DISCUSSION
The applicant, Benjamin Ward, is seeking Planning Commission approval of a Special Exception
permit to relocate a single-family home from it's existing location on Dodd Boulevard in
Lakeville to the proposed location in Farmington on 195th Street W.
The home is being moved to make way for a townhome development within the City of
Lakeville. As of the time of this report the City Building Inspector is scheduled to inspect the
home on Monday, May 21 st.
Currently the property in which the structure is proposed to be moved to has an existing home
and garage along with two outbuildings in addition to an existing outbuilding to be constructed
on the three (3) acre site (of which .5 acres is comprised of right-of-way easement for 195th
Street W.). The applicant has indicated that the existing home will either be sold or moved off
the property. Staff recommends establishing a time frame for completion of moving or razing
the existing home from the property.

Engineering has examined the proposed travel route and sees no issues with an oversized load to
be carried along those routes. Dakota County Highway Department has an application pending
on the proposed routes concerning routes along the County roadways.
ACTION REQUESTED
Staff recommends approval of the Special Exception Permit contingent upon the following:
1. The City Building Official approves to the overall condition of the structure;
2. That the existing home be moved or razed from the property within 60 days from the date the
proposed structure is moved onto the property;
3. The exterior of the structure shall be completed, upgraded and landscaped within 90 days of
moving the structure onto the property;
4. Dakota County Highway Department approval permitting vehicles of excessive weight or
size on County Highways.

. 10-8-7: SPECIAL EXCEPTIONS:
The Board of Adjustment may authorize a permit to move structures into or within the City in
accordance with the criteria and provisions listed herein: (Ord. 086-177, 3-17-1986)
(A) Applications will be filed with the Zoning Officer who shall set a public hearing, transmit
the application directly to the Board of Adjustment and mail a notice to property owners
adjacent to the subject property, disregarding public rights of way. Failure of such owners to
receive notice shall not invalidate the proceedings. The application shall consist of:
1. An application fee in an amount equal to that set by the City Council.
2. Six (6) copies of a site plan and supporting data which show the size, proposed location of
the structure and topography of the site.
3. A list of the streets on, over or through which said structure will be moved.
4. Photographs showing front, rear and side views of the structure. (Ord. 095-357, 8-7-1995)
(B) Upon a filing of an application, the Zoning Officer shall cause the Building Inspector to
investigate the building and report to him the results of the investigation together with
recommended action thereon.

(C) No permit shall be issued to move any building or structure which, in the opinion of the
Zoning Officer:
1. Is constructed or in such condition as to be dangerous.
2. Is infested with pests or is unsanitary.
3. Is unfit for human habitation.
4. Is so dilapidated, defective, unsightly or in such disrepair that its relocation at the
proposed site would cause appreciable harm to the property or improvements in the
neighborhood.
(D) The Board of Adjustment may authorize the move of a structure based upon the evaluation
of the following:
1. The age of the structure shall be similar to the age of the structures in the immediate
neighborhood.
2. The value of the structure shall equal or exceed the value of the structures in the
. immediate neighborhood.

3. The architecture of the proposed structure shall produce a visual impression which is
consistent with the architecture of the immediate neighborhood.
4. The exterior of the structure shall be completed, upgraded and landscaped within a time
frame established by the Board of Adjustment, but in no case shall exceed ninety (90) days.
5. There shall not be any storage of structures on any property, public or private.
6. The Board of Adjustment may attach other conditions as they deem necessary which
preserve the spirit and intent of this Title. (Ord. 086-177, 3-17-1986)
(E) Before a building permit can be issued, an applicant shall deliver surety acceptable to the
City Administrator in an amount equal to the cost of the work to be done as estimated by the
City Building Official. In the event the work is not completed, within six (6) months of
issuing the permit, the letter of credit shall be claimed, giving the City the option of
completing the work or demolishing the structure to clear, clean and restore the site, unless
an extension is granted by the City Council. In the event that the moving of any building
causes damage to the public streets or other public property, in addition to any other
remedies the City may have, the Zoning Officer may require the damage to be repaired with
the cost to be deducted from the letter of credit. (Ord. 095-357, 8-7-1995)

