These purchases were included in the 1993 budget. Following Council approval, the Public Works Department made arrangements to install one of these tarps on a truck. The department feels that the tarp purchased from Crysteel is adequate for the job, however the unit available from Twin City Truck will function more efficiently. In addition, the installation of tarps at Crysteel (located in the north metro area) requires a lot of additional time spent by depart- ment employees taking trucks to the north metro shop, when compared to Twin City Truck. It is in the department's best interest to utilize its resources most efficiently. The Public Works Department is requesting Council approval for the purchase of three (3) tarp systems from Twin City Truck of Lakeville. The three (3) tarp systems will cost $1,917.00. The department has $2,170.88 remaining from the original capital outlay request. It is recommended that the revised capital outlay request for $1,917.00 be approved. In addition, the Department has a need for a push lawn mower. The City received a low quote of $239.63 from Cherokee Power for the Lawn Boy mower. It is proposed to fund this purchase from the $253.88 savings from the tarp purchase. W. The Finance Department has received the attached damage claim from Pam Hockert, 5151-183rd St . W. The Hockerts landscaped the corner of their yard which was in the city boulevard. Under city ordinance only specified trees are allowed to be planted. Last winter the snowplow went 8 feet into the yard and dug up the landscaping. The following is an itemization of the request for damages : 2 - Dwarf spruce trees ($6 . 97 ea. , plus tax) $14 . 85 1 - Shrub ($11 . 97, plus tax) 12 . 75 1 - Edging ($10 . 99, plus tax) 11 . 70 Rocks (1/3 of 2yds . @ $86 . 77) 28 . 92 Sod (5 rolls @ $1 . 88) 9 .40 Total $77 . 62 Pam Hockert stated in her letter to Council, she understands the City must enforce its ordinances and not pay for anything but the sod. In practice the property owner should call the Public Works Department regarding the sod damage and the Public Works Department would replace the sod. In this case it is recommended to pay Pam Hockert for replacing the sod. I do not recommend paying for the trees, shrub, edging, or rock. The City does have an ordinance stating only specified trees are allowed to be planted in the boulevard. The ordinance does not- allow for landscaping in the boulevard because of the snow plowing and maintenance of city services in the boulevard. Also, there are many properties in Farmington that have landscaping in the boulevard and in most cases add to the esthetics to the neighborhood. If the City pays for the replacement of Pam Hockert' s trees, shrub, edging, and rocks, the City sets a precedents of paying for all damage to landscaping in the boulevard the City causes . This claim brings up the following questions : 1) Since there is a number of properties that have landscaping on the boulevard, should the City enforce the current ordinance and have all landscaping removed except for specified trees under the ordinance? 2) Should the City allow landscaping on the boulevard but if any damage does occur, it is the liability of the property owner? 3) Should the City allow landscaping on the boulevard and if any damage caused by maintaining city services occurs, the City will pay for the damage? `,1JC�Z�In.Lfz 3111Pi Wayne E. Farmington, MN 55024 July 14, 1994 City of Farmington Attn: Finance Director 325 Oak Street Farmington, MN 55024 Dear City Finance Director and Farmington City Council: Per my phone conversation with the Finance Director on 7/13/94, I am writing this letter. I understand my case is going to be presented to the Council and I just wanted to give everyone some additional information. In the summer of 1993, we spent hours (and a substantial amount of money) sodding and landscaping our yard. I put together a nice arrangement in the corner of our yard, not knowing about any ordinance against certain land- scaping nor the manner in which the snowplowing is done in the winter out in Dakota County Estates. As being fellow homeowners, you can probably imagine the extreme disappointment and sadness I felt one afternoon when I drove up to our house and observed the damage the snowplow had done. Can you imagine spending hours on something and having it completely destroyed within minutes? The snowplow came into our yard 8 feet and dug up down to the dirt an area approximately 8-10 feet in width. Try to imagine something that is 8 feet in length. My belief as a homeowner (and I'm sure other homeowners would agree) , that the snowplow had no business going into our yard 8 feet. Two city workers came out to assess the damage a couple of weeks later. They were extremely sorry and suggested the least they could do at the time was stop by in the spring to help clean the mess up. But, no one ever showed up to even help with that rotten job. We then spent days on our hands and knees picking up little rocks. I understand that you have city ordinances, but as a new homeowner you are not aware of landscaping limitations, where you can plant trees, fencing restrictions, etc. It is my suggestion that a letter be sent to each new homeowner explaining that there are certain restrictions and they should call the city before landscaping, planting any trees, etc. For the present time, however, I know you can enforce your ordinances and not pay for anything but the sod that was dug up by the snowplow. I know for a fact, though, that there are many other homeowners that have some sort of landscaping 8 feet from the curb. I guess in all reality, if the snowplow City of Farmington July 14, 1994 Page 2 had dug up something 2-3 feet in the yard or right along the curb, it would be a little more understandable. But, what business does he have digging up (let me remind you again, down to the dirt) 8 feet into anyone's yard. I think any homeowner that experienced the whole corner of their yard dug up 8 feet in for no reason, would have a little bit of a problem with that. I do not expect to be reimbursed for my time, even though the city employee who stopped by to assess the damage suggested that they would stop by when in the neighborhood to help clean up the mess they had made. (No one ever showed up.) I would, however, appreciate being reimbursed for the actual cost to me that the snow plow caused. Thank you for your prompt attention to this matter.
