INTRODUCTION
The applicant, Francis Valek, is seeking a variance (Exhibit A) from Section 10-6-4 (M) of the
City Code to encroach into the 5-foot wide setback for hard surfaced driveways in residential
areas. Mr. Valek's property at 607 Oak Street currently has an existing gravel driveway that is
located directly on the westerly property line.
DISCUSSION
In September of 1994, Oak Street was reconstructed. The project included the installation of
new sanitary and storm sewer lines, along with updated sidewalks, driveways, and street lighting.
The City installed a sidewalk and driveway apron at all properties within the project area,
including 607 Oak Street (Exhibit B). A driveway apron was installed by the City directly on the
westerly property line at Mr. Valek's residence. The apron was installed at 12 feet in width and
30 feet in length from the curb to the property line. Mr. Valek currently has a gravel surface
from the City-installed driveway apron which he utilizes as his existing driveway. Mr. Valek
would like to upgrade his existing gravel driveway with a concrete driveway that will extend
onto his property by approximately 28 feet in length. He would also like to continue the concrete
paving from the driveway to the rear of his house by 31 feet to provide a patio on the west side
of his house (Exhibit C). The driveway and patio would be installed directly on the westerly
property line of 607 Oak Street. The patio is not considered a structure and no easements exist
on this lot, thereby allowing the patio to be located directly on the westerly property line.
Mr. Valek is requesting to encroach into the 5-foot setback for a concrete driveway to be
installed directly on his westerly property line because of the following City Code requirement:

10-6-4 (M)Parking In Residential Areas:
All vehicles shall be parked on a hard surface driveway or parking apron. All parking areas shall
maintain a five foot (5') setback from side and rear lot lines. (Ord. 002-469, 2-19-2002)
The City Code provides the following criteria that must be met for a variance to be approved:
1. Because the particular physical surroundings, or the shape, configuration, topography,
or other conditions of the specific parcel of land involved, strict adherence to the
regulations of this Title would cause undue hardship. Economic consideration alone
shall not constitute an undue hardship if reasonable use for the property exists under
the terms of this Title.
The driveway apron installed by the City during the Oak Street Reconstruction
project in 1994 was located directly on the westerly property line of 607 Oak Street
causing a hardship.
2. The conditions upon which a variance is based are unique to the parcel of land for
which the variance is sought and are not applicable, generally, to other properties
within the same zoning classification.
Not all of the properties in this area are upgrading their driveways from gravel to
concrete.
3. The alleged difficulty or hardship is caused 'by this Title and has not been created by
any person presently having an interest in the parcel of land.
The hardship of the existing location of the concrete apron was not created by the
applicant.
4. The granting of the variance will not alter the essential character of the locality or be
injurious to other property in the vicinity in which the parcel of land is located or
substantially diminish property values.
The variance will not alter the essential character of the locality or be injurious to
other property in the vicinity.
5. The proposed variance will not substantially increase the congestion of the public
streets, or increase the danger of fire, or be detrimental to the public welfare or public
safety.
The variance would not create any of the above-mentioned adverse effects.
6. The requested variance is the minimum action required to eliminate the hardship.

The driveway apron installed by the City during the Oak Street Reconstruction
project in 1994 was located directly on the westerly property line of 607 Oak Street
and is the minimum action required in order to eliminate the hardship.
Staff will be discussing similar situations concerning existing gravel driveways on property lines
within the downtown district at this meeting under "Discussions".
ACTION REOUESTED
Approve the 5- foot wide variance request to allow a concrete driveway to be located directly on
the westerly property line at 607 Oak Street.

INTRODUCTION
Allina Hospitals & Clinics has submitted a preliminary and final plat that would create two (2)
commercial lots east of TH 3 and north of 213th Street (Exhibits A, B & C). The 3.59 acre
property to be split is zoned B-1 (Highway Business) and is planned for commercial uses.
DISCUSSION
Anna's Bananas Daycare (Lot 1) is proposed for the north lot and Allina Medical Clinic (Lot 2)
is proposed to be located on the south lot. Lot 1 will contain 1.34 acres and Lot 2 will contain
2.25 acres. The site plan for the 13,468 square-foot Allina Medical Clinic was approved by the
Planning Commission on February 12, 2008 (Exhibit D) and the site plan/CUPNariance was
approved for the 14,036 square-foot Anna's Bananas Daycare by the Planning Commission on
May 13,2008 (Exhibit E). Access to both proposed uses will be from 9th Street.
Drainage and Utility Easements
The applicant is proposing to plat the property to not only split the lot into two lots, but to also
plat the required drainage and utility easements. An easement at approximately 45 feet in width
is proposed along the north and west sides of Lot 1 and some of Lot 2 on the west. An additional
20-foot wide easement is proposed on the west central side of Lot 2. Finally, 10-foot wide
easements are proposed along the remainder of the property lines, except at the common
property line which shows 5 feet on either side.
Park Dedication
Park dedication is not required for this property since it was taken when the Giles Commercial
Addition was platted.

