Fax 651.463.259l www.ci.farmington.mn.us TO: Planning Commission FROM: Lee Smick, AICP Jv City Planner {J SUBJECT: Conditional Use Permit Public Hearing - Impound Lot DATE: April 8, 2008 INTRODUCTION The applicant, Steve Lorenz, has submitted an application for a Conditional Use Permit to open an impound lot at 22068 Canton Court (Exhibit A). The property is zoned B-3 (Heavy Business). This is a public hearing for a CUP that was noticed in the Farmington Independent in the April 10, 2008 edition. DISCUSSION On March 3, 2008, the City Council approved the use of an impound lot as conditional in the B-3 zoning district. The following language was approved at that time: Impound Lot: Any structure or land devoted principally to the storage of impounded vehicles or recreational vehicles with or without an office on the premises for the release of those types of vehicles. The impounded vehicles need to be parked in a building or in the rear of a building and any outside parking needs to be 100% screened. On April 8, 2008, the Planning Commission reviewed the proposed permit during the discussion portion of the meeting. The following information was reported at that meeting and corrections made during the meeting are in italics: The impound lot operation will consist of an impound/towing use where cars are either impounded on the lot at 22068 Canton Court upon police direction or autos are towed to a repair shop. Some of the cars parked in the lot may be accident vehicles. The hours of operation are 24 hours a day, 7 days a week. There will be staff members on site at all times. Mr. Lorenz currently has a staff of lO and owns 5 trucks for towing autos. Mr. Lorenz is renting half of the existing building with an interior space of 5,000 square feet (Exhibit C). The rented space is at the south side of the building. Some cars will be stored inside of the building for security purposes, hO'.\'e'ler, Storage of cars inside of the . . . building is not permitted, therefore, all of the impounded cars will be parked at the rear of the building located on the east side of the property. The cars parked outside will be parked on the existing class 5 material. Mr. Lorenz proposes to screen the east, south, and west sides of the fence with bfe.wfI: white slats. Because the impound business \yill be operated at the south end of the building, no screening 'Hill be required on the north side of the lot since the current property O'.vner still o'.vns a business in the north side of the building. The applicant will ask the property owner to the north if he can screen the fence. Security lights currently exist on the building and will light the outside impound lot. Security cameras will also be mounted to the building. Discussion bv the Plannine: Commission on Avril 8. 2008 The Planning Commission discussed the following items and concerns: l. Screening the lot on the east. Commissioner Larson suggested that a condition should be required for screening the east fence by the applicant if the existing trees are removed, or the golf course to the east develops. - The applicant agreed to this requirement. (Exhibit B). 2. Screen north lot. The applicant asked the owner of the fence to the north if he could screen the fence and it was approved. Exhibit C shows photos of slats and Exhibit D shows remainder of property. 3. Should a fence be located between the impound lot and Tracy Bauer's (owner of the property at 22068) business for tighter security for the impound lot? The entire lot is fenced for security purposes so no fence between the applicant and Mr. Bauer's property is required. 4. The elevation of the cars parked on the lot is 900.79 feet and 897.35 feet on the golf course. (Additional elevations are shown on Exhibit E). 5. No storage of cars inside of building is allowed because the building is not sprinkled. ACTION REQUESTED Staff recommends approval of the Conditional Use Permit application with the following conditions: l. Impounded cars may not be stored within the building at any time. 2. The screening of the fence on the east side of the property will by installed by the applicant when one of the following occurs, l) the trees are removed, or 2) development occurs to the east of the property. Fax 651.463.2591 www.ci.farmington.mn.us TO: Planning Commission Lee Smick, AICP ., V pi City Planner v'(;6 FROM: SUBJECT: Parking Lot Configuration - 808 2nd Street DATE: April 22, 2008 INTRODUCTIONIDISCUSSION At the February 26, 2008 Planning Commission meeting, the Commissioners approved the variance to expand the envelope of the nonconforming structure at 808 2nd Street. At the time, the property owner did not submit a parking lot plan, however, the Commissioners requested that the plan be discussed when it was submitted to the City. The plan was submitted on April 11, . 2008 and staff is bringing it to the Planning Commission for discussion. The following are the conditions of the approved variance: l. A parking lot plan showing a paved, striped parking lot with 8 spaces (multi-family parking spaces = 2.5 spaces per unit) is required. 2. A grading plan for the paved parking lot is required. 3. The parking lot needs to be screened by a fence, wall, landscaping or earth berm because the lot consists of more than 6 spaces in a residential district. 4. Landscaping (1 tree and 3 shrubs as possible due to existing trees) every 40 feet along the perimeter of the parking lot is required. 5. The applicant submits a bond for the parking lot costs. The plan shows the required 8 spaces, however, the length of the parallel spaces need to be increased to 22 feet rather than 20 feet. The driveway and parking areas will be asphalted and the south driveway will need to maintain a 5-foot wide setback from the south property line. Asphalt will be located to the building foundation line on the south side of the building, and grass areas will be maintained on the north side of the building between it and the parking lot/driveway. At the time of this writing, a revised parking plan has been requested by the engineering division in order to review the drainage on the site upon installation of the parking lot. At this time, staff is requesting that the Planning Commission cancel the workshop that was to be held on April 22, 2008. Staff will discuss a proposed date for a workshop in May at the May 13th Planning Commission meeting. ACTION REQUESTED Cancel the April 22nd Planning Commission workshop for the 2030 Comprehensive Plan - 2008 Update Work Plan.
