INTRODUCTION I DISCUSSION
Newland Communities, the applicant, has submitted for review the above mentioned items. The
original submittal was received on January 12,2007 upon which comments were later provided to the
applicant. The applicant then re-submitted plans on March 23, 2007 based on the comments
previously provided. Since the re-submittal, the various agencies and City staff have been reviewing
the updated plans. However, due to the size and amount of detail incorporated within the plans and
the fact that it is an extremely quick turn-around from March 23rd to the Planning Commission
meeting on April 10t\ staff is not ready at this time to make a recommendation on these items.
ACTION REQUESTED
Open the public hearing, allow for Newland Communities to comment on the current status of the
project, and then continue the public hearing to the next scheduled Planning Commission meeting.

The applicant, Jill Steffes, is requesting Planning Commission approval for a Conditional Use / Home
Occupation Permit to allow her to conduct a beauty salon within her home.

The salon will involve basic hair cuts, colors, permanents, etc. Most of this work will be completed
in one barber chair; some chemicals may be involved. A second chair will likely be utilized for
pedicures.
Operation
Ms. Steffes indicated that she would be the only person working in the salon and that she would be
available by appointment only. She has indicated that her work week would be approximately 10
hours long.
DISCUSSION
Section 10-6-2 of the City Code provides as follows:
A home occupation is permitted as an accessory use if it complies with the requirements of this
section following all procedures outlined for approval of a conditional use.
(A) The home occupation shall be conducted solely and entirely by persons who reside full
time in the home.
As stated above, the applicant has indicated that she would be the sole person working in
the salon.
(B) The home occupation shall be conducted wholly within the principal or accessory
structures.
The salon operation would be conducted wholly within the applicant's home.
(C) No structural alterations or enlargements shall be made for the sole purpose of conducting
a home occupation.
The applicant will not be making any enlargements to the home to accommodate the
proposed home occupation. However, the applicant is proposing to finish off the
basement of the home and the salon area will occupy one of the rooms to be finished
(D) One one home occupation shall be permitted for each principal structure.
No conditional use/home occupation permit exists for this property.
(E) Exterior displays or signs other than a two-sided, two (2) square foot, non-illuminated sign
and exterior storage of materials and exterior indication of the home occupation or
variation from the residential character of the principal structure shall not be permitted.
The applicant has not indicated whether she would install a signfor the business or not.
A sign permit would be required if the applicant wishes to install a sign.
(F) The activity does not involve the manufacture, assembly or distribution of goods and the
activity does not deal with the general retail public.

ACTION REQUESTED
Determine if the operation of a salon is acceptable under the City's Home Occupation ordinance

INTRODUCTION / DISCUSSION
Trinity Care Center has submitted an application for Preliminary and Final Plat for Trinity Health
Care I st Addition. The plat area contains two parcels of land under the ownership of Trinity Care
Center. The property to be platted currently contains a parcel consisting of the Trinty Campus
(hospital, nursing home, and apartment complex) located off of 213th Street West and a parcel ofland
south ofthe campus that consists ofthe daycare and vacant land.
The applicant is proposing to combine the two parcels of land into one large lot to facilitate the
construction of a nursing home expansion. The plat is necessary as the proposed expansion crosses
property lines. By combining the two lots into a single lot this issue would be absolved.
However, at this time additional information needs to be submitted by the applicant regarding the
placement of certain easements as well as the need for a grading and utility plan. Therefore, there is
not sufficient enough information for staff to make a recommendation on the Preliminary and Final
Plat at this time. It is the recommendation of the planning staff to continue the public hearing
concerning these items to the next scheduled Planning Commission meeting.
ACTION REQUESTED
Continue the public hearing concerning the Preliminary and Final Plat for Trinity Care Center 1st
Addition to the next scheduled Planning Commission meeting.

FINDINGS OF FACT
AND DECISION
On March 13, 2007 the Farmington Planning Commission met to consider the application of
Michael Bischel for a variance from the minimum lot width requirement of 75 feet for the purpose of
constructing a two-family dwelling in an R-2 zoning district. The applicant was present and the Planning
Commission heard testimony from all interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The location of the proposed two-family dwelling is at 601 8th Street.
2. The property at 601 8th Street was identified as being zoned R-2 (Low/Medium Density
Residential), under which the minimum lot width and lot area for a two-family dwelling is 75 feet
and 11,000 square feet, respectively.
3. The width and square footage of the lot is 60 feet and 12,001 square feet, respectively.
4. The lot currently contains a single-family home and meets all the bulk requirements for a single-
family home in the R-2 zoning district.
5. The Planning Commission denied the variance request of fifteen feet.
6. The Planning Commission detennined that reasonable use of the property would not be
diminished if the variance was to be denied. In addition, the Planning Commission detennined
that there were no findings of hardship, other than financial, since the lot meets all the bulk
requirements for a single-family residential lot.
7. The Planning Commission's decision was also based on the staff report, analysis and
reeommendations. Staffs findings were adopted by the Planning Commission.
DECISION
Applicant's request for a fifteen (15') foot variance from the minimum lot width requirement in an R-2
zoning district for the purpose of eonstructing a two-family home is denied.
