MINUTES
COUNCIL MEETING
REGULAR
NOVEMBER 3, 1975
1. The meeting was called to order by the Mayor at 7:30P.M.
Present: Mayor Daily, Councilmen Akin, Johnson, Kuchera, McElmury
Also Present: Administrator Ford, Attorney Gorgos, Engineer Blaisdell
2. At 7:30 P.M. the mayor called to order the public hearing on Project 75-4,
Storm Drainage correction which had been continued from a previous meeting.
Councilmen Akin and Kuchera reported to the council that they had been unsuccess-
ful in getting other engineering firms interested in possible solutions partly
because of the $250 that had been allotted for such activity. There was some
discussion about the improvement in clean up which had taken place but the council
asked the Administrator to contact the owners of Townsedge to see if more emphasis
could be put on the pond itself. There was a consensus among the council that is
was worth while to pursue new and innovative solutions to this problem and they
were informed that the staff was pursuing along these lines. Motion by Kuchera,
second by Akin to adopt resolution #R102-75 which continued the public hearing
to 7:00 P.M. , December 1, 1975. APIF, motion carried.
3. The Mayor then opened the public hearing in the matter of the proposed rezoning
of Railroad property, East of the RR track and west of 2nd Street. This public
hearing originally was set for October 6, 1975 and was continued to November 3, 1975.
Motion by Johnson, second by McElmury that the council concur in the recommendation
of--tHe Planning Commission as expressed in their minutes dated October 21, 1975,
and that no change to the zoning ordinance be effected. APIF, motion carried.
4. Motion by Akin, second by Kuchera authorizing the City Administrator to commis-
sion a land survey of the City Owned land on Linden Street. APIF, motion carried.
S. Motion by Akin, second by McElmury that the council minutes of 10/16/75 be
amenTe_d_7Fy changing in paragraph 3, the words 113 lots" to "City owned parcel".
APIF, motion carried.
6. Motion by Akin, second by McElmury that the minutes of 10/16/75 as amended be
approves— APIF, motion carried.
7. Motion by McElmury, second by Johnson the minutes of 10/20/75 be approved as
presented. APIF, motion carried.
8. Motion by Kuchera, second by Johnson that the minutes of 10/23/75 be approved
as presented. APIF, motion carried.
9. Motion by Akin, second by Kuchera to adopt resolution #R103-75 which sets a
public �iearing for 8:30 P.M. , December 1, 1975, to consider the proposed amendment
to the zoning ordinance dealing with Flood Plain Control with the Attorney to
publish notice of same. APIF, motion carried.
10. The council instructed the staff to prepare a model ordinance and recommendation
dealing with peddlers, solictors, and transient merchants.
11. Motion by McElmury, second by Akin to adopt resolution #R104-75 which provides
for cooperation between the City and the Minnesota Hi g way Department for removal
of snow on Trunk Highway 50. APIF, motion carried.
12. Motion by Akin, second by McElmury that the following amendments to minutes
be approved as follows:
4/7/75 Paragraph 9 to read:
"Failing which, the council would then proceed with the intent of assessing
the total cost to Townsedge Shopping Center. Motion by Akin, second by
McElmury to adopt resolution #R40A-75 continuing the public hearing to
7:30 P.M. , May 5, 1975. APIF, motion carried."
5/5/75 Paragraph 1, Last sentence to read:
"Motion by Kuchera, second by Daily to adopt resolution #R51A-75 continuing
the public hearing to 7:30 P.M. , May 19, 1975. APIF, motion carried."
8/18/75 Paragraph 13, Last sentence to read:
"Motion by Daily, second by Akin to adopt resolution #R80A-75 reviving
project #75-4, Storm Drainage Correction, setting a pu lic Baring in the
matter for 7:30 P.M. , September 15, 1975."

10/6/75 Paragraph 4 First sentence to read:
'Motion by Akin, second by Kuchera to adopt resolution #R89A-75
continuing the public hearing to 7:30 P.M. , November 3, 1975. APIF
motion carried. Motion by Akin, second by Kuchera that councilmen
Akin and Kuchera be appointed as a special committee to assist the
Administrator in selecting a firm or individual to help in this situa-
tion and to give an independent engineering opinion as to other pos-
sibilities at a fee not to exceed $250.00 and that Resolution #R90-75
be adopted authorizing the above and that the Administrator report
to the Council. APIF, motion carried."
APIF, motion carried.
13. Motion by Akin, second by Kuchera to approve the payment of a bill to
D. S. Blaisdell and Assoc in the amount of $4374.71 in conjunction with
Fund #6-83A-75 and contracts 1975-4 and 1975-5. APIF, motion carried.
14. Motion by McElmury, second by Daily to adopt resolution #R105-75 which
approves list of eligible rural tax districts or 1976 collecti le and
authorizes its submission to the County Auditor. APIF, motion carried.
15. Motion by McElmury, second by Kuchera that the schedule of Ice time rental
rates submitted by the Park and Recreation Department be approved. APIF, motion
carried.
16. The council was informed of correspondence received from Peoples Natural
Gas Company advising that an area wide increase in rates would go into effect
very shortly.
17. Motion by McElmury, second by Johnson approving of the recommendations of
staff and the Arena Engineer that the contractors work day be increased from
181 to 195 calendar days in conjunction with the Arena construction which would
the anticipated construction completion date at January 1, 1975. Voting for:
Daily, Johnson, Kuchera, McElmury. Voting against: Akin. Motion carried.
18. The council informed the Administrator that they concurred with his recom-
mendation that the maintenance repair and general housekeeping of the arena be
the responsibility of Bill Hince and that the suggestion that he prepare to
hire and assign an individual to that responsibility beginning January 1, 1976
be approved. The hiring of a year round, full time, park maintenance man would
be affected by reducing the temporary part time help normally hired in the
summer only.
19. All members of the council publicly commended the Farmington Fire Department
for its efforts in combatting a fire on October 11, 1975 which resulted in the
saving of one Single Family residence.
20. Motion by Akin, second by Johnson that the Civil Defense Plan be approved
as presented. APIF, motion carried.
21. Motion by Akin, second by McElmury that the bills be approved as presented.
APIF, motion carried.
22. Motion made and carried that the council adjourn at 9:10 P.M.
