INTRODUCTION
Newland Communities has submitted three applications for review of the Fairhill development by the
Planning Commission. The applications include the review of a Comprehensive Plan Amendment, a
Schematic PUD, and the review of the Fairhill Preliminary Plat - Phase I and Site Plan. The property
consists of 965 acres and the developer proposes between 2,201 and 3,016 total housing units at build-out
of the entire project.
DISCUSSION
The Developer has submitted a number of items for review by the Planning Commission. The following
items will be addressed throughout the memorandum:
1. Proposed Comprehensive Plan Amendment Map
2. Schematic Planned Unit Development
3. Fairhill Preliminary Plat, Phase I and Concept site plan
Comprehensive Plan Amendment
Attached as Exhibit A, is the original land use configuration (Comprehensive Plan) within the
Seed/Genstar property which was approved in 2000 as an update to the Farmington 2020 Comprehensive
Plan. The original Comprehensive Plan was then amended on June 19, 2006 by the City Council. The
2006 Comprehensive Plan amendment is attached as Exhibit B.
Newland Communities is seeking a new comprehensive plan amendment that allows for an adjustment in
the proposed housing mix to respond to the changing market conditions. The major change that has
occurred in this latest amendment is in regard to the amount of Low Density Residential acreage. The
proposed amendment also shows a significant decrease in the amount of acreage being designated as
Low-Medium Density Residential. Approximately 513.2 acres of the entire site is to be designated as
Low Density Residential. The breakdown of acreage for each proposed land use is as follows:

Fairhill Schematic Planned Unit Development
. Sheets PUD-OO through PUD-17 of the attached packet are addendums to the PUD Agreement for this
development. The PUD Agreement is currently being prepared for review by the Planning Commission
and the City Council, however, the aforementioned Sheets offer the Planning Commission the needed
information to approve the schematic PUD, The final PUD, including the PUD Agreement, will be ready
for Planning Commission review at the time of Final Plat review for the first phase.
The Fairhill project aims to supply housing for those individuals, couples, and families seeking entry-
level, move-up, upper bracket and maintenance free housing options. In addition, Fairhill will offer
parks, playfields, protected open spaces, expanded roadway systems and walkable trails through the
development.
The development encompasses 965 acres, of which approximately 732 net acres are reserved for
residential development, and approximately 25.43 acres is reserved for commercial development. The
commercial development will be located at the northwest intersection ofTH 3 and 19Sth Street (Outlot CC
of Preliminary Plat). It should also be noted that the information center for the development is proposed
to be located on Lot 1, Block 14 of the Preliminary Plat. The total acreages of the PUD are detailed on
Sheet PUD-12. Overall, the developer is proposing a net density of 3,02 - 4.14 dulac, which averages a
net of 3.5 dulac, meeting the requirements of the Metropolitan Council.

The PUD concept site plan shown on Sheets PUD-12 and PUD-13 meet the Comprehensive Plan (shown
on Sheet PUD-OS) proposed with this submission. Sheets PUD-08 and PUD-09 identify the access and
circulation plan for the Schematic PUD. Highway 3 and 19Sth Street will be major transportation
corridors throughout the project. A north/south "spine" road will connect the local roads throughout the
development.

The Open Space & Amenities Plan shown on Sheet PUD-07 identifies the developer's proposal for parks,
and open space within the development. A revised version of Sheet PUD-07 had been submitted by
Newland Communities to address some previous concerns expressed by the Park and Recreation
Advisory Commission [PRAC]. Randy Distad, Farmington's Parks & Recreation Director, and PRAC
have reviewed and approved the revised Open Space and Amenities Plan. Mr. Distad has submitted a
review Letter (attached as Exhibit C) recommending that the Planning Commission approve the acreage
and locations of the parks, sidewalks, and trail locations as shown on Mr. Distad's Exhibit A (attached to
the aforementioned Exhibit C). Exhibit A is the revised Open Space and Amenities Plan that was recently
submitted by Newland Communities.
The lot width and number of homes for each residential product are shown on Sheet PS-03. The setbacks
being proposed for this development are as follows:

. City staff has reviewed the PUD Schematic concept plan and has determined that the proposal meets the
requirements for approval of the Schematic PUD and is consistent with the proposed Comprehensive
Plan.
Fairhill Preliminary Plat. Phase I/Site Plan
The overall Preliminary Plat being proposed by the developer is shown on Sheet PP-01 of the attached
packet.
The Phase I Plan consist of the existing conditions, plat, grading, streets, utilities and landscaping plan,
along with the building and monument sign plans. Phase I consists of approximately 99 gross acres and
the platting of 241 lots with numerous outlots. The remaining 865 acres of the site will be platted as
outlots for future phases.
The 241 residential units in the first phase will include a mix of single-family housing choices, including:

The developer is projecting a gross density of 2.44 dwelling units per acre and a net density for the first
phase of 2.64 dwelling units per acre.

