INTRODUCTION
The City Code currently allows one (1) monument sign for nonresidential uses
that are conditionally permitted in residential zoning districts. The Code does
not have a provision to allow a second monument sign if a property has more
than one street frontage. The new Farmington Lutheran Church has expressed
an interest in erecting signs at both the entrance on Akin Road and the
entrance on Devonport Drive. Currently, only one (1) sign is allowed.
DISCUSSION
According to the City Code:
10-6-3(2)(c): Permitted Nonresidential Uses: For permitted
nonresidential uses, one freestanding monument sign not to exceed fifty
(50) square feet in sign area and ten feet (10') in height. Signs shall be
located at least ten feet (10') from property lines and in no case shall be
permitted within the thirty foot (30') triangle of visibility at street
intersections. Wall signs shall not exceed twelve percent (12%) of the
building facade or three hundred (300) square feet, whichever is less.
The Planning Commission reviewed this issue at its meeting on January 11,
2005 and agreed that it may be appropriate to allow one sign per street
frontage, but only if an access was present. The Code could be amended as
follows:

AN ORDINANCE AMENDING SECTION 10-6-3 (SIGNS AND
BILLBOARDS) REGARDING SIGNS ALLOWED FOR NON-
RESIDENTIAL USES IN RESIDENTIAL ZONING DISTRICTS
THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Section 10-6-3 (B)(2)(c) of the Farmington City Code is amended as follows
(new text is underlined, deleted text is stmek):
Permitted Nonresidential Uses: For permitted nonresidential uses, one freestanding
monument sign is allowed per street frontage is allowed if an access drive is present.

INTRODUCTIONI DISCUSSION
The applicants, Kim Friedrich and Terry Mahoney of Hometown Inc., have submitted a
2 revised concept plan for a proposed single-family development that would be
located south of 209th Street, east of the American Legion on Trunk Highway 3, and
north of the Marschall Lines bus garage.
The applicants have submitted 2 revised concepts that they believe meet the
suggestions of the Planning Commission from the meeting on January 11 th. The
packet from that meeting is attached for reference.
Concept 1
Concept 1 shows a similar design from the January 11th meeting; however, the lots on
the west side of the property adjacent to the existing commercial areas have been
lengthened from approximately 110 feet to approximately 200 feet.
Concept 2
Concept 2 shows a cul-de-sac along the south property line. The lots on the west side
of the property adjacent to the existing commercial areas have also been lengthened
from approximately 110 feet to approximately 200 feet. A 50-foot buffer is proposed
at the rear of the lots and a pond is proposed adjacent to the American Legion's
volleyball courts.
Development Committee Comments
The Development Committee prefers Concept 1 due to the ease of extending the
north/south road to the south in the future.

Hometown Concept Plan

INTRODUCTION
The applicants, Kim Friedrich and Terry Mahoney of Hometown Inc., have submittedia
concept plan for a proposed 28-lot Single-family development that would be locat~d
south of 209th Street, east of the American Legion on Trunk Highway 3, and north of
the Marschall Lines bus garage. The process for submitting a concept plan is outlined
in the City's Subdivision Ordinance and allows the Planning Commission to provide
comments prior to preliminary plat submittal.
DISCUSSION
The concept plan consists of two separate properties that are currently located in
Empire Township. The westerly property is owned by the American Legion and
comprises' 4.67 acres. The easterly property is owned by Steve Frandrup and
comprises 2.97 acres. The owners of Hometown Inc. have signed a purchase
agreement for the two properties. The City's MUSA Review Committee recently
approved MUSA to the two properties contingent upon annexation of the properties.
Concept Plan Review
Hometown Inc. proposes to develop 28 single-family lots on a total of 7.64 acres with
a density of 3.53 units/acre. Hometown Inc. has proposed a subdivision development
with minimum lot sizes of 6,000 square feet and minimum lot widths of 60 feet.
Therefore, Hometown Inc. would have to (a) petition for a Comprehensive Plan
Amendment to allow low/medium density on the property and (b) request R-2 zoning
to meet the density requirements.
Transportation
As shown on the concept plan, the only access into the proposed subdivision would be
from 209th Street. The interior roadway is proposed with a 60-toot right-ot-way and
roadway width of 28 feet. The proposed roadway requires a sidewalk on one side of
.
the street as per City standards. The proposed cul-de-sac length to the southern cul-
de-sac is approximately 1,100 feet, requiring a variance to the City's maximum cul-
de-sac length of 600 feet. In 2001, the Planning Commission approved a variance of
910 feet for the cul-de-sac in Middle Creek Estates to allow a total length of 1,410
feet. The roadway width in Middle Creek Estates is 32 feet and the development
totals 26 single-family lots.
UtiUties
Both water and sanitary sewer were constructed along the eastern border of the
Hometown Inc. site in 2000 to service the Tamarack Ridge development to the north.
The existing water and sanitary sewer lines are located within an existing 42-foot
wide utility easement on the east side of the Hometown Inc. concept plan. Utilities
for the proposed Hometown development would connect to these existing utilities. A
storm water pond is also required for the Hometown Inc. development. Th~
applicants have proposed a pond in the southeast corner of the development that wiUl
outlet to the Prairie Waterway to the east. The Engineering Division has reviewed the
concept plan and has provided a number of comments to the applicants concerning
engineering requirements on the plan.
Park and Trail Requirements

