HomeMy WebLinkAbout02.01.77 Special Council Minutes MINUTES COUNCIL MEETING SPECIAL FEBRUARY 1, 1977 1. The Mayor opened the meeting at 5:00 P.M. and indicated that all of the members of the council had been contacted by phone for this meeting and had wiaved their right to mailed 48 hour notice and also that the press had been notified and was in attendance. Present: Mayor Akin, Councilmen Johnson, Kuchera, McElmury, Whittier Also Present: Administrator Ford and Attorney Gorgos 2. The minutes of previous meeting were deferred. 3. The purpose of the meeting dealt with matters of annexation. The Mayor indicated that at a previous meeting of the council it had been agreed that all members of the council would study recommendations which had been made by the Planning Commission and also the petitions for annexation which had been submitted to the council and the Minnesota Municipal Board and would be prepared to arrive, at least at a preliminary, decision as to what course should be fol- lowed by the council. 4. The Mayor emphasized that the time schedule had now been altered by receipt of correspondence from the Minnesota Municipal Board informing us of the date of a hearing to be held by the MMB on February 28, 1977, which required immediate action by the council as to the response and the preparation necessary for that response. The Mayor was joined in by other members of the council in agreeing that two types of decisions were probably necessary at this time. The first would be a general decision as to whether or not any action toward annexation is called for and secondly, if so, the engaging of special legal counsel. A fairly lengthy discussion then took place. After the discussion, each councilman then expressed his opinion that some annexation was proper and appropriate, the extent of which however, was yet to be determined. Motion by Johnson, second by Kuchera that the council engage the services of Attorney John McBrien as special counsel for annexation. Voting for: Johnson, Kuchera, McElmury, Whittier.
