HomeMy WebLinkAbout08.25.75 Special Council Minutes MINUTES COUNCIL MEETING SPECIAL AUGUST 25, 1975 1. The Mayor opened the Meeting at 7:30 P.M. The Mayor stated that the primary purpose of this council meeting was to conduct a public hearing scheduled for 7:30 P.M. as previousl published to allow for citizen input in the Housing and Community development grant application which had been prepared by the City and submitted to the Metro council and HUD 2. Present: Mayor Daily, Councilmen Akin, Johnson, Kuchera, McElmury Also Present: Administrator Ford, Attorney Gorgos, Consultant B. Chapman 3. Although the public hearing was well publicized there appeared to be no interested parties in the audience. Several members of the council stated that the reason for this probably was that they had been contacted individually by several citizens and had indicated their agreement with the contents of the Housing and Community Development Grant Application. After a reasonable time, the Mayor closed the public hearing and entertained a motion. 4. Motion by McElmury, second by Kuchera that the previous approval by the council of t e—HMD Grant application be reaffirmed. APIF, motion carried. S. Motion by Akin, second by Kuchera to approve the request by the Fire Department to sena fur firemen to Fire Fighting School at Dakota County Vo Tech involving an estimated maximum cost of $115.00 out of an existing budget balance of $465.00. APIF, motion carried. 6. The Administrator read to the council a letter which had been received from Mr. Dale W. Wisherd, the apparent high bidder and awardee on the 1963 International Scout Vehicle which the council had sold to him by award of high bid at the meeting of August 18, 1975. The letter stated further that he was returning the vehicle to the City and requesting refund of the $1078.51 which he had paid to the City. The letter aledged certain tampering with, or disconnecting of the odometer on the vehicle. The Administrator informed the council that he had investigated the matter with people in General Services and in the Fire Department and that he had come to the conclusion that the city, nor its employees, had not tampered in any way with the odometer, had not disconnected it, was not aware of whether it was operating or not operating and in any case made no representation to any prospective buyer as to the correctness of the mileage and that the vehicle was offered in an as is and whereas condition. Motion by Akin, second by Kuchera that the Administrator be instructed to inform Mr. Wisherd that he would be held to his previous bid and award of same. APIF, motion carried. 7. The Mayor read a letter written by Phyllis Brosseth, complimenting certain personnel in the operation of the Municipal Swimming Pool. 8. The council had agreed at the last council meeting and had publicized the fact that it would be discussing and would be inviting those interested parties to attend in the matter of the Downtown business district and the illegal and undesirable con- gregating in the district resulting in certain illegal acts which had resulted in a strenuous enforcement policy by the Police Department at the instruction of the council. There were approximately fifty persons present in the audience all of whom were given an opportunity to express their thoughts. The meeting was largely conciliatory with all parties agreeing that a problem existed and further agreeing that it would take cooperation on the part of the citizens and local government to correct the problem. The council agreed and so instructed Police Chief Metcalf that the previous policy of "moving on" groups who had not violated a specific ordinance would cease and in place of that would be the following policy: "peaceful, orderly, and legal assemblies would not be bothered by the Police unless and until and undesirable act were performed or committed within the group, at which time the group would then be dispersed without the necessity of determining the individual specifically responsible for the act. Failure to dispurse when requested would result in the issuance of a complaint or ticket.Specific acts in violation of State Statute or City ordinance would continue to be strictly enforced.
