MINUTES
COUNCIL MEETING
SPECIAL
FEBRUARY 10, 1977
1. The meeting was called to order by the Mayor at 5:00 P.M.
Present: Mayor Akin, Councilmen Johnson, McElmury, Whittier
Absent: Councilman Kuchera
Also Present: Administrator Ford and Attorney John McBrien
2. This was a special meeting called by the Mayor.
3. The Administrator informed the council that all members had been contacted
by phone 48 hours prior to the meeting and all had waived entitlement to mailed
written notice.
4. He further informed the council that the official newspaper had been notified
by phone along with the admonition that the council would be advised to declare
the meeting an Executive Session under the open meeting law because of the
lawyer-client nature of the subject.
5. The purpose of the meeting was to receive the response of Mr. McBrien to
the council's invitation to him to act as Special Counsel in pending matters
of annexation.
6. An agreement was struck between the council and Mr. McBrien which set forth
the conditions by which he would act as Special Counsel in these matters. The
hearing on annexation scheduled for February 28, 1977 by the Minnesota Municipal
Board was also discussed and an appropriate course of action determined.
7. Motion made and seconded to adjourn at 7:00 P.M.