Engineering
The City Engineer has reviewed the plat and recommends approval of the preliminary and final
plat.
ACTION REOUESTED
Recommend approval of the Allina Medical Addition Preliminary & Final Plat contingent upon
the following requirements and forward the recommendation to the City Council:
1. The satisfaction of any engineering and planning comments.

DISCUSSION
According to the City Code, Churches are conditionally allowed in the B-2 (Downtown
Business) Zoning District. The Code provides the following criteria that must be met in order
for the Planning Commission to approve a conditional use permit:
1. The proposed use conforms to the district permitted and conditional use provisions and
all general regulations of this title.
A church is a conditional use in the B-2 Zoning District.
2. The proposed use shall not involve any element or cause any conditions that may be
dangerous, injurious or noxious to any other property or persons and shall comply with
the applicable performance standards.
The proposed use will not involve any elements that may be dangerous, inJurIOus or
noxious to any other person or property and it does comply with all applicable
performance standards.
3. The proposed use shall be constructed, designed, sited, oriented and landscaped to
produce a harmonious relationship of buildings and grounds to adjacent buildings and
properties.
The proposed use will occupy a portion of an existing building. Therefore, this
requirement is non applicable in this instance.
4. The proposed use shall produce a total visual impression and environment which is
consistent with the environment of the neighborhood.
Again, the proposed use is to occupy a portion of an existing building in the downtown.
The use will not affect the visual impression and environment of the downtown
neighborhood
5. The proposed use shall organize vehicular access and parking to mlillmlze traffic
congestion in the neighborhood.
The B-2 zoning district does not have requirements for offstreet parking. Existing on-
street parking as well as nearby public parkingfacilities will be utilized
6. The proposed use shall preserve the objectives of this title and shall be consistent with the
comprehensive plan.
The proposed use is consistent with the City's comprehensive plan,
. Staff believes that the proposed church use meets all of the aforementioned criteria.

Proposed Use - Church
The River Church has requested a conditional use permit in order to operate a church in the B-2
Zoning District. The church has a congregation of approximately 100 people and would like to
hold service on Sunday mornings from lOam - II am out of the southern most portion of the
building formerly known as Dueber's. The address of the building where the church is proposed
to be located is 408 3rd Street. The church would like to occupy approximately 5,800 square feet
of vacant space in the building. The applicant has also indicated that the space would also be
utilized on Wednesday nights for youth group activities. In addition, the applicant is proposing
some office space in this portion of the building for daily church operations.
Per Section 10-6-4 of the City Code, the B-2 (Downtown Business) Zoning District does not
require off-street parking stallsllots be provided. There is on-street parking adjacent to the
building both on 3rd and Oak Streets. In addition, the second street parking lot is located one
block west. All of these parking areaslspaces could potentially be utilized as parking for the
church.
ACTION REOUESTED
Approve the Conditional Use Permit contingent upon the following:
1. The applicant obtain all necessary building permits for conversion of space to a church
2. A sign permit shall be required for any signage to be placed on site.

INTRODUCTIONIDISCUSSION
The Parks Director, Randy Distad, has recently been approached by T-Mobile requesting to
locate a cell tower in the Tamarack Park. Mr. Distad presented the request to the Parks &
Recreation Advisory Commission on May 14, 2008 and the Commission was generally in
support of this proposal.
Planning staff has researched the issue and determined that towers are only allowed in the A-lor
1-1 zoning districts and a text amendment would be required if towers were to be installed in the
PIOS district. Planning staff also reviewed the existing tower ordinance and determined that an
update to it would be beneficial since new technology in tower construction may eliminate the
need for such large fall zones as required in Farmington's existing code. Additionally, by
allowing towers to be located in PIOS zoning districts the Park's Improvement Fund may be
subsidized through a monthly fee from the tower company. Attached is a survey of park revenue
that has been received by communities that allow cell towers in city parks (Exhibit A).
Representatives from T-Mobile will be on hand to answer any questions concerning the new
technologies in the construction of towers and any other concerns that the Planning
Commissioners might question.
I have attached an analysis of the Farmington Tower Ordinance along with the ordinances from
Maple Grove, Eden Prairie, Plymouth, and Lakeville that was compiled by T -Mobile (Exhibit
B). As illustrated by this information, the communities listed allow towers in park areas.

professional engineer, and the existing or approved structure, building or tower
cannot be reinforced, modified, or replaced to accommodate planned or
equivalent equipment at a reasonable cost.
ii. The planned equipment would cause interference materially impacting the
usability of other existing or planned equipment at the structure, building or
tower as documented by a qualified and licensed professional engineer and the
interference cannot be prevented at a reasonable cost.

