INTRODUCTION
Tim Giles of Giles Properties, Inc. proposes to plat 6 single-family residential lots in the
East Farmington 9th Addition. The proposed 6 lots are located on the west side of 12th
Street within the City of Farmington. The proposed 6 lots are zoned R-2 (Low/Medium
Density Residential) which allows for a minimum lot size of 6,000 square feet, minimum
lot widths of 60 feet, minimum setbacks of 20 feet in the front and 6 feet on the side and
rear yards, a maximum of 5.5 net dwelling units per acre, and a maximum lot coverage of
30%.
DISCUSSION
Tim Giles submitted a Wetland Exemption Form for the existing wetland that presently
encompasses the 6 lots proposed for development in the East Farmington 9th Addition.
The Notice of Wetland Conservation Act Decision has denied the wetland exemption (see
attached), requiring that Mr. Giles submit a Wetland Conservation Act Mitigation Plan.
The Plan needs to be prepared by Mr. Giles and upon completion, needs to be distributed
to reviewing agencies (Minnesota Pollution Control Agency, Minnesota Department of
Natural Resources, etc) for their review of the mitigation plan. This process will take
approximately one to two months to complete. Therefore, City staff is recommending
that the East Farmington 9th Addition Preliminary &: Final Plat be continued until the
wetland mitigation plan has been approved by agencies.
ACTION REQUESTED
Staff recommends that the East Farmington 9th Addition Preliminary &: Final Plat be
continued until the wetland mitigation plan has been approved by reviewing agencies.

WETLAND CONSERVATION ACT
FINDINGS OF FACT
East Farmington 9th Addition
The applicant has indicated that excavation done previously within an existing
wetland was mitigated for by the construction of a replacement wetland on the east
side of the East Farmington development site in the late 1990s. The applicant has
requested an incidental wetland exemption for the area of the wetland within the
East Farmington 9th Addition.
We have reviewed the 1994 permit application and found that the wetland in
question was 2.47 acres. The permit application approved impacts to 1.00 acre of
the wetland for the construction of Twelve and Elm Street. The remainder (1.47
acres) of the wetland was not impacted or replaced with the East Farmington
Development. As a result it has been found that the incidental exemption requested
for the entire wetland does not qualify and is denied.
