Approval of Minutes a. MOTON by Windschitl, second by Rotty,to approve the minutes of October 8 and 22, 2019. APIF, MOTION CARRIED. 3. Discussion a) HPC—Signage Proposal Exchange Bank Building—344 Third Street Homestead Community Church, 344 Third Street(Exchange Bank building) has submitted a sign permit application for a projecting blade sign. Projecting signs in the downtown must comply with the zoning code. The sign would be for identification purposes only. The sign would be located near the corner of Third and Oak Streets. The size of the sign would need to be revised to not extend out more than 4 feet in the absence of a variance. It would be difficult to determine a practical difficulty to approve a variance. The code allows for external lighting only. The applicant would be requesting a variance for cabinet signage with internal lighting. Again, determining practical difficulties would be difficult. According to the code,projecting box or cabinet signs are prohibited. The proposed sign is a cabinet sign and would require a variance, but difficult to show practical difficulties. This building is on the National Register of Historic Places. Signs on historic buildings should not cause damage to architectural features, should be designed and installed in such a manner that when removed or replaced there is no physical evidence of their former presence. The applicant is proposing to fasten the sign into the mortar and not the bricks. If the mortar is strong enough,that would be acceptable. Staff asked for feedback on the following: 1. The distance that the proposed sign projects out from the building. 2. Having the proposed sign be internally lit. 3. Having the proposed sign be a cabinet or box sign. Mr. Kerr, Homestead Community Church, liked this sign concept because it fits the concept of the building and it could be done without damaging the building. They wanted the projecting sign so it could be seen from both streets. Member Windschitl liked the sign and asked if there was an alternative plan if it cannot • be fixed to the mortar. Mr. Kerr stated an option would be to affix it to the Larson building, but it would remove it from the prime visibility spot. They looked into an Planning Commission Minutes November 12,2019 Page 2 exterior lit sign,but would cause more instances of getting electrical lines affixed to the brick. Member Lehto asked if there was any fire risk with the sign being internally lit. Staff replied no,the majority of downtown signs are internally lit. Member Lehto asked about the variance for the size of the sign and noted it seemed that amount of overage would be easy to fix. Mr. Kerr noted scaling down the size would be no problem. Chair Rotty welcomed Mr. Kerr and the church to this building. He asked about the entrance to the building. Mr. Kerr stated the main entrance would be at the front corner by the sign and the ADA entrance will be on the side of the building. They are in the middle of renovation now and should be done the end of January. So they want the sign installed around that time. Chair Rotty asked staff why it is difficult to justify this type of sign. Staff stated they could do a sign that would meet all the requirements. When the code was changed, it was to go back to the way the signs used to be and are either not lit or externally lit. As part of that,we determined we did not want to allow the box or cabinet sign. We have not had applications for this type of signage until now. If we allow this variance,we may want to amend the code in the future rather than doing little variances here and there. Variances are approved for specific reasons which are that they could not have a sign without the variance. Chair Rotty noted members don't seem to be against this type of sign. Blade signs work well with this type of application. Member Windschitl asked if the street light provides enough light. Mr. Kerr stated they would like an internally lit sign. If this wasn't approved,they would do a sign that is against the building. Chair Rotty asked Mr. Kerr to modify the size of the size and then staff will set a public hearing for the December Planning Commission meeting for variance review. b) 2040 Comprehensive Plan Work Plan and Schedule Staff prepared a schedule for the 2040 Comp Plan work plan. The Met Council will take action on the plan at their December 11, 2019,meeting. The city then has nine months to amend its official controls to be in compliance with the plan. The final plan and all supporting documents has to be submitted to the Met Council by September 16, 2020. Staff anticipates having the work plan completed by July 27, 2020. 4. For your reference I have attached the sign plans that were originally submitted by Archetype Signs on behalf of Homestead Church. DISCUSSION The property at 344 Third Street is located within the city's Downtown Commercial Overlay District. Any projecting/blade sign proposed within the Downtown Commercial Overlay District must comply with subsection 10-6-3(B)5(e) of the zoning code(Spruce Street signs). Subsection 10-6-3(B)5(e) of the zoning code is as follows: (e) Projecting Signs: (1)Type of Signage: No advertising signage is allowed;only business identification signs are permitted. The proposed signage would be for identification purposes only. (2) Projecting: The sign shall be perpendicular to the surface of the building and the sign may be no more than one foot(1')thick. The proposed sign would be perpendicular to the surface of the building. It is proposed to be located above the main entrance to the building near the corner of Third Street and Oak Street. The proposed sign would be approximately 6 inches thick. (3) Size: Projecting signs may project no more than four feet(4')from the front edge of the building and be no more than twelve(12)square feet in area. The sign as shown in the attached plans indicates that the sign would project out 52 inches(4.33 feet) from the front face of the building. The applicant has indicated in the attached letter that if the variance is approved that the plans would be revised to adhere to the maximum projection of 48 inches (4 feet). The proposed sign would be approximately 10.4 square feet in area. (4) Height: The bottom of the projecting sign must be at least eight feet(8') above the sidewalk grade. The bottom of the proposed projecting sign would be approximately 11 feet above the adjacent sidewalk. (5) Materials: Projecting signs must be approved by the Planning Commission during the sign permit application process. The Planning