DISCUSSION City staff received a faxed letter on February 6, 2001 from Newland Communities officially withdrawing their plat application for the Charleswood 5th Addition due to an unresolved zoning issue. . Staff recognized that the current zoning map incorrectly has shown the area between the Charleswood property and Pilot Knob Road (CSAH 31) being zoned as part ofthe Charleswood Planned Unit Development (PUD). This was deemed incorrect after reviewing the legal description of the ordinance rezoning the property from R- 1 (Low Density) to R-3 PUD. Newland Communities has made fonnal application to amend the Charleswood PUD rezoning the subject property from R-I to R-3 PUD. Newland has also made application for Preliminary Plat approval for the Charleswood 5th Addition including the proposed 96 townhome units. ACTION REOUESTED Staff recommends a motion to accept the withdrawal letter from Newland Communities, officially withdrawing the Preliminary and Final Plat approval of the Charleswood 5th Addition. ;;2~ Michael Schultz Associate Planner cc: Steve Juetten . Although we have completed these plans, ttn additional zoning issue has surfaced that requlres a small portion of the subject property to be rezoned from R-l to P.U.D. prior to preliminary plat review. DATE: February 13,2001 INTRODUCTIONIDISCUSSION The consultant, Hoisington Koegler Group Inc., will be m attendance to discuss items concernmg the Zoning/Subdivision Code Update. Discussions will include the proposed fonnat of the Zoning/Subdivision Code Update and analysis on the current uses within in each district. City staff met with the consultant on February 2, 2001 to evaluate the proposed fonnat. The Planning Commission should be prepared for an open discussion with the consultant concerning the proposed fonnat for the Zoning/Subdivision Code Update.
