Variance for Rear Yard Setback -1210 Fairview - Keith Bistodeau
The owner of the property at 1210 Fairview is requesting a variance to the rear yard
setback requirements to locate a 999 square foot detached accessory building, four foot
from his rear property line. The property is located in an R-2 district requiring a six foot
rear yard setback requirement. The accessory building will encroach upon the rearyard
setback by two feet. The proposed accessory building will be constructed twelve feet
from the side property line to the north.
The lot consists 12,158 square feet and an existing home and deck reside on the property
constituing a 21 % lot coverage well below the 30% lot coverage required in an R-2 zone.
Residential uses surround the property on the north, south and east and Dakota County
Fairgrounds abuts the west property line where the encroachment of the rear yard setback
occurs.
The owner proposes to store metal siding within the building along with a truck used for
his business. Two accessory buildings are permitted for each residential lot. The
accessory building must be of the same or similar quality exterior building material as
used for the principal building. The building shall be constructed on a permanent
foundation and shall be limited to a height of twenty feet.
The Planning Commission needs to review whether the accessory building will require a
Home Occupation Permit in order for the owner to store business material within the
structure. If the Planning Commission requires the permit, the owner would have to
apply for a conditional use permit.

Riverside Preliminary and Final Plat
The preliminary plat for Riverside has been reviewed by the Planning and Engineering
Departments. The platting process will consist of separating the preliminary and final
plat into two steps since all of the information for the final plat review have not been
recieved.
The project proposes 57 townhome units on a 12.82 acre site creating a unit/acre density
of 4.4 in an existing R-3 zone well below the 14.0 density allowed. Riverside is located to
the east of the proposed 208th Street extension. The proposed project is surrounded on
the north by vacant land located in Empire Township, the south by Farmington Middle
School, the east by the CP Railroad, and the west by the Riverside single-family home
subdivision. The site plan consists of a private loop road at 24 feet in width and provides
two cul-de-sac roads well under the maximum length of 500 linear feet. The site plan
also provides for a holding pond at the southeast comer of the site.
The flood fringe is located at the southeast comer of the site. An initial review of the
project by the engineering staff verified that the flood fringe limit was at the 901 contour
line and that no building pads were to be constructed below this elevation. Within the
flood fringe zone (F-2), no placement offill over 1,000 cubic yards may be located within
the flood fringe zone without a conditional use permit. Therefore, the developer would
. have to follow these guidelines for the excavation of the pond soil.
The engineering staff is also reviewing the proposed 208th Street extension with Dakota
County to determine the exact location of the roadway. Engineering is requiring that the
extension be shown to the north property line and constructed to this point. Spot
elevations are required at the railroad to insure that 208th Street will match sufficiently
with a future bridge over the railroad track to the northeast.
The landscape plan has been reviewed and approved. Preliminary elevations for the
townhomes illustrate an aluminum sided finish. The Farmington park trail system is
located to the east of the railroad and eventually turns toward the south side of the
proposed parcel along Farmington Middle School property.
The design layout illustrates a separate bituminous driveways located for each unit.
Curved driveways were shown on the plan at the May 13th Planning Commission
meeting, but have been revised to show straight driveways capable of hold two cars per
drive and meeting the minimum parking standards.
The Engineering Department has required additional information for the review of the
plat (see attached memo from Lee Mann) and is recommending that the plat be continued
in order to review this information.

Recommendation
.
Continue the public hearing for the preliminary plat to the July 22nd Planning
Commission meeting in order to review additional information required by the
Engineering Department.
c) Dakota Mini-Storage Preliminary and Final Plat
This is a continuation of the June 10th Planning Commission meeting for Dakota Mini-
Storage located along Highway 50 and east of the FEI building within Phase III of the
Farmington Industrial Park. The developer, Mark Peltier, has informed the City in the
attached letter that he has withdrawn his proposed plat citing that the intended project is
economically unfeasible after consultation with his attorneys and accountants.
This location will eventually be controlled by Overlay Zone #1 when the ordinance is
approved by the City Council. After approval of the proposed ordinance by the City
Council, a mini-storage use will not be allowed to be constructed on this site or within
Overlay Zone # 1.
Recommendation
Acknowledge the withdrawal of the Dakota Mini-Storage Preliminary and Final Plat and
. close the public hearing.
3. DISCUSSION
a) Conditional Use - Grading Permit - Dakota County Lumber - Steve Finden
Steve Finden, owner of Dakota County Lumber, recently graded the north side of his lot
without applying for a grading permit. The City is requiring that he apply for a grading
permit, participate in the public hearing process and pay any associated fees even though
the work has been completed. The City Code requires that the grading permit be
discussed at the Planning Commission level and the Planning Commission recommend
the public hearing to be held at the City Council level as a conditional use.
Approximately 1,248 cubic yards of material was graded on the site, over the 1,000 cubic
yards constituting a grading permit. Six to twelve inches of topsoil was taken off of the
site and limerock was placed on the location to provide additional storage space for the
lot.
Recommendation

Recommend the conditional use grading permit public hearing to be held at the City
Council.

b)
Rezone lot from R-3 to R-2 at 201 Fourth Street
The lot at 201 Fourth Street is currently zoned R-3 and consists of7,597 square feet. The
property is currently for sale as a tax forfeited lot and a number of inquires have been
received by the Planning Division because the lot is presently unbuildable with the
existing zoning. The minimum size for an R-3 lot is 10,000 square feet and an existing
sewer easement crosses through the center of the lot. If the lot was rezoned to R-2, the
minimum lot size requirement of 6,000 square feet would be sufficient to make the lot
buildable. The R-3 zone abuts the property on the west, east and south and the R-2 zone
is located across the Main Street.
A gasoline service station previously existed on the site, but was razed and the
underground tanks were removed in late September 1996. A utility easement runs along
the south side of the property and connects to the main sewer line along Main Street. A
sewer stub exists for the house located at 209 Fourth Street on the south side ofthe
property. At the time that Fourth Street was reconstructed, the owner at 209 Fourth Street
did not want to pay for reconnection charges when it wasn't necessary, stating that when
the lot at 201 Fourth Street was developed, the owner would abandon the sewer easement
if the new owners would pay for the reconnection charge.
The Planning Staff has brought this matter to your attention because of the large number
of inquiries for the property. Staff would like direction on possible solutions to the
unbuildable lot and make recommendations which coincide with the Commission's views
to interested parties.
c) Joint City/County Planning Commissioners Meeting
Dakota County has scheduled a joint City/County Planning Commissioners meeting for
Thursday, July 17 from 7:00 to 9:00 PM at Rosemount City Hall. Discussions will
include planning issues within cities, the County's role and responsibility and planning
opportunities county-wide. An information packet will be distributed to each
Commission member.

DATE: July 3, 1997
Glenn Cook and I have given the above referenced project a preliminary review. Based on this
review, I would recommend that a meeting be scheduled with the Developer and his engineer.
There are several major issues to resolve in regards to the grades on 208th Street and the grading
and drainage on the site. I would not be able to recommend Preliminary Plat approval until these
issues are resolved.
