Ordinance Amendment Regarding Number of Allowed Dogs This ordinance is to increase the number of allowed dogs from two to three and revising the definitions for commercial kennels and residential hobby kennels where four or more dogs are kept. The Planning Commission has discussed this previously and with residents. Members had no concerns. MOTION by Tesky, second by Windschitl to close the public hearing. APIF,MOTION CARRIED. MOTION by Tesky, second by Windschitl to recommend approval of the ordinance amendment and forward to the City Council. APIF,MOTION CARRIED. b. Variance Request from the Minimum Rear Yard Setback within an R-2 Zoning District The city is requesting approval to encroach into the required rear yard setback and to cross property lines for the construction of a park shelter in Marigold Park in the New Sunrise subdivision. The property is 21195 Cameron Way and is zoned R-2 which requires a minimum rear yard setback of six feet. When the property was platted in 2006, the property was to be a private tot lot for the development. In 2014,the development went through the foreclosure process and was replatted as the New Sunrise addition. In 2014,the developer requested to deed this outlot to the city as a public park. A park master plan was approved in 2018. A shelter and playground equipment is to be installed. The playground equipment is larger than anticipated and has forced the shelter to be relocated on the south side of the trail. Shelter is 22 feet x 22 feet and would be located in the southwest corner of the property. The request meets the variance requirements. This playground will serve a wider age group of children. MOTION by Windschitl, second by Tesky to close the public hearing. APIF,MOTION CARRIED. MOTION by Tesky, second by Windschitl to approve the requested variance to allow the construction of a park shelter within the required rear yard setback and over the adjoining property lines subject to the submittal and approval of a building permit. APIF,MOTION CARRIED. Planning Commission Meeting May 14,2019 Page 2 4. Discussion a. Fairhill Estate at North Creek Final Plat M/I Homes of Minneapolis, LLC and True Gravity Ventures, LLC are the applicants. The development is located at the southwest intersection of 190th Street W and TH3. The preliminary plat contained 244 single family lots on 91 acres. Approximately 2.98 acres in the east central portion of the development will be dedicated for city parkland. Minimum lot sizes will be 4,800 to 9,425. The lots will deviate from the city's standards for minimum lot width and area requirements. Reduced front and side yard setbacks in certain portions are being requested and will be addressed as part of a Planned Unit Development Agreement. The main access will come from 190th Street W. The emergency access for the development will be from 194th Street and will be a gravel road with barricades near the future connection to 194th Street. A physical connection to 194th Street will only be made when the city and Empire Township agree that the connection for general traffic is needed or warranted. Sidewalks will be on one side of the roads with the exception of Colonial Trail which will have a sidewalk on both sides and is the main north—south road. There will be a trail network that bisects the center of the development going east and west as well as a north/south route through a gas easement. This is the first of a five-phase development and will consist of 97 single family lots and 17 outlots. Approval of the final plat is contingent upon the following: 1. All engineering issues shall be addressed,the construction plans for grading, storm water and utilities finalized and approved by the Engineering Department. Work with the parks and recreation director to finalize the grading of the park area to maximize the programmable area of the park and incorporating the trail along 195th Street from the entry drive to the gas easement. 2. A Development Contract between the applicants and the city of Farmington shall be executed and security, fees and costs shall be paid. Submission of all other documents required under the Development contract shall be required. 3. The preparation and execution of a Planned Unit Development Agreement. 4. The finalization and acceptance of all HOA documents. Chair Rotty was asked by a resident about the type of housing in the first phase. A representative of MII Homes stated there will be single family, villa homes and carriage homes. Chair Rotty asked about the timing of the project. Grading has started and street and utility work will start upon Council approval in June. Their goal is to have models open by the first week in September and start home construction in October. MOTION by Tesky, second by Windschitl to recommend approval of the Fairhill Estate at North Creek final plat and forward the recommendation to the City Council with the above contingencies. APIF,MOTION CARRIED. b. Upcoming Joint Meetings There will be a joint meeting with the City Council/Parks and Recreation Commission/ Planning Commission on May 20 to review the Bike Pedestrian