sponsored a Public Safety Education booth at the Dakota County
Fair .
The booth is an alcohol effect driving simulator and to demonstrate
alcohol impairment . The program has been very successful and
popular in the- past and I expect will continue to be the same.
As in the past , our sponsorship involves $ 150 and use of materials
identifying the Farmington Police Department . There will be no use
of Farmington police personnel .
I request authorization to co-sponsor this program to a maximum of
$150 .

Every year police officers are required to complete mandated
training in various areas including use of force , firearms ,
First Aid , laws update , etc . These classes alone would cost
hundreds of dollars per officer .
For the past several years , the Farmington Police has entered
into a Training Agreement with the Law Enforcement Program of
the Dakota County Technical College to provide all mandated
training plus additional optional training at a substantial
fee reduction . This year ' s contract will be at- $298 per
officer for a total of $2 , 084 .00 . This contract fee is then
subject to a 100% reimbursement from Police Officer Standards
and Training ( POST) .
At this time , I am requesting authorization to enter into this
training contract .

SUBJECT: WASTE LUMBER RATE INCREASE - SOLID WASTE
DATE: JULY 16, 1993
Recently, the construction/demolition landfill rate for the 8} cy dumpsters
the City provided for some of its commercial customers increased to $60.00
per container. This new rate is still considerably less than the rate at
the MSW landfill. It is illegal to dump construction materials in an MSW
landfill.
Staff is recommending that the rate increase to $50.00 per container for
a one year period. This increase is significant as the current rate charged
customers is only $31.12. Yet it is still approximately one-third the rate
the customer was paying before the 8i cy containers were provided.
I feel that the rate charged to all solid waste customers should cover the
cost of the service provided. The intention of the rates is to cover all
associated costs, to break even. Even at the rate of $50.00 per container,
the City is not recuperating the cost of fuel, vehicle use, manhours, etc.
used to collect and dump the 8i cy containers (approximately $88/trip) . Based
upon the Council's establishment of the original rate of $31.12, staff did
not feel that the Council would want a higher rate at this time. It is staff's
recommendation to gradually increase the rate to cover all of the associated
costs. This increase could be spread over a three year period. The $50.00
rate is suggested based upon the first step of a three year incremental increase.
If the Council wishes to charge all of the associated costs to the customers
now, staff would calculate the revised rate. I am confident that such a
revised rate would still be significantly lower than the MSW rate charged
before the introduction of the 8} cy containers.

DATE: JULY 16, 1993
The City of Farmington is now reviewing its fourth and fifth PUD's. The early PUD process was
simplified because the projects were relatively straight forward. Once the schematic plan was ap-
proved,the developer moved directly into the platting process. Fee's,when charged,were related to
platting fee's. The most recent PUD's have made it clear that an abbreviated PUD process will not
work because of the amount of staff time that a relatively large PUD can require. Based upon this
experience,the staff has developed a fee shcedule for PUD's that is related to acreage during the the
schematic phase and a plat fee thereafter. The recommended amounts generally reflect the effort that
is involved.

Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Farmington, Minnesota, was held in the Civic Center of said
City on the 19th day of July, 1993 at 7:00 P.M. .

WHEREAS, pursuant to the City's solid waste policy, waste lumber and MSW
disposal are charged at the same rate; and
WHEREAS, waste lumber tip fees are substantially lower than MSW; and
WHEREAS, it is determined that it would be more equitable to charge waste
lumber disposal at a lower rate than MSW; and
WHEREAS, it has been determined that certain charges should be adopted to
cover administrative services performed in the submittal and review of PUD's.
NOW THEREFORE, BE IT RESOLVED that Resolution No. R13-93 is hereby amended
as follows:

