HomeMy WebLinkAbout09.05.78 Council Minutes MINUTES COUNCIL MEETING REGULAR, SEVIEMBER 5, 1978 1. Note: Monday, September 4, 1978, the normal date on which the regular meeting would be held was Labor Day. As per City Ordinance the regular meeting automatically fell on the following date September 5, 1978. 2. The meeting was called to order by the Mayor at 7:00 P.M. Present: Mayor Akin, Councilmen Johnson, Kuchera, McElmury, Whittier Also Present: Administrator Ford, Attorney Gorgos 3. The minutes of August 21, 1978 were deferred. 4. The council reconsidered their previous action concerning a request for subdivision waiver from Helen M. Fischer as petitioned by the new purchaser, James Gerths, 425 3rd Street, involving parcel numbers 14-77000-085-20 and 14-77000-086-20. The earlier decision of the council held that the above split would be approved contingent upon both parcels being joined into one by Mr. Gerths. Mr. Gerths asked the council to reconsider this requisite in that these two parcels had been treated as separate entities for years and, in fact, had two separate buildings on them. There was a consensus on the part of the council that this was a particular case and that in view of the circumstances and facts surrounding the instance, that the grandfather rights probably historically had been established andthe two parcels had been for many years been treated as separate, and the fact that two separate buildings existed, should warrant further consideration. Motion by McElmury, second by Kuchera that special consideration be given in this case and that the subdivision waiver be approved without the requirement of joining the two parcels. APIF, motion carried. 5. The council then considered the request of Frederick Willys, Inc. , of 510 Willow Street for a subdivision waiver involving the following parcels, 14,03100-022-09, 14-03100-030-11, 14-03100-011-11 and 14-03100-020-11. Said action to supercede the subdivision waiver granted on the 15th of March, 1977. Motion by McElmury, second by Kuchera that the subdivision waiver be granted with the stipulation that 55 ft. of parcels 14-03100-011-11 and parcel 14-03100-020-11 be split off and added to parcel No. 14-03100-030-11 as shown on the attached drawing. APIF, motion carried. 6. Motion by Kuchera, second by Akin that the city publish in the official newspaper a notice of election to be published October 31, 1978, showing in addition to general information, the location of polling places. APIF, motion carried. 7. Motion by McElmury, second by Kuchera to approve the attendance of two Park and Recreation personnel to the Annual Metro Ice Arena Managers Association Management Seminar. APIF, motion carried. 8. The Mayor then opened the public hearing scheduled for and previously published at 7:30 P.M. , which was the second revenue sharing hearing to determine disposition of Federal Revenue Sharing funds. The Mayor inserted into the record the fact that the council had met on August 15 and 16, 1978, and conducted field inspections throughout the city to specifically address themselves to problems that had been called to their attention and for which revenue sharing might be appropriate. There being no one in the audience wishing to address themselves to the problem, the Mayor then closed the public hearing and indicated that he would entertain a motion. Motion by Kuchera, second by McElmury to adopt resolution #R30-78, that the city continue the past practice of incorporating revenue sharing funds as receipts into the general budget by which the effective tax rate is reduced. Apif, motion carried. 9. The council then addressed themselves to the appointment of an HRA member to fill out the term of the recently resigned Warren Sifferath. Motion by Akin, second by McElmury thatthe council adopt Resolution #R31-78 appointing Eugene Kuchera, presently a member of the council, to assume the vacated chair of Mr. Sifferath and his term, to run to the expiration of his tenure as councilman, i.e. , December 31, 1978. APIF, motion carried. 10. The Mayor then requested the City Administrator to swear Mr. Kuchera in, and this was done. 11. Motion by Whittier, second by Johnson that the request of the Fire Department for capital outlay purchase for a rescue kit in the amount of $427.73 on Capital Outlay request dated August 29, 1978, be approved. APIF, motion carried. 12. Motion by Whittier, second by McElmury that the council approve the attendance of Robert E. Metcalf at the International Chiefs of Police Annual convention in New York City, October 9 through October 12, 1978. APIF, motion carried. 13. Motion by Johnson, second by Kuchera that the request of Stella Hammer for a billboard to be erected by Burnett Realty on her land located at the inter- section located at the southwest corner of County Road. 31 and State Highway 50 hereby be approved upon the finding of the Building Inspector that the request meets all of the requirements of the ordinance. APIF, motion carried. 14. The Mayor then opened the public hearing at 8:30 P.M. to consider amending the zoning ordinance as regards Accessory Storage building set backs, unattached garage separation distances, radio towers and other related matters which had been continued from the hearing of August 7, 1978. The Administrator informed the council that the work involved in this matter had not been completed on the staff level and requested that it again be continued. Motion by Akin, second by Kuchera that the public hearing be continued to 7:30 P.M. , October 16, 1978. APIF, motion carried. 15. Motion by McElmury, second by Kuchera to approve the bills for payment as presented. APIF, motion carried. 16. The council then very quickly dealt with several miscellaneous matters which the Administrator was directed to look into. 17. The council then conducted a general review of the budget which had been delivered to the council the previous Friday. It was agreed that a special budget meeting would be set by the Mayor within the next few days. 18. Motion made and seconded to adjourn at 10:30 P.M. Respectfully submitted, William J.