Plan. '., FarmingtonMN.gov TO: Planning Commission FROM: Tony Wippler, Planning Manager SUBJECT: Conditional Use Permit Amendment-20522 Akin Road DATE: June 11, 2019 INTRODUCTION The Planning Commission approved a Conditional Use Peudit [CUP] on December 12, 2017 to allow a recreational vehicle storage facility on the property located at 20522 Akin Road. Subsequently the Commission approved and amendment to the CUP on November 13, 2018 that extended the timeframe for completion of the bituminous drive aisle through the site. The applicant, Eric Ruud, is requesting an additional amendment to the CUP to remove the timeframe for the drive aisle from the approved conditions. Mr. Marty Halstead is the owner of the property. DISCUSSION The applicant as part of the initial CUP approval in 2017 was to asphalt the front entry to the site and around the existing building(this was completed in 2018). Additionally, the applicant agreed to pave a drive aisle through the site in between the various limerock parking pads (see attached list of conditions, specifically #4). The drive aisle was to initially be paved by December 12, 2018 per the conditions of the approved CUP. The Planning Commission granted approval of the requested amendment in 2018 to extend this timeframe to June 30, 2019 to allow the spring cycle to pass and to see how severe any tracking of surface material off site may be. Mr. Ruud is requesting a second amendment that would eliminate the timeframe for completion of the drive aisle from the conditions of the approved CUP, thereby not requiring the applicant to pave said drive aisle through the site. Staff has reviewed the request and monitored the site over the last six months and has not witnessed any off site tracking of material. Staff is comfortable with granting the requested amendment conditioned upon the city reserving its right to revisit and potentially require the need for the paved drive aisle through the site if determined necessary in the future. ACTION REQUESTED Approve the CUP amendment eliminating the timeframe for completion of the bituminous drive aisle from the approved conditions subject to the following: 1. The hours of operation for the shop shall be limited to 6:00 a.m.to 9:00 p.m. CITY OF � \!J 430 Third St, Farmington, MN 55024 FARM N GTO 65,._.)._68.0 FarmingtonMN.gov TO: Planning Commission FROM: Tony Wippler, Planning Manager SUBJECT: Conditional Use Permit Amendment- 321 Elm Street DATE: June 11, 2019 INTRODUCTION Eric Zeimet of EZ Auto Repair, LLC is requesting an amendment to a Conditional Use Permit [CUP] for the expansion of his auto repair, major use located at the northwest intersection of Elm Street and 4th Street (321 Elm Street). The subject property is zoned B-2 (Downtown Business)which conditionally allows for Auto Repair, Major uses. DISCUSSION The applicant was granted a conditional use permit on October 17, 2017 to construct a 3,616 square foot building to house his auto repair, major business (EZ Auto). The building was completed and a Certificate of Occupancy granted on June 4, 2018 by the Building Official. The applicant has since purchased the adjacent lot(212 4th Street)to the north of his existing business and is proposing to demolish the existing house on site in order to accommodate the proposed business expansion. The property were the house is located is also zoned B-2(Downtown Business) and will need to be combined with the 321 Elm Street parcel. A condition of approval should be that a lot combination be executed through Dakota County to combine the two parcels into one parcel identification number. The proposed expansion includes a 2,520 square foot(35' x 72')building addition as well as parking on the north end of the lot with access to this parking area from the adjacent alley. The addition will be constructed of the same material as the existing building(architectural precast concrete walls). Setbacks and Lot Coverage The minimum bulk density standards for the B-2 zoning district are: • Lot area: none • Lot width: none • Front yard setback: 0 feet • Side yard setback: 0 feet • Rear yard setback: 0 feet • Maximum height: 45 feet • Maximum lot coverage of all structures: 100 percent The setbacks for the proposed addition are as follows: • Front yard setback off of Elm Street: NA • Front yard setback off of 4th Street: approximately 13 feet • Side yard setback: 5 feet from western property line • Rear yard setback: approximately 45 feet • The building coverage with the expansion is proposed at 40.04% The setbacks and lot coverage for the proposal meet the above mentioned standards. Transportation and Off-street parking As shown on the attached site plan, the existing curb opening off of 4th Street is proposed to be enlarged from its current width of approximately 33 feet to a width of approximately 66 feet. Section 10-6-4 of the city code limits the width of access drives to 30 feet at the right-of-way line and at the public street paved surface. The driveway along 4th Street will have to be reduced to 30 feet(or to what is existing-33 feet)or the applicant will have to apply for a variance to exceed the limitation provided above. Being the subject property is zoned B-2, it is exempt from the off-street parking standards. With that being said, the applicant is proposing to add 7 off street stalls to the north of the proposed building addition. ACTION REQUESTED Approve the CUP amendment allowing the expansion of the Auto Repair, Major use within the B-2 zone located at 321 Elm Street, subject to the following: 1. The applicant obtaining all necessary building permits. 