COUNCIL MEETING
REGULAR
OCTOBER 7, 1974
The meeting was called to order by Acting Mayor Akin at 7:30 P.M.
Present: Akin, Graphenteen, McElmury
Absent: Daily, Kuchera
Also Present: Administrator Ford, Attorney Gorgos
Motion by McElmury, second by Graphenteen to approve the minutes of September 9,
1974 as presented. APIF, motion carried.
Motion by Graphenteen, second by McElmury to defer the minutes of September 16,
1974 to the next meeting. APIF, motion carried.
The council deferred until October 14, 1974, consideration of the proposed Cable
Television Franchise Ordinance amendment.
The council heard a first reading of the proposed ordinance prohibiting the
consumption of alcohol on public thoroughfares and set it over to the meeting of
October 21 , 1974, to consider it in final form.
Motion by McElmury, second by Graphenteen that the public hearing in the matter
of the request by Peerless Plastics for the vacation of a portion of 2nd Street,
be set over for 8:30P.M. , November 4, 1974. APIF, motion carried.
The Administrator informed the council that the repair work on the Railroad Tracks
on the ELM STreet crossing which had taken place previously this week, was not,
as far as he understood it, the repair of the surface crossing to which the Railroad
had committed itself in a meeting with Mr. Bannon earlier. The council requested
the Administrator to again contact the Railroad for these repairs and also to request
the Engineer to have the feasibility previously ordered for the repair of crossings
ready for presentation to the council October 21 , 1974, 8:00 P.M.
Motion by Akin, second by McElmury to adopt resolution #R97-74 approving the Rural
Tax District list of parcels for 1975 collectible. APIF, motion carried.
Motion by Graphenteen, second by McElmury to adopt resolution #R98-74 setting a
public hearing for 8:00 P.M. November 4, 1974 in the matter of a request to vacate
a portion of Heritage Way by Farmington Development Corporation to correct a
technical error in official records. APIF, motion carried.
The Administrator informed the council that a letter had been received from NSP
informing the City that in accordance with new legislation, all costs and charges
to the municipalities, as of January 1 , 1975, will be within the jurisdiction of
the Public Service Commission and as a result all existing contracts between NSP
and the City of Farmington, at that time, will become null and void.
The Administrator presented to the Council a letter from the Chicago, Milwaukee,
St. Paul and Pacific Railroad, requesting a meeting between themselves, the City
of Farmington and School District #192, to discuss the erection of a fence along
Railroad Right of Way in the area along 1st Street between Maple and Ash. The
Administrator was instructed to write to the Railroad informing them that in the
opinion of the council the fencing off of hazardous activities within the city is
the responsibility of the property owner and the City expects the Railroad to so
.take the necessary precautions.
Motion by Akin, second by Graphenteen that the resignation of Municipal Liquor Store
Manager, Glen Moser, be accepted effective November 15, 1974. APIF, motion carried.
Motion by Akin, second by Graphenteen that the list of election judges for the
State General Election of November 5, 1974 as follows be approved:

The council instructed the Administrator to put on the agenda of the meeting
of November 4, 1974 the matter of adjustment of precinct boundaries of
precincts one and two.
Motion by Akin, second by McElmury to drop project #71-6, improvement of Locust
Street as per request of School District #192, which is on file. APIF, motion
carried.
Motion by Akin, second by Graphenteen authorizing the attendance of the
Administrator at a workshop dealing with the new Federal and State Fair
Labor Standards Act on November 13, 1974. APIF, motion carried.
The City Attorney informed the council that a notice of appeal had been
received by P. H. Feely, eta] , in the matter of special assessments for
water and street improvements on Spruce Street.
The City Attorney informed the council that the appeal of condemnation of
the City of Farmington vs Daisy Nelson had been set on for trial for 10:00 a.m.
October 15, 1974.
Acting Mayor Akin set a special meeting of the council for 5:00 P.M. , October
14, 1974, at which time the council will discuss the proposed comprehensive
1975 budget and also at which time department heads will be interviewed.
Motion by Akin, second by Graphenteen that the bills be approved for payment
as presented. APIF, motion carrried.
