MINUTES
COUNCIL MEETING
REGULAR
FEBRUARY 21, 1978
1. The meeting was called to order by the Mayor at 7:00 P.M.
Present: Mayor Akin, Councilmen Johnson, Kuchera, McElmury, Whittier
Also Present: Administrator Ford, Attorney Gorgos
2. Motion by McElmury, second by Kuchera to approve the minutes of February 6,
1978. APIF, motion carried.
3. Motion by Whittier, second by Kuchera to approve the attendance of two persons
from the General Services Department at a State Tree Inspection Workshop March 7,
1978. APIF, motion carried.
4. The council then discussed the proposed contract for Engineering Services
with Bonestroo, Rosene, Anderlik and Assoc. , which had been negotiated between
that firm and representatives of the City. The Mayor suggested that in the
section dealing with notification to the City of delinquencies or deficiencies
in the work, that notice be made prantly or immediately. He also observed that
in section 3.8 dealing with the designated responsible individual on the part
of the City, which presumably was the City Administrator, that that section not
be inferred that the responsible individual would make decisions outside the
jurisdiction of his authority, but would merely interpret and transmit council
policy and decisions. Motion by Kuchera, second by Akin that the Mayor and
Administrator hereby be authorized and directed to execute and transmit the
contract to the Bonestroo Firm. APIF, motion carried.
5. Motion by Akin, second by McElmury that arrangements for transition of
building inspection services be scheduled for March 1, 1978, if all parties are
in agreement and if such accelerated transition does not inconvenience either
Mr. Kirsebom or Rosemount. APIF, motion carried.
6. The City Council took note of the correspondence from the City Administrator
to Donohue and Assoc. , and to the Metropolitan Waste Control Commission regarding
the Infiltration/Inflow study in progress.
7. The council was informed by the Administrator that the City had received
a voluminous study dealing with a County Wide dispatch system being proposed.
It was agreed that Chief Metcalf would review these documents and present a
capsulized analysis of them to the City Council at the next meeting.
8. The Council was also notified that the City had received and environmental
impact study concerning the construction of a pipelipe immediately to the east
of Farmington. A!r'
9. The council took no action in regard to the supLeague opo,
Cities Bill which would allow cities to publish ordinances i summary form rather
than verbatim.
10. The Mayor then opened the public hearing on a proposed zoning ordinance
amendment at 7:30 P.M. This amendment would provide authority for the Board
of Adjustment to allow a new non-conforming use in an existing structure under
certain conditions. Motion by McElmury, second by Kuchera to adopt Resolution
No. R9-78 entitled Authorizing the Preparation of a Zoning Amending Adding the
Concept of Transitional Nonconforming Uses within Existing Structures. APIF,
motion carried.
11. The proposed amended Empire Township Comprehensive Plan was then discussed
by the Council. It was pointed out that approximately three copies of the plan
had been submitted to the City which had to be circulated among the council
members, the Planning Commission, Park and Recreation Commission and others
and that insufficient time had been allowed for the council to receive comments
from their Boards and Commissions and staff in order to act on this matter at
this meeting. The council decided that Empire Township be notified of this
fact and that this item be put on the agenda of the second meeting in March
(March 20, 1978).
12. The council then conducted an extensive discussion concerning the problem
with which the City has been faced involving improper and dangerous installation
of wood burning fireplaces. It was decided that no additional controls would be
effective and that perhaps, instead of additional controls, that more stringent
enforcement of existing laws and ordinances and publicizing the danger of these
devices would be more effective.
13. Motion by Kuchera, second by McElmury that the Council decline to exceed
to the request of Central Telephone Company to waive $190.34 of penalty on
their special assessment for project 75-3. Voting for: Johnson, Kuchera,
McElmury, Whittier. Voting No: Akin. Motion carried.
14. The council requested staff to put together a study dealing with the
possibility of further regulation of private on-lot sewer systems for further
consideration by the council.
15. Councilman Johnson was excused.
16. Mayor Akin submitted the following nominations for appointments for Boards
and Commissions:
Planning Commission 3/1/78 to 1/31/79 William Carey
Park and Rec Comm 3/1/78 to 1/31/79 Tom Solinger
Motion by Akin, second by Kuchera that the above appointments be made. APIF,
motion carried.
17. Motion by Kuchera, second by McElmury that the Police Chief be authorized
to attend a training institute on March 28-30, 1978, and a C.D. Directors
meeting on March 10, 1978. APIF, motion carried.
18. Motion by Kuchera, second by McElmury to adopt Resolution No. R10-78 which
places the Farmington City Council in opposition to the approval of any
Hazardous Waste Site in Dakota County. APIF, motion carried.
19. Motion by Akin, second by McElmury to approve the bills as presented.
APIF, motion carried.
20. The council then discussed the possibility of submitting a pre-application
to HUD for a 1978 Community Block Grant to be used for storm sewer installation
and construction in the south drainage area (Ash Street and Highway 3). Motion
by Whittier, second by McElmury to authorize the above. Voting for: Whittier,
McElmury, Akin. Voting against: Kuchera. Absent: Johnson. Motion carried.
21. Councilman Whittier observed the survey had shown a high rate of people
interested in Mass Transit or public transportation and he suggested that
the city follow up on the previous discussions that we had had with Minn Dot
and Metropolitan Council.
22. Motion made and seconded to adjourn at 9:00 P.M.