Commission is now reviewing the projecting sign. (6) Illumination: Projecting signs may be lit with external lighting only and shall comply with Section 10- 6-8 of this chapter. The sign is proposed as a cabinet sign that would be internally lit. A variance must be approved by the Planning Commission to allow this type of signage to be internally lit. (7) Public Right Of Way: Projecting signs may not extend over a public right of way or public property (except a sidewalk or trail portion thereof) except by conditional use permit. The proposed sign extends over a public sidewalk and therefore does not require approval of a conditional use permit. (8) Parking Space Or Loading Dock: Projecting signs may not extend over a designated parking space or loading area. The proposed sign would not extend over a designated parking space or loading area. (9) Box Signs: Projecting box or cabinet signs are prohibited. The proposed sign is a cabinet/box sign. A variance would have to be approved by the Planning Commission as this is a deviation from the code. According to Section 10-3-6(C) of the city code,the Planning Commission shall not approve any variance request unless they find that"practical difficulties" as defined in city code exist using the following criteria: 1. Because the particular physical surroundings, or the shape, configuration,topography, or other conditions of the specific parcel of land involved, strict adherence to the regulations of this title would cause practical difficulties. 2. That the variance would be consistent with the Comprehensive Plan. 3. That the variance would be in harmony with the general purpose and intent of this title. 4. The conditions upon which the variance is based are unique to the parcel of land for which the variance is sought and are not applicable,generally,to other properties within the same zoning classification. 5. The alleged difficulty or hardship is caused by this title and has not been created by any persons presently having any interest in the parcel of land. 6. The granting of the variance will not alter the essential character of the locality or be injurious to other property within the vicinity in which the parcel of land is located or substantially diminish property values. 7. The proposed variance will not substantially increase congestion of the public streets, or increase the danger of fire, or be detrimental to the public welfare or public safety. 8. The requested variance is the minimum action required to eliminate the practical difficulties. 9. Variances may not be approved for any use that is not allowed under this title for property in the zone where the affected person's land is located except that the temporary use of a one-family dwelling as a two-family dwelling may be authorized by variance. The Planning Commission did discuss the proposed signage at its regular meeting on November 12, 2019. The Commission was generally in favor of granting a potential variance to allow an internally lit cabinet projecting sign. With that being said, it is very difficult for staff to determine that a practical difficulties exist in this instance as the applicant could very easily install a sign that meets all the requirements of the current code provisions. Because of this staff will be recommending a denial of this application. ACTION REQUESTED Deny the variance application to allow an internally lit cabinet projecting sign for the property located at 344 Third Street and direct staff to prepare Findings of Fact for approval at the January regular meeting. There are two main reasons for our variance request. First, being uniquely located on the corner of two main downtown streets, on the what is the primary downtown intersection, a blade sign would give us most visibility from multiple directions. Second, our proposed sign fits the original character of the building, as blade signs would have been used originally, We will fasten the sign bracket to the mortar as to not damage any bricks, although there are currently holes in the brick where previous signs had been fastened, This proposal is in violation of the city ordinance not allowing for interior lit blade signs. Hence the variance request. This proposed sign will help bring original character back to the building. It will be tastefully done and will enhance the downtown look as well as give Homestead Church optimum sign visibility. We are so excited to invest in our downtown and this amazing building. The final plat consists of right-of-way to be dedicated for 213th Street W and Spruce Street as well as two outlots. DISCUSSION The Sapphire Lake 1st Addition final plat was approved by the City Council on April 1, 2019. Sapphire Lake is a multi-phased development on the east side of town generally located east of 14th Street and the Prairie Waterway and is bordered by 213th Street W to the north and Spruce Street to the south. 213th Street W was extended to the east from Cambodia Avenue with this initial phase. This extension required the crossing of property owned by the city(Prairie Waterway). Additionally, Spruce Street to the south will also have to be extended across the Prairie Waterway as part of a subsequent phase of this development. The right-of-way through the Prairie Waterway is not required for the construction of these roads as the city is the fee owner of the underlying land. However, it is appropriate to have the right-of-way separated out from the waterway/open space. The attached Prairie Waterway First Addition final plat does this. As previously mentioned the Prairie Waterway First Addition final plat consists of the right-of-way for 213th Street W (0.5303 acres) on the north end of the subject property and right-of-way for Spruce Street(0.8554 acres)that essentially bi-sects the subject property. Additionally,the first addition plat contains two outlots (Out lot A- 12.5474 acres and Outlot B- 13.4109 acres). Outlots A and B will combine four existing parcels (one platted outlot and three meats and bounds parcels)that make up a portion of the Prairie Waterway into two outlots. The preliminary plat for Sapphire Lake was approved by the City Council on August 20, 2018. Right-of- way for both 213th Street W and Spruce Street were shown in the approved Preliminary plat through the Prairie Waterway. The Prairie Waterway First Addition final plat is consistent with the Sapphire Lake preliminary plat. ACTION REQUESTED Recommend approval of the Prairie Waterway First Addition final plat and forward that recommendation onto the City Council.
