. If the property owner has multiple users of his/her property, it is the property owners responsibility to determine his/her own method of distributing the bill from the City. 15. The City shall be notified for the following: A. New Utility Accounts - The name, address and telephone number of the property owner to establish the utility account. B. Change in Ownership - The name, address and telephone number of the new property owner to establish the utility account. The previous aimer will be liable for all utility bills prior to the property transfer. The City will need to have the property owners forwarding address so the final bill can be mailed. C. Maintenance - Please contact City Hall if you are having some kind of problems with your sanitary service. It is important to contact the City as soon as possible when problems occur. Upon receiving notification of these types of problems, city staff will document the notification with a Citizen Action Request,per the policies that apply to that document. The City Policy is to respond to reports of sewer backups on an emergency basis. The response will be done as quickly as possible. The person notifying the City will be told the City's findings after the initial response. If further action is required,then city staff will implement the action promptly. 16. Notice of Disruption of Sanitary Services: The City policy is to notify affected properties prior to disruption of sanitary service. All service line connections shall be inspected by the City prior to backfilling. These inspections shall be done by the City's licensed sewer operators utilizing the existing forms established by the City. A sketch of the service lines shall be made at the time of inspection. Ties from the curb stop to the corners of the buildings shall be noted on this sketch. When this occurs prompt action is needed to prevent major damages. The following outlines the City's policy on responding to this type of problem. 1) Typically the City will receive a phone call of sewer backup to a property. City staff is to complete a"Citizen Action Request Form" when this call is received. All policies that apply to these forms must be followed. This form is then given to the Street and Utility Foreman with a copy to the Director of Public Works, for implementation. 2) City staff is to respond as quickly as possible to a suspected frozen service. Contact between the Street and Utility Foreman and property owner(and/or resident) shall be implemented immediately to determine what plan of action is to be followed. 3) The Street and Utility Foreman is to discuss the plan of action with property owner as quickly as possible. Frozen sanitary service lines are typically thawed by introducing heated water from the downstream side of the blockage, with a culvert steamer and/or high pressure washer. A) If the City and resident agree to share the cost equally at this discussion, the foreman will proceed to have the service line thawed from the main to the structure. It is difficult to determine the actual location of the frozen portion of the service and under this policy the City and property owner agree to share liability. B) If the resident and City do not agree to share the cost equally, the foreman will proceed to thaw the water service line from the main to the property line. No attempt will be made to thaw the service line between the property line and the structure. This portion is the homeowners responsibility. The City will be responsible for all costs associated with thawing the City's share of the service line. (From main to property line.) It is recognized that the property owner is assuming some risk under option B. If the service is frozen beneath the street,he may not have any costs. If the service is frozen on private property, he may incur more costs on his own. The property owner will be responsible for all costs associated with repairs to a frozen sewer service under option B. 4) The Street and Utility Foreman is to prepare a written report to document what has occurred in responding to the frozen service. A copy of this report is to be given to the Public Works Director and Finance Department(for billing). A copy of this form is attached. 5) The City Council will implement a policy to insulate all mains and service lines to the prop- erty line installed less than six(6) feet in depth. This program will be implemented as street • reconstruction occurs or as the City can fund it. , 6) If the City is going to do any repairs to a frozen service line that is the property owners responsibility, the parties must sign an agreement before the work is done. • MEMO TO: WAYNE HENNEKE SUBJECT: SANITARY SEWER SERVICE POLICY DATE: JULY 7, 1994 The City Council has adopted a Sanitary Sewer Service Policy at its July 5, 1994 Council meet- ing. This policy states that "the City is responsible for the sanitary service between the main and property line". The City's responsibility is based upon a depreciation schedule in the policy. Recently, the City Council reviewed two (2) sanitary services; 1) 905 Westwood Ct. 2) Dakota County Lumber Based upon the Council Policy, the following payments should be made; 1) Mr. & Mrs. Lamberty should receive a check for $1,030.88 for 100% of the repairs to their service line constructed in 1979. The City should reimburse its insurance company $377.00 for damages at the Lamberty's, damages covered by the City's insurance. Note the City has a $500 deductible. 2) Mr. Finden, owner of Dakota Lumber Co. should be reimbursed $509.60 that he recently paid for repairs/insulation for his service which was built in 1972. These discussions were prompted by problems that arose at two (2)locations: 1) Dakota Lumber at Pine & 7th Streets 2) Lamberty residence at 905 Westwood*Ct. Memos outlining the problems encountered were sent to the Council previously. The Lamberty's and Steve Finden have been invited to the 7/5/94 to discuss the Council's policy. Attached is a draft policy for sanitary sewer services, improvements, repair and maintenance for your review and comment. This will be discussed at the 7/5/94 Council meeting.