iii. An existing or approved structure, building or tower within the one-mile radius
cannot accommodate the planned equipment at a height necessary to function
reasonably as documented by a qualified and licensed professional engineer.
IV. Other unforeseen reasons make it infeasible to locate the planned
telecommunications equipment upon an existing or approved structure, building
or tower.
Eden Prairie:
I. Location:
a. Towers shall be allowed only in the following residentially-zoned locations:
i. Parks, when compatible with the nature ofthe park;
ii. Schools; and
iii. Public streets and rights-of-way when attached to, or part of a public utility
structure.
II. Conditions:
a. Collocation:
i. Eden Prairie does not require newly constructed towers to be co-locatable for
additional users
Height:
a. In all zoning districts the maximum height of a tower, except those which are public
utility structures located within a Public Street or right-of-way, shall not exceed one foot
for each four feet the tower is set back from a Rural or Residential Zoning District up to a
Maximum height of 150 feet.
b. No antenna shall extend more than 20 feet above the highest point of a public utility
structure.
Setback for newly constructed towers:
a. Towers located within a Public Street or right-of-way, shall meet the setbacks of the
underlying zoning district, except industrial zoning districts where towers may encroach
into the rear setback area, provided that the rear property line abuts another industrially
zoned property and the tower does not encroach upon any easements.
b. Towers, except those which are public utility structures, located within a Public Street or
right-of-way need not be set back from a street or right-of-way line
c. Towers except those which are public utility structures, located within a Public Street or
right-of-way, shall not be located between a principal structure and a public street, with
the following exceptions:
i. In industrial zoning districts, towers may be placed within a side yard abutting
an internal street.
ii. On sites adjacent to public streets on all sides, towers may be placed within a
side yard abutting a street.
d. A tower's setback may be reduced or its location in relation to a public street varied, at
the sole discretion of the City Council, to allow the integration of a tower into an existing
or proposed structure such as a Place of Worship steeple, light standard, power line
support device or similar structure by a new structure provided the structure is
substantially similar in design and color to the existing or proposed structure and extends
no more than 20 feet above the highest point of the existing or proposed structure.
e. The set back and height requirements shall not apply to Water Towers and poles
supporting emergency warning devises to which are attached antennas nor shall the
height and setback requirements apply to Place of Worship sanctuaries, steeples and bell
towers to which are attached antennas.

vi. That application shall be accompanied by payment of such fees as provided by

b, Industrial Districts
i. For antennas located upon an existing structure or tower:
1. Building mounted antennas shall extend not more than ten (IO) feet
above the roof, and shall be set back at least five (5) feet from the roof
edge
2, Wall or fa~ade mounted antennas may not extend more than five (5)
feet above the cornice line and must be constructed of a material or
color that matches the exterior of the building
ii. For antennas requiring the construction of a new tower:
1. If there is no existing structure which meets the height requirements for
mounting the antennas, the antennas may be mounted upon a monopole
tower not exceeding one hundredfifiy feet (150~ in height, with a
setback equal to the height ofthe tower, unless a qualified engineer
specifies in writing that the collapse of the pole or tower will occur
within a lesser distance under all foreseeable circumstances.
Permit Requirements:
a. For antennas located in Residential or Public/Institutional and Commercial or Business
Districts
i. Antennas not located upon a public or quasi-public structure or existing tower
shall require the processing of a conditional use permit.
ii. Antennas to be located upon public structures or existing towers shall require the
processing of an administrative t>ermit.
Location:
a. With certain conditions, Lakeville allows towers to be located in:
i. Agricultural/ Rural or Residential Districts
ii. Commercial or Public Districts
iii. Industrial Districts
Conditions:
a. Collocation:
iii. Lakeville Ordinance does not mention collocation requirements
b. The applicant shall demonstrate by providing a coverage/interference analysis and
capacity analysis prepared by a qualified engineer that location of the antennas as
proposed is necessary to meet the frequency reuse and spacing needs of the personal
wireless service system and to provide adequate wireless coverage and capacity to areas
which cannot be adequately served by locating the antennas in a less restrictive district.
Height & Setback Requirements
a. Agricultural/Rural or Residential and Commercial or Public Districts
i. For antennas located upon an existing structure or tower:
1, Antennas mounted on public structures shall not extend more than
fifteen feet (I5') above the structural height ofthe structure to which
they are attached.

Attached for your review are two examples of downtown neighborhood residential blocks in
which driveway situations similar to that in the Valek variance exist. This seems to be a
common issue within the older neighborhoods.
ACTION REOUESTED
Staff would like to discuss potential options (i.e., code amendments) that could resolve having
property owners request variances every time they would like to make an improvement to an
existing driveway that does not meet the current setback requirements for parking surfaces in
residential areas.