DISCUSSION
Michael and Eileen Devney and Lawrence Rother are seeking a Comprehensive Plan Amendment for their
respective properties to Low/Medium Density Residential and to rezone their properties from A-I
(Agriculture) to R-2 (Low/Medium Density-Residential).
The properties were annexed into the City on April 16, 2001. Each property was brought into the City in 60-
acre increments and was given an A-I zoning classification per City policy. The total acreage ofDevney's
property is 71 acres and Rother's is 69.6 acres.
The applicants each propose to amend the Comprehensive Plan to Low/Medium Density Residential on the
properties. Preliminary development proposals have ranged from multi-family townhomes to smaller single
family lot development, similar to East Farmington.
The property owners are also seeking to rezone the properties from A-I (Agricultural District) to R-2
(Low/Medium Density Residential District). The A-I zoning category is designated to a property when it is
annexed into the City. Additionally, a Comprehensive Plan Amendment and Zone Change is required if an
applicant plans for development on the property.
The R-2 (Low/Medium Density Residential District) is intended as an area which incorporates older existing
development as well as undeveloped land that would be suitable for small lot single-family constructions as
well as duplexes, townhouses and quad homes.
Transportation
The properties can be served by County Road 72 (213th Street) from the west. The street has recently been
upgraded in 2000 to include curb and gutter and pavement from Trunk Highway 3 to the southeastern corner
of Bristol Square where the street turns to the north. At this location, County Road 72 exists as a crushed rock
roadway. County Road 72 would most likely split the Devney and Rother property at their adjoining property
lines to access each property. The existing street measurements and curb and gutter would be required with
the extension of the roadway to the Devney and Rother properties.

Proposed Infrastructure
The City has reviewed the feasibility of serving this property with sanitary sewer and water service. As the
attached comments from Mark Rolfs of Bonestroo indicate, only the west half of the properties can currently
be served with gravity flow sewer service (see attached plan). Other possibilities to serve the east half of the
properties would involve extending a new trunk line south from the existing interceptor line near CSAH 66
approximately % mile to the north of the properties or installing a lift station.
A l2-inch water main exists in the County Road 72 right-of-way. Water is accessible from this main to both
of the properties as suggested by Mark Rolfs in his correspondence to the City.
ACTION REQUESTED
If the Commission wishes to recommend approval of the Amendment to the Comprehensive Plan to
Low/Medium Density Residential for the Michael and Eileen Devney and Lawrence Rother properties and
Rezone the properties from A-I (Agriculture) to R-2 (Low/Medium Density-Residential) and forward this
recommendation to the City Council, it should be contingent upon the following:
1. Staff evaluation and amendment to other chapters of the Comprehensive Plan, i.e. transportation, sewer
and water, housing, parks and trails, etc. in order to properly plan connection to necessary services.
2. Approval by the Metropolitan Council to amend the 2020 Comprehensive Land Use Plan.

AN ORDINANCE OF THE CITY OF FARMINGTON,
ANNEXING CERTAIN PROPERTIES TO THE CITY OF FARMINGTON
THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Farmington City Code Section 1-11-2: CHANGES; OFFICIAL MAP,
(A) Annexation is amended by adding paragraphs 34 to read as follows:
34. The property described below is hereby annexed to the City of Farmington pursuant to MSA
section 414.033:
The West 2200 feet of the South one-half (Sl/2) of the Northeast Quarter
(NEl/4) of section 32, Township 114, Range 19, Dakota County,
EXCEPTING therefrom the West 350 feet thereof. Containing 56.12
Acres more or less.
SECTION 2. Effective Date. This ordinance shall be effective immediately upon its passage
and publication according to law.