SUBJECT: FILL AGREEMENT - PINE STREET CUL-DE-SAC
DATE: JULY 15, 1993
Attached you will find a proposed agreement between the City of Farmington and Mr. Oran
Weierke, 10 Pine Street. This agreement was prepared by Council direction. Attached is a map
which shows Mr. Weierke's property. Mr. Weierke desires to raise his property above the flood
elevation. The City's flood insurance maps indicate that elevation 9024 would meet the criteria.
Note that the existing ground at the southeast corner of Mr. Weierke's house is at elevation
902.26. I have calculated grades which would allow a minimum grade of 0.5% away from this
location for proper drainage.
The City is entering into this agreement to provide fill from City street reconstruction projects. It
is recommended that Mr. Weierke would have to pay for this material. The City has received
$1.75/cubic yard for this material in past projects. The City contracts require the contractor to
smoothen out the fill disposal site. Mr. Weierke has indicated that he could reseed the disturbed
areas. A preliminary estimate of the fill required is 300 cubic yards. Note that the fill will be
from zero to two feet in depth.
Mr. Weierke is not sure how he would like to handle the fill on his driveway (ranging from 1.7
feet to 2.04 feet). Using gravel to do it would provide the best base, however, it would be expen-
sive (est. 400 tons). Another option is to fill with dirt and place 8" of gravel on the fill for the
driveway (est. 150-200 tons of gravel). Another option would be to have Mr. Weierke place sand
fill on the existing driveway followed by 8" of gravel.
I have discussed this with Mr. Weierke. He has many options to choose from. Most involve
$2000.00 to $3000.00 in construction. Mr. Weierke has to decide whether to proceed or not.
I've invited him to the meeting to discuss the project.

AGREEMENT
THIS AGREEMENT, made and entered into this day of
, 1993, by and between ORAN WEIRKE, ("Weirke") , and the
CITY OF FARMINGTON, a Minnesota municipal corporation ("City") .
WHEREAS, Weirke is the owner of real property located at 10
Pine Street in the City of Farmington, County of Dakota, State of
Minnesota; and
WHEREAS, Weirke is desirous of having the City construct a
flood protection berm in accordance with the plan as shown on
Exhibit "A" ; and
WHEREAS, City is willing to provide the fill from certain
street reconstruction at a cost of $ /. 75 per cubic yard
for the fill, with the understanding that each truckload
delivered will be considered to be 12 cubic yards of fill; and
WHEREAS, Weirke is willing to pay $ /. 73 per cubic yard
of fill for the flood protection berm; and
WHEREAS, Weirke is agreeable to seed with grass seed any and
all areas disturbed by the construction of the berm including but
not limited to the berm.
NOW, THEREFORE, in consideration of the mutual undertakings
herein, the parties agree as follows:
1. City shall construct a berm in accordance with Exhibit
"A" attached hereto.
2 . Weirke shall pay to City $ 1. 7S"-- per cubic
yard of fill used in construction of the berm in that it will be
agreed that each truck will deliver 12 cubic yards of fill to the
site of the berm construction.
3 . City shall grade the fill in accordance with Exhibit
"A" attached hereto.
4 . Weirke is agreement that the fill provided by the City
shall come from certain street reconstruction projects within the
City of Farmington.
5 . Weirke agrees to seed with grass seed all areas
disturbed by the berm construction including but not limited to
the berm itself.

This memo is to inform you that I have polled the City Council members regarding the
filling of two Maintenance Worker l's as outlined in my previous memo. The Council will
be acting on the positions at the July 19, 1993 meeting.
I have contacted Mr. Tom Jensen and Mr. Gary Hilsgen about the positions. Both have
agreed to accept the positions. Mr. Jensen reported to work on July 12, 1993. Mr. Hilsgen
will report to work on August 9, 1993,following the 30 day notice he has given his former
employer.
These new hirings will add needed staff to the Street and Utility Crew of the Public
Works Department. The Public Works Department has one more position to fill.
Interviews for the position will be scheduled in the next week to 10 days.