Randy Distad, the Parks &. Recreation Director has provided comments concerning the
concept plan that are attached to this packet. He recommends that trails and
sidewalks be included within the development; however, because of the close
proximity of Tamarack Park to the north of this plan, he will make a recommendation
to the Parks &. Recreation Committee that the City take cash-in-lieu of park property
from the applicant.
Development Committee Comments
At the January 4, 2005 Development Committee meeting, the members suggested
revisions to the concept plan. Those suggestions included relocating the storm water
pond to the southwest and/or to a location along the southern property line to
provide a buffer from the existing volleyball courts owned by the American legion
and/or the bus depot owned by Marschall lines. Additionally, the members suggested
a buffer from these existing uses through the planting of trees and fencing. The
members also suggested that if the pond remains where it is proposed, it needs to be
reconfigured to remain out of the roadway boulevard. Additional comments included
the concern of buildable lots on 1, 8, 12, 20, 24, 27, and 28.

Comments on Hometown Conceptual Development Plan

INTRODUCTION
I received the Hometown Conceptual Development Plan and wish to provide some comments about trails,
sidewalks and parks within this development.

DISCUSSION
The submitted conceptual development plan does not identify any trails, sidewalks or a park. I have attached for
the Planning Commission's consideration a concept plan that contains proposed trail and sidewalk locations. It is
shown as Exhibit A. While none of the trail and sidewalk locations are identified on the City's trail master plan, I
nonetheless feel that there needs to be some pedestrian and bike connections made to Tamarack Park, which is a
City park located just to the north of this development and across 209th Street West. Within Tamarack Park there
have been trails constructed that will provide a connections to other future trails that will constructed as part of the
City's comprehensive trail system. As you can also see, constructing these trails in the locations identified in
Exhibit A allows for a future trail connection to be made to the south where it could connect to a future east/west
trail that is proposed to run along former railroad right of way that is currently owned by Marschall Line, Inc. This
proposed future east/west trail along the former railroad right of way will allow a trail connection to be made to
Trunk Highway 3 to the west and to the Prairie Waterway Trail to the east.
The trails and sidewalk locations proposed by staff within the development and combined with existing trails in
Tamarack Park will provide a variety of walking and biking loops of varying distances to be created. Still even
more loops of varying distances could eventually be created should trails in the development be connected south to
a proposed trail along former railroad right of way.
At this time I would recommend that the City not require the developer to dedicate any land for a park in this
development for the major reason that Tamarack Park is located within close walking pistance of this development
and with the construction of trails and a sidewalk should allow for good, quick access to Tamarack Park. I would

INTRODUCTION
Representatives of Round Bank have submitted a revised concept plan before
submittal of their plat in order for the Planning Commission to review and comment
on the access to the bank facility and the location of the building.
DISCUSSION
The subject property is zoned B-1 (Highway Business) and is designated 'Business' in
the Comprehensive Plan. The lot was platted in the Tamarack Ridge First Addition as
an outlot that was designated for future development. The bank would require only a
portion of the outlot, leaving the remaining area for other commercial development.
The plat that will be submitted will include the entire outlot. The portion of the
outlot that is not utilized by the bank will likely be platted as an outlot(s) until such
time as additional development is proposed.
Site Plan Review
According to the City Code, site plan review and approval by the Planning Commission
is required for all commercial development. The Commission would review general
site design, including setbacks, access, parking, landscaping, and other potential
impacts to surrounding properties. The applicant could choose to have the site plan
reviewed concurrently with the plat or at a future meeting after the plat has been
approved.
Transportation
As shown on the concept plan, the main access would be from Cascade Drive, which
currently terminates at the east edge of the subject property. The original concept
plan showed a second access from Trunk Highway 3 that was proposed as a 'right-in
only'. This access was not approved by the Minnesota Department of Transportation,