Phase I consists of the construction of 195th Street, a portion of the main north/south parkway and a
number of local roads and cul-de-sacs. Sheet P A-02 shows designs for the main entry monument plan,
roundabout plan for the intersection of Trunk Highway 3 and 195th Street, and roundabout monument.
The monument signs will need to be reviewed upon the submission of a sign permit application. The size
height, and lighting of the monument signs will also need to be reviewed at that time.
The Preliminary Planting Plan for phase I is shown on Sheets PL-O I and PL-02. The developer is
proposing the installation of boulevard trees with this development. The City has determined that the
developerlHome Owner Association [HOA] will be responsible for all boulevard trees in this
development. The responsibility includes the installation, maintenance, and replacement of any
boulevard trees. This is a major deviation from the City's current boulevard tree policy and the
responsibility of the trees by the developer will be included in the PUD Agreement.
Staff has determined that the preliminary plat and site plan meet City Code requirements and, therefore
recommends approval of the documents.
ACTION REOUESTED
City staff recommends the following:
1. Recommend approval of the Fairhill Comprehensive Plan Amendment, Schematic PUD, and the
Fairhill Preliminary Plat - Phase I/Site Plan Review and forward the recommendation to the City
Council.

INTRODUCTION
Newland Communities, Inc. (the Developer) submitted a PUD and Preliminary Plat for the Fairhill
Development that the Park and Recreation Department staff and the Park and Recreation Advisory
Commission (PRAC) members have reviewed.
DISCUSSION
The PUD and Preliminary Plat identifies park, open space and trail locations. Additionally, sidewalks are also
shown that provides a plan for pedestrian movement through the development. The parks that are identified to
be public parks are generally in compliance with the location of parks identified in the City's Existing and
Proposed Parks, Open Space and Trail Plan. The Developer identifies 101,86 acres of public park land to be
given to the City. It includes two community parks, two neighborhood parks and land for trails.
The developer also identifies that an additional approximately 150 acres of open space along North Creek will
be given to the City that contains floodplain, wetlands and wetland buffers. This will allow the preservation
and protection of the North Creek Greenway corridor. The developer is proposing that an additional 33A7
acres of private open space being created that will be used for trails and amenities and will be constructed by
the Developer and maintained by the homeowner's association.
While there was a concern with the location of some sidewalks and trails that were originally identified by the
Developer, these concerns were discussed and resolved with the Developer in a meeting on December 4,2007
with staff. As a result of this meeting a revised sidewalk and trail plan was presented to the PRAC at its
December 5, 2007 meeting, Exhibit A, which is attached to this memo, is the revised plan that shows
additional sidewalk and trail connections not previously identified in the original PUD and Preliminary Plat
submitted by the Developer, After a presentation by and discussion with the Developer, PRAC members
unanimously approved the location and size of the parks and approved the trails and sidewalks plan that
creates additional connections.
ACTION REQUESTED
The PRAC is recommending that the Planning Commission approve the acreage and locations of the parks and
the sidewalk and trail locations as shown in Exhibit A for the Fairhill Development PUD and Preliminary Plat.

the R-2, R- T, and R-D zoning districts the Subdivision Code

INTRODUCTIONIDISCUSSION
The Planning Commission met on December 11, 2007 to discuss the proposed text amendment
to Section 10-4-2 (D) concerning streets in the downtown district. The Planning Commission
also began discussions of whether this amendment should be all inclusive for the residential
zoning districts (i.e., R-l, R-2, R-3, R-4, R-5, R-T, and R-D).
The Planning staff would like to address the R-l, R-3, R-4, R-5 zoning district issue, particularly
the R-l zoning district, at a later date in order to consider streets only within the downtown
district. As mentioned before, the Planning Commission met at a joint workshop on October 17,
2007 to discuss the splitting of lots in the downtown residential district. At the meeting, the City
Council and Planning Commission determined that lots splits should not occur unless on a City
approved public street (Exhibit A).
As stated in Section 11-4-2 (D) ofthe Subdivision Code
(D) Frontage: Every lot must have the minimum frontage on a city approved street other than an
alley, as required in the city zoning ordinance.
To eliminate the vague language concerning a "city approved street" in the text above, staff is
proposing that the language be revised to "city approved public street".
Additionally, staff has recommended that language concerning a private street should be
included in this section. The revised language (Exhibit B) is proposed as follows:
Private streets that are consistent with City Standard Detail Plates & Engineering Guidelines, will
only be allowed in the R-2. R-T. and R-D zoning districts as Planned Unit Developments within
outlots owned by a homeowners association and subject to covenants providing for long term
care and maintenance of the private streets.

The City Code requires that Planned Unit Developments be comprised of at least five (5) acres of
contiguous land in order to provide a private street. The 5 acres is a typical minimum size for a
Planned Unit Development. This proposal should eliminate the language confusion between a
public and private street in the downtown district since no lots over 5 acres exist in the
downtown area.
ACTION REQUESTED
Review the text amendment, make revisions as necessary, and approve the amendment to
Section 10-4-2 (0) concerning the frontage of lots as described and forward the
recommendations to the City Council.

THE CITY COUNCn.. OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. The City of Farmington City Code, 11-4-2 (D) Frontage, is amended by adding the
underlined language as follows:
(D) Frontage: Every lot must have the minimum frontage on a city approved public street
other than an alley, as required in the city zoning ordinance. Private streets that are consistent
with City Standard Detail Plates & Engineering Guidelines will only be allowed in the R-2.
R-T. and R-D zoning districts as Planned Unit Developments within outlots owned by a
homeowners association and subject to covenants l>foviding for long term care and
maintenance of the private streets.
SECTION 2. Effective Date. This ordinance shall be effective upon its passage and publication
according to law.
