Charleswood 5th Addition Preliminary & Final Plat
DATE:

INTRODUCTION
Newland Communities has officially withdrawn their application for Preliminary and Final Plat Approval for
the Charleswood 5th Addition plat.
DISCUSSION
City staff received a faxed letter on February 6, 2001 from Newland Communities officially withdrawing their
plat application for the Charleswood 5th Addition due to an unresolved zoning issue.
. Staff recognized that the current zoning map incorrectly has shown the area between the Charleswood property
and Pilot Knob Road (CSAH 31) being zoned as part ofthe Charleswood Planned Unit Development (PUD).
This was deemed incorrect after reviewing the legal description of the ordinance rezoning the property from R-
1 (Low Density) to R-3 PUD.
Newland Communities has made fonnal application to amend the Charleswood PUD rezoning the subject
property from R-I to R-3 PUD. Newland has also made application for Preliminary Plat approval for the
Charleswood 5th Addition including the proposed 96 townhome units.
ACTION REOUESTED
Staff recommends a motion to accept the withdrawal letter from Newland Communities, officially
withdrawing the Preliminary and Final Plat approval of the Charleswood 5th Addition.

On January 19,200.1, Astra Gcnstar PtU'tnership, L.L.P. requested an
extension of time to complete revised pla.ns for Charleswood Sdl Addition.
Although we have completed these plans, ttn additional zoning issue has
surfaced that requlres a small portion of the subject property to be rezoned
from R-l to P.U.D. prior to preliminary plat review. Based on this, WiJ
formally withdraw lhlj prelimina.ry and tinal plat applicat.ion that was
submitted on November 14, 2000.

Further to the withdrawal orthe application, we submit an applicatioll 1.0
rezone a portion ofthc suhjed property from R-l to P.U.I1. and an
application requesting preliminary plat review and approval for
Charles wood 5th Addit.ion.
B~ed 011 the delays that we have experienced to date on this project, it
would be appreciated if you could place the abovlj rezoning and
preliminary plat applications on the soonest Planning Commission agenda.
Please call with questions.

Newland Communities
