A special meeting of the Village Council of the Village of Farmington, Minn.

COUNCIL MEETING
A regular monthly meeting of the Village Council of the Village of Farmington, Minn.
was held in the council chambers on January 5th, 1953 with all members present.
The minutes of the last regular meeting and of the special meeting held since that
date were read. Upon motion by A.H. Field, seconded by Reuben Petersen, the Clerk
was directed to correct the minutes of the last regular meeting (December 8, 1952
as follows: Delete that portion pertaining to the presentation of a proposed
Ordinance No. 121 and subsitute "that it was moved by Reuben Petersen, seconded by
A.H. Field, that a franchise be granted to Peoples Natural Gas Division- Northern
Natural Gas Co. Upon being put to vote, there were: AYES, 5; NAYES, 0; . and the
motion was declared passed".
Upon motion by Eugene Kuchera, seconded by Reuben Petersen, the Council approved the
action taken at the special meeting held on December 29, 1952.
Upon motion by H.M. Johnson, seconded by Reuben Petersen, the Clerk was directed to
transfer $1,000.00 from Liquor Fund to General Fund.

• The applications for building permits and the recommendations of the Building &
Planning Commission were duly considered. Upon motion by A.H. Field, sedonded by
Reuben Petersen, a permit was ordered issued to Alfred Fischer to construct an
addition to the existing commercial building at 821 Third Street.
Upon motion by A.H. Field, seconded by Reuben Petersen, the official bonds of
C.B. Whittier, Village Treasurer; H.M. Johnson, Village Clerk; O.J. Lubke,
Village Assessor; and C.G. Chase, Justice of the Peach were approved and ordered
placed on file with the proper authorities.
IIIA¢ request having been received from the Village Treasurer, it was moved by Reuben
pete'rsen, seconded by Eugene Kuchera, that The First National Bank of Farmington,
Farmington, Minn. be designated as the depositary of all village funds, that the
collateral pledged by the said bank be approved, and that the Federal Reserve Bank
of Minneapolis, Minn. be designated as the place of safekeeping of said collateral.
Upon motion by A.H. Field, sedomded by H.M. Johnson, the following appointments
for the year, 1953, made by Mayor Ingerson, were approved:

E After considerable discuss ion and due deliberatiin, a proposed ordinance entttled:
"ORDINANCE GRANTING A NON-EXCLUSIVE FRANCHISE TO NORTHERN NATURAL GAS COMPANY,4
CORPORATION (operating as PEOPLES NATURAL GAS DIVISION)" was introduced and
assigned No. 121. A.H. Field moved its adoption, seconded by Eugene Kuchera.
Upon being put to vote, there were: AYES, 5; NAYES, 0; and the ordinance was
declared passed.
Attorney John McBrien reported to the Council that he had received word from the
Miltaukee Railroad Company concerning the parking of the engines adjacent to Pine
Street ii#######i#########ii and that they were giving the matter their attention
but that they could promise no definite action until spring.
Attorney McBrien also reported that he had received lord from the Attorney General
in response to his inquiry regarding the legality of the proposed agreement between
the State Civilian Defense Committee and the Village of Farmington. The Attorney
General °reported that the -State Civilian Defense Director had withdrawn the proposed
agreement and therefore no decision appeared necessary.

Special Meeting
A special meeting of the Village Council of the Village of Farmington, Minn.
was held in the offices of the First National Bank of Farmington on
January 9tti,1953 with the following members present: Francis Ingerson,
Reuben Petersen, Eugene Kuchera, ### H.M. Johnson, and A.H. Field.
The Village Clerk's Financial Statement for the year ending December 31, 1952
was presented and reviewed. Upon moyion by A.H. Field, seconded by Eugene
Kuchera, the Financial. Statement was approved, ordered placed on file for
public inspection, a copy thereof published in the Dakota County Tribune,
and a copy thereof filed with the Public Examiner f or$ the State pf Minnesota,
in accordance with the/ requirements of law.
The General Liability Insurance Policy submitted by Anchor Casualty Company
of St. Paul, Minn. was duly considered, particularily in reference to the
question of inclusion or elimination of the Civil Liability Endorsement
for the Munttipal Liquor Store. Upon motion by Eugene Kuchera, seconded
by A.H. Field, the policy was accepted including the Civil Liability
Endorsement.
Upon motion by Reuben Petersen, seconded by EugeneKuchera, the application of the
Clifford Larson Post #189, The American Legion, for an "On-Sale Club Liquor
License" was approved at the fee of $100.00 as set by law, and a license
ordered issued.

