COUNCIL MEETING
A regular monthly meeting of the Village Council of the Village of Farmington, Minn.
was held in the council chambers on January 8th, *1951 with all members present.
The minutes 'of the last regular meeting were read and approved.
The following bills were reviewed and upon motion by A.H. Meld, seconded by Reuben
Petersen, ordered paid from the fund indicated:

The bill from Faribo-Kennon Fire Equipment Co. for fireman's helmets was reviewed
and upon motion by A.H. ield, sedonded by Eugene Kuchera, payment was rejected
until adequate adjustment was made on the fire hose previously purchased from
,said concern. •
The Village Clerk's Financial Statement for the year ending December 31, 1950 was
presgnted and reviewed. Upon motion by A.H. Field, secpnded by Reuben Petersen,
the Financial Statement was approved, ordered placed on file for public inspection,
and a copy thereof published in the DaJota County Tribune in accordance with the .
requirement of law.
A request having been received from the Village hreasurer, it was moved by Reuben

Petersen, seconded by A.H. Field, that the First National Bank of Farmington,
Farmington, Minn. be designated as the depositary of all village funds that the
collateral pledged by the said bank be approved, and that the Federal Reserve Bank
of Minneapolis, Minn. be designated as the place of safekeeping of said collateral.
Motion duly carried.
Upon motion by Eugene, Kuchera, seconded by `t'euben Petersen, the offical bonds of:
C.B. Whittier, Village Treasurer, Oscar J. Lubke, Village Assessor, and C.G. Chase,
Justice of the Peace were approved and ordered placed on file with the designated
authorities.
Mr. D.B. Whittierm Chairman of the Youth Commission appeared before the Council and
presented a statement of Receipts & Disbursements for the year ending Dec.31,1950.
After due consideration, upon motion by Reuben Petersen, seconded by A.H. Field,
the Clerk was directed to transfer $500.00 from the General Fund to the Youth
Commission.
Upon motion by Reuben etersen, seconded by Eugene Kuchera, the application of the
Clifford arson Post #189, The American Legion, for an "On-Sale Club Liquor License"
was approved at the fee of $100.00 as set by law, and a license ordered issued.
A letter from the Farm. Bureau 'service Co. requesting the use of the old chairs that
were moved out of the City Hall was read. The Clerk was instructed to notify said
organization that the chairs could be used free of charge.

Upon motion by H.M. Johnson, seconded by A.H. Field, the Clerk was directed to
transfer $1,500.00 from Liquor Fund to General Fund.
Upon motion by Reuben Petersen, seconded by A.H. Field, the Clerk Imes directed to
make a temporary transfer of $1,500.00 from the P.I.R. Fund to the "amoral Fund.
A proposed resolution entitled: "RESOLUTION AUTHORIZING MAYOR & CLERK TO EXECUTE
AGREEMENT WITH TWIN CITY MILK PRODUCERS ASSN. FOR THE CONSTRUCTION OF A CIVILIAN
DEFENSE WATCHTOWER" was intro4uced and assigned No. 1-51. H.Y. Johnson moved its
adoption, seconded by Reuben etersen. Upon being put to vote there were: AYES,5;
NAVES, 0; and the resolution was declared adopted and passed.
Edward Pechacek, Altoit Youngkrantz, and J.L. Turek Jr. representing the Sypal-
Lundgren Post of the eterans of goreign Wars, appeared before the council re-
questing information regarding the requirements that must be met in order to be
elgible to apply for a Club Liquor License or an Non-Intoxicating Beverage license.
After ful� discussion, the Mayor informed the delegation that in view of the fact
that the illage Attorney was absent, no decision could bei rendered at this time
and suggested that they appear before the council at the next regular meeting in
March.
The Mayor i4quired if any bids had been received for the purchase of a police squad
car in answer to our advertisement in the Dakota County Tribune. The Clerk in-
formed ?e council that two bids had been received. Whereupon itwas moved by
Reuben etersen, seconded by Eugene Kuchera that bids be closed.

The Mayor then instructed the Clerk to open and read the bids which were as follows:

After due consideratftn,, it was moved by Reuben Petersen, seconded by Eugene
III Kuchera to accept the bid of Farmington Auto Company for a 1951 Ford V-8 2r.
Sedan at a cost of $1,496.00. Upon being put to vote there were: - AYES, 5; NANFS,0;
and the motion was declared passed. The Clerk was instructed to place an order
in accordance with said bid.

Upon recommendation of the Building & Planning Commission and notion by A.H. Field,
seconded by Eugene .Kuchera, the following building permits were ordered issued:

After full discussion, it was moved by H.M. Johnson seconded by A.H.Field, that

Motion by H.M. Johnson, seconded by Eugene Kuchera,. that the following licenses
be issued:

** After due consideration and upon recommendation of George Sypal, Manager of
the Municipal Liquor Store, it was moved by A.H. Field, seconded by Eugene
Kuchera, that Paul Leidner be hired as a bartender gt the Municjpal Liquor
Store at a salary of $210.00 per month effective March 1, 1951. Upon being
put to vote there were: AYES, 4; NAYES, 0; and the motion was declared
passed.

Applications for building permits and the recommendations of the Building &
Planning Commission were duly considered. Upon motion by Reuben Petersen,
seconded by Eugene Kuchera, the following building permits were ordered issued:

Upon motion by H.M. Johnson, seconded by Eugene Kuchera, the Clerk was directed
to transfer $150.00 from the Rural Truck Fund to the General Fund and transfer
the balance to the Farmington Fire Department.
The Clerk read a letter from Mrs. ########00# John Harkins and Getrude Harkins
regarding a frozen sewer line into their property. ,After due consideration,
the Clerk was instructed to notify the parties concerned that the Village of
Farmington felt no liability of their part inasmuch as the condition existed
in' the service connection and not in the sewer main ibself.

A petition was received from property owners requesting sidewalk on Elm Street
between 5th and 6th streets. A public hearing on said petition was set for
Monday, June 4, 1951. `
Applications for "On-Sale & Off-Sale Non Intoxicating Beverage" licenses were
reviewed. `Upon motion by A.H. Field, seconded by Reuben Petersen, the following
licenses were ordered issued: `

moved by A.H. Fields seconded by Eugene Kuchera, that the Council did not feel
it was proper to be a member of the said organization. Upon being put to vote
there were:Ayes, 4; NAYES, 0; and the motion was declared carried.
The matter of `salaries for the employees of the Village Street Department was
discussed. Upon motion by Eugene Kuchera, seconded by Reuben Petersen, the
following salaries changes were made effective June 1, 1951:
Bill B. Hince - new salary $225.00 per month
Melvin Doffing - new salary - $215.00 per month.
The hea g was held on the proposed construction of Sidewalk on Elm Street
betweenth and 6th streets. No objections being voiced, a proposed resolution
entitled: "RESOLUTION FOR SIDEWALK CONSTRUCTION" was introduced and assigned
No. 4-51. H.M. Johnson moved its adoption, seconded by A.H. Field. Upon
being put to vote, there were: AYES,5;; NAYES,p; and theresolution was de-
clared adopted and passed and the Clerk directed to call for bids in accordance

The council then formally adjourned and reconvened as the Board of Review for the
personal property assessments. Mr. A.L. Mallery, County Assessor, and Mr. O.J. Lubke,
local assessor, met with the Board. Assessments were duly considered and adjustments
made to equalize assessments on the basis of evaluations.

The matter of salaries for the Liquor Store employees was discussed and compacted
with other city employees. In order to put these employees on an equal basis,
it was moved by Reuben Petersen, seconded by H.M. Johnson, that the salaries of
Chas. Riegert and Paul Leidner be set at $215.00 per month, effective 8-1-51.
Motion by Reuben Petersen, seconded by Eugene Euchera, that in view of 5 years
continuous service in the employ of the Village, George Sypal be granted a two
week vacation with pay. Carried.
It was called to the attention of the Village Council that a complaint has been
filed of a violation of a Village Ordinance and that the case had been scheduled
- for Justice Court. In view of the alleged# ordinance violation, the Council
directed their attorney, John J. McBrien,, to act as prosecuting attorney for the
Village. .

Proper notice having been given in accordance with Village Ordinance #119,
a public hearing was then held on the request of the Continental Oil Co.
for a non-conforming use permit at 400 Elm Street. Mayor Ingerson directed
John J. McBrien to conduct said hearing. Mr. A.C. Smith Jr., representing
property owners in said area, presented objections to the granting of the
permit in question. Mr. Frank Hauser of aribault, Minn, representing The
Continental it Company spoke in favor of said permit. After a full dis-
cussionthe public hearing was concluded. Mayor Ingerson,then relinquished
the Chairman's position to Reuben Petersen and absented himself for the
discussion that followed. After due consideration, it was moved by A.H. Field,
seconded by Eugene Kuchera, that the non-conforming use permit application-by
Continental Oil Co. be denied. Upon being put to vote, there were: AYES, 4;
NAYES, 0; and the motion was declared passed.

seconed by A.H. Field that the Village Council decline to request a re-assessment
inasmuch as it was felt that the local assessor had already made the assessment on
a fairly equitable basis and that the Clerk be directed to notify the Minnesota

Upon motion by H.M. Johnson, seconded by Reuben Petersen, the Clerk was directed to
make a temporary transfer of $2,000.00 from the P.I.R. Fund to Ggneral Fund.
The Clerk read a report from the Minnesota Department of Health following a regular
inspection of the Village Water System. The contents therein were noted and the
report ordered placed on file with the Water Board.
Upon motion by H.M. Johnson, seconded by A.H. Field, the polling hours for$ the
annual village election to be held on December 4, 1951 were set from 1:00 P.M. to
8:00 P.M. and the Clerk was directed to post notices accordingly.
An application for an "On-Sale and Off-Sale Non-Intoxicating Beverage License" was
received from Richard A, Stassen to replace the license issued to Theodore C. Engle.
Upon motion by Reuben Petersen, seconded by Eugene Kuchera, the On-Sale & Off-Sale
Beverage License ofTheodore C. Engel was ordered cancelled and a refund of$40.00
ordered paid.
Upon motion by Reuben Petersen, seconded by Eugene Kuchera, a On- ale & Off-Sale
Non-Intoxicating Beverage License was ordered issued to Richard A. Stassen for a a.
period of six months.
After a full discussion and due consideration of 1951 expenditures to date and upon
motion by A.H. Field, seconded by Eugene Kuchera, the following budget for the year
of 1952 was established and the Clerk directed to notify the County Auditor of the

to pay the Farmington Public Library Fund the annual contribution of $200.00.
A meeting was then held with the members of the Water Board regarding the possibility
of a stand-by well and auxiliary pumping facilities. The Council directed the
Welter Board to check with their engineers regarding possible solution to the
problem and report back to the council.

its adoption, seconded by Reuben Petersen. Upon being put to vote, there were:
