COUNCIL MEETING
REGULAR
JUNE 6, 1977
1. The meeting was called to order by the Acting Mayor Kuchera at 7:00 P.M.
Present: Acting Mayor Kuchera, Councilmen Johnson, McElmury and Whittier
Also Present: Administrator Ford, Engineer Blaisdell Excused: Mayor Akin
2. Motion by McElmury, second by Whittier that the minutes of 5/23/77 be approved
as presented. APIF, motion carried.
3. The council requested the City Administrator to seek from the Cable' Television
Franchisee, a list of present subscribers in their search for a 3rd member to
the CATV Advisory Commission. Action was deferred.
4. Acting Mayor Kuchera informed the council that he had, at the request of Robert
Steele, submitted a letter written by him on behalf of the council supporting the
request of Farmington Army Reserve Unit to be located at the recently abandoned
Nike Site outside of Farmington.
5. Motion by McElmury, second by Johnson that the request of the County Auditor
be exceeded to in the waiving of interest on the special assessment to the County
Maintenance building on Highway 50 in return for the total payment of $1185.00.
APIF, motion carried.
6. Motion by McElmury, second by Johnson that the specifications for contract
1977-1*, Sealcoating 1977, be approved as submitted and authorized the taking
of bids for 2:00 P.M. , July 5, 1977. APIF, motion carried.
7. The City Administrator informed the council that he had attended a pre-construction
conference on the new interceptor, to be constructed by the Metropolitan Waste Control
Commission, and that at that meeting he had pointed out to the MWCC that they had
neglected to obtain two easements from the City, one being the area immediately
north of the Vermillion river adjacant from the Farm Service Elevators, the other
being the point of intersection between the new interceptor and the present lines
going from the city to the Waste Water Treatment Plant. Motion by Whittier, second
by Johnson that the City Administrator hereby be authorized and directed to sign
on behalf of the council , easements as described above and submit to the MWCC.

8. The City Council deferred to the meeting of June 14, 1977 the request for
tax abatements from Dale and Beverly Neilan.
9. The council again made the announcement that the annual Tax Board of Review
for the City of Farmington would be held at 7:30 P.M. , June 14, 1977.
10. The council concurred with the recommendation of the City Administrator that
a letter be obtained from Dakota County Electric stating that if for whatever reason
plans to construct a new building were to fall through, that Dakota Electric would
agree to accept as an assessment, that portion of the cost presently agreed upon
to be paid by the City.
11. The Administrator reported to the council that he had received a letter dated
June 2, 1977, from the Metropolitan Waste Control Commission indicating that the
city would be liable to 10% of the cost under the present Farmington Sewer System
Evaluation Survey be conducted by Donahue and Associates. The discussion brought
out that this is contrary to the continuing understanding by the City that the
City would not be subject to any cost. The Administrator was instructed to continue
negotiations with the MWCC while the work proceeded.
12. The council then entered into a lengthy discussion concerning the Metropolitan
Systems Statement with the City Planner and representatives from the Metropolitan
Council . Various subjects were discussed in this regard including development of
contiguous areas to municipalities, park and open space, low and moderate income
housing, urban service area designation, regional allocation plans, transportation
and free-standing community designation. Airports were touched on briefly and the
council was informed of a meeting to be held on June 16, 1977, concerning metropolitan
airports. Waste water treatment flows and population projections were discussed at
length. It was pointed out that the final systems statement must be issued by the
Metropolitan Council by July 1, 1977. The council instructed the City Planner to
meet with the Metropolitan Council staff in an attempt to incorporate into the final
systems statement, the changes, modifications and suggestions passed to him by the
members of the City council and staff.

13. The council then discussed the 1977 construction schedule. Developer Gil
Gilbertson who was in the audience, took part in the discussion. Motion by
Whittier, second by Johnson that the City Attorney be directed to prepare and
submit to Mr. Gilbertson, the written agreement by which an easement would be
secured, no later than 12:00 noon, Friday, June 10, 1977. APIF, motion carried.
14. Motion by McElmury, second by Johnson to approve the plans and specifications
for project 75-3, Street Improvement, Spruce Street (Contract 1977-3) . APIF,
motion carried.
15. Motion by McElmury, second by Johnson to approve the plans and specifications
for project 77-1, sewer and water, Ash Street, Contract 1977-2*. APIF, motion
carried.
16. Motion by McElmury, second by Johnson to approve the plans and specifications
for project 77-2, street improvement, Dunbar Ave. , Contract 1977-3. APIF, motion
carried.
17. Motion by McElmury, second by Johnson to approve the advertising for and
acceptance of bids for contract 1977-2* for 3:00 P.M. , June 20, 1977. APIF,
motion carried.
18. Motion by McElmury, second by Johnson to approve the advertising for and
acceptance of bids for contract 1977-3 for 3:00 P.M. , June 20, 1977. APIF,
motion carried.
19. The council then considered the recommendations of Municipal Bond Consul-
tants, Springsted, Inc. , in which they suggested that bonds for the above work
be negotiated rather than bids taken. This work is incorporated with Fund
#6-24-77, 1977 Improvements. Motion by McElmury, second by Kuchera to adopt
Resolution No. R25-77 which approves of the prospectus prepared by Springsted
for fund #6-24-77 and authorizes the negotiation for and award of bond sales
in the amount of $60,000. APIF, motion carried.
20. Motion by McElmury, second by Kuchera to adopt Ordinance No. 077-56 entitled
An ordinance Regulating Parks with the following amendment, Section IX, Subd 2. ,
shall read "no vehicles shall be parked in the parking areas later than or
before the hours of operation". APIF, motion carried.
21. Motion by Johnson, second by McElmury that the request of Recreation
Manager Jim Bell , dated June 2, 1977, to hire Sue Korsman and Michelle Cook
as Recreation Assistants at $2.00 per hour, temporary, part-time, and Jane
Nowacki as Recreation Instructor at $4.00 per hour, temporary, part-time, all
effective June 13, 1977, hereby be approved. APIF, motion carried.
22. Motion by Johnson, second by McElmury that the bills be approved for payment
as submitted. APIF, motion carried.
23. Acting Mayor Kuchera read an ordinance which he had prepared and presented
to the council dealing with the control and penalties provided for erratic
driving of a motor vehicle. Motion by Kuchera, second by McElmury that said
ordinance be adopted. Voting for: Kuchera, McElmury. Voting against: Johnson
and Whittier. Motion failed.
24. Motion by Whittier, second by Johnson that the agenda item entitled Engineering
matters be deferred to the next meeting. Voting for: Johnson, McElmury, Whittier.
Voting against: Kuchera. Motion carried.
25. Motion by Johnson, second by McElmury that the minutes of 5/2/77, paragraph 8
be amended by changing to Lot 1, Block 5. APIF, motion carried.
26. Motion by Johnson, second by McElmury to adopt Ordinance No. 077-57 entitled
An Ordinance Amending the Zoning Ordinance Map by Changing from R-3 to B-2,
Certain Lands in the Replat of Westview Acres. APIF, motion carried.
27. The council discussed briefly the possibility of adopting rules and regula-
tions which would require the printing of the agenda in the Dakota County Tribune
which would then of course require the closing off of the agenda, no later than
10:00 A.M. Tuesday in the week prior to the meeting itself. Motion by Johnson,
second by Kuchera that the council adopt that procedure on a trial basis. Apif,
motion carried.
28. Motion made and carried to adjourn at 10:20 P.M.
