DISCUSSION
St. Michael's Church, who owns the entire block 12 area, is selling the south half of the block to the
School District contingent upon approval of the conditional use permit. It is not known what the
future of the north half of the block is that contains both St. Michael's Church and a single-family
home.
Independent School District 192 has applied for a conditional use permit to convert the building
located at 421 Walnut Street from office space to classroom space for the School Districts
Alternative Learning Center. The building is approximately 7,000 square feet (foundation area) and
sits on 1.4 acres of property (excluding the alley was that divides the block north/south).
The applicant proposes to begin with at least five (5) classrooms with the ability to add two (2)
additional classroom spaces. The building would also contain a computer lab, bookstore, copy
room, kitchen (for staff), resource center, a large group area, a director's office along with three (3)
other office rooms and restrooms.

The ALC program currently has 30 middle and high school aged students with the anticipation of
adding approximately 10 more over the next several years. No future expansion of the facility is
anticipated at this time; if student enrollment expands the School District would offset the need for
additional classroom size by extending service hours. Students will continue receiving meals at the
District Service Center.
It is planned that if a school bus drop off area is needed it will be located at the rear of the building
in the alleyway. Currently there are approximately 8 ALC students riding the bus, with about 75%
of the ALe students having personal vehicles. The property contains a total of 103 parking spaces; a
parking lot containing 88 spaces is located on the west side of the subject lots and 15 parking spaces
are located in the rear of the building.
The property presently is adequately landscaped and staff will not reqUIre any additional
landscaping on the property.
Staff has determined that the proposed classrooms for the Alternative Learning Center would be an
adequate reuse of the property. Remodeling of the building and the relocation of the students is not
anticipated to be completed until fall of the 2000 school year or when the new St. Michael's Church
completes it's move to their new location.
ACTION REOUESTED
Staff recommends the Commission approve the conditional use permit for Independent School
District 192 in order for the applicant to convert the building located at 421 Walnut Street from

minimum lot size requirement. The applicant also is applying for a special exception
permit to move the structure over city streets.

DISCUSSION
David King has made application to the City for the approvals of a conditional use permit to
locate a two-family (duplex) unit within an R-2 (Medium Density) Zoning District, a
variance to the minimum lot size (11,000 square feet required) and a special exception
permit to move the structure along public streets.
The existing structure on the property was damaged by a fire in January 1998 and has sat
vacant since that time. The house served as a duplex although was not formally recognized
by the City through a conditional use permit.
Mr. King proposes to raze the existing damaged structure along with the garage and replace
it with a duplex unit that would be positioned over the existing foundation. (The applicant
plans to make application for a variance to the front yard setback for the next Planning
Commission meeting upon approval of the current applications.) The applicant also plans
on placing a two-stall garage on the property with parking in the drive, access would come
off of I st Street. The applicant intends to reside the home with vinyl siding, install new
insulation, windows and possibly a new fascia.
The proposed structure to be moved onto the property is a rambler style house measuring
twenty feet (20') by sixty-four feet (64'). The age of the structure is estimated in the mid-
1970's, and the estimated value of the structure will equal or be greater than those
properties surrounding the home after remodeling. The applicant and the contractor will
make the appropriate applications to MNDOT and Dakota County for moving the structure
along State and County highways; and staff will coordinate any issues that may arise with
both the contractor and MNDOT. Mr. King will need to apply for building permits for the
appropriate work done to the structure.
A variance for the placement of the structure is required due to the size of the lot at 9,032
square feet. Planning Commission has established recent precedence in granting variances
allowing duplexes on nonconforming lots. In June of 1994 the Commission approved a

