Subject: Pine Knoll Sanitary Sewer Service Connection Agreement
Date: August 5, 1994
A Pine Knoll property owner has raised a concern regarding the language in the Sanitary Sewer
Service Connection and Assessment Agreement. The agreement is a standard form used when the
City installs improvements requested by owners which were not part of the original project (see
attached.) The owner is concerned that the agreement states that the City install and "connect" the
sanitary sewer. Services are normally connected as part of the project, but in this instance, the
Council has agreed to allow owners with functioning systems to delay hooking up to the system.
The main purpose of the agreement is to ensure that the assessments for the cost of installing the
service will not be appealed. Therefore, staff has interpreted that the language only applies to the
improvements which are installed, and the agreement would not force owners to hook up to the
system. The owner has requested that the City amend the language to explicitly state that the
home does not have to be connected, and indicated he would not sign the agreement if it is not
amended. It was indicated that I did not feel it would be appropriate for the Council to amend the
agreement for one owner, and that the other property owners felt comfortable with the language.
If the City changed that language in his agreement, they should do so for all agreements which
- would mean starting the process over again. The City Attorney has indicated that Council action
affirming staffs position would effectively amend the contracts and should eliminate any doubts.
It is therefore recommended that the Council affirm staffs interpretation, and not amend the
agreement.

REQUEST FOR
SANITARY SEWER SERVICE CONNECTION,
AGREEMENT 'FOR ASSESSMENT OF COSTS,
AND
RIGHT OF ENTRY
(husband and wife) (a single person),
hereinafter "Owner" whether one or more, requests the City of Farmington, a Minnesota munici-
pal corporation, hereinafter "City", install a sanitary sewer service and connect said service to the
existing private line on my property at
Farmington, Minnesota, hereinafter "Property".
Owner agrees to pay a fee of$8.75 per lineal foot of service length plus $312.50 per connection
and comply with the terms and conditions of this agreement. This fee shall be assessed against the
property over a period of fifteen (15) years with 7.5% interest on the unpaid balance. The assess-
ment shall be deemed adopted on the date this agreement is approved by the City. The assessment
may be prepaid at any time. Owner waives any and all procedural and substantive objection to the
assessment including any claim that the assessment exceeds the benefit to the property.
Owner waives any appeal rights otherwise available pursuant to MSA 429.081.
Owner gives the City's representatives and its contractor the permission to enter onto the Property
to perform the sanitary sewer service connection and any associated work.

An Ordinance Amending Title 8, Chapter 2 of the Farmington City Code by Changing
Sewer Hookup Requirements From One Year to Two Years
THE CITY COUNCIL OF THE CITY OF FARMINGTON, MINNESOTA, HEREBY OR-
DAINS AS FOLLOWS:
SECTION I: Title 8, Chapter 2, Section 6 shall be amended by adding (underlined) and deleting
(truck) as follows:
8-2-5 PRIVATE SEWER SYSTEM UNLAWFUL: It shall be unlawful for any person to
install a private or community sanitary sewer system within the City limits except
in cases where the public sanitary sewer system is not accessible to the premises where such
private systems are requested. To determine whether or not such public sanitary sewer system is
_ available for connection each person or corporation desiring to install a private or community
sanitary sewer system must first make application for connection to a public system. Upon
determination of the Utilities Supervisor that it is not feasible to connect the applicant's premises
to the public sanitary sewer system then the applicant shall be granted a permit to install a private
sanitary sewer system.
All properties using a private or community sewer system in the City shall connect to the public
sanitary sewer system of the City within one two years after the time that said system is available
to the property.
SECTION II: After adoption, signing and attestation this ordinance shall be published one
time in the official newspaper of the City and shall be in effect on and after the day following
such publication.

Attached are copies of the two proposals to perform a space needs
study for the City of Farmington. The proposals were submitted by
CNH Architects, $3, 500 and Bonestroo,Rosene, Anderlik and
Associates, $5, 000 . The Bonestroo proposal would be completed
within 1 to 2 months. CNH' s proposal would be completed within
3 to 4 weeks. Both firms have demonstrated experience in
performing space needs studies for other communities . Both
proposals appear to be similar in scope.
The HRA reviewed these proposals at the August 1, 1994 meeting
recommending CNH Architects to perform the space needs study for
the City.
The City staff reviewed the proposals discussing the merits of
using a firm other than the City ' s engineering consultant and the
_time frame of the two proposals . There were questions as to CNH
meeting their time frame to complete the study. The consensus of
the group was to recommend the use of CNH Architects for the study.
The City Council should determine which firm they would use for
performing the space needs study. A motion should be passed
selecting the firm to be used for the study. The HRA will fund the
cost of the space needs study.

Re Architectural Proposal for City of Farmington Facilities Need Assessment
Dear Mr.Henricks:
We appreciated this opportunityto submit this proposal to assess the City of
Farmington's facility needs. The following is a description of the approach we would
follow, the work to be performed and our fee for the Study.
Approach to Needs Asset; •
Our approach will be broken into the following four phases:
• Analyze Existing Space
•
By reviewing existing facilities,drawings of facilities, comments by Department Heads,
concerns of the City Council,and general oberservations we will analyze your existing
facilities current condition,ability to meet needs, and potential for expansion and change
of use, if required. This analysis will form a basis from which to start the space
projections. It will also identify potential reuse capabilities as desired or required in the
years to come as the City grows.

• Establish Standards
Space standards vary for city to city,company to company and employee to employee.
Before projections can be made a space standard must be established. A few examples
of decisions which need to be made include:
• Conference area within offices vs,separate conference and offices.
• What positions get private offices vs.open stations.
• 12 x 12 vs. 18 x 12 offices.
• 6 x 6 vs.9 x 9 open stations.

These decisions are general based on a combination of existing conditions and the
philosophy of the City. It is our intent to discuss this at our first work session with the .
City Council. .
• Needs Projection •
Using the City's Vision' document, conversations with the City Council, analysis of
existing facilities, space standards and population growth projections, the space needs of.
the City will be projected 5, 10, 20 and 50 years out. The 20 and 50 years projections
•
are not intended to be very accurate, their purpose is to raise long range planning issues •
for discussion. These may in turn effect some shorter term decisions.
Where possible the results of these projections will be compared with the facilities of •
similar cities as a method of validating the results. .
• Option For Discussion
It is our philosophy that the end results of this study should be a combination of our
findings, projections and the City Councils vision for the City. For this reason,we will
develop several options for discussion with the City Council. The optionswill be
conceptual and developed to address both short and long term planning issues.
Worked To Be Perfbrmeds •
As part of our study,we will:
Analyze existing facilities and population projections.
Meet with individual Department Heads and City Administrator to discuss .
projection and future needs.
Review 'Vision' document.
Meet with City Council to present and discuss standards, philosophy,
findings, City's vision, and options.
Compare results with similar sized communities.
Develop options.
Compile report. .
It is expected the City will supply:

Dear Mr. Hendricks:
Thank you for contacting us about your space needs study. We have done many similar
projects. Examples are Cottage Grove and Woodbury.
Our Proposal is as follows:
1. Background Information: Summarize current staff levels, city population projections
and current spaces.
2. Interviews: Meet with supervisors and department heads about current and future
staffing.
3. Projections: Make preliminary space need projections based on interviews and
population growth forecasts.
4. Correlation: Cross reference space projections with per capita averages and cities
of similar size.
5. Report: Summarize space needs, research process and data base in a bound report
of about twenty pages.
Note that preliminary layout drawings are not included. We understand a space needs study
is the only work needed.