SUBJECT: PERSONNEL - PUBLIC WORKS DEPARTMENT
DATE: JULY 13, 1993
The City has advertised for the hiring of a maintenance worker. (See attached
advertisement.) This position became open with the retirement of Don Dahl. The
City received 65 applications for the position. During the advertising period,
the City received a resignation notice from Bob Hanson. This created 2 openings.
Bob Hanson was employed as a Maintenance Worker II. A requirement of this position
is sewer and water licenses. I posted this job opening at the various shops
per the City/Union contract. Bill Weierke applied for the position. Bill meets
most of the job qualifications, with the exception of one license. Both Larry
and I feel that Bill should be given consideration for this promotion, however,
Bill must secure the required licenses first. Bill has indicated a willingness
to pursue the licenses. We have discussed the possibility of enrolling Bill
in a training session. The next regularly scheduled testing is in January, 1994.
It is my recommendation that the Maintenance Worker II position remain unfilled
until after February 1, 1994 to allow Bill the time to secure the required licenses.
If Bill does not secure the licenses by that time, I would review all Maintenance
Worker I employees for possible promotion.
It is my recommendation that the Public Works Department select two Maintenance
Worker I positions from the 65 applicants. These applicants were screened and
10 semi-finalists were chosen. The semi-finalists were sent a list of skills
(attached) and asked to indicate their knowledge. With this information, the
review committee selected 5 candidates for interviews and testing. The tests
consisted of a written exam and hands-on operation of equipment.
My recommendations for filling these two positions are:
1. Gary Hilsgen - Gary has worked for various cities since 1989. He has the
sewer and water licenses required and his equipment operation
skills are good. He also has a permit for the Class "A" driving
license. He has a high school diploma.
2. Tom Jensen - Tom has a strong background in construction. He has worked
for the City of Farmington previously. His equipment operation
skills are good and he holds a Class "A" license and a high
school diploma.
The wages for these positions will be set at the entry level of $11.86/hour or
$24,668.80 annually per the Union contract. Because both candidates exceed the
minimum requirements, it is my recommendation that they receive the first step
after the successful completion of their 6 month probationary periods. Their
wages would be raised to $12.55 per hour effective January 1, 1994 ($26,104.00) .

City of Farmington (pop. 6,500) a growing southern Metro city, located 25 minutes south of Mpls/St.
Paul is accepting applications for the position of Maintenance Worker in the Public Works
Department. Position is responsible for general maintenance duties as they relate to streets, sewer and
water utilities. Salary range is $23,927 - $28,655.
Minimum Qualifications: Class "A" Drivers License and High School Diploma. Previous experience

RE: SOLID WASTE POLICY REVISION

Attached is a revised copy of the Solid Waste Policy for the Council's approval. The revision is
in a fee for return collection trips for garbage and recyclables that do not meet City ordinances
and/or policy. Namely garbage and recyclables that are not put out by 7 am and/or before the
collection vehicle arrives, and containers that are placed less than the minimum distance from
obstacles.
Often the customer will call City Hall requesting that their material be collected a on return trip.
The customer often denies any non-compliance with ordinances or policy. Numerous discussions
with City personnel on the collection vehicles indicate that less than five percent of the incidences
are error or omission by the Solid Waste crews.
The return collection trips are too frequent of occurrences to disregard. Each trip, no matter how
short, takes time from a necessary duty and costs the City money. The cost to the City of operat-
ing its garbage and recycling vehicles runs between $80-100 per hour. An example of a simple
return collection trip to a home in Dakota County Estates, based upon a fifteen minute total round
trip time, can cost the City up to $25.00.
These costs are being incurred now and have been throughout Farmington's involvement with
garbage collection. A majority of these costs are being incurred due to forgetfulness and laziness.
The majority of the customers, who do a satisfactory job of preparing their material for collection,
are bearing the additional costs of the selfish minority.
The City, as the MSW collector, is trying to run the most cost-effective system possible in order
{ to save all of its customers money. A fully cooperative system has been shown to work the best
to meet has been shown to work the best to meet that desire. The suggested fee would encourage
that cooperation.
Staff is proposing that a $5.00 return collection fee be established. This fee would cover all cases
in which a return trip is requested by the customer because they did not comply with the City's
Solid Waste Ordinances and Policy. No fee would be charged to the customer due to error or
omission by City personnel.
This fee system is currently used by private haulers in the local area. This fee is not expected to
cover the total additional costs accrued by the return trips. The intent of the fee is to be more of a
penalty to help encourage a lessening of the occurrences.
Staff is not looking to lessen the service of its MSW collection, but to increase the efficiency
through a responsible, cooperative effort from its customers. Efficiency can help keep costs
down, to the benefit of the customers.
I strongly recommend the Council's approval of this revised Solid Waste Policy.