variance for William Olson to convert a single-family house at 409 Oak Street into a duplex
situated on a 10,200 square foot lot. Do we want A hardship can be claimed due to the
splitting of the property around 1956 from the typical 10,000 plus square foot lots found on
the block to the existing lot size (the property was split from the north 75 feet of lots 1 and
2).
Staff feels that the applicant is making appropriate reuse of the property by re-establishing a
duplex on the subject site and having the City formally recognize the land use through
proper permitting.
ACTION REQUESTED
Staff recommends the Commission approve the conditional use permit, special exception
permit and variance in order for the applicant to move in an existing duplex structure onto a
less than minimum size lot in an R-2 zoning district contingent upon the following:
1. Applicant secure all proper permits including
a. Building Permits
b. Demolition Permit
c. Oversize Load Permit from MNDOT
d. Any Engineering Permits (i.e. curb breaking, additional water stub out)
e. Necessary setback variance if the existing foundation is to be utilized
2. Applicant complete an upgrade of exterior of structure within 60 days and any
appropriate landscaping (to be determined by staff) within 90 days upon approval of
permit.
3. Applicant deliver an acceptable surety equal to the cost of the work to be done to ensure
completion.

DISCUSSION
The manager for Lamperts Lumber, Mike Cordova, met with City staff on June 3, 1999 to discuss
various issues concerning the proposed rezoning of Lots I, 2 and 3 and also discuss requirements
that were not met from a past expansion ofthe supply yard.
In reviewing the requested rezoning, the owner originally desired a similar zone (B-3 Heavy
Business) in Lots 1,2 and 3 that currently exists on the Lamperts Lumber lot to the south. Since
the B-3 zoning district permits supply yards, the owner requested the B-3 zone to alleviate the
need for additional meetings such as the need for conditional use permits if the lumberyard were
to expand in the future.
However, at the June 3, 1999 meeting, City staff indicated to Mr. Cordova that staff would be
recommending that the lots be rezoned to B-2 General Business. Staffs position on this deals
with the need to control future expansion of Lamperts Lumber through conditional use permits
because of the close proximity to residential uses on the west and north. With the conditional use
process, certain conditions may be placed on a business when expansion or other construction is
proposed such as screening or landscaping requirements.
If the request to rezone the property to B-3 were approved, the City would not be in a position to
recommend conditions to the property. This could prove detrimental to adjacent residential areas
if screening or other conditions was not required for a higher intensity use such as the
lumberyard.
City staff also explained that if the property is rezoned to B) Heavy Business, off-street parking
would be required, eventually taking valuable supply yard space from the operation. Therefore,
Mr. Cordova acknowledged staff's recommendation to changing the original zoning request of B-
3 Heavy Business and propose a new request to rezone Lot 3, Block 16, Town of Farmington to
B-2 General Business and maintain Lots 1 and 2 as B-2 General Business and appeared to be in
agreement. Mr. Cordova and another representative from Lamperts Lumber will be in
attendance at the Public Hearing.
Additional discussions at the June 3, 1999 meeting included past requirements that were not met
when the lumberyard expanded in approximately 1993. A site plan submitted in 1993 showed
parking and landscaping improvements along Spruce Street in front of the retail portion of the
lumberyard. The City approved the site plan, however, the improvements along Spruce Street

were never installed. Currently, the parking lot along Spruce Street consists of gravel and no
landscaping has been installed. As required by City Code 10-6-8 (A2), "any off-street parking lot
and driveway area shall be graded for proper drainage and surfaced with concrete or bituminous
material. "
Therefore, the City will recommend that the parking lot be paved along Spruce Street and
landscaping per the 1993 plan be installed to fulfill the requirements of that approval.
In conclusion, the following issues need to be addressed before the Planning Commission:
I. Staff recommends changing the original rezoning request of B-3 Heavy Business to B-2
General Business, thereby rezoning Lot 3 of Block 16, Town of Farmington to B-2 General
Business and maintaining the B-2 General Business zone for Lots I and 2, Block 16, Town of
Farmington.
2. The City recommends Lamperts Lumber to pave the parking lot along Spruce Street and
provide landscaping per the 1993 plan in order to fulfill the requirements of that 1993
approval.
3. The City recommends that screening be provided within the expansion area requiring slats to
be installed within the proposed chain link fence.
4. The City recommends landscaping along Oak Street at the north side of the property.
. ACTION REQUESTED
Staff recommends forwarding an approval to the City Council to rezone Lot 3, Block 16, Town of
Farmington from R-2 (Medium-Density Residential) to B-2 (General Business) contingent upon
the approval of the 2020 Comprehensive Plan Update. This recommendation includes leaving
Lots I and 2 as B-2 (General Business).