2. The applicant obtaining a demolition permit for the removal of the existing house located at 212 4th Street. 3. The execution of a lot combination through Dakota County to combine the two parcels into one parcel identification number. 4. The access drive off of 4th Street should be reduced at a minimum to 33 feet in the absence of a variance being approved by the Planning Commission. 5. The applicant was Oleg Vdovchenko of ONG Auto, LLC DISCUSSION Attached, for the your review is the staff memorandum from the June 13, 2017 meeting. Three conditions were assigned to the conditional use peiuut approval, those conditions are: 1. The applicant obtains all necessary building permits from the city's Building Official. 2. A sign permit is applied for any external signage. 3. The proposed parking area must be surfaced with concrete or bituminous and shall be setback at least ten feet from all property lines. Over the last several months the city has received numerous complaints regarding the overall condition that the property is being kept. Vehicles are being parked and stored off of the hard surface. Vehicles are being kept in the city's boulevard (area between the curb of the roadway and the front property line), and Pine Street has continually been used as a staging area for loading and off loading of vehicles for this site. Additionally, the required fencing that was shown and approved as part of the site plan for the CUP has not yet been installed. The City mailed Mr. Vdovchenko the attached compliance letter on February 14,2019 indicating that the property was in violation of the terms and conditions of the approved CUP and provided him until April 15, 2019 to rectify the parking of the vehicles on site, installation of the fencing as well as general clean up of the property. As of the date of this memorandum, these issues still exist on this site. The February 14th letter indicated that non-compliance would result in the city taking action to revoke the CUP. ACTION REQUESTED Review the attached information and direct staff to set a public hearing for July 9, 2019 for consideration of revocation of Conditional Use Permit for the property located at 315 Pine Street. There is an existing 5,800 square foot building that will be utilized on the property. Surrounding Land Uses:A mixture of commercial and industrial as well as a single-family residence is adjacent to the east. a vacant lot is adjacent to the west. A commercial business and a single-family residence to located to the south. The Vermillion River is to the north of the subject property. Proposed Land Use: Major Auto Repair and Automobile Sales DISCUSSION The applicant,Oleg Vdovchenko,has submitted a Conditional Use Permit application in order to allow major auto repair to take place on the property located at 315 Pine Street. Mr. Vdovchenko is proposing to open a business that would consist of repairing motor vehicles including the repair,rebuilding and reconditioning of engines,body work,framework,welding and major painting. Mr.Vdovchenko would also be selling vehicles from the premises. Automobile sales is a permitted use within the B-3 zoning district. 1 The applicant will be utilizing the existing building on site and modifying it to meet his business needs,this will include the addition of two overhead doors on the west side of the building. If the Conditional Use Permit is approved,the applicant will need to contact the City's Building Offiicial to determine what building upgrades, if any,would be necessary for the proposed use. The applicant is proposing to create a parking area for his vehicles on the west and northern sides of the property(see attached site plan). The applicant is showing the parking area as gravel. Section 10-6-4(B)of the City Code requires any off street parking lot and driveway be surfaced with concrete or bituminous material. Additionally,code requires a minimum nonpaved area of at least ten feet in width between the edge of the parking area/lot and the property line. The site plan shows a setback of five feet for the parking area to the property line. The site plan also shows at least four parking spaces in the right-of-way of Pine Street. All parking areas must be keep on the applicant's property and outside of the city's right-of-way. As shown on the attached site plan,the applicant is proposing the construction of two accessory shop buildings towards the northern portion of the site. The applicant is not proposing to construct these buildings immediately. Accessory structures on commercial property are approved through a Conditional Use Permit[CUP]process. Separate CUP's will be required if and when the applicant is ready to proceed with the construction of the accessory buildings. A Conditional Use Permit shall be approved if it is found to meet the following criteria: 1. The proposed use conforms to the district permitted and conditional use provisions and all general regulations of this title. The subject property is zoned B-3. The use of the property as an auto sales lot is a permitted use. Additionally, the applicant wishes to do major auto repair work out of the existing building. Auto repair; major is a conditional use in the B-3 zoning district. 