CITY OF FARMINGTON
PUBLIC WORKS DEPARTMENT
SOLID WASTE POLICY
I. PURPOSE:
To outline policies regarding all solid waste collection methods and administrative
procedures.
II. MSW COLLECTION
A. Residential, commercial, industrial and institutional collection is provided by the City on
a one time per week basis with an automated or semi-automated system using:
1. Single Family Residential (1) 90 gal. container
2. Multi Family (2-4 units) (1) 90 gal. container/unit
3. Multi Family (5+ units) 300+ gal. container
4. Commercial/Industrial 90 gal. or 300+ gal container, 8 1/2 yard rolloff box
(wood waste)
5. Industrial 300+ gal. container, 8 1/2 yard rolloff box
(wood waste)
B. The container shall be provided by the City. The type of container provided multi-family
(5+ units), commercial, industrial and institutional customers shall be determined by the
Public Works Director.
C. Additional collections for multi-family (5+ units), commercial, industrial and institutional
customers shall be determined by the Public Works Director.
D. The general location for single family residential and multi-family residences (2-4 units)
containers in areas without alleys is on the boulevard, one to four feet (l'-4') behind the
curb line or pavement with handle positioned away from the street. Preferred placement
is directly adjacent to or on the driveway. The container should be placed a minimum of
three feet (3') from any building or other obstacle and a minimum of two feet (2') from any
other container.
E. The Public Works Department reserves the right to designate location of containers to
maintain an efficient pattern of collecting and/or allow safe operations.
F. Location of the containers for multi-family (5+ units), commercial, industrial and
institutional customers will be determined by the Public Works Director.
G. Charges will be based on scheduled pickups, number and type of container.
(See Appendix A)
H. Properties located on alleys that require trucks to be backed in will only be collected from
the street side.
I. Automated refuse truck operators may leave the vehicle to move containers or dispose of
MSW which has spilled from the containers for an out of cab fee as listed in Appendix A.
J. Container accessibility is the responsibility of the customer. This includes snow removal
to allow pickup. Special care should be taken to place containers where a vehicle will
not block pickup.
K. The container may remain at the pickup location only on pickup days, unless an exception
is granted by the Public Works Director.
L. The customer is responsible for cleaning the container and any repairs caused by
negligence.
M. The City will repair damage caused by collection equipment or conditions beyond the
customer's control. Residents may be charged for repair or lost containers if negligence
is determined by the Public Works Director.
N. Only MSW as defined by the City Code will be accepted.
O. Only MSW which can be contained within the containers will be collected. Any MSW
which spills from the containers upon being grabbed by automated refuse truck shall be
considered to be unacceptable. (Refer to I)Any MSW which spills from the containers
during the dump mode shall be disposed of at no cost to the customer.
P. Collection will be on a regularly scheduled basis. In the event of a holiday, the scheduled
pickup will be determined by the Public Works Director.
Q. Failure by the City to collect MSW or recyclables due to the customers non-compliance
with City ordinances regarding solid waste collection and/or this solid waste policy is the
responsibility of the customer. Upon request, a return collection trip will be made by the
City at its convenience and for a return collection trip fee as listed in Appendix A.
III. EXTRA REFUSE SERVICES
A. Extra 90 gallon containers for weekly pickup are available at an extra charge.
B. 300+ containers are available for temporary usage by request at a charge listed in
Appendix A. Requests are processed by the Billing Clerk at City Hall with a 2 day
minimum notice.
C. A carry out service is available at an extra charge (see Appendix A) provided the container
is placed in an outside location that is accessible.
IV. RECYCLABLES