Special Meeting
A special meeting of the Village Council of the Village of Farmington, Minn.
was held in the offices of The First National Bank of Farmington, on the
24th day of January, 1953 with the following members present: Francis
Ingerson, Reuben Petersen, and H.M. Johnson.
A prposed resolution entitled: "RESOLUTION AUTHORIZING MAYOR & CLERK TO
EXECUTE A LEASE AGREEMENT WITH THE STATE OF MINNESOTA, DEPARTMENT OF CIVIL
DEFENSE" was introduced and assigned No. 1-53. Reuben Petersen moved its
adoption, seconded by H.M. Johnson. Upon being ,putto vote there were:
AYES, 3; NAYES, 0; A.H. Field and Eugene Kuchera being absent, a majority
of}g the Village Council voted therefor and the resolution was declared
adopted and passed.

The matter of the increase of rates for natural gas users was thoroighly
discussed. After due consideration and upon motion by H.M. Johnson, seconded
by A.H. Field, the Village Attorney was directed to make inquiry to the
Peoples Natural Gas Division - NorthernNatural Gas Co., requesting information
for the basis used in determining the increase in rates that became effective
with the last billing and Ei report back to the council.

Upon motion by H.M. Johnson, seconded by Eugene Kuchera, the Clerk was directed
to issue a Wholsale Non-Intoxicating Beverage License to the following for a
period of one year upon payment of the license fee of $10.00:

Attorney McBrien reported that he had contacted the Peoples Natural Gas Division
regarding the increase in gas rates and that Mr. Harrison, President of the
Division, intended to attend this meeting if weather permitted travel by air.
If not, he stated that he would plan to attend the next regular meeting. In
view of the fact that flying conditions were not favorable, Mr. MoBrien stated
that he could not be present but would be expected at the next meeting.
The matter of the proposed increase in telephone rates and the notice of the
hearing with the Minnesota Railroad & Warehouse Commission was discussed.
Upon motion by Reuben Petersen, seconded by Eugene Kuohera, Attorney McBrien
was directed to attend the hearing at Slayton, Minnesota on March 10th, 1953
and represent the Village of Farmington in opposition to the proposed increase.

Upon motion by A.H. Field, seconded by Eugene Kuchera, the Clerk was directed to
transfer $1,500.90 from Liquor Fund to General Fund.
H.W. Hosmer and George Mussman of the Building & Planning Commission discussed
with the Council the appointment of a Building Inspector and the duties of said
inspector. After due consideration, upon motion by Eugene Kuchera, seconded
by H.M. Johnson, Bernard Record was appointed Building Inspector of the year
1953.
Mr. G.J. Reihsen and Gordon Bezdicheck of the Farmington Commercial Club
appeared before the Council to discuss the matter of Angle Parking on Third
Street. After considerable discussion, the Mayor informed the representatives
III present that the Council would investigate the matter and report back to the
Commercial Club. Mayor Ingerson then directedv Attorney McBrien to investigate
the matter of bus stops, etc.-and report to the Council.
Applications for building permits and the recommendations of the Building &
Planning Commission were duly considered. Upon motion by Eugene Kuchera,
seconded by A.H. Field, Unit #4-NE of the Veterans Housing was rented to
William Cook and the following permits ordered issued:

structure at #320 Elm Street.

III Upon motion by H.M. Johnson, seconded by Eugene Kuchera, the proposal of
L. Paulle-Midway to prepare plans for the interior of a proposed new Liquor
Store at a cost of $200.00 was accepted and the Clerk authorized to sign
said proposal in behalf of Village of Farmington.

A special meeting of the Village Council of the Village of Farmington, Minn.
was held in the offices of the First National Bank of Farmington, on Saturday,
April 25th, 1953 with all members preeent.
John J. McBrien, Village Attorney, reported that the requested increase in
rates by the Central Telephone Company was granted by the Minnesota Railroad
& Warehouse Commission. He also discussed the rate of return for this
exchange in comparison with return for the whole system and recommended that
the "Village appeal the decision of the Railroad and Warehouse Commission.
A proposed resolution entitled: "RESOLUTION AUTHORIZING AN APPEAL TO BE TAKEN
FROM ORDER OF THE RAILROAD AND WAREHOUSE COMMISSION" was introduced and assigned
No. -2-53. H.M. Johnson moved its adoption; seconded by A.H. Field. Upon being
pmtto vote, there were: AYES, Francis Ingerson, A.H. Field, Reuben Petersen,
Eugene Kuchera, H.M. Johnspn; NAYES, None. and the resolution was declared
adopted and passed.

A letter from Mrs. Harris Ehlers, Secretary of to Castle Rock Farm Bureau Unit,
III complaing about the condition of the city dump was read. After-due discussion,
it was decided to refer the matter to the Street Commisioner, recommending that
a bull dozer be obtained to clean up the area.
A delegation of citizens on Third Street (H Smithberger, Haffner, Diesen
and Sawyer) appeared before the council complaining that the property formerly
occupied by the Farmington D-I oil station was a public nuisance; that it was
allowedbto fill up with used machinery, junk, and weeds; that the noise of
welding and repairing was not conducive to a residential neighborhood. After
considerable discussion, it was proposed that a meeting be scheduled with
Fischer Bros. to see if a solution could not be worked out.
John McBrien reported that an appeal had been taken with District Court from the
ruling of the Minnesota Railroad & Warehouse Commission regarding the increase
in telephone rates. He further explained that he would request a stay of the
order of the rate increase pending a determination of the appeal.
The matter of parking on Third Street was discussed. In a survey made by McBrieh
and Police Chief Klotzbeacher, it showed that diagonal parking would provide space
for 32 additional mars, if no exception was made for the Bus Depot at the Grey
Sweet Shop. Klotzbeacher reported that a 12-day survey showed that there were
an average of 25 to 28 cars, owned by business proprietors and their employees,
were parked in the business area for hours at a time. After considerable
discussion, it was proposed that a meeting be scheduled with the Commercial
Club to discuss the matter further.
III A discussion of the proposed new Liquor Store followed but no action taken at
the present time, pending further$ investigation and study.

IIIA delegation of property owners on south Third Street appeared beforeithe Council
regarding action taken on the former Farmington D-X station. The Mayor informed
them that the Pillage Clerk and himself had discussed the matter with Fischer
Bros. and that they were in the process of taking steps to correct the situation.
G.J. Reihsen, President of the Farmington Commercial Club, met with the Council
to discuss the matter of parking in the business area on Third Street. After a
lengthy. discussion and due consideration, it was decided that, in the interests
of safety, parallel parking should be continued. While it was recognized that
diagonal parking would provide additional parking space, it was the unanimous
opinionof the Council that the increased traffic hazards to both pedestrians
and motorists would not justify the change. -Additional factors influencing
the decision were: Additional enforcement problems requiring the services of
anotherpolice officer; maintenance problems of cleaning streets in summer and
snow removal in winter; and the resulting necessity of prohibiting farm truck
parking,in the entire business area.
Upon motion byA.H. Field, seconded by Reuben Petersen, the resignation of Paul 1
Leidner as bartender in the Liquor Store was accepted.

his Gas Station at Third & Elm Streets and generally agreed that every attempt
would bemade to correct the situation.
A proposed resolution entitled: "RESOLUTION DECLARING ASSESSABLE COST OF SIDEWALK
CONSTRUCTION" was introduced and assigned No. 4-53. H.M. Johnson moved its

Minn. was held on November 9th, 1953, having been postponed from November 2, 1953
for lack of 'quorum, with all members present.

The applications for building permits and the recommendations of the Farmington
Building & Planning(L Commission were duly considered. Upon•motion by A.H. Field,
seconded by Eugene Kuchera, a permit was ordred issued to Lyle Bung to move the
existing drive-in restaurant from Lot 1, Block 1, Bung's Addition to Lot 8,
Block 1, Bung's Addition and the application of Arline Ebeling to move a dwelling
on to Lot 11, Block 2, Shepley's Addition was tabled, pending a report from the
Building Inspector and firther considerajsion.
The application from the Minnesota Liquid Fertilizer Co. for a non-conforming use
IIIpermit on the Chicago, Milwaukee Railroad right-of-may was duly considered. After
a full discussion, it was moved by A.H. Field, seconded by Reuben Petersen, that
a public hearing on the matter be called for 8:00 P.M. on Monday, November 23, 1953,
in accordance with Village Ordinance No. 119.
An arplication for an "On-Sale and Off-Sale Non-Intoxicating Beverage License"
in the building at 417 Third Street by Francis Deegan was received. After due
consideration, it was moved by H.M. Johnson, seconded by A.H. Field, that the
application be approved and a license issued. Motion was unanimously carried.
Upon motion by Reuben Petersen, seconded by A.H. Field, the Clerk was directed to
transfer $679.66 from Improvement Fund #9 to Improvement Fund #8 and to pay off
the balance of the said Improvement #8 warrants with interest on December 15, 1953.
Further, that any assessments collected for this improvement in the future be credited
to the General Fund. Motion carried.
Upon motion by A.H. Field, sedonded by Reuben Petersen, the polling hours for the
annual village election to be held on December 8, 1953 were set from 1)00 P.M.
to 8:00 P.M. and the Clerk was instructed to post notices accordingly.
A proposed ordinance entitled: "ORDINANCE FIXING COUNCIL SALARIES" was introduced
and assigned No. 122. H.M. Johnson moved its adoption, seconded by Reuben Petersen.
Upon being put to vote, there were: AYES, 5; NAYES, 0; and the ordinance was
declared passed.
After due consideration of the 1952 and 1953 village budgets, of the receipts and
IIIexpenditures for 1951, receipts and expenditures for 1953 to October 31, 1953,
and the estimated receipts and expenditmres for the balance of 1953, it was moved
by Eugene Kuchera, seconded by Reuben Petersen, that the following budget be

A special meeting of the Village Council of the Village of Farmington, '9.nn.
was held in the council chambers on November 23rd, 1953 with all members present.
A public hearing on the matter of a "Non-Conforming, Use Permit" as applied for by
the Minnesota Fertilizer Company on Chicago, Milwaukee Railroad right-of-way
was then conducted. Mr. Emerick & Mr. Nolte of the company making the application
discussed their plans, ,method of operation, and presented a number of letters
from localities such as Windom, Waseca, Fairmont, and Le Sueuer, where they now
have plants in operation, stating that there were no oblectionable odors connected
with the operation in each of the respective communities.
Residents of the proposed area, J.P. Sauber, Peter Rasmussen, Maynard Colebank,
B.A. Record, Sye Spaniol, and Frank Lehr, made a number of inquiries 'relative to
the operation.
After all present had-been given an opportunity to express their opinions, Mayor
Ingerson declared the public heari g closed and informed all present that the
Council woyld discuss the matter in executive seesion and make a decision relative
to the application.
.The matter of an application by Edwin and Arline Ebeling for a permit to mime a
veteran's housing unit from Minneapolis on to Lot 11, Block 2, Shepley's addition
was then brought up for discussion. Mr. & Mrs. Ebeling appeared and discussed
the matter with the council. They stated that they intended to put the "house on
a full basement, cover the exterior with wood siding, and shingle the roof with
conventional shingles within one year. Also, they intended at a later date to
build a breezeway and garage in connection with the front of the house. Village
Clerk, H.M. Johnson, presented a petition signed by eleven property owbers in
Shepley's Addition, objecting to the granting of a permit. £he applicants then
stated that they believed that a majority of the signers ,were not aWare of the fact
that they intended to make alterations to the exterior which would make it resem ale
a conventionable rambler house. After considerable discussion, Mayor Ingerson
informed the applicants that the council would consider the matter and make a
decision.
The council then went into executive session. The matter of the application for
the permit by Edwin & Arline Ebeling was discussed and considered further.
Upon motion by A.H. Field, seconded by Reuben Petersen, a permit was ordered
issued to Edwin & Arline Ebeling to move in a veteran's housing unit on to Lot 11,
Block 2, Shepley's Addition, when and if a Cash Bond of $500.00, payable to the
Village of Farmington, was posted by the applicants which would guarantee that
the following items would be completed within one year or the bond forfeited:
construction of a full basement; cover the exterior walls with wood siding or
shingles; and mover the roof with conventional type shingles. Motion was carfied.
The matter of the application for a Non-Conforming Use Permit by the Minnesota
Fertilizer Co. was then discussed and considered further. Upon motion by A.H. Field,
seconded by Reuben Petersen, a "Non-Conforming Use Permit" was ordred issued to
the Minnesota Fertilizer Company on Chicago & Milwaukee Railroad right-of-way,
between Willow & Pine streets, immediately west of Highway #218. Upon being put
to vote, there were: AYES, 3; NAYES, 2; and the motion was declared passed.