and was therefore dropped from the concept. The applicant is working with the
property owner, Jim Ostenson, to prepare a transportation plan for the overall
commercial area fronting TH 3 that would include a north/south access road from
Cascade Drive to 209th Street. However, plans have not been completed and staff is
recommending that those plans be finalized before the plat comes before the
Planning Commission for review. This recommendation is stated in Section 11-4-3 (C)
of the City Code and reads as follows, Ilwhere the plat includes only part of the tract
intended for development by the subdivider, a tentative plan of a proposed future
street system for the unsubdivided portion shall be prepared and submitted by the
subdivider. "
Variance Discussion
Round Bank Representatives propose the building to be constructed at the corner of
TH 3 and CR 66. Both transportation routes are considered minor arterial roadways
and therefore require a 50-foot front yard setback as per section 10-4-1 (L) of the City
Code. Additionally, the proposed lot abuts two roadways and therefore, the front
yard setback requirement is in effect along both TH 3 and CR 66 as per Section 10-4-1
(A) of the City Code. The representatives have questioned whether the Planning
Commission would favor a variance to these requirements along CR 66 to allow a 30-
foot setback in order to achieve the circulation and parking required for the concept.
ACTION REQUESTED
Provide comments to the Round Bank Representatives regarding the revised concept
plan and give them guidance concerning the variance discussion.

Please find the attached Preliminary Site Plan Submittal for the proposed Roundbank project to
be located at the intersection of Chippendale Avenue (TH 3) and Vermillion River Trail (CSAH
66) in the Tamarack Ridge Development We have included five full size plan sets and two
reduced scale plan sets for your use and distribution.

We understand today's submittal will be used for a concept plan review only but have included
as much information as possible for your review and comment Using your comments from this
concept plan review, we will prepare our formal site plan submittal for the February 1 submittal
deadline. We are anticipating the plat submittals from James Development for the February 1
submittal as well.
Please note that we will be requesting a variance to change the setback along CSAH 66 from 50
feet to 30 feet at the February 8 Planning Commission Meeting. If the Planning Commission
concurs with our request at that meeting, we will submit the formal variance application for
approval at the March 8 Planning Commission Meeting.

INTRODUCTION
.
Tom Wartman, owner of the Farmington City Center, has submitted a site plan for a
retail! office building that would be located at the northeast corner of the City Center
shopping area, east of Pellicci Ace Hardware and north of Edina Realty. Mr. Wartman proposes
the construction of a 6,400 square-foot one-story retail space (which will include the new
Farmington Liquor Store and an adjacent rental space) and a two-story, 4,800 square-foot
retail/office space attached to the rear of the liquor store.
DISCUSSION
The property is zoned B-2 (Downtown Business District) and allows both retail and office
spaces as permitted uses in the zoning district.
Section 10-6-23 (E) of the City Code requires that "Major Projects" be reviewed by the
Planning Commission. Under Section 10-6-23 (E) subd. 1, projects need to be reviewed by
the Planning Commission when construction of new structures with site improvements is
proposed for undeveloped land. This requirement was added to the zoning code on May 6,
2002. An application must be reviewed within 60 days of submittal of the site plan. The site
plan was submitted to the City on January 28, 2005 and the review falls within the allotted
time frame.
The liquor store will be located in front of the two-story portion of the building. The retail
entrance to the liquor store is at the southeast corner of the building. The two-story building
will provide space for both retail and office spaces and an elevator will be located in the
northeast corner of the two-story building. The entrances on the first level of the two-story
building are located on both the east and west sides of the building. Although the
architectural plan for the liquor store shows a blank wall facing Pellicci Ace Hardware, Mr.
Wartman has verbally indicated that the south end of the west wall will include a bank of
windows.

The plan shows 97 parking spaces on the lot; 75 spaces along with one space per retail
employee are required for the retail/office building. The spaces shown on the plan meet the
parking requirements stated in Section 10-6-4 of the City Code. A trash enclosure is located
on the west side of the building at the rear of the liquor store. The owner proposes a pylon
sign within a parking island in front of the liquor store. The pylon sign is allowed, however,
the allowable height for the sign is 18 feet and the allowable size is 50 square feet.
The following items need to be addressed contingent upon approval of the site plan:
1. An application for a sign permit needs to submitted and approved.
2. Provide detail concerning screening of trash enclosure.
3. Provide a landscape plan per Section 10-6-10 of the City Code.
RECOMMENDED ACTION
City staff recommends approval of the Farmington Center Retail/Office Site Plan contingent
upon the above-mentioned items being addressed.