2. The proposed use shall not involve any element or cause any conditions that may be dangerous., injurious or noxious to any other property or persons and shall comply with the performance standards listed below. Staff believes the use will not involve any element of cause any conditions that may be dangerous, injurious or noxious to any other person or property. The proposal is similar to other uses in and around the property. 3. The proposed use shall be constructed,designed,sited,oriented and landscaped to produce harmonious relationship of buildings and grounds to adjacent buildings and properties. The proposed use will utilize the existing building on site. The offstreet parking will be located on the west and north side of the property. 4. The proposed use shall produce a total visual impression and environment which is consistent with the environment of the neighborhood. Staff believes the proposed use is consistent with the business uses that are in the near vicinity of this property. 5. The proposed use shall organize vehicular access and parking to minimize traffic congestion in the neighborhood. Access to the site will continue to be from the existing driveway that is located in front of the building. Additional parking areas will be added to the west and northern side of the property. 6. The proposed use shall preserve the objectives of this title and shall be consistent with the comprehensive plan. The subject property is comprehensively guided as commercial. The proposed use is consistent with the 2030 Comprehensive Plan. ACTION REQUESTED Approve the Conditional Use Permit allowing major automobile repair to take place on the property addressed as 315 Pine Street,subject to the following conditions: 1. The applicant obtains all necessary building permits from the City's Building Official. 2. A sign permit is applied for and approved for any external signage that may be placed on the premises. 3. The proposed parking area must be surfaced with concrete or bituminous and shall be setback a minimum of ten feet from all property lines. 4. The CUP was to allow Major Auto Repair within the B-3 (Heavy Business)zoning district. The conditions that are attached to your CUP are as follows: 1. The applicant obtains all necessary building permits from the city's Building Official. 2. A sign permit is applied for any external signage. 3. The proposed parking area must be surfaced with concrete or bituminous and shall be setback at least ten feet from all property lines. The city has received a number of complaints regarding the condition that the property is being kept. I recently inspected the property and noticed the accumulation of auto parts scattered throughout the property. I realize that with the type of business that you operate at this property there will be a certain amount of these items that will be present on property from time to time;however,what is currently on the property is excessive without the proper screening in place. During this inspection,it was also noticed that the property is not in compliance with the approved CUP and site plan from 2017. As previously noted, a condition of approval for the CUP was that all parking must be setback at least ten feet from"all"property lines—this includes the front. Upon inspection of the property it was noticed that you are parking vehicles up to the property lines and almost entirely to the curb line of Pine Street. All parking must be kept outside of the city's right-of-way and on private property. This means that all vehicles must be stored at least 30 feet from the back of curb of Pine Street and at least ten feet from all other property lines. It also appears that some vehicles may not even be parked on a hard surface as required. The parking of vehicles was specially discussed at the Planning Commission on June 13,2017. Additionally,the site plan that was approved as part of the CUP application shows the installation of fencing on site to provide screening to adjacent properties and added security for your operation. As of the date of this letter,the fence has yet to be installed. I am providing you with 60 days to come into compliance with the approved CUP and site plan. This includes rectifying the parking of vehicles on site as mentioned above,installation of the fencing as shown on the approved site plan as well as general cleanup of the property. Failure to comply with the terms of the CUP and approved site plan by April 15,2019 will result in the city taking the necessary actions to revoke your CUP.
