Request from Brent Peterson, 5893 193rd Street, for 6 Foot Fence
A variance has been requested by Brent Peterson for the fencing he has erected
on his property at 5893 193rd Street West in TroyHill subdivision. The Peterson
lot is a corner lot at the intersection of 193rd Street West and Everest Path.
The fencing consists of two types of materials; the fencing along the east side
of the lot and abutting Everest Path is a six foot (6') high cedar fence,
whereas the remaining fence is made of four foot (4') high chain link with a
wood trim. The fence appears to be built right up to the property lines.
Grading plans indicate that the structure on the lot to the north of the
Peterson property (which is part of TroyHill 3rd Addition) will be facing north.
Thus the six foot (6') fencing along the east side of the Peterson property
should not obstruct views from a front yard.
Although the fence is not currently a hindrance to views of the abutting lot, it
does not meet zoning ordinance standards for fencing. The ordinance indicates
that a six foot fence can only be uerected on the side and rear lot line behind
the nearest front corner of the principal building." However, the applicant
called City Hall for an explanation of requirements for fencing and did not
understand what was being said.
Allowing the resident to keep, after the fact, his six foot cedar fence along
Everest Path may lead to future requests for variances in similar situations.
The Planning Commission will need to decide if a variance granted here will lead
to a walled appearance along this and other neighborhood streets. The options
include removing the fence, cutting it to four feet in height, or granting a
variance because it will not adversely affect the adjoining property immediately
to the north due to the proposed lot layout.
. Front Yard Variance at 19279 Encore Court
A variance is requested by Tricia Wolff and Mike Krois for the fence they have
erected on their property. Their lot is at the corner of 193rd Street and
Encore Court. The fencing is comprised of a six foot (6') high chain1ink fence
(upon inspection it was closer to 5 1/2 feet). The fence is constructed mainly
in the rear yard of the property, in which the fence starts and ends at the back
corners of the house and shares a portion of it with the neighbor to the north.
Because the property is a corner lot, and the ordinance clearly states that the
fence must be constructed behind the nearest front corner of the principal
building, it does not meet the requirements of the City Code regarding fences.

This fence provides a different impression within the neighborhood than does the
subject fence of the previous request. The open chain link construction does
not obstruct the views from neighboring housing and it does not extend to the
street right of way. If a variance is granted here it should be based upon the
fact that it does not block the view from adjoining property.

The purpose of the discussion is to be assured that comments made during the
last meeting have been incorporated into this ordinance.
. Proposed Zoning Ordinance Amendment Regarding Antenna Towers
The revised draft of the Antenna ordinance now includes the advised changes of
Chris Lehmann from Grannis and Grannis.
. Comprehensive Plan Amendment Regarding MUSA Expansion
The MUSA expansion will be discussed at length focusing on the priority of the
sites after 1 and 2 have been added to the urban service area.