A. Residential
1. Residential collection shall be provided on a weekly basis at no extra charge.
2. Containers shall be provided by the City.
3. Recyclable materials should be placed separately in paper bags, except newspaper,
which may be placed directly in the container.
4. The following are determined as recyclable materials:
a. Newspaper, including inserts
b. Colored glass
c. Clear glass
d. Beverage cans(metal and aluminum)
e. Other cans such as juice, coffee, food cans commonly referred to as "tin cans"
f. Corrugated cardboard
g. Plastic containers with necks
h. Household batteries (AA, AAA, C, D, 6 & 9 volt, button batteries and nickel cadmium)
i. Magazines
j. Office-type paper
5. Recyclable materials shall be prepared as follows:
a. Paper- Bundle with twine or place in paper bags, combine newspaper and office paper.
b. Glass - Caps removed, rinsed, drained and separated by color.
c. Beverage cans - rinsed and drained.
d. Corrugated cardboard - bundled with twine. Bundles not to exceed 3'x3'.
e. Plastic containers - place in paper bags.
f. Batteries- place in clear plastic bag and clip to side of recycling bin.
g. Magazines - place in paper bags.
6. Containers will be placed 3-10 feet from the MSW container.
B. Commercial/Multi Family/Institutional
1. Collection shall be provided on a scheduled basis as determined by the Public Works
Director at no extra charge.
2. Containers shall be provided by the City.
3. Materials shall be placed in the proper containers unless otherwise specifically exempted
by the Public Works Director. Because of the variation in volumes, the Public Works
Director shall determine the size and style of containers.
4. The following items are determined as recyclable materials:
a. Newspaper
b. Colored glass
c. Clear glass
d. Office Paper
e. Computer paper
f. Food/beverage cans
g. Corrugated cardboard
5. Recyclable Materials shall be prepared in the following manner:
a. Newspaper - Bundle with twin or place in paper bag.
b. Glass - Caps removed, rinsed, drained and separated by color.
c. Beverage/Food Cans - Rinsed and drained.
d. Office/Computer Paper/Corrugated Cardboard - Because of the variation of volume
and density of these materials, the Public Works Director shall determine the method
of preparation.
6. Placement of containers shall be determined by the Public Works Director.
7. Because of the limited volume of recyclable materials produced by certain commercial
accounts, the Public Works Director may refuse to collect certain recyclable materials.
The Director shall report all refusals to the City Council.
8. Exemption: Upon recommendation of the Public Works Director, the City Council may
license a private hauler, public agency, service organization, or individual to collect or
convey recyclable materials within the City.
V. YARD WASTE COLLECTION
A. Residential collection is provided by the City on a 1 time per week basis on the same day
as MSW/Recyclable collection.
B. Containers shall be provided by the owner and may be either 39 gallon plastic bags or 39
gallon plastic containers maximum.
C. The City will only collect plastic bags with daily stickers or plastic containers with a
seasonal sticker attached to them.
D. Only yard waste as defined by Title 7-1-1 of the City Code will be accepted.
E. Containers will be placed 3-10 feet from the MSW container.
F. Charges will be on a per sticker basis as set forth in Schedule A.
G. Stickers may be obtained at the Billing Clerk's office at City Hall during normal office
hours.
VI. SPECIAL COLLECTIONS
A. Special wastes as defined by the City code or MSW which does not fit into containers will
be made by request.
B. Special collections will only be made on Tuesday of each week.
C. Requests shall be made by the Friday preceding the pickup day. Materials shall be placed
in a location determined by the Public Works Director.
D. Customers will be charged an extra fee for special collections.
VII. SENIOR CITIZENS
A. Upon review of operations after implementation of the Automated System, policies may
be adopted giving special consideration to senior citizens. Such policies may include:
1. Weight based system
2. Reduced fees
3. 30 or 60 gallon containers/reduced fees